CITY OF GEM LAKE, MN <br />4707 Hwy 61 # 253 <br />White Bear Lake, MN 55110-3227 <br />E-mail City(a�.gemlakeMN.org <br />Telephone 651-747-2790 <br />- Resolution 2007-08 <br />Resolution Stating Agreement to Extend Effect of Former Zoning Code to Hillary <br />Farm Subdivision <br />WHEREAS, Hillary Farm LLC ("Hillary Farm"), a Minnesota limited liability <br />corporation, obtained final approval for a subdivision in the City of Gem Lake and signed <br />a developers' agreement in August 2004; and <br />WHEREAS, Hillary Farm requested an extension of the statutory 2-year period in which <br />zoning and comprehensive plan changes would not apply to the lots in the subdivision; <br />and <br />WHEREAS, the City of Gem Lake granted this request on December 21, 2006, with the <br />condition that the principal of Hillary Farm, James McNulty, remain in ownership of the <br />lots in the development; and <br />WHEREAS, Hillary Farm has asked that the condition stated on December 21, 2006 be <br />amended to allow the company to sell individual lots to other owners or builders; <br />NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of Gem <br />LAKE, Minnesota, as follows, <br />1. That the action taken by the City Council on December 21, 2006 granting an extension <br />of the Minn. Stat. § 463.358 subd. 3(c) exemption to Hillary Farm is hereby rescinded. <br />2.
