DRAFT <br />JOINT POWERS AGREEMENT BETWEEN <br />THE TOWN OF WHITE BEAR AND <br />THE CITY OF GEM LAKE <br />THIS AGREEMENT, is made to be effective the day and year set <br />forth below between the TOWN OF WHITE BEAR, a statutory Township under <br />the laws of the State of Minnesota (TOWN), and the CITY OF GEM LAKE, a <br />municipal corporation under the laws of the State of Minnesota (CITY). <br />RFrITAI S- <br />A. The TOWN is planning to extend municipal sanitary sewer and water to <br />the building to be known as HERITAGE HALL. <br />B. That the CITY wishes to contribute a monetary amount to have the TOWN <br />oversize the watermain from an 8" to a 16" service line for future extension <br />of service to the CITY. They are not interested in hook-up to the system <br />at the present time. <br />C. It is feasible for the TOWN to oversize the watermain to allow for future <br />use by the CITY, and the CITY is desirous of having the TOWN oversize <br />such main. <br />PURPOSE: <br />D. Minnesota Statutes, Section 471.59, provides that two or more <br />governmental units, by agreement entered into through action of their <br />governing bodies, may jointly or cooperatively exercise any power <br />common to the contracting parties or any similar powers, including those <br />which are the same except for the territorial limits within which they are <br />exercised. <br />AGREEMENT: <br />Now, therefore, in consideration of the mutual undertakings herein <br />expressed, the Town of White Bear and the City of Gem Lake agree as follows: <br />1. That the CITY shall pay to the TOWN the sum of S in <br />payment of the over sizing charges. <br />
