CITY OF GEM LAKE RESOLUTION NO..2004-10 14.July 2004 } A RESOLUTION AMENDING RESOLUTIONS NO. 1993-07 AND NO. 2004-06 [ry REGARDING GEM LAKE'S PARTICIPATION IN RAMSEY .COUNTY FUNCTIONAL CONSOLIDATION OF 'ROADWAYS BY ACCEPTING CERTAINPORTIONS OF THE PROPOSED ROADWAYS AND AMENDING THE CONDITION3OF SUCH ACCEPTANCE. WHEREAS, The 1991 Minnesota*Leggislature established a Ramsey Coiinty Local Government Services -Study Commission to -"report on*the.advantages and:disadvantages ofsharing, cooperating. restructuring, or consolWtirie..." activities in. areas of public servlce including public. works, and WHEREAS; the Gdm Lake City Council did- by means of Resolution No: 1.99347 agree to accept ownership. of certain Ramsdy County "roadways irrthe. City of Gem Lake subject to certain conditions: and WHEREAS, The Ptinctional Consolidation Plan provides for reclassification of roadways and corresponding changes in _jurisdiction including the transfer of local and State Aid roadways between 1bg County and municipalities; and WHEREAS, Scheuneman Road (County Road. 147) from Otter Lake. Road to Trunk-kiighway 6.1, located. in; the City of Gem Lake, is presently under the jyOsdiction of Ramsey County as a County Road; and WHEREAS, ' ws roadway has-been determined to serve -a local function only; and WHEREAS. Revocation of "County Road" status may be accomplished by resolution:.of the Ramsey County Board of Commissioners pursuant to Minnesota: Statutes § 163.114 and WHEREAS. It appears to the City Council ofthe..City of Gem Lake that: the street hereinafter described upon turnback from Ramsey County should be designated a City Street:under the provisions of Minnesota Law- and j' WH EREAS, The Functional Consolidation Plan stipulates that. Ramsey County shall improve the roadway to acceptable t. levels .prior to transferring jurisdiction over roadway segments from Ramsey County to municipalities, :and t1tc..Ramsey County Capital. Improvement Program provides funding for theseimprovements;.artd WHEREAS, Minnesota Statutes §383A.16 requires that i�amsey County shall, before transferring jurisdietian over roadway scy�siients, improve each highway to a condition consistent with -a Ramsey County pavement management score of ninety; and VV H F KEAS, The City of Gern Lake desires to reconstruct -Scheune rnan Road; from .Otter .Lake .Road to. Trunk Highway '6l and fund the .reconstruction project with Municipal sources;-alyd up to $170,000 *from. Capital .Improvenlent.Funds for.. Ramsey County Roadway Consolidation; and WHEREAS. The..City of Gem Lake has agreed that .by accepting this jurisdictional transfer and receipt of tip to $170,000 for the reconstruction :of :this.. segment of Seheuneman Road from Capital Improvement Funds for .Ramsey County Roadway Consolidations .that Ramsey County has fully discharged its obligations. to the City arNingitnder Minnesota Statutes §.§163.I.1 And 383A. 16 and the Functional Consolidation Plan, and that it has no expectation of funding of the ongoing maintenance of this segment by Ramsey County; Now, Therefore; Be It RESOLVED, The City of"Gem Lake does hereby concur with the..Ramsey County Board of Commissioners revoking the. "County Road" .status of*Scheuneman Road.(Coudiy Road 147) from Ottet Lake Road to TNnk Highway .61, and accepts tr<uisfer of jurisdiction over this roadway to tha-City of Gem Lake, effective after the Ramsey County Office of Budgeting and. ,Accounting has encumbered the funds necessary to fund t:his:reconstruction project up to.$170,U00;.and Be It Further RLSOLVF.D,. The County shalt transfer it's interest in.the..poblic road right-of-way and road easements to the City of Gem' Luke i'or the delineated roadway it currelitly holds; an4-13e It-170ther RESOLVED,. This transfer is; conditioned upon receipt by Ramsey County of this .resolution adopted by the City.of Gern Lake cpncurring with: the.County revoking the "County Road." status of Scheunerian Road from Otter Lake Road .to Trunk Highway 61, and further providing that receipt of up to $170.000 for the reconstruction of this segment from Capital Improvement.
