<br />THE ZONING ORDINANCE OF GEM LAKE, MINNESOTA, RELATING TO AND REGULATING THE LOCATION, SIZE, USE AND HEIGHTS
<br />OF BUILDINGS, THE ARRANGEMENT OF BUILDINGS ON LOTS, AND THE DENSITY OF POPULATION IN THE CITY OF GEM LAKE,
<br />AND FOR THE PURPOSE OF PROMOTING THE PUBLIC HEALTH, SAFETY, ORDER, CONVENIENCE, PROSPERITY AND GENERAL
<br />WELFARE IN SAID CITY, AND FOR SAID PURPOSE, TO DIVIDE THE CITY INTO DISTRICTS, AND MAKE DIFFERENT REGULATIONS
<br />FOR DIFFERENT DISTRICTS.
<br />The City of Gem Lake does ordain as follows:
<br />SECTION 1- TITLE
<br />This Ordinance shall be known, cited and referred to as the GEM LAKE ZONING ORDINANCE except as referred to herein, where it shall be known
<br />as "this Ordinance".
<br />SECTION 2 - INTENT AND PURPOSE
<br />This Ordinance is adopted for the purpose of-
<br />... protecting the public health, safety, morals, comfort, convenience and general welfare.
<br />... dividing the City into zones and district, restricting and regulating therein the location, construction, reconstrucfion, alteration, and use of
<br />structures and land.
<br />... promoting orderly development of the residential, business and industrial areas.
<br />... providing adequate light, air, and convenience of access to property.
<br />... preventing overcrowding of land and undue concentration of structures by regulating the use of land and buildings and the bulk of buildings
<br />in relation to the land and buildings surrounding them.
<br />... providing for the compatibility of different land uses and the most appropriate use of land throughout the City.
<br />SECTION 3 - RULES AND DEFINITIONS
<br />Section 3.1 Rules
<br />The language set forth in the text of this Ordinance shall be interpreted in accordance with the following rules of construction:
<br />3.1 (1) The singular number includes the plural and the plural the singular.
<br />3.1 (2) The present tense includes the past and future tenses, and the future the present.
<br />3.1 (3) The word "shall" is mandatory, and the word "may" is permissive.
<br />3.1 (4) The masculine gender includes the feminine and neuter genders.
<br />3.1(5) Whenever a word or term defined hereinafter appears in the text of this Ordinance, its meaning shall be construed as set forth in such
<br />definition thereof.
<br />3.1 (6) All measured distances expressed in feet shall be to the nearest tenth of a foot.
<br />Section 3.2 Definitions
<br />The following words, and terms, whenever they occur in this Ordinance, are defined as follows:
<br />ACCESSORY USE OR STRUCTURE
<br />A use or structure or portion of a structure subordinate to and serving the principal use or structure on the same lot and customarily
<br />incidental thereto.
<br />ACCESSORY AND SECONDARY USE ANTENNAS
<br />Radio and television receiving antennas, satellite dishes, TVRO antennas three (3) meters or less in diameter, short wave radio receiving
<br />antennas, those antennas necessary for the operation of aFederally licensed Amateur Radio station, and towers/antennas for radio systems
<br />operated by the City of Gem Lake.
<br />ANTENNA
<br />A device used to trans in i t and/or receive telecommunications, television or radio signals which is located on the exterior of or outside of
<br />any building or structure. Such anteanas include, but are not limited to, broadcast radio or television, wireless communications, cellular,
<br />personal communications systems or any other dispatch type system, microwave or satellite dish, short -wave receiving or Amateur Radio
<br />transmit/receive, and other Accessory and Secondary use antennas.
<br />ALLEY
<br />A public right-of-way which affords a secondary means of access to abutting property.
<br />BASEMENT
<br />That portion of a building located partly underground but having less than half its floor -to -ceiling height below the average grade of the
<br />adjoining ground.
<br />BOARDINGHOUSE
<br />Abuilding otherthan a motel or hotel where, forcompensation andbypre-arrangement for definite periods, meals or lodgings areprovided
<br />for three (3) or more persons, but not to exceed eight (8) persons.
<br />BUILDABLE AREA
<br />A contiguous area of real property within a lot deemed suitable by best engineering practices for construction of a principal use structure
<br />with no part of said area of real property within delineated wetlands, right-of-ways, set -backs, or easements.
<br />BUILDING
<br />Any structure havi ng a roof which may provide shelter or enclosure ofpersons, animals or chattel, and when said structures are divided
<br />by party walls without openings, each portion of such building so separated shall be deemed a separate building.
