5.8 (2) All appeals shall be filed in writing with the Zoning Administrator accompanied by any substantiating information and list of expens <br />who shall may testify on behalf'ofthe appellant. Upon receipt, materials shall be forwarded to the Chairman of the Planning Commission who <br />shall place the matter on the agenda of the next meeting or a special meeting, provided a notice of the special meeting is appropriately published <br />in the City's legal publication. Notice of all hearings for appeals shall be mailed to all appellants. <br />5.8 (3) Upon review of the appeal and supplemental documentation and testimony related thereto, the Planning Commission shall decide the <br />matter subject to judicial review or appeal to the City Council. <br />5.8 (4) In the event the appeal is granted, it shall be published in the City's legal publication and shall become effective the date ofpublication. <br />Section 5.9 Fees <br />5.9 (1) Application Fels. The fees to be paid to the City for an application for amendment of this Ordinance, a Variance from this Ordinance, <br />a Special or Interior Use Permit, or any construction, plumbing, electrical, mechanical or other related permit shall be made payable to the City <br />in an amount established by resolution of the City Council and as amended from time to time. <br />5.9 (2) Supplemental Fees. In addition to application fees, the City may require payment of supplemental fees related to an action or application <br />including, but not limited to: attorney's fees, fees of outside experts; staff time; direct expenses exceptional to the effort and as identified by <br />City staff. <br />5.9 (3) Fees shall be payable at the time applications are first filed with the City and are not refundable unless the application is withdrawn prior <br />to referral of the matter for consideration. There shall be no fee in the case of an application filed in the public interest by members of the <br />Planning Commission or City Council. <br />Section 5.10 Violations and Penalties <br />5.10 (1) Anyperson, firm, corporation, orvoluntary association which violates or refuses to comply with any of the provisions ofthis Ordinance <br />shallbe charged with a misdemeanor and, upon conviction thereof, subject to a fine ofnot more than One Hundred ($100.00) Dollars and costs <br />for every offense or to imprisonment not exceeding ninety (90) days. Each day that a violation is permitted to exist shall constitute a separate <br />offense. <br />SECTION 6 - ZONING DISTRICTS AND MAP <br />Section 6.1 Districts <br />6.1 (1) In order to carry out the purpose and provisions of this Ordinance, the City of Gem Lake is hereby divided into the following Zoning <br />Districts and groups of Districts <br />A) Residence Districts <br />1) "R-1" Lake Residence <br />2) "R-2" Acre Estate Residence <br />3) "R-3" Low -Density Residence <br />4)"R-4" Medium -Density Residence <br />B) Business Districts <br />1) "R-B" Retail Business <br />2) "G-B" General Business <br />3) "LD-B" Low -Density Business <br />4) "G-B 11" General Business H <br />Section 6.2 Map <br />6.2 (1) The boundaries of the above districts areherebyestablished on that certain map entitled "Zoning District Map of Gem Lake, Minnesota," <br />dated 24 January 2000, which map is properly approved and hereinafter referred to as the "Zoning Map". This map and all of the notations, <br />references and other information shown thereon shall have the same force and effect as if fully set forth and described herein. <br />Section 6.3 Boundaries <br />6.3 (1) District boundary lines as indicated on said map follow lot lines, the center lines of streets, alleys, or railroads, the center lines of streets <br />or alleys projected, the center of water courses or the corporate limit lines, all as they exist upon the effective date of this Ordinance or <br />amendments thereto. If district boundary lines do not follow any of the above described lines, the district boundary lines are established as <br />drawn on the zoning map. Where a District boundary line divides a lot of record which was in single ownership at the time of enactment of <br />this Ordinance and places portions of such lot of record in two (2) or more Use Districts, any portion of such lot with fifty (50) fret on either <br />side of such a dividing district boundary line may be used for any use of either Use District; provided, however, if any portion of such lot shall <br />extend beyond the fifty (50) feet limitation. the District line as shown shall prevail. Appeals from the Zoning Administrator's determination <br />and questions of doubt concerning the exact location of District boundary lines shall be heard by the Board of Appeals. <br />SECTION 7 - "R 1" RESIDENTIAL DISTRICT <br />Section 7.1 Permitted Uses <br />Within the "R-l" Residential District, no structures or land shall be used except for one (1) or more of the following uses: <br />7.1 (1) One family detached dwellings <br />7.1 (2) Truck gardening and other horticultural uses provided that only those products produced on the premise be sold or offered for sale. <br />7.1 (3) Agricultural activities, provided that no building in which farm animals or fowl are to be housed is nearer than one hundred (100) feet <br />of a lot line. <br />Section 7.2 Permitted Accessory Uses <br />Within any "R-1" Use District, the following uses shall be permitted accessory uses. <br />7.2 (1) Attached or detached housing for domestic servants <br />7.2 (2) Private garage, car port or parking space <br />7.2 (3) The keeping of not more than two (2) roomers <br />7.2 (4) Private swimming pool, tennis court, horse training ring, and other sites necessary to conduct a home sporting event. <br />72 (5) 1 ionic occupation <br />7.2 (6) Signs as regulated by this Ordinance <br />-15- <br />
