Mr. Hoeschler agreed with Mr. Rossow that the procedures of the site review process would be <br />incorporated in an amendment to the Developer's Agreement. Mr. Rossow said he heard the calls for more trees, <br />but they wanted to be careful not to over -promise what could or would be done. He stressed recognition of the view <br />easement for the benefit of the Bemis house. <br />Mr. Rafferty asked for direction. He was told that the audience supported his proposals for additional <br />screening but he was assured that he (and Mr. Emeott) had authority to make a fmal deal with McNulty but the deal <br />should be well documented. <br />2. Review of Outstanding Zoning Code Issues. The discussion then turned to a Summary of Open Zoning Code <br />Issues that had been circulated by Mr. Hoeschler. He said he wanted to receive direction from the Commission on <br />these issues as he and Mr. Emeott continue to draft the final code language. He said that the code would apply to <br />Hillary Farm after the August moratorium runs out and he therefore invited input by Mr. Rossow. <br />A. Height restrictions and method of measurement. After lengthy discussion, it was the sense of the <br />majority that (i) the IBC measurement method ( to the mean roof level) should be used; (ii) the bottom <br />starting point should be ground level 6 feet from the front door; (iii) District limits should be 30 feet <br />for R-1 and 25 feet for R24; (iv) lake lots should not have two fronts for height measurement <br />purposes; (v) front heights should be limited as stated, but back or side walkout facades with greater <br />height (up to 40 feet in R-1 and 35 feet in R2-4) would be allowed with a SUP that would address the <br />following factors: <br />a. The facade should be 60% screened from the views of neighbors through a 90 degree arc <br />centered on the fagade in question. That is, at least 60% of the facade should be screened by <br />vegetation considered at full bloom when viewed from any angle starting and ending 45 <br />degrees to the fagade in question This screening can be by existing or planted and maintained <br />trees, and the natural topography of the lot and surrounding areas; <br />b. The shear verticality of the facade should be interrupted by decks, balconies, bow windows, <br />bays and other design features so that there is no more than a 35 foot shear vertical plane at <br />any point; <br />c. The fenestration should be designed to avoid large sheets of glass that attract birds and create <br />glare; <br />d. Weather vanes, antennas and decorative cupolas should not be counted as an element of the <br />structure for height measurement; <br />e. A walkout will not be allowed on a lot by virtue of any artificial grading. The lot topography <br />must naturally allow a walkout; and <br />f. Any time the side or rear elevation of a building exceeds the standard limit, it needs to be <br />further set back from the standard side setback line 2 feet for every 1 foot of extra height <br />above the standard. <br />(vi) accessory buildings cannot exceed absolute height as follows: <br />a. R-1 = 25 feet <br />b. R-24 = 15 feet <br />B. Set Backs. Set back restrictions should be changed as follows: <br />a. Instead of 100 foot set back for stables, barns, kennels, etc., their set back should be <br />determ ined by Special Use Permit based on the following factors: <br />i. Screening available or to be provided; <br />ii. Distance from wells, ISTS and neighbor's buildings must be at least 100 feet; and <br />iii. Drainage characteristics of the land must be such that pollution of neighboring <br />property or any wells is avoided. <br />
