Section 6.5. Maximum Term Of Acceptability. Upon expiration of the applicable three (3) or five (5) year period specified in Section <br />6.1.1 and 6.1.2 above, continued compliance with the applicable minimum separation standards specified herein shall be provided by the <br />Property Owner of any seepage pit system as determined reasonable by the Septage Inspector and all seepage pit systems shall be <br />deemed "failing" and shall be replaced within the fifteen <br />(15) year period ending 31 December 2012. <br />SECTION 7. Inspection and Monitoring. Section 7.1. Initial Inspection. The Septage Inspector shall make at least one inspection and <br />such additional inspections as are necessary to determine whether an installation or renovation of an ISTS for which a permit is required <br />pursuant hereto is being accomplished in compliance with this Ordinance and the applicable permit. No part of such an ISTS shall be <br />covered until it has been inspected and finally approved by the Septage Inspector. All inspections shall be performed promptly and final <br />inspection shall be performed within five (5) days after the Septage Inspector or Administrator is notified that the installation or renovation <br />work has been completed and is ready for inspection. Section 7.2. Certificate of Approval: New or Renovated Systems. No ISTS, for <br />which a system permit is required pursuant hereto, shall be placed or replaced in operation until the Septage Inspector has issued a certificate <br />of approval governing the subject installation or renovation. Where, upon inspection, the Septage Inspector discovers that an ISTS has not <br />been installed or renovated in compliance with the provisions contained in this Ordinance or the applicable permit, the Septage Inspector <br />shall give the Applicant written notification describing the noncompliance. The Applicant shall be responsible for correcting and eliminating <br />all defects and noncompliance prior to the date scheduled for reinspection. Section 7.3. Inspections On Complaint. It shall be the duty of <br />the Property Owner of the real property upon which an ISTS exists to give the Septage Inspector free access to the premises at reasonable <br />times for the purpose of system inspection. The Septage Inspector shall inspect any ISTS concerning which a written complaint, signed by <br />two (2) or more residents of the City of Gem Lake, is received by the City. The Septage Inspector may inspect any system he deems <br />necessary as a result of a written complaint. Such inspections shall be performed within thirty (30) days following receipt of the complaint or <br />report and shall be conducted between eight o'clock a.m. and six o'clock p.m., unless otherwise agreed to by both parties. Section 7.3.1. Cost <br />Of Inspections On Complaint. The cost of Inspection On Complaint of any ISTS in the City shall, in the event a defective system is <br />determined, be the sole responsibility of the Property Owner with said fees as established by the City of Gem Lake Council and from time to <br />time amended by resolution. In the event the complaint cannot be verified and the system is found to be in good working condition in <br />accordance with the requirements of this Ordinance, the City shall assume responsibility for the costs of inspection. An invoice for fees <br />associated with valid Inspections On Complaint will be provided at the time of inspection by the Septage Inspector. Any fees for Inspection <br />On Complaint which remain unpaid for more than sixty (60) days by the Property Owner to the City may, along with related administrative <br />fees, be certified to Ramsey County for assessment against the real property upon which the ISTS is located. Section 7.4. Required <br />Inspections. "The septage inspector shall inspect existing ISTS's at least once every three years in accordance with Minnesota <br />Rules Part 7080.0175, and in the case of new ISTS's within the first five years and at least every three years thereafter to insure <br />that each ISTS and the City is in good operating condition and in compliance with the operating requirements of this Ordinance." <br />. Section 7.4.1. Cost Of The cost of Inspection of ISTS in the City shall be the sole responsibility of the Property Owner and shall be as <br />established by the City of Gem Lake Council and from time to time amended by resolution. An invoice for fees associated with Bi-Annual <br />Inspections will be provided at the time of inspection by the Septage Inspector. Any fees for Bi-Annual Inspection which remain unpaid for <br />more than sixty (60) days by the Property Owner to the City may, along with related administrative fees, be certified to Ramsey County for <br />assessment against the real property upon which the ISTS is located. Section 7.4.2. Inspection Reports. At the time of inspection, the <br />Septage Inspector will provide a signed inspection report to the property owner. A copy of the inspection report will also be filed with the <br />City Clerk for permanent attachment to the property record. Section 7.5. Systems Inventory. The Administrator shall create, update and <br />maintain an accurate inventory of all ISTS for which permits have been issued or inspections made within the City of Gem Lake. <br />Information shall include but shall not be limited to design, location, system description, renovation description, and reports received <br />pursuant to Section 7.3 and 7.5.2. <br />
