CITY OF GEM LAKE <br />Office of the City Clerki;/ <br />/ <br />1369 County Road "E" East <br />Gem Lake, MN 55110-5231 <br />Telephone: ( 651) 426 - 6443 Email: gemlakecity@aol.com Facsimile: ( 651) 426 - 6444 <br />cTiik %gnrusoa Oiy Clerk Paul emeoN, 9►lagor <br />darmb abiaa cTrewurer <br />BILL OF SALE - SANITARY SEWER DEDICATION <br />24 JULY 2006 <br />Whereas, the City of Gem Lake did on 23 August 2004 enter into a Developer's Agreement with Hillary Fa4LLC; and <br />Whereas, Item l3. of said Developer's Agreement states that "Within sixty (60) days of completion of installation and inspection <br />by the City Engineer to verify as built condition, the sanitary sewer system installed within the Plat shall be dedicated to the City as <br />part of the Gem Lake Municipal Sanitary Sewer System with such dedication to be in form and substance acceptable to the City <br />Attorney."; and, <br />Whereas, the City Engineer acting on behalf of the City ofGem Lake has verified that the sanitary sewer system installed within the <br />Plat was built according to plans, details and specifications approved bythe office of the CityEngineer, and, <br />Whereas, the Developer has connected to and implemented use of the sanitarysewer system within the Plat at the Model Home and <br />Sales Office; now, therefore be it <br />Resolved, that in consideration ofreceipt of the sum of One ($1.00) Dollar in the form of City ofGem Lake Sewer Fund Check No. <br />/ 2 1 III drawn upon Premier Bank of White Bear Lake and other good and valuable consideration, Hillary Farms, LLC does hereby <br />dedicate to and convey ownership of the entire sanitary sewer system within the plat along with attendant warranties to the City of <br />Gem Lake; and, be it <br />Further Resolved, that the City of Gem Lake by tendering said payment and consideration does hereby accept said sanitary sewer <br />system with attendant warranties and does hereby make same a part of the City of Gem Lake Municipal Sanitary Sewer System <br />effective the date first written above. <br />IN WITNESS WHEREOF, the parties have signed this BILL OF SALE to be effective the date first written above: <br />CITY OWNER/DEVELOPER <br />CITY OF GEM LAKE i- A I.Y FARM, LLC i <br />Paul R_ Emeott, Mayor R. dames cNulty, Jr. Chief Ma, <br />BY <br />Frederic C.
