14 September 2006 <br />RESOLUTION NO. 2006-27 <br />RESOLVED, The County shall transfer it's interest in the public road right-of-way and road easements to the City of Gem <br />1 Lake for the delineated roadways it currently holds; and Be It Further <br />RESOLVED, This transfer is conditioned upon receipt by Ramsey County of this resolution adopted by the City of Gem <br />Lake concurring with the County revoking the "County Road" status of Scheuneman Road (County Road #147) from County <br />Road E (Ramsey County Road #15) north to Trunk Highway 61 and Hoffman Road West (County Road #146) from Trunk <br />Highway 61 north to County Road E (Ramsey County Road #15), and further providing that receipt of up to $70,126 for the <br />reconstruction of these segments from Capital Improvement Funds for Ramsey County Roadway Consolidation that Ramsey <br />County has fully discharged Ramsey County's obligations to the City arising under Minnesota Statutes §§163.11 and <br />383A.16 and the Functional Consolidation Plan relative to this segment of roadway, and that the City of Gem Lake has no <br />expectation of funding of the ongoing maintenance of these segments of roadway by Ramsey County; and Be It Further <br />RESOLVED, that upon receipt of this resolution Ramsey County will pay to the City as just compensation for these <br />jurisdiction transfers, up to $70,126 upon presentation of billings from the construction contractor(s) for the reconstruction of <br />the segments of Scheuneman Road and Hoffman Road, and that upon receipt of the billings, the County shall reimburse the <br />City in accordance with Minnesota State Statute 471.425; and, Be It Further <br />RESOLVED, the Gem Lake City Clerk is authorized within the limits of this resolution to take actions necessary to have the <br />identified jurisdiction changes executed; and Be It Further <br />RESOLVED, the City Of Gem Lake recognizes that no additional consideration of other Ramsey County roads originally <br />included as part of Gem Lake's Resolution No. 1993-07 remain as previously established by the City Council. <br />The foregoing Resolution was offered by Schilling and was supported by Watson and was declared adopted based <br />coon the following vote: <br />NAME <br />EMEOTT <br />WATSON <br />RASMUSSEN <br />SCHILLING <br />BOSAK <br />VOTE <br />Aye <br />Aye <br />Absent <br />Aye <br />Aye <br />ATTEST <br />I, Frederic C.
