11002 .280 <br />ALCOHOLIC BEVERAGES 11002.200 <br />a. Maximum rent that may be charged is $1,000.00 per <br />month. (Ref. Ord. 912, 6/28/94) <br />b. Rental payments may not be based on a percentag4i-of <br />profits from gambling. <br />c. The charitable organization may pay a percentage up <br />to 25% per month of directly related gambling ex- <br />penses including janitorial services and rubbish <br />removal. The total payment may not exceed $1,500 per <br />month. The expenses will be stated on the lease <br />agreement and payment for these expenses must be paid. <br />directly to the suppliers of these services. With <br />its application, the Licensee shall provide suffi- <br />cient information to the City to allow a deter- <br />mination that the expenses to be paid under this <br />section are related to the gambling activity and are <br />reasonable. The City Council may limit the related <br />expense paid by the charitable organization to the <br />amount it determines to be reasonable. Requirement <br />or acceptance of payment of expenses on behalf of the <br />Licensee which have not 'received prior approval by <br />the City Council may result in revocation or suspen- <br />sion of the liquor license. (Ref. Ord. 912, 6/28/94) <br />d. The only form of gambling that shall be permitted on <br />the licensed premises shall be lawful gambling devic- <br />es approved by the City council. <br />e. Lawful gambling devices shall only be operated or <br />sold from a booth used solely by the charitable orga- <br />nization, and shall neither be sold by employees of <br />the licensee nor sold from the bar service area. <br />f.. The construction and maintenance of thebooth used by <br />the charitable organization shall be the sole respon- <br />sibility of the charitable organization. <br />g• <br />The lease shall contain a provision permitting the <br />licensee toterminate the lease if the charitable <br />organization is found guilty of any violation of <br />state or local gambling statutes, ordinances or rules <br />and regulations. <br />4. only one charitable organization shallbe permit- <br />ted to operate or sell lawful gambling devices on the licensed <br />premises. <br />146.2 Revised 06/28/94 <br />
