RESOLUTION NO. 95-04
WHEREAS, the City of Gem Lake has approved lawful gambling by
charitable organizations within the city, and
WHEREAS, all lawful gambling within the city limits of the City of
Gem Lake is subject to all laws.. and ordinances of the State of
Minnesota, the County of Ramsey, and the City of Gem Lake, and.
WHEREAS, the City Council of the City of Gem Lake intends to allow
gambling by charitable organizations to continue during: 1995, and
WHEREAS, the City Council of the City ;of Gem Lake reserves the
right to suspend or revoke the gambling licenseor gambling exempt ion of
any organization upon review and due process.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of:

RESOLUTION NO. 95-08
WHEREAS; the. City of Gem Lake currently operates a Curbside Recycling. Program for
all single family residences 'within the City, and
WHEREAS., the City Council realizes that increased public education and
participation in the program is in the best ln.tereste of all citizens and wishes:
to expand our current. Recycling: Program; and
WHEREAS; our current .budge.t includes cuts from state and county agencies who have.
previously assisted the City financia11y in it's efforts to operate, increase
participation in, and expansion of the City's Recycling.Program, and
WHEREAS, the Division of Solid Waste of the Ramsey County Department of Public
Health has .made certain funds available for qualified Recycling ;Programs Within
the County..
NOW. THEREFORE BE IT RESOLVED that the City Council of the City of Gem Lake
hereby empowers the City Clerkto apply for Score Func7ing to be used to ope:ra.te.
and expand the City's 1994 Residential Curbside Recycling program, and
That said funds, if .approved and provided by Ramsey County, shall be used in such
a manner as recommended by the City'sRecycling Coordinator and approved by the
City Council.

WHEREAS,. the .City of Gem. Lake has partially funded and participated in the multi -
jurisdictional study of the I--3.5.E Corridor;. and
WHEREAS, the City of Gem Lake intends to: adopt the recommendations of the I-3.5E
Corridor Study Report into its local Comprehensive Municipal Plan; and
WHEREAS., the I-35E Corridor Study Project Management Team has requested acceptance of
the 2-35E Corridor Study Report and continued support for this project; and
WHEREAS, .a permanent, formal corridor management team is needed to continue
coordinating the ongoing balance of land use and transportation within the I--35E
Corridor; and
WHEREAS., Addendum No. 1 of the I-35E Corridor Study enumerates the :responsibilitiesof
an I.-35E Corridor Management Team,
NOW THEREFORE BE IT RESOLVED that the City Council of the City. of Gem Lake does, by
means of this Resolution No 95-10, commit to continued participation as a member in
the I-35E Corridor Management Team.

RESOLUTION NO. 95-09
15. May 1995.
WHEREAS, ownership of the roadway in the City of Gem Lake originally
known as the St. Paul White Bear and Bald Eagle (SPWB and BE) Road
located north of Lot 26, Block 1, Hicks Addition has, for several years
been in question; and
WHEREAS, the City of Gam Lake has, on several previous occasions,, made
public statements that it retains no claim of ownership to this roadway;
and
WHEREAS, the property owners adjacent to said roadway wish to make claim
to said lands so asto make clear their title to same; and
WHEREAS, on 25 March 1991, then Assistant County Attorney David
MacMillan made clear` inhis written opinion ;that said roadway has, is
and shall remain abandoned lands; and
Whereas, the City Council did on this day hold a public hearing on this
matter with proper notification to all affected residents.
NOW THEREFORE BE IT RESOLVED that effectivethis day, the City Council.
of the City of Gem Lake does, by means of this Resolution No...
publicly state that it has no ownership of or claim to or against the
lands previously identified as the St, Paul White Bear and Bald Eagle

WHEREAS, Mr. & Mrs. Gerald Thomson have acquired lands from Mr. Ernest Bernier of 1633
Goose Lake Road in the City of Gem Lake, said lands having been properly subdivided
Lrom Mr. Bernier's property; and
WHEREAS ,. Mr. & Mrs. Thomson have appropriately filed all applications and paid all fees
required for relocation of a building .onto the aforementioned property; and
WHEREAS, the Building .Inspector has .pre -.inspected thestructure at it's current..
location and` found it to be consistent with the City's residential building and zoning
requirements; and
WHEREAS,. the Building Inspector will require compliance withall applicable Building
Codes and Ordinances ,in force and. effect once:located ❑n the site.

RESOLUTION NO.95-13
04 August 1995
WHEREAS, Ramsey County Department of Public Works has proposed to pave two -thousand seven -
hundred fifty (2,750) feet of four {4'0") foot shoulders of LaBore Road suitable for use as a bicycle path from
County Road E to Goose Lake Road in the Cities of Gem Lake and Vadnais Heights in conjunction with a
recycling and overlay project on said road; and.
WHEREAS, Ramsey County's cost participation policy calls for municipal participation in shoulder paving
costs by both the City of Gem Lake and the City of Vadnais Heights; and
WHEREAS, the City Council of the City of Vadnais Heights has approved shoulder paving along the west
side of LaBore Road in the City of Vadnais Heights; and
WHEREAS, the City of Vadnais Heights has agreed to acknowledge the residential zoning of Gem Lake.
along the east side of LaBore Road as it considers further development along the west side of LaBore Road;
and
WHEREAS, the City Council of the City of Gem Lake believes it is in the best interest of public safety and
general improvement of the community to improve and pave said shoulders,
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Gem Lake does, by means
of this, Resolution No. 95-13, approve the expenditure of four -thousand four -hundred eighty-four ($4,484)
dollars for said improvements; and
BE IT FURTHER RESOLVED that the City Council authorizes the City Clerk to execute Ramsey County
Agreement No. 95017 as City of Gem Lake Agreement No. 95-0.1.

RESOLUTION NO. 95-14

WHEREAS, the City of Gem Lake has , over the past several years modified and amended the City's Zoning
Ordinance No. 43 to meet the changing needs of the community; and
WHEREAS: the Mayor and City Council are empowered to appoint a Zoning Administrator to enforce the
City's Zoning Ordinance No. 43; and
WHEREAS, the Mayor and City Council have determined the need to expand enforcement of the City's
Zoning Ordinance No. 43 through additional personnel due to continuing violations of same.
NOW THEREFORE BE IT RESOLVED that the Mayor and City Council of the City of Gem Lake do,
by means of this Resolution No. 95-14, approve the addition of the position of Assistant Zoning
Administrator; and
BE IT FURTHER RESOLVED that said position shall have full responsibility for enforcing and
administering the Ordinance; and
BE IT FURTHER RESOLVED that the Mayor and City Council do hereby appoint Frederic C. Magnuson
as Assistant Zoning Administrator for the period 01 August 1995 through 31 December 1995.

RESOLUTION NO. 95-15

A RESOLUTION TO PARTICIPATE IN COST SHARING OF CONSULTANT
SERVICES TO THE ON -GOING 1-35E CORRIDOR MANAGEMENT STUDY.
WHEREAS, the City of Gem Lake has partially funded and participated in the multi -jurisdictional study of
the I-35E Corridor; and
WHEREAS, the City of Gern Lake has committed to continue participation as a member of the I-35E
Corridor Management Team; and
WHEREAS, the Corridor Management Team will continue to coordinate the ongoing balance of land use
and transportation within the I-35E Coridor; and
WHEREAS, continued consultant services will be required to assist the Corridor Management Team; and
WHEREAS, SEI-I, Inc, has prepared the attached scope of services to provide such assistance at a cost of
Five -Thousand ($5,000) Dollars per year; and
WHEREAS, the Corridor Management Team has proposed cost sharing contributions from the participating
local units of government as follows; the Cities of Vadnais Heights and White Bear Lake and White Bear
Township at $1,250 each; the City of North Oaks at $900; and the City of Gem Lake at $3 SD; and
WHEREAS, the Minnesota Department of Transportation, Ramsey County and the Metropolitan Council
have agreed to provide in -kind planning and technical servicesand projectcoordination throughoutthe course.

NOW THEREFORE BE IT RESOLVED that the Mayor and City Council of the City of Gem Lake do,
by means of this Resolution No. 95-15, approve a contribution of three -hundred ($350.00) dollars for
consultant services from SEH, Inc. For the ongoing I-35E Corridor Management Study during calendar year
1996.

RESOLUTION NO 95 -- 07
January, 1995
WHEREAS; the City pf Gem Lake operates and maintains a municipal
sanitary sewer as a public utility for the benefit of it's residents,
and
WHEREAS; the cost of operating said sanitary sewer is determined by the
Metropolitan Waste Control Commission (MWCC) annually based upon it's
costs of Operation, and
WHEREAS, current and future maintenance costs are the responsibility of
the City af. Gem Lake, and
WHEREAS, funding of operating and maintenance costs is derived from
local sewer user charges established by resolution of the Gem Lake City
Council.
NOW THEREFORE BB XT RESOLVED that the City Council of the City o:f.Gem
Lake does hereby approve the following rates and fees to be set for the
use ofthe municipal sanitary sewer system operated as a public utility
by the City Of Ger Lake, said rates to be effective at the next billing
date for services.
1995 RESIDENTIAL SEWER CHARGES
Municipal Sanitary Sewer Charge $ 100.00 p:er Unit.
