MINUTES OF MEETING OF CITY COUNCIL <br />OF CITY OF GEM LAKE <br />October, 1996 <br />The October meeting of the City Council of the City of Gem Lake was called to order by Mayor <br />Emeott on Monday, 21 October 1996, at 7:04 p.m. in the first floor meeting room of Tousley Ford. Mayor <br />Emeott, Council. Members Igo, Kunin, Birkebak and Nielsen, Treasurer Nordstrom, and Clerk Magnuson <br />were present. Also present were Mr, Mike Gerner, Mr. Joel Andersen, and Dr. Kimberly Andersen. <br />Following Mayor Erneott's request for additions, deletions, or corrections of minutes distributed to <br />the. Council and questions thereto, the minutes of the 16 September 1996 City Council Meeting were, upon <br />motion duly made (Igo) and seconded (Nielsen), unanimously approved as amended. <br />Following . Mayor Emeott's request for additions, deletions, or corrections to the Agenda as distrib- <br />uted to the Council, the Agenda for 21 October 1996.was, upon motion duly made (Igo) and seconded <br />(.Nielsen), unanimously approved as presented, <br />Mayor Emeott then reported that Rod Titcomb has resigned from the Planning Commission. Mr, John <br />Hannaford has agreed to replace Mr. Titcomb on a short term basis and Mayor Emeott recommended his. <br />appointment which received unanimous Council consent. <br />Mr. Gerner was then recognized. Mr. Gerner presented the revised site plan for his project at 3642 <br />Scheuneman Road. The Planning Commission has recommended this project be approved with six (6) <br />conditions as stated in Mr: Gardner's letter to Mayor Emeott dated 15 October 1996. Mr. Igo raised the issue <br />of hazardous materials, hazardous waste, and also the limited availability of space for a commercial dumpster, <br />recommending that a seventh condition be included requiring indoor on -site hazardous material storage; <br />hazardous waste storage, and commercial refuse storage. Following discussion and upon motion duly made <br />(Igo) and seconded (Kunin), Mr. Gerner's site plan was unanimously approved with the conditions set forth <br />in Mr. Gardner's letter plus the aforementioned hazardous material and waste codicils. The Clerk was <br />directed to draft a Developers Agreement with Mr. Gerner which will include all the stipulations. <br />Mr. Magnuson then reported that the Leuthard matter has been mutually resolved to the benefit of <br />the landowner and the City through voluntary site clean-up. <br />Mr. Magnuson then reported that he has issued an extension of the Continental Motors Temporary <br />Special Use Permit to allow November installation of light standards required by the City. <br />Mr..Magnuson then reported that the Gem Lake Hills.noise complaint has been settled. <br />Mr. Magnuson then reported. on the. Thury. Filling.Permit matter, stating that a neighbor has com- <br />plained of severe run-off due to filling. of the Goose Lake Road ditch. Ramsey County has agreed to address <br />the matter as the ditch falls within their right-of-way and the .run off poses potential damage to the road bed. <br />Mr. and. Dr.. Anderson were then recognized. The. Andersen' s wanted to discuss the instaIIation,. <br />removal and reinstallation of asphalt. at the end of their driveway.. Mr.. Anderson stated that the roadbed .has <br />.both settled and. been milled down since constructing their driveway and that a transition .from driveway <br />elevation to road elevation should be provided. Dr. Andersen. also stated her reasons for wanting the <br />transition and indicated that; contrary to the report from Schifsky, she did not badger the workmen into <br />installing the transition that was removed: The Andersens further stated that they believe when the contractor. <br />1 <br />
