WHEREAS, Gem Lake Halls: Inc. has applied for renewal of an On -Sale Liquor and Special Sunday On -Sale
Liquor License For the period 01. January 1996 through 31 December 1996; and
WHEREAS, said applicant has paid all fees and met all requirements of the application process; and

WHEREAS, the. City of Gem Lake has approved lawful gambling by charitable non-profit organizations
within the city; and
W H EREAS, all lawful, gambling within the city limits of the. City of Gem Lake is subject to all laws and
ordinances of the State of Minnesota, the County of Ramsey, and the City of Gem Lake; and
WHEREAS, the City Council of the City of Gem Lake intends to allow gambling by charitable organizations
to continue during 199& and
WHEREAS, the City Council of the City of Gem Lake reserves the right to suspend or revoke the gambling
license or gambling exemption of any organization upon review and due process.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Gem Lake, Ramsey,

CITY OF GEM LAKE
RESOLUTION NO. 96-07

WHEREAS, the City of Gem Lake operates and maintains a municipal sanitary sewer as a public utility for
the benefit of it's residents, and
WHEREAS, the cost of operating said sanitary sewer is determined by the Metropolitan Waste Control
Commission (MWCC) annually based upon it's costs of operation, and.
WHEREAS, current and future maintenance costs are the responsibility of the City of Gem Lake, and
WHEREAS, funding of operating and maintenance costs is derived from local sewer user charges established
by resolution of the Gem. Lake City. Council.
NOW 'THEREFORE BE IT RESOLVED that the City Council of the City of Gem Lake does hereby
approve the following rates and fees to be set for the use of the municipal sanitary sewer system operated
as a public utility by the City of Gem Lake, said rates to be effective at the next billing date for services.

WHEREAS, the City of Gern Lake provides services as well as dissemination of public information to all
persons in accordance with United States, State of Minnesota, County ofRamsey and City of Gem Lake laws
and ordinances; and
WHEREAS, said services and dissemination ofinformation have exceptional costs associated with providing
same to thegeneral public which are beyond budgeted costs; and
WHEREAS, the City of Gem Lake wishes to establish a fair and uniform basis for providing said services
and information to all persons so requesting.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Gem Lake does hereby
establish and approve the rates and fees set forth herein for the use of the City staff' in providing said services
and information, said rates to become effective immediately and to be reviewed annually unless otherwise
required.

WHEREAS, the City of Gem Lake. and Ramsey County have planned the improvement of County Road E
(CSAH 15) from LaBore Road to Trunk Highway 61; and
WHEREAS, Ramsey County will be expending County State Aid Highway funds S.A.P. 62-615-15 on the
improvement of said street; and
WHEREAS, said improvement does not conform to the approved minimum standards as previously adopted
for such County State Aid streets and that approval of the proposed construction as a County State Aid street
project must, therefore, be conditioned upon certain parking restrictions; and
WHEREAS, the extent of these restrictions that would be a necessary prerequisite to the approval of this
construction as a County State Aid projectin the City has been determined..
NOW THEREFORE BE IT RESOLVED that the City bymeans of this resolutionrequests the County
to restrict the parking of motor vehicles on the north side of County Road E from LaBore Road to Trunk
Highway 61,
CITY OF GEM LAKE
RESOLUTION NO. 96-10

WHEREAS, the City of Gem Lake has received ongoing complaints from residents along the eastern and
southern boundaries of the City regarding the imposition of loud speaker paging by Highway 61 auto.
dealerships on their comfort and repose; and
WHEREAS, the City's Assistant Zoning Administrator has verified that said noise pollution does exist and
eminates from auto dealerships located in Gem Lake as well as in White Bear Lake and Vadnais Heights in
direct violation of Ordinance No, 16; and
WHEREAS, the City Clerk has determined that affordable technology does exist and has been successfully
employed in other cities which not only abates the noise pollution but also enhances the on-stie business
climate and efficiency; and
WHEREAS, the City Council believes it is in the best interest of all theresidential citizens, business citizens,
and municipalities to seek a voluntary solution to the problem.
NOW THEREFORE BE IT RESOLVED, that the City Council of the City of Gem Lake requests by
means of this resolution that all auto dealers with locations on Highway 61 between Interstate 694 to the
south and Ramsey County Road "F" to the north voluntarily install electronic paging systems and eliminate
use of all exterior loud speaker systems on or before the first day of July, 1996.

RESOLUTION NO. 96-1.1.

WHEREAS, the City of Gem Lake has received ongoing complaints from residents along the eastern and

NOW THEREFORE BE IT RESOLVED, that the City Council of the City of Gem Lake requests by
means of this resolution that the City Councils of White Bear Lake and Vadnais Heights support this effort
by adopting similar resolutions for distribution to said auto dealers,
CITY OF GEM LAKE
RESOLUTION NO. 96-17

WHEREAS, the Gem Lake Planning Commission, City Engineer and City Planners have spent considerable
time, effort and municipal resources over the last two years updating the City's Comprehensive Municipal
Plan; and
WHEREAS, the development of the Comprehensive Municipal Plan is, as of the date first written above,
essentially complete; and
WHEREAS, it is in the best interest of the residents of Gem Lake and adjacent communities, the Gem Lake
City Council, Planning Commission and City Planners to have said plan reviewed by adjacent communities
and the Metropolitan Council and to solicit their insights and opinions regarding the plan; and
NOW THEREFORE BE IT RESOLVED, that the City Council of the City of Gem Lake does hereby
authorize the City Planner to forward the most recent draft of the Comprehensive Municipal Plan to the
Metropolitan Council as well as the cities of White Bear Lake, Vadnais Heights and White Bear Township
accompanied by correspondence seeking their comments regarding the Plan; and
BE IT FURTHER RESOLVED, that the City Council requests that said opinions and comments be
forwarded to the City Planner, Mr. Randall Thoreson, at Short Elliott and Hendrickson at the earliest possible
date so that revisions .to the plan, if any, resulting .from comments by neighboring communities may be
incorporated as necessary prior to final adoption by the City. Council.
CITY OF GEM LAKE.
RESOLUTION NO. 96-15

WHEREAS, the City of Gem Lake adopted a street maintenance plan and a statement of need in 1995 for
the ongoing maintenance of city streets; and
WHEREAS, the City Council did advise all affected landowners in accordance with all applicable law by
direct mail and by holding a public hearing on the matter of the City's intent to perform improvements
identified as Ramsey County Improvement No. 6584 :(alkla 96sealcoat)and Municipal Improvements No.
96-01 and No. 96-02 and prepared by the City Engineer; and
WHEREAS, the City Council did approve implementation of Municipal Improvements No, 96-01 and No.
96-02 at it's regular August meeting and did further authorize assessment of a portion of the costs to the
benefitted land owners at it;s October meeting,
NOW THEREFORE BE IT RESOLVED, that the City Council of the City of Gem Lake does hereby
establish the costs to be assessed to benefitted land owners as Four -Hundred. Thirty --Nine ($439.00) Dollars
for Municipal Improvement No, 96-01 and Two -Hundred Twenty -Nine ($229.00) Dollars for Municipal
Improvement No. 96.02; and
BE IT FURTHER RESOLVED, that the City Council authorizes an interest rate of six (6.00%) percent
to be applied to all assessments not paid within the prepayment period allowed and to be collected by Ramsey
County as part of the land owners' 1997 payable property taxes with payment in full due in 1997.
CITY OF GEM LAKE
RESOLUTION NO. 96-12
21 October 1996
WHEREAS, the City of Gem Lake currently operates a Municipal Curbside. Recycling Program for all single
family residences within the City; and
WHEREAS, the City Council realizes that increased public education and participation in the program is in.
the best interest of all citizens and wishes to expand the current program; and
WHEREAS, the. Division of Solid Waste of the Ramsey County Department of Public Health has made.
certain funds.available for qualified recycling programs within Ramsey County,
NOW THEREFORE BE IT RESOLVED, that the City Council of the City of Gem Lake hereby empowers.
the City Clerk to annually apply for any and all Score Funding or other such grants as may be made available
from time to time by other agencies for the sole purpose of expanding resident participation in the Gem Lake
Municipal Recycling Program; and
BE IT FURTHER RESOLVED, that said funds shall be used in such a manner as recommended by the.
City's Recycling Coordinator and as approved by the City Council.
CITY OF GEM LAKE.
RESOLUTION NO. 96-13
25 November 1996.
WHEREAS, the City has employed considerable resources in the development of it's Comprehensive
Municipal Plan specifically to respond to the Community Survey and the overwhelming desire of 97% o of the
community to maintain lower density in it's residential areas; and
WHEREAS, there are several large parcels of undevelopedland in the City which are privately owned,
including lands owned by Judson and Barbara Bemis, which may be subject to future residential development;
and
WHEREAS, Judson and Barbara Bemis have willingly consented to a request from the Planning Commission
that all their lands in the City of Gem Lake, including certain lands currently zoned R-3 Residential (36,000
square feet minimum), be rezoned to R-1 Residential ( 3,0 acre minimum); and
WHEREAS, the Planning Commission held a public hearing on 14 October 1996 to receive public comment
on the aforementioned rezoning and no opposition was received; and
WHEREAS,. The City Council held a public hearing on 25 November 199E to receive public comment on
the aforementioned rezoning and no opposition was received; and
NOW THEREFORE BE IT RESOLVED, that the City Council of the City of Gem Lake does hereby
amend the zoning of all lands owned by Judson and Barbara Bemis in the City of Gem Lake to R-3
Residential zoning; and
BE IT FURTHER RESOLVED, that the City Engineer shall be charged with redrawing the zoning
boundaries to reflect said change within one (1) week of the date first written and shall also incorporate said
zoning changes in the City's Comprehensive Municipal Plan currently in draft stage.

WHEREAS,. The City Council held a public hearing on 25 November 1996 to receive public comment on
the aforementioned rezoning and no opposition was, received; and
NOW THEREFORE BE IT RESOLVED, that the City Council of the City of Gem Lake does hereby
amend the zoning of all lands owned by Gem Lake Hills, Inc. And it's shareholders in the City of Gern Lake
to R-3 Residential zoning; and
BE IT FURTHER RESOLVED, that the City Engineer shall be charged with redrawing the zoning
boundaries to reflect said change within one (1) week of the date first written and shall also incorporate said
zoning changes in the City's Comprehensive Municipal Plan currently in draft stage; and
BE IT FURTHER RESOLVED, that in the event the small parcel lying north of Goose Lake Road and east
of the current golf course area meets all otherrequirements of the Zoning Ordinance, a variance may be
granted to said parcel to allow for it's subdivision and classification as R-2 Residential zoning consistent with
adjacent properties.

RESOLUTION NO. 96-16

WHEREAS, the City of Gem Lake held a general election on 05. November 1996 for the office of Mayor
for two (2) years and for the offices of two (2) City Council Members for four (4) years; and
WHEREAS, the public was duly notified in accordance with all applicable law of the offices to be elected,
the availability of application for candidacy, the method of applying for such candidacy, and the date of the
general election; and
WHEREAS, judges of election were duly sworn and present during the hours of polling and all ballots cast.
were properly secured during the hours of election and accounted for following the close of the polls; and.
WHEREAS, the results of said election are attached hereto indicating Paul R. Emeott elected as Mayor and
Roland C. Birkebak and Patrick J. Igo elected as City Council.
NOW THEREFORE BE IT RESOLVED, that the City Council of the City of Gem. Lake does hereby
accept the Municipal Election Summary Statement attached hereto and orders said elected candidates to be
appropriatelyy installed in their respective offices effective the first official meeting of the City Council in 1997..

RESOLUTION NO. 9648
17 DECEMBER 1996
WHEREAS,: the City Clerk has .presented a (Proposed) Budget and (Proposed) Tax Levy for fiscal year
1.997 based upon best estimates of costs for running.the City of Gem Lake in 1.997; and
WHEREAS, these estimates were reviewed by the City Council in August, 1996, amended based upon best
information received from outside contractors, and revised in December, 1996;.and
WHEREAS, the City Council did review the (Proposed) Budget and Tax Levy for 1997, including all.
revisions thereto as of the date first written.
NOW THEREFORE BE IT RESOLVED, that the City. Council of the City of Gem Lake does, by means
of this Resolution No. 96 18,.formally adopt the 1997 Budget of $1.26,021. and the 1997 Net Tax Levy After
HACA Reduction of $90,000 prepared by the City Clerk; and
BE IT FURTHER RESOLVED that the City Clerk is charged with. Certifying said Tax Levy to Ramsey
County Property. Taxation and other government bodies for whom this information is required_
