within the city; and
WHEREAS, all lawful gambling within the city limits of the City of Gem Lake is subjectto all laws and
ordinances of the State of. Minnesota, the County of Ramsey, and the City of Gem Lake; and
WHEREAS, the City Council of the City of Gem Lake intends to allow gambling by charitable organizations
to .continue during 1997; and
WHEREAS, the City Council of the City of Gem Lake reserves the right to suspend or revoke the gambling
license or gambling exemption of any organization upon review and due process.

WHEREAS, the City of Gem Lake operates and maintains a municipal sanitary sewer as a public utility for
the benefit of it's residents, and
WHEREAS, the cost of operating said sanitary sewer is determined by the Metropolitan Waste Control
Commission (MWCC) annually based upon it's costs of operation, and
WHEREAS, current and future Maintenance costs are the responsibility of the City ofGem Lake, and
WHEREAS, fundingof operating and maintenance costs is derived from local sewer user charges established.

NOW THEREFORE BE IT RESOLVED that the City Council of the City of Gem Lake does hereby
approve the following rates and fees to be set for the use of the municipal sanitary sewer system operated

A RESOLUTION TO PARTICIPATE IN COST SHARING QF CONSULTANT
SERVICES TO THE ONGOING I-35E CORRIDOR MANAGEMENT STUDY
WHEREAS, the City of Gem Lake has partially funded and participated in the multi jurisdictional study
of the I-35E Corridor; and
WHEREAS, the City of Gem Lake has committed to continue participation as a member in the I-35E
Corridor'Management Team; and
WHEREAS, the Corridor Management Team will continue to coordinate the ongoing balance of land use
and transportation within the 1-35E Corridor; and
W€:IEREA.S, continuedconsultant services will be required to assist the Corridor Management Team; and
WHEREAS, SEH, Inc. has prepared the attached scope of services proposal to provide such assistance at
a cost of $5,000.00 for calendar year 1997;.and
WHEREAS, the Corridor Management Team has proposed cost sharing contributions from the participating
local unfits of government as follows: Vadnais Heights @ $1.250; White Bear Lake @ $1.250; White Bear
Township ,r ..S I:.250; North Oaks A $900; and Gem Lake @ $350; and
WI�IEREAS, the Minnesota Department of Transpiration, Ramsey County and the Metropolitan Council
have agreed to provide in -kind planning and technical services and project coordination throughout the
course of the study.
NOW THEREFORE BE IT RESOLVED, that the. City Council of the City of Gein Lake authorizes
payment of a contribution of $350.00 for consultant services from SEH, Inc: for the ongoing 1.35E Corridor

The annual work program for the Corridor Management Team Sias been discussed on a number of
occasions. We summarized the concept in the 1-351' report and provided additional inforouticr in
letters dated May 9, 19995 and September 10,1996. After considerable discussion, we wouldpropose
the following as a general schedule of meetings for the CMT.

This meeting would be focused on roadway projects. M.wDOT, Met Council and Ramsey County
would by requested to provide an update of the status of projects and programs for roadway
construction and maintenance. Met Council could also provide info on area trends for traffic and
growth. The involved communities could also provide input on road projects within their
communities. Attendance by ltdjacent communities or counties such as Washington and Anoka
Counties and Lino Lakes in Hugo could also be rcqucsted.

This meeting would .he oriented primarily to land use. Development proposals and the status of
approved development would be provided from. the Eve communities. In addition, the
comprehensive plan update status fur each of the communities should be provided. Data sheets
should be completed by this meeting and submitted to the team. Regional and local land use issues
could also be discussed at the mecti ig. Hugo and lino i.akcs could be invited to attend and provide
input.

At this meeting, trends and assumptions would be discussed. SEH would provide an update, which
tvould. be in writing and could be added to the Corridor report. Traffic volumes and trends,: the
validity of assumptions used in the model and the report, and other factors which couId affect the
balance between marls and land use should be discussed. At this time, an update of the model could

WHEREAS, on 01 November 1984 the City Council of the City of Gem Lake approved a "special use
permit issued pursuant to Sections 5.6 and 7.3(2) of the Zoning Ordinance for the construction and use for
church related purposes of a church by Lamb Of God Fellowship presently based at 3881 Highland Avenue,
White Bear Lake provided that such special permit shall extend only to the Lamb Of God Fellowship and.
shall be non-transferrable by sale or lease. and
WHEREAS Articles of Amendment to Articles of Incorporation of Lamb Of God Fellowship, Inc. were
executed by the Stephen. K. Val.entine as. President and: Glenn R. Carlson as Secretary on 12 December 1996.
amending the name of the church to Majestic Pines Community Church of The Christian and Missionary
Alliance of White Bear Lake; and
WHEREAS, Restated Articles Oflncorporation of Lamb Of God Fellowship, Inc. having similar effect and.
purposewere filed with the Secretary Of State of the State of MN on 18 December 1996;.and
WHEREAS, said Articles of Amendment and Restated Articles Of Incorporation represent a formal and.
duly filed name change of the corporation; and
WHEREAS, representatives of the church have appeared before the City Council of the City of Gem Lake
and have maderepresentation to the name change and the activities to beconducted on the site as church
related only consistent with the original special use permit authorized.
NOW THEREFORE BE IT RESOLVED, that the City Council of the City of Gem Lake does, by means
of this Resolution No. 97.10, authorize the City Clerk to replace the original Special Use Permit authorized
by the City Council on 01 November 1984 with Special Use Permit No. 97-03 to become effective on 16
June 1997; and
BE IT FURTHER RESOLVED that all conditions set forth in the original special use permit approved
by the City Council shall remain in full force and effect.
CITY OF GEM LAKE
RESOLUTION NO.97-11

WHEREAS, the Metropolitan Council has required all cities within the Metropolitan Urban Service Area
to update their comprehensive municipal plans on or before 31 December 1998; and
WHEREAS, the City has engaged the services of professional planners and engineers for the purpose of
carefully preparing a plan consistent with the wishes expressed by the Planning Commission, City Council,
and citizens of the community that will guide the Cityin the future; and
WHEREAS, the Planning Commission and City Council have received and considered direct input for
consideration of amendments, additions and deletions to the Proposed Comprehensive Municipal Plan from
the citizens of Gem Lake via a community wide survey, direct input from citizens and other interested parties
via public information meetings and hearings, and direct input from adjacent communities and regulatory
bodies by direct written invitation; and
WHEREAS, the Planning Commission and City Council have incorporated and/or made changes to the
Proposed Comprehensive Municipal Plan based upon input received during the process deemed to be
reasonable and prudent and within the, guidelines established by the citizens of Gem Lake; and
WHEREAS, the. Metropolitan Council and it's advisory bodies have reviewed and approved the Proposed.
Comprehensive Municipal Plan with conditions and advised the City of Gem Lake in writing that it: may
adopt the plan, recognizing conditions presented and without amendment.
NOW THEREFORE BE IT RESOLVED, that. the City Council of the City of Gem Lake does by this
resolution adopt the City of Gem Lake Comprehensive Municipal Plan as approved by the. Metropolitan
Council and with recognition of Metropolitan Council conditions publicly expressed to the City; and
BE IT FURTHER RESOLVED, that the City Council . hereby directs the. Planning Commission, City
Planner, City Engineer, and other necessary professionals to draft a Watershed Management Plan to be
presented for approval by the Metropolitan Council and included in the. Comprehensive Municipal Plan by
not later than 31 December 1998; and
BE IT FURTHER RESOLVED, that the City Council hereby directs the Planning Commission and other
necessary professionals to evaluate and amend, as necessary, all current city ordinances to reflect the
intentions of the plan and to introduce for consideration and adoption new ordinances required by the plan.

A RESOLUTION GRANTING THE CONSENT OF THE CITY OF GEM LAKE AS
LOCAL FRANCHISE AUTHORITY (LFA) TO THE SALE, TRANSFER AND
ASSIGNMENT OF THE NON-EXCLUSIVE CABLE FRANCHISE FROM
MEDIAONE OF DELAWARE, INC AS TRANSFEROR -SELLER TO MEREDITH
ACQUISITION CORP. AS TRANSFEREE -BUYER.
WHEREAS. MediaOne of Delaware, Inc. holds and owns a cable television franchise and system to provide
cable communications servicesto the City of Gem Lake, ..(hereinafter "LFA") said franchise having been
duly granted on 15 May 1989, accepted on 31 May 1989 and as duly assigned and/or amended from time
to time; and
WHEREAS, on 27 May 1997 MediaOne of Delaware, Inc_ (f/k/a Continental Cablevision. Inc. and.
hereinafter referred to as "MediaOne.") entered into a contract with CCTC Moldings, Inc. (hereinafter
referred to as "CCTC"); and
WHEREAS, that contract has been assigned to Meredith Acquisition Corp (hereinafter referred to as
"MAC") an indirect and wholly owned subsidiary of CCTC; and
WHEREAS, the contractprovides for the sale of the issued and outstanding capital stock of North Central
Cable Communications Corporation (hereinafter "NCCCC") which owns all of the issued and outstanding
Capital Stock (hereinafter, the "Group W Shares") of each Group W Cable of Burnsville/Eagan, Inc.; Group
W Cable of the North Suburbs, Inc.; Group W Cable of Ramsey/Washington, Inc.; and Group W of
Columbia. Heights/Hilltop, Inc.; and
WHEREAS, a request for transfer of control of NCCCC to MAC was duly filed with the. City of Gem Lake.
and MAC has requested franchise consent to change of naive of the franchises for the Group W Shares to
NCCCC. FCC form #394 Application For Franchise Authority Consent To Assignment Or Transfer Of
Control Of Cable Television Franchise was filed on or about 15 July 1997; and.
WHEREAS,. The City of Gem Lake has conducted a thorough review and investigation into the legal,
financial and techniicalqualifications of MAC to own and operate the cable television system in light of the
above referenced FCC form #394; and

WHEREAS, Mr. & Mrs. Michael Larkin of 1385 East County Road "E" of this city did receive approval
for a preliminary plan for subdivision of the aforementioned lands in May, 1997 from this City Council; and
WHEREAS, said approval did allow: for extension(s) of said approval by the City Council from time -to time
for periods not to exceed six (6) months in accordance with City ordinances; and
WHEREAS, the purchaser of said lands have requested in writing that the approval granted in May, 1997
be extended to May, 1998..
NOW THEREFORE BE IT RESOLVED, that the City Council of the City of Gem Lake does by means
of this resolution extend the aforementioned approval of a preliminary plan for subdivision of the lands
associated with 1385 East County Road "E said extension being valid through 18 May 1998.

WHEREAS, Mr. & Mrs. E. Rodman Titcomb of 1430 Goose Lake Road of this city did receive approval
for a preliminary plan for subdivision of the aforementioned lands in May, 1997 from this City Council; and
WHEREAS, said approval did allow for extension(s) of said approval by the City Council from time to time
for periods not to exceed six (6) months in accordance with City ordinances; and.
WHEREAS, the owners of said lands have requested in writing that the approval granted in May; 1997 be
extended to May, 1998.
NOW THEREFORE BE IT RESOLVED, that the City Council of the City of Gem Lake does by means
of this resolution extend the aforementioned approval of a preliminary plan for subdivision of the lands
associated with 1430 Goose Lake Road, said extension being valid through 18 May 1998.
CITY OF GEM LAKE
RESOLUTION NO. 97-16

WHEREAS, the State of Minnesota did enact and make effective 01 August 1997 legislation requiring all
local units of government to license and regulate the sale of tobacco under Chapter 227 / H.F. ] 17; and
WHEREAS, said statutes require that local ordinances be developed to provide for licensing and one or
more inspections of compliance with the costs of same bornby the retail seller of tobacco products; and
WHEREAS, the North Suburban Tobacco Compliance Project offers compliance checking of local
ordinances at reasonable fees, such that the City could not coordinate and engage in such investigations.
NOW THEREFORE BE IT RESOLVED, that the City Council of the City of Gem Lake does hereby
order the development of an Ordinance for Tobacco Sale Licensing and Compliance for review, public
comment, and implementation not later than 28 February 1998; and
BE IT FURTHER RESOLVED that all current retail tobacco licenses issued or the year 1997 be extended
until 28 February 1998..atwhich time said licenses will require renewal; and
BE IT FURTHER RESOLVED that the City Clerk shall engage the services of the North Suburban
Tobacco Compliance Proiect as an independent contractor to provide compliance checks in accordance with
the ordinance to be enacted, the date of commencement of said services to be 01 March 1998 immediately
tbliowing adoption of the. City's tobacco ordinance and the date of payment for said services for the year
1998 to be upon adoption of this resolution.

WHEREAS, the Council of the City of Gem Lake has reviewed and approved Ordinance No. 70 defining
annual pay for the Mayor and Council as elected officials; and
WHEREAS, City staff are appointed and must be hired at cprnpetitive wages;. and
WHEREAS, City stafff are continuously being asked to perform additional tasks while containing costs and
have done so without consideration of pay since 1992.
NOW THEREFORE BE IT RESOLVED, that the Council of the City of Gem Lake does hereby set the
annual salaries for City staff as follows:
City Clerk $ 3,000.00 Annually
City Treasurer. $ 2,500.00 Annually.
BE IT FURTHER RESOLVED that the City shall reimburse City staff for all expenses incurred in the
performance of their duties; and
BE IT FURTHER RESOLVED that the City shall reimburse the City Clerk, Treasurer and Mayor for

WHEREAS, all written comments and staff reports have beenreceived and made part of the record; and
WHEREAS, following review and investigation, the City of Gem Lake has concluded that the Applicant
has established that it meets the legal, technical and financial criteria to operate the CATV system and has
satisfied all criteria set forth in and/or under ail applicable or required City of Gem Lake and federal
documents, laws, rules and regulations, including FCC form #394.
NOW THEREFORE BE IT RESOLVED, that the City Council of the City of Gem Lake hereby gives
it's approvalto the sale, transfer and assignment of the cable system serving the City of Gem Lakeland of
the rights under the, franchise. from MediaOne to MAC; and
BE IT FURTHER RESOLVED, that
1. The City of Gem Lake hereby confirms that the Franchise is valid and outstanding and in full
force and effect; and
2. Upon passage of this transfer Resolution, MAC shall be bound by the terms and conditions
of this franchise.
3. As of the date of this Resolution No. 97-12, MediaOne is deemed in material compliance
with the Franchise Agreement.
4. This Resolution No. 97-12 shall be effective upon execution by the City Council.
5. Upon acceptance of this Resolution No. 97-12 by signing below, MAC may encumber all or
any part of interest of MAC in and under the Franchise Agreements, for financing puzposes,
by one or more security agreements, devises, mortgages, deeds of trust or other
encumbrances from MAC to any lender providing financing to MAC from time to time and
encumbering any property or assets of MAC under the Franchise Agreement.

53,600.O0 for the year. Ibis is well within the initial budget of $5,000.00. We feel that we can be
more effective without. spending any adds oaal funds if the CMT can adopt a.schedule of meetings
and purposes, and additional duties can be spread to the various members.. Ramsey County,.
