MINUTES OF CITY COUNCIL MEETING
APRIL, 2001
The April, 200 I meeting of the City Council Oldie City of Gem Lake was called toorder by Mayor Bineott on Monday, 16
April 200 I, at 703 p.m. in the first floor meeting room of'1'inisley Pohl. Mayor Eineott, Council Members Bosak and Birkebak,
Prosecutor Mesiow, and Clerk Magnuson were preserri. Also present were residents Lorenz (2), Watson (2), Herzog (1), Bo1fing,
Lindner, and Brown.
Following Mayor Eineott's request for additions. deletions, or corrections, the following wore unanimously approved: 1) the
19 March 200I City Council Minutesas presented on Motion h\ Bosak and Second by Birkebak; 2) the 16 April 2001 City
Council Agenda as presented on Motion by .Birkebak and Second by Bosak.

Emeottthen reviewed activities offthc. Planning oiiimssion, noting specifically;that further discussion ofthe proposed animal
control oi'diri lace had been. held with a more friendly draft developed by 1..indner. Meslow was then recognised arid discussed how
anitttal control ordinances are handled in other eoniIllunities, He stated that while certain issues are' clear eta (e.g. biting dogs,
roaming at large, etc) and can be dealt with pi'iiceduraliy, other issues like barlcing are terribly subjective as to provocation,
duration, intensity,. etc: The latter (barkiiig:) is iln issue; judges of the court do not like to deal with as they are insignificantrelative
to perceptions of crane and outer issues. Meslow siated the city can proceed one of three ways: I) do nothing and utilize the
existing ordinance in conjunction with tlre.nuisance ordinance: or 2) enact a tougher ordiIlailce and not enforce it (which is what
most cities do), orii) enact a tougher ordinanceand attempt to ent.orce same. As prosecutor, Meslow will not attempt to prosecute
the grey areas of clog barking.'I'be council thanked him for his input.
Magnuson reported thatadVei'tisenleiits for the vacant Nielsen and Treasurer's posit ions appeared in the 1 1 Apri12001 edition
ofthe White. Bair Press. No responses were received. althrugll Jim Segerntark called and indicated he felt Ms. Cobian was ideal
as Treasurer given her experience and the tactshe Works with the Clerk. Following discussion of candidates for the:. Nielsen City
Council seat and upon motion by Birkebak and second hBosak, Resolution No. 2001-12:, a copy of which..is attached hereto as
Exhibit. "A". appointing Chuck Watsnil to the Nielsen vacancy lar a term coding. on 31 December 2002. was unanimously
approved. Mayor Enleott administered the Gatli of .Office, attached hereto as Exhibit "B"., and welcomed Mr. Watson to the

Discussidti of Resolution No. 200 I- 13 regarding Mrs. Cobian's permanent appointment was delayed to allow more time for
applicants to respond. ~
Birkebak presented his law enittieenhent report stating titat costs lor2002 imiy increase as much as 7%. He. also reported. the
Smart Cart LvilIbe ready inthenext few: days ibr use. Magnuson reported he has already requested same .nor Scheunernan Road.
The.Recycling Report for the I `'. Qiiartei was reviewed with nei action taken.

Magnuson reported he has ordered pot hole rnainten8itci] by T.A. Schifsky R. Sons.as soon as possible. He will also discuss
street sweeping with Mr. lungnlan.
Magnuson iepoited he has spoken with iylayasich who liar proposed a meeting with Ken Heider, the new director of public
works for the county. Similarly a nleetrtlg \vit11 Mr, Soler regarding the (01111t', 1:, / Lal3ore Road project will be scheduled.
Biheott.repuried he has spoken with some neighbors regarding sewer and there is seine interest along with Gem Lake Hills.
Magnuson reported Water Invitations for proposals.11ave h.eeil.sent.
Magnuson preseiited a Sta ff Policy Hecoitl€iteridaticrii regarding. Charitable Gambling Contribution distributions. based upon
current state law and interpretations by state staff.

Following discussion and motion by Bosak and second by I3irkcbak. the following distributions of charitable gambling
voluntary contributions were approved:
Willow Lane School Extended reading program, globes and maps $ 2,800
White Bear Emergency Food Shelf Ongoing support $ 1,200
RC Friends of Parks & Trails Ongoing support $ 210
TOTAL 2001 DISTRIBUTION ALL PROJECTS $ 4,210
Discussion of (Proposed) Ordinances No. 77 and No. 78 followed. It was recommended that staff send a letter of the public
hearing for tire inspections to each business owner as supplemental to public notice given.
Emeott discussed the matter ofdefinition came businesses in residential districts stating concern over home day care where
traffic and large numbers of small children could represent a nuisance. The matter is under discussion with no imminent decision
pending. Jodi Lorenz asked about her day care and foster cars arrangements and was advised that no plan currently is under
consideration that would impair the concept.
Magnuson reported that a second organization studying rail transit to be potentially routed along our northern border has
emerged and that this seems to be another example of tax pavers paying for the same work twice.
Mr. Lindner was recognized and identified he has taken on the task of historian and has completed some research already.
He will keep us advised as he proceeds.
Motion by Birkebak, second by Bosak to accept Treasurer's Report as presented by Magnuson was unanimously approved.
Motion by Birkebak, second by Bosak to Transfer $ i 5,000 from the Sewer Fund to the Sewer Investment Fund and to reinvest all
funds as CD's with Premier Bank was unanimously approved.
Emeott noted the next meeting will be on Monday. 21 May 2001.
There being no further business. the meeting was adjourned at 9:10 pm by Emeott on motion by Birkebak, second by Bosak
and unanimous vote.
