HomeMy WebLinkAboutCC JUN 2004 MINUTESCITY OF GEM LAKE RESOLUTION NO.2004.07 24 May 2004 RESOLUTION DECLARING THE, OFFICIAL INTENT OF THECITY OF GEM LAKE, MINNESOTA TO REIMBURSE CERTAIN ORIGINAL EXPENDITURES FOR 'GOVERNMENTAL .PURPOSES FROM THE PROCEEDS OF TAX- EXEMPT BONDS TO BE ISSUED.BY THE CITY OF GEM LAKE, MINNESOTA AFTER THE PAYMENT OF SUCH ORIGINAL EXPENDITURES WIIEREAS, Treasury Regulations, Section 1..1.50-2 (the "Reimbursement Regulation"), promulgated pursuant to Section 150 of the Internal Revenue Code of 1986, as. amended (the "Code"), providesthat the allocation of the proceeds of tax-exempt bonds to expenditures for governmental purposes originally paid from a .source other than such tax-exempt bonds will be treated as expenditures of such tax-exempt bonds onlyif certain requirements .of the Reimbursement Regulation.. are satisfied by the issuer of such tax-exempt bonds; and WHEREAS, the City of Gem Lake, Minnesota, a statutory city and a political subdivision of the State of Minnesota (the "City"), expects to incur certain original expenditures for governmental purposesto be financed temporarily from sources other than the proceeds of tax-exempt bonds and which are expectedto be reimbursedfromtheproceeds of one or more series of tax-exempt. bonds; NOW. THEREFORE, BE IT RESOLVED BY THE CITY .COUNCIL OF THE CITY OF GEM LAKE AS FOLLOWS: 1. The City has a reasonable expectation. (within the meaning of Treasury Regulations,Section I.148-1(b)) that it will make expenditures for the projects generally described. in EXHIBIT A attached to this resolution (the "Projects"): The City has a reasonable expectation that it will issue one or more series of tax-exempt bonds (the "Bonds") for each .of'the Projects in the estimated maximum principal amounts set forth in EXHIBIT A and that it will make reimbursement allocations with respect to such original expenditures from. the proceeds of such. Bonds. 2 The City Clerk is authorized to designate appropriate additions to EXHIBIT A in circumstances where time is of the essence, and any such designation shall be reported to the Council at theearliest practicable date and shall be fled with the official books and records of the City as provided in Section 3. 3. This resolution shall be maintained as part of the books and records .of the City at the main. administrative office of the. City, and shallbe continuously available: duringnormal business hours of the City on every business. day of the period .beginniingnot more than thirty days after adoption of this resolution and ending onthe last date of issue of. any Bonds issued to reimburse expenditures described in.EXH1BIT A. 4. This resolution has .been .adopted not later than sixty (60) .days after payment of any original. expenditure to be subject to a reimbursement allocation with respect to the proceeds .of Bonds. 5. All reimbursement allocations with respect to the Bonds will be made notlater than eighteen (18) months after the later of: (i) the date the original expenditure is paid; or (ii) the date the Project is placed in service or abandoned, but. in no event more than three (3) years after the original expenditure. 6. All original expenditures to which reimbursement allocations are to be made. constitute: (i) capital expenditures; (ii) costs :of issuance of the Bonds; (iii) expenditures for extraordinary, nonrecurring items that are not customarily payable from current revenues, such as casualty losses or extraordinary legal judgments in amounts in excessof reasonable insurance coverage, and for which no reserve is maintained; or (iv). a grant (as defined in Treasury Regulations,. Section 1.148-G(d)(4), as a transfer fora governmental purpose of money or property to a transferee that is not.a related party to or an agent .of the transferor with: respect towhich no obligation or condition is imposed to directly or indirectly repay any amount to the transferor). -1- 7. The limitations set "forth in paragraphs 4 and of thisresolution do not apply to: (i) the costsof issuance of the Bonds: (ii) an amount not inexcess of the lesser of $100.,000or five percent (5%) of the proceeds of the Bonds; or (iii) preliminary expenditures up to: an amount not in excess of twenty percent (20%) of the aggregate issue price of the Bonds that finance or are reasonably expected by the City to finance the. Projects for which the preliminary expenditures were incurred. The term "preliminary expenditures" includes architectural, engineering, surveying, soil testing, reimbursement bond issuance, and similar costs that are .incurred prior to commencement of acquisition, construction, or rehabilitation of a Project, other than land acquisition. site preparation, andsimilar costs incident to commencement of construction. 8. This resolution is an expression of the reasonable expectations of the City based on :the facts and circumstances known to the City as of the date hereof. The anticipated original expenditures for the Projects set forth at 1 XI I]B11 A and.. the principal amount of the Bonds set Earth in EXHIBIT A are consistent with the City's budgetary and financial circumstances. No sources other than proceeds of Bonds to be issued by the City are, or are reasonably expected to be, reserved, allocated on a long-term basis, or otherwise set aside pursuant to the City's budget or financialpolicies to pay such Project expenditures. 9. This resolution is intended to constitute a declaration of official intent for purposes oldie Reimbursement Regulation. 10. No reimbursement allocation of the proceeds of the Bonds to Projectexpenditures will employ an abusive arbitrage device (within the meaning of Treasury Regulations, Section 1.148-10) to avoid the arbitrage restrictions or to avoid the restrictions of Sections 142-7 of the. Installation of Municipal Sanitary Sewer pursuant to Minnesota Statutes, Chapter 429. The sanitary sewer would be constructed along and in the right-of-way of Scheuneman Road commencing at it's intersection with Kahl Circle and thence southerly approximately 2,100 feet to a point adjacent the south entrance to Hillary Farm, located at 384] Scheuneman Road. The area proposed to be served and assessed is all real property with addresses from 3841 Scheuneman Road through. 4031 Scheuneman Road and 4039 Scheuneman Road (Gem Lake Hills Golf Course). The estimated cost of the improvement is $600,000. A reasonable estimate ofthe impact of the improvement and assessment was made available at a public hearing. 21 June 2004, Resolutions No. 2004-11 and No. 2004-12 Installation of Municipal. A reasonableestimate of theimpact of the improvement and assessment was made available at a public hearing. CITY OF GEM LAKE RESOLUTION NO. 2004-11 21 June 2004 RESOLUTION OF THE. CITY OF GEM LAKE, MINNESOTA ODERING CERTAIN PUBLIC IMPROVEMENTS WHEREAS, the City of Gem Lake, Minnesota. (the "City") has received the request of McNulty Construction Company (the "Developer") for the development of certain real property within the corporate limits of the City for the purposesof constructing a development of approximately 29 single family homes (the "Development"); and WHEREAS, the preliminary plan for the Development is knownas the Hillary Farm Plan B-2 (the "Preliminary Plat"); and WHEREAS, the majority of the homes in the City currently operate septic systems and are not connectedto the.inetro sanitary sewer systemand certain existing homesin the City have septic systems thatare failing or willfail in the near future; and WHEREAS, as part of the City's:review .and approval process for the Development and the Preliminary Plat, the City is requiring that the Developer connect the homes in. the. Development to the metro sanitary sewer system; and WHEREAS, the main sanitary sewer line for the Development will be constructed under Scheuneman Road and there are other homesin the City abutting ScheunemanRoad that will benefitform theconstruction oldie sanitary sewer line under Scheuneman Road and being connected to the metro: sanitary sewer system; and WHEREAS, the construction of thesanitary sewer system for the homes abutting. (the "City Council") of the City on .May :24,2004 (the "Resolution2004-05"), the City ordered sanitary sewer improvements (the "Original 2004 Improvements") for homes abutting Scheuneman Roadleading upto a single family residential development to be constructed by McNulty Construction (the "Development") and in. the Development; and (b) Pursuant to Resolution No. 2004-11 adopted by the City Council on the date hereof ("Resolution 2004-11"), the City ordered sanitary sewer improvements for homes abutting Scheuneman Road commencing at the intersection with Kahl Circle and thence northerly approximately 1,000 feet to the intersection of Scheuneman and.. I 1 The Gem Lake Planning Commission met on Monday, June 7, 2004 in the first floor meeting rootrt ofTousley Ford. This was a rescheduled meeting originally slated for June 1. Members Jim Lindner, Derek Wippich, and Kathy Robins were present. Mayor and Co -Zoning Administrator Paul Emeott was also present. In the absence of Chairman Hoeschler, Mr. Lindner served as acting chair. The meeting came to order at 7:00PM. There was a brief discussion of new sewer along Scheunemann Road, from. Kahl Circle to Hillary Farm south entry. The city engineer has beengiven the notice to proceed in notifying residents and will do a survey of land 100' either way from the center line of Scheunernann Road. Mr, Wippich introduced a means of adding gentle curves to the roadway to create three way intersections with traffic control signs to limit speeds on the road and add to the aesthetic quality of the road. Ramsey County will turn the road back to Gem Lake at its June 8, 2004 meeting, along with $170K- the cost of brining the road to 90% of new condition. Given the nature of progress involving Scheunemann Road, we feel it worthwhile to invite the City Engineer to our July meetingfor an update. There. are some creative suggestions the Planning Commission wants to bring to the attention of the engineeras well. Next there. was a brief discussion of the next phase .of McNulty's.development. With 28 .new homes (plus the existing estate house)" it is projected that fewer than 100 people (perhaps as few as 75) will be added to the population of the city. NeXt, several means of controlling traffic on Schettnernann Road were debated. Besides Mr. Wippich's curved road, speed bumps, stop signs at. Kahl Circle, one way "north bound only" from Gem Lake. Hills Golf Course to Highway 61, signage such as "local. traffic only", and, as a last resort, terminating the road at Highway 61 with a formal cul .de sac, were all discussed. Emergency vehicle access is a consideration.. Many S:cheunernarin Road. residents like the cul de sac idea. .No formal. idea. was voted upon. Derek presented an "Uriweave the Weave" update. Edgerton St. bridge will be closed and reworked in 2004. There is a long lead timefor steel whichis delaying this component. MNDOT is looking for a convenient time to block Interstate 694 to demolish the Edgerton bridge. The group discussedvarious traffic hazards in the "Commons Area." Paul issued a draft copy of his density transfer proposal. This establishes zoning. considerations for unique land forms and creative land use. It contains site control and standards language. It limits the amount of density transferred (5 acre minimum lot size and only 1/3 of zoning area allowed to be transferred- i.e., one acre transferred on a 3 acre lot). We will find appropriate spot in Ordinance 43 for this section. We plan on a public hearing on July 14, 2004 Planning Commission meeting. Working title is BHDTA. We next discussed height limit restrictions as described in our zoning ordinance. Mr. Wippich promoted moving away from current language, of strict height requirements and moving instead towards median height measured from a predetermined elevation. If enacted, this would allow for more varied roof heights, which would be consistent with. our preference for unique house designs. This also would allow for easier compliance with state energy code requirements. At 7:45 Jack Hoeschler arrived fresh from Italy. Mr. Lindner refused to yield the chair to Mr. Hoeschler. Church zoning was the next topic. Mr. Hoeschler introduced the group to RLUIPA, the Religious Land Use and Institutionalized Persons Act of 2000. This act limits a city's ability to prevent churches from entering a community through restrictive zoning requirements. Jack briefly discussed Lake Elino and Eden. Prairie as two cities with successful limits to church growth through zoning controls that comply with RLUIPA.. Sonie metro area churches exist through PUD ordinances. Finally we discussed site control, particularly as it relates to Hillary Farm, but in general for all future developments, specifically those involving density transfer or restrictive covenants. The group agrees site review should roll up to the. Zoning Administrator, but there should be some guidelines drafted by the Planning Commission. The Planning Commission should also become involved in more complex zoning situations. Due to several scheduling conflicts our next meeting will be moved to Wednesday, July 14, 2004..Notification must go to the city clerk for publication. There being no further business, the meeting adjourned at 8:3.5PM. MINUTES OF A MEETINGOF THE JURISDICTIONS THAT CONTRACT WITH RAMSEY COUNTY SHERIFF'S DEPARTMENT FOR POLICE SERVICES. APPROVAL OF AGENDA The agenda was approved as submitted. NATIONAL NIGHT OUT PLANNING Lt. Paget updated the Group regarding National Night Out, noting that Deputy Ruettimann was not available to attend today's meeting. He stated that this year's NNO will be held on August 3rd, and Deputy Ruettimann will prepare a press release far publication in our Local paper. He stated that registration forms will be mailed to all Block Captains by June 21st, and he will request that they be returned by July 30th. The list of gatherings will be faxed to each community prior to the event. Lt. Paget reported that Deputy Ruettimann intends to purchase Child Internet Safety Mouse Pads to hand out during NNO, and if anyone wants to order them for their community, they should contact him. Altendorfer noted there will only be a few to hand out at each event, due to budget constraints. The cost is $1.18 per mouse pad. Lt. Paget will provide a sample for the next meeting. Minutes Sheriff Contract Group Meeting June 17, 2004 TRAFFIC CONTROL OPTIONS. Brown Day: Lt. Paget distributed a press release with :regard to the first "Brown Day" traffic saturation. event that occurred on June 10th Z. 15th in the contract communities:. He explained that the press release was. planned with the idea of "voluntary compliance". He stated that it was .a successful detail, and that no overtime was used for these events. He reported that 190 stops were made -and 181 citations were issued,. which included 172 speeding citations: He stated there were a total of 183 charges, and that 17 written warnings were given. He provided a breakdown of the statistics for each community as follows: Arden. Hills — 41 speeding citations; •Vadnais Heights — 41 speeding citations, 3 other charges, 7 written warnings;. Shoreview — 13 speeding citations, 1 other charge, 3. written warnings; White Bear Township — 36.speeding citations, 5 other charges, 5 written warnings; North Oaks — 19 speeding citations, 1 written warning; Little Canada 22 speeding citations, 2 other charges. He noted that the speeding citations •were generally issued for between 11 -- 27 miles per hour over the speed limit. He stated there were other charges that were issued in addition to the speeding citations (17 seat belt, no front plates; etc.). •Schwerin commented that he perceived that everything went well, noting that the timing was good (just after school let out), and feeling that it sent •a good message to residents. Altendorfer stated that another similar event may be planned in the fall when school begins. Altendorfer reported on a chase that originated in the City of WBL and proceeded down Highway 96 to Centerville Road. He explained that stop sticks were used, which eventually ended the chase. He reported on "Pursuit Driving Course" training, which includes maneuvers to end pursuits by causing them to drive into the ditch. He stated that pursuits are happening more and more often. With regard to a question about the use of helicopters during chases, Altendorfer responded that they are riot used very often due to timing, since pursuits usually don't last that long. Traffic Control Options: Altendorfer reported that Sheriff Fletcher has advised him that the County would not object to hiring Kim Klawitter, a retired state patrol officer, for additional traffic control. Altendorfer provided a ballpark figure of $1 0,000 for a used vehicle for the position, and a minimum cost of $25,000- $28,000 for a new vehicle. He stated that he had not discussed the position with Mr. Klawitter because he was waiting for Department authorization. Urban stated that he has been advised that there will not be a need for additional traffic control until July of next year, however; he noted. that. we .could begin sooner, possibly in the spring of next year, to prepare for the situation. 2 Minutes Sheriff Contract. Group Meeting June 17, 2004 Hanson questioned how the position would be structured (Le., three or five days per week, Monday — Friday?). He also reiterated his suggestion for weekend presence. Altendorfer suggested beginning with a minimum of three days per week, then assess it and make suggestions. Altendorfer stated that Mr. Klawitter is a professionally minded, highly motivated individual who he believes will appreciate the position. He noted that Mr. Klawitter is not restricted to a limited number of work hours during his retirement. Schwerm noted that it will be necessary to determine Mr. Klawitter's availability for the position. He explained that the position needs to be incorporated into everyone's budget, and a determination will be necessary with regard to a fair amount for each community to contribute. He felt that part-time will be more affordable than overtime, and that it made sense to take a car out of auction to use for the position. Hanson noted that this will give the Group a way to test the position. Urban felt that we will need minimum coverage of four hours, five days per week, which may need to be extended, and that we should include supplemental coverage on weekends. He suggested that the position be year-round, beginning in the summer of 2005. Hanson noted that Little Canada is prepared to do more, if needed. It was determined that this matter will be discussed at next month's meeting, including how the position will be structured, and each community's participation level. 2005 BUDGET Altendorfer reported that, per Georgie. Schulte, Ramsey County Risk Consultant, the main reason for the Worker's Compensation increased cost in 2004, was due to rate increases. She stated that the rate for officers increased from 1.517% in 2003, to 1.979% in 2004; and that the rate for clerical increased from 1.76% to 2.34%. She also stated that a small amount of the cost increase was due to a payroll increase. Altendorfer also reported that he received an e-mail advising him that the Contract Group received checks for Workers Compensation refunds and an auto adjustment in the amounts of $3,184.00 and $186.00, which can be added back into the budget as a recovery of expense. There was discussion with regard to "auto adjustment" versus dividends, and it was noted that the e-mail received referred to an adjustment, not dividends. 3 Minutes Sheriff Contract Group. Meeting June 17, 2004 There was a question with regard to verification of the rate increase for clerical. Altendorfer stated that he will follow-up on this. There was discussion with regard to. the budget estimate. for dividends, with a consensus 'that it is .necessary to. make sure these figures are realistic. Altendorfer will check on this and report back. It was the Group's consensus that the budget be updated for next month, including traffic, clerical (additional 1/2 time person in crime prevention position) and insurance, and that it be provided to each community to review prior to the meeting. OTHER ISSUES There was discussion regarding the Dispatch Center, and it was the. Group's consensus that nobody would support a combined Dispatch Center.
