Minutes of Gem Lake City Council Meeting
16 June 2009
The regular meeting of the City Council of the City of Gem Lake was called to
order by Mayor Uzpen on Tuesday, June 16, 2009 at 7:00 pm in the Gem Lake
City Hall meeting room.
The following members were present: Mayor Bob Uzpen, Council members
Gretchen Artig-Swomley, Chuck Watson, Tom Rasmusen and Jim Lindner.
Other members of the public were also in attendance per the sign in sheet sent
around the room.
APPROVAL OF AGENDA AND MEETING MINUTES
Minutes of City Council meeting of May 19, 2009: The City Council did not.
receive the May 19, 2009 City Council meeting meetings so was pushed back to
approve at July 21, 2009 City Council meeting.
Planning. Commission Minutes for May, 2009: The City Council members did
not receive the May 5th, Special Meeting on May 12tn and June 2nd minutes. Will
be resent to the. Council members and approved at the. July 21, 2009.City
Council meeting.
City Council Agenda: Mayor Uzpen called for additions, deletions and
corrections to the agenda. Jessie Hart, Treasurer for Gem Lake added news
from the Legistration Update on Allotment for the New Business discussion.
Upon motion by Artig-Swomley and seconded by Watson, the agenda was
approved for June 16, 2009.
OLD BUSINESS
City Newsletter — July, 2009: The council discussed ideas for the July
newsletter. Will be doing a profile on the Trike Shop as they were not available
for an interview for the June newsletter. A request has been made to start
putting the Neighborhood Watch information in every issue. Also discussion on
Gem Lake's 50t" Anniversary on June 30, 2009 and the National Night Out on
Tuesday, August 4, 2009. Other topics of interest were Surface Water public
hearing in August, 2009 and mention of the high school graduates from Gem
Lake.

Surface Water Project Plan: Mayor Uzpen brought to the meeting the permit
that expires in 2011. Was supposed to have the inspections done this past
month. The timeline will be in July contacting neighborhood cities in regards to
what they are doing for inspections.
NEW BUSINESS
Legistration Allotment: Jessie discussed how the State of Minnesota in
balancing the budget was to reduce local government aid and market value.
homestead credit by 300 Billion and included Cities, Counties and. Townships.
Gem Lake is going to lose everything that it does get in government aid and
market value homestead credit in 2009. By the year 2011 everything should go
back to status quote.
2008 Audit. Report: Thomas Koop and Michelle Burley from Larson Allen was
there to discuss the audit that was done for Gem Lake. The. City Council was
given handouts discussing the 2008 audit. The auditors said that Gem Lake is.
doing well with the system they are currently using. Mr. Koop touched base on
government accounting standards and fund level. Gem Lake is at 90% of one
year expenditures for reserve and is very solid. The other funds are more
specific related to Levying and/or collecting special assessments to specific bond
issues. The e City Hall construction fund is solid.
Claims for June: The bills for June were discussed and authorized to pay.
Scheuneman Road: The presentation from Justin from SEH that was discussed
at the May 19th City Council meeting is about right for the estimate. The proposal
is 1.5 million with cleaning the ditch. Need to decide if the citizens want it fixed.
and how to asset it. It was suggested that more citizens participate in the project.
It was also suggested that maybe the County would help pave the road. Will
need to talk to the property owners and find out what the expectations and needs.

Sign for Scheuneman Road: Residents are complaining and Mayor Uzpen has
witnessed it himself, that when people leave the golf course, they turn right and
it's a dead end. They turn around and floor it past the golf course. Suggestions
were to buy a sign from Gopher Sign and install or talk to the golf course and
place the sign on their property. The sign would say "right turn no outlet"_ Also
was suggested that the bushes need to be trimmed in that area on the golf
course. There is money in, the budget for a sign.

Handouts from Kelly and Lemmons: The Council members were given a
packet from Kelly and Lemmons regarding the New. Legislation regarding State
Building Code Enforcement - Disabilities and Proposed Legislation regarding
Administrative Penalties — Minor Traffic. Mayor Uzpen asked the Council
members to review the packet.
White Bear Mechanical: Gem Lake has used this company to fix controls. The
company has gone out of business. Mayor. Uzpen has received a bill from them
for fixing the controls of the building. The Council members have shown a
concern for this issue.
Sheriff's Department. Eliminating Administrative Back -Up: Mayor Uzpen was
informed that the Ramsey County Sheriffs Department will not be providing
back-up if the Administrative Assistant is sick or takes vacation days. The Mayor
wanted the Council to be informed of the new situation.
NEW BUSINESS - OPEN ITEMS
Shoreline Beach Complaint: Artig-Swomley received a complaint from two
neighbors regarding large beaches in front of two houses in Gem Lake. She
brought pictures of the two properties. Ordinance 43, Section 21 protects the
shoreline zero (0) to fifty (50) feet starting at the land to the lake. The Council
stated that the resident has to present a plan to the Council for their approval.
Will send out White Bear Township's inspector to view the shoreline on those
homes and will report back to the City Council.
RCLLG Meeting: Tom Rasmusen is one of the Board Members that meet with
this group every Thursday. Thursday, June 18, 2009, Gem Lake along with
White Bear Township is hosting the meeting at Heritage Hall and Rasmusen
cannot make the meeting. Artig-Swomley will attend this meeting.
Gateway: Mayor Uzpen received an email from Justin at SEH and Mayor Uzpen
forwarded the email to the Council. Justin is requesting to meet with the Council
regarding the email. Mayor Uzpen also received an email from Trevor regarding
incentives from Gateway. Trevor would like to set up a meeting in July to discuss
this, Trevor is getting feedback that he needs to discuss with the Council. The
Council decided to meet with Trevor in July.

ADJOURN
The June 16, 2009 regular meeting of the City Council was adjourned at 9:10
p.m. Upon motion by Lindner to adjourn, seconded by Rasmusen.
