MADE BY THE CITY OF Gem Lake
DATE: 10-19-2009
WHEREAS, the City of Gem Lake is a member of the Vadnais Lake Area
Water Management Organization (VLAWMO) Joint Powers Agreement (JPA) to provide water management as
required under MN. Statute Chapters 103B and 103D, and.
WHEREAS, all affected JPA municipalities have been consulted in the boundary change process and have
approved the new boundaries between adjoining watersheds, and
WHEREAS, the attached map and legal description of VLAWMO have beendeveloped to reflect the updated
boundaries of this watershed,
THEREFORE BE IT RESOLVED that all VLAWMO JPA municipalities do hereby amend the Joint Powers Agreement.
with the following Amendment together with the attached updated legal description and map of the VLAWMO
watershed area.
AMENDMENT TO THE JOINT POWERS AGREEMENT
PROTECT AND MANAGE THE VADNAIS LAKE AREA WATER MANAGEMENT ORGANIZATION
THIS AMENDMENT is madeand entered into as of the last (fate of execution by and between the participating
units of local government of the cities of Gem Lake, Lino Lakes, North Oaks, Vadnais Heights, and White Bear
Lake and the Township of White. Bear.
The updated legal description and map of the VLAWMO jurisdiction dated: May 6, 2009 are attached to this
Resolution and hereby replace the previous legal description and are incorporated as Appendix A of the
VLAWMO Joint Powers Agreement.

As you are aware an update of the watershed boundaries has been in process for some time. The new
watershed boundary lines were approved by each ofyour communities last year. The.. Minnesota Board
of Water and: Soil Resources approved the petitions for change last March. One last step remains.
A new legal description of the Vadnais Lake Area Water Management. Organization (VLAWMO) has been
developed by Stevens Engineering and is enclosed. The legal description, watershed map and the
experience of the technical experts who generated it have been reviewed by the VLAWMO legal
counsel.
"Based upon his (Joe Grandburg, Stevens) certification, his training and experience, and the
methodology explained tome, it is my opinion that the VLAWMO Board may rely upon the legal
description and map prepared by Stevens.' Roger Jensen, VLAWMO legal counsel
VLAWMO asks all of our member communities to amend the VLAWMO Joint. Powers Agreement by
replacing the previous legal description with the new Appendix A including.: both the updated legal
description and the attendant: map.
A sample. draft Resolution of Amendment to the JPA is also enclosed for your use. Obviously feel free
to modify the resolutionto fit your resolution conventions.
Please return a signed Resolution by September 30, 2009 or earlier.

ORDINANCE NO. 111
AN ORDINANCE REGULATING THE CONDUCT OF PEDDLERS, SOLICITIORS,
AND TRANSIENT MERCHANTS WITHIN THE CITY OF GEM LAKE
THE CITY COUNCIL OF THE CITY OF GEM LAKE ORDAINS:
SECTION I. PURPOSE AND INTENT. The purpose of this Ordinance is to ensure citizens'
privacy rights in their homes and protect residents from fraud and other crimes. This regulation
is intended to regulate the appropriate time, place and manner of door-to-door or transient
business methods employed within the City. In doing so, the Ordinance shall be applied without
regard to the affiliations or messages of any person engaged in these practices. It is not the intent
of this ordinance to prohibit or place any prior restraint on a person's freedom of speech, religion
or association, and any conflict between this Ordinance and those interests shall be resolved in
favor of the speech, religion or associative interest.
SECTION 2. DEFINITIONS. Except as may otherwise beprovided or clearlyimplied by
context, allterms shall be given their commonly accepted definitions. For thepurpose of this.
ordinance, the following definitions shall applyunless the context clearly indicates or requiresa
different meaning.
CANVASSER. A person who goes door-to-door for the purpose of obtaining or
attempting to further advocacy of a religious, social or political organization or cause
through collection of signatures, donations, memberships, other financial support, or
taking orders for good s to be delivered at a later date in order to raise money for the
supported not -for -profit organization or cause.
DOOR-TO-DOOR. Where used, this term refers to the act of going from house to house,
business to business, street to street, or any other type of place -to -place movement within
the City of Gem Lake in furtherance of activity described within this Ordinance, without
prior invitation by the owner or occupant of each of the places visited for that purpose.
NON COMMERICAL DOOR-TO-DOOR ADVOCATE A person who goes door-to-
door for the primary purpose of disseminating religious, political, social, or other
ideological beliefs, through personal interaction, distribution of written materials, or both.
PEDDLER. A person engaged in for -profit business with no fixed place of business, but
goes door-to-door for the purpose of offering for sale, displaying for sale, selling or
attempting to sell the goods, wares, products, merchandise, or other property that the
person is carrying or otherwise transporting for delivery immediately upon sale. For
purposes of this ordinance, the term peddler shall have the same common meaning as the
term "hawker."
PERSON. Any natural individual, group, organization, corporation,partnership. or
similar association.
PROFESSIONAL FUNDRAISER. Any person, including a corporation or other entity,
who, for compensation, performs any solicitations or other services for a religious,
politician, social, or other charitable organization.
REGULAR BUSINESS DAY. Any day during which the city hall is normally open for
thepurpose of conducting public business. Holidays defined by state law shall not be
considered regular business days.
SOLICITOR. A person engaged in for -profit business who goes door-to-door for the
purpose of obtaining or attempting to obtain orders for goods, wares, products,
merchandise, other personal property, or services for which delivery or performance shall
occur at a later time.
TRANSIENT MERCHANT. A person who engages in temporary or transient for -profit
business in the city selling or attempting to sell goods,wares, products, merchandise or
other property, and who for the purpose of carrying on such business hires, leases,
occupies or uses a vehicle, trailer, boxcar, tent, portable shelter, or vacant lot for the
exhibition and sale of such items, or who leases or intends to occupy a building or portion
thereof for fewer than four (4) months for the exhibition and sale of such items.
SECTION 3. EXCEPTIONS TO DEFINITIONS. For the purpose of this chapter, the terms
PEDDLER, SOLICITOR, and TRANSIENT MERCHANT shall not apply to:
3.1 Non-commercial door-to-door advocates and canvassers. Nothing within this
ordinance shall be interpreted to prohibit or restrict non-commercial door-to-door
advocates and canvassers. Person engaging in such activity shall not berequired to.
register as a solicitor under Section 7.
3.2 Any person selling or attempting to sell at wholesale any goods, wares, products,
merchandise, or other personal property to a retail seller of the items being sold by the
wholesaler.
3.3 Any :person who makes initial contacts with other people for the purpose of
establishing or trying to establish a regular customer delivery route for the delivery of
perishable food and dairy products, such as baked goods or milk.
3..4 Any person. selling products of a farm. or garden which that person occupies. and
cultivates.
3.5 Anyperson making deliveriesof newspapers, newsletters, or other similar
publications on an established customer delivery route, or when publications are
delivered to the community at large, even if the publications contain advertising or
solicitations fora for -profit business.
3.6 Any person conducting the type of sale commonly known as garage sales, rummage
sales, or estate sales.
3:7 Any person participating in an organized. multi -person: bazaar or flea market.
3'.8 Any person conducting. an auction as a proper]y licensed auctioneer.
3,9 Any officer of the court conducting a count -ordered • sale.
Exemption from these definitions shall not, for the scope of this chapter, excuse any person from
complying with any other applicable statutory provision or requirement provided by another city
ordinance. A person exempt from these definitions. must still obey •a placard..posted by a
property owner or tenant as described in Section 10,
SECTION 4. LICENSING; EXEMPTIONS.
4.1 County license required. No person shall conduct business as a transient merchant.
within the city limits without first having obtained a Transient Merchant License from
Ramsey County.
4.2 City license required. Except as otherwise provided for by this Ordinance, no person
shall conduct business within the City of Gem Lake as a peddler or a transient merchant
without first obtaining a license from the City. Solicitors need not be licensed, but are
required to register with the city pursuant to Section 8.
4.3 Application. An application for a city license to conduct business as a peddler or
transient merchant shall be made at least fourteen (14) regular business days before the
applicant desires to begin conducting a business operation within the city. Application for
a license shall be made on a form approved by the. City Council and available from the
office of the city clerk. All applications shall be signed by the applicant. All applications
shall include the following information:
(a) The applicant's full legal name.
(b) Any and all other names under which the applicant has or does conduct
business, or to which the applicant will officially answer to.
(c) A physical description of the applicant (hair color, eye color, height, weight,
any distinguishing marks or features, and the like).
(d) Full address of applicant's permanent residence.
(e) Telephone number of applicant's permanent residence.
(f) Full legal name of any and all business operations owned, managed, or
operated by applicant, or for which the applicant is an employee or an agent.
(g) Full address of applicant's regular place of business, if any exists.
(h) Any and all business -related telephone numbers of the applicant, including.
cellular phones and facsimile (fax) machines.
(i) The type of business for which the applicant is applying for a license.
(j) Whether the applicant is applying for an annual or daily license.
(k) The dates during which the applicant intends to conduct business. If the
applicant is applying for a daily license, the number of days he or she will be
conducting business within the city, with a maximum of fourteen (14) consecutive
days.
(1) Any and all addresses and telephone numbers where the applicant can be
reached while conducting business within the city, including the location where a
transient merchant intends to set up his or her business.
(m)A statement as to whether or not the applicant has been convicted with the last
five (5) years of any felony, gross misdemeanor or misdemeanor for violating any
state or federal statuteor any local ordinance, other than minor traffic offenses.
(n) A list of the three (3) most recent locations where the applicant has conducted
business as a peddler or transient merchant,
(o) Proof of any required county license.
(p) Written permission of the property owner or the property owner's agent for
any location to be used by a transient merchant.
(q) A general description of the items to be sold or services to be provided.
(r) Any and all additional information as may be deemed necessary by the City
Council.
(s) The applicant's driver's license number or other acceptable form of.
identification.
(t) The license plate number, registration information, vehicle identification.
number (VIN) and physical description for any vehicle to be used in conjunction.
with the licensed business operation.
4.4 Fee. All .applications fora license under this chapter shall be accompanied by the fee
established in the city licensing. fee schedule as it may be amended from time to time.
4.5 Procedure.. Upon receipt of the application and payment of the. license fee; the city
clerk will, within two (2) regular business days, determine if the application is complete:
An application will be considered: complete if all required information is. provided. If the
city -clerk. determines that the application is incoiptete, the .city clerk must inform the
applicant of the required, necessary information that is missing. If the application is
complete, the. city clerk must. order any investigation, including background checks,
necessary to verify the information provided with the application. Within ten (10) regular
business days. of receiving a complete. application the city clerk . must issue the license
unless grounds exist for denying the license application under Section 4, in which. case
the clerk must deny the.request for a city peddler or transient merchant If the city
clerk denies the license application,. the applicant must. be .notified in writing of the
decision, the reason. for denial and the applicant's. right to. appeal the denial by requesting,
within twenty (20) days of receiving notice of rejection, •a public hearing before the City
Council. The City Council shall hear the appeal with twenty (20) days of..the date of the
request for a hearing. The decision of the city Council following the public. hearing can
be appealed by petitioning the Minnesota Court of Appeals for a writ of certiorari.
4.6 Duration. An annual license granted under this ordinance shall be valid for one
calendar year from the date of issuance. All other licenses granted to peddlers and
transient merchants under this ordinance shall be valid only during the time period
indicated on the license.
SECTION 5. LICENSE INELIGIBILITY. The following :.shall be grounds for denying a
peddler or transient merchant license.
5.1 The failure of an applicant to obtain and demonstrate proof of having obtained any
required county license.
5.2 The failure of an applicant to truthfully provide any information requested by the
city as part of the applicatio. n process.
5.3 The failure of an applicant to sign the license application.
5.4 The failure of an applicant to pay the required fee at the time of application.
5.5 A conviction with the past five (5) years of the date of application for any violation
of any federal or state statute or regulation, or of any local ordinance, which adversely
reflects upon the person's ability to conduct the business for which the license is being
sought in a professional, honest and legal manner. Such violations shall include, but are
not limited to, burglary, theft, larceny, swindling, fraud, unlawful business practices, and.
any form of actual or threatened physical harm against another person.
5.6 The revocation with the past five (5) years of any license issued to an applicant for
the purpose of conducting business as a peddler, solicitor, or transient merchant.
5.7 Established bad business reputation. Evidence of a bad business reputation shall
include, but is not limited to, the existence of more than three (3) complaints against an
applicant with the Better Business Bureau, the Office of the Minnesota Attorney General
or other state attorney general's office, or other similar business or consumer rights office
or agency, within the preceding twelve (12) months, or three (3) complaints filed with the
City against an applicant within the preceding five (5) years.
SECTION 6. LICENSE SUPENSION AN❑ REVOCATION
6.1 Generally. Any license issued under this section may be suspended or revoked at the.
discretion of the City Council for violation of any of the following:
(a) Subsequent knowledge by the city of fraud, misrepresentation or incorrect
statements provided by an applicant on the application form.
(b) Fraud, misrepresentation or false statements made during the course of the
licensed activity.
(c) Subsequent conviction of any offense to which the granting of the license
could have been denied under Section 4.
.(d) Engaging in any prohibited activity as provided under Section 8 of this
ordinance.
(e) Violation of any: other provision of this ordinance.
6.2 Multiple.. persons .under one license. The suspension or revocation of any license
• issued for the purpose of authorizing multiple persons to conduct business as peddlers or
•transient merchants on behalf of the licensee shall serve as a suspension. or revocation of
each authorized person's authority to cortduct.business as a•peddler or transient merchant
on behalf of the licensee whose license is suspended or revoked.
6.3 Notice. Prior ,to revoking or suspending. any license issued under this. chapter, the city.
.shall. provide a license holder With written notice of the alleged violations and inform the
licensee: of his. or her right to a hearing on. the alleged violation: Notice shall. be delivered
in person or by mail to the permanent residential address listed on the license application,
of if no residential address is listed, to the business address provided on the license
application.
6.4 •Putlic Hearing. Upon receiving the notice provided in section 6.3,. the licensee shall
have the right to request a public hearing. If no request for a hearing is received by the
city clerk. •within ten (10) days following the service of the notice, the city may proceed.
with the .suspension or revocation: For the purpose of a mailed notice, service. shall be
considered complete as of the date the. notice is placed in the mail. If a public heating is
requested. within the stated time fraine, a hearing shall be scheduled within twenty (20).
days from the date of .the. request for the public hearing. Within three (3). regular business
days;o.f.the hearing, the City Council shall notify the licensee ofits decision.
6,5 Emergency. If, in the discretion of the City Council, irnnainent harm to the health or
safety of the .public may occur because of the actions. of a peddler or. transient merchant
licensed under this ordinance, the. City Council may immediately suspend the person's
license and provide notice of the right to hold a subsequent public hearing as prescribed.

6.6 Appeal. Any person whose license is suspended or revoked under this section shall
have the right to appeal that decision in court.
SECTION 7. LICENSE TRANSFERABILITY. No license issued under this chapter shall be
transferred to any person other than the person to whom the license was issued.
SECTION 8. REGISTRATION.
8.1 All solicitors shall be required to register with the city prior to engaging in those
activities. Registration shall be made on the same form required for a license application,
but no fee shall be required. Immediately upon completion of the registration form, the
city clerk shall issue to the registrant a certificate of registration as proof of the
registration. Certificates of registration shall be non-transferrable.
8,2. Individuals that will be engaging in canvassing or non-commercial door-to-door
advocacy shall not be required to register.
8.3 Professional fundraisers not exempt. A professional fundraiser working on behalf
of an otherwise exempt group or person shall not be exempt from the licensing
requirements of this ordinance.
SECTION 9. PROHIBITED ACTIVITIES. No peddler, solicitor, canvasser, transient
merchant, non-commercial door-to-door advocate; or other person engaged in other similar
activities shall conduct business in any of the following manner:
9.1 Calling attention to his or her activities or the items to be sold by means of blowing
any horn or whistle, ringing any bell, crying out, or by any other noise, so as to be
unreasonably audible within an enclosed structure.
9.2 Obstructing the free flow of traffic, either vehicular or pedestrian, on any street,
sidewalk, alleyway, or other public right-of-way.
9.3 Conducting themselves or their business in a way as to create a threat to the health;
safety, and welfare of any specific individual or the general public.
9.4 Conducting business before '8 a.m. or after 8 p.rn..
9.5 Failing to provide proof of license, or registration, and identification when
requested.
9.6 Using the license or registration ofanother person.
9.7 Alleging . false or misreading statements . about. the products. or • services being sold,
including untrue statements of endorsement: No peddler, solicitor, or transient merchant
shall claim to have the endorsement of the city solely based on the city having issued a.
licezise or certificate of registration to, that person.
9.8 Remaining on the property of another when requested to leave.
9.9 Otherwise conducting themselves or operating their business inany manner that a
reasonable person would find obscene, threatening, intimidating or abusive.
SECTION 10. EXCLUSION BY PLACARD. Unless specifically invited by the property
owner or tenant, no peddler, solicitor, transient merchant, canvasser, non-commercial door-to-
door advocate, or other person engaged in other similar activities shall enter onto the property of
another for the purpose of conducting such business when the property is marked with a sign or
placard that is:
(l) At least four inches long;
(2) At least four inches wide;
(3) With print of at least 48 point in size;
(4) Which states No Peddlers, Solicitors or `Transient Merchants," "Peddlers, Solicitors,
and Transient Merchants. Prohibited;" or other comparable statement.
No person other than the property owner or tenant shall remove, deface, or otherwise tamper
with any sign or placard under this section.
SECTION 11. PENALTY. Any individualfoundin violation of any provision of this
ordinance, including disobedience of a property placard, shall be a guilty of a misdemeanor.
SECTION 12. SEVERABILITY. If any provision of this ordinance is found to be invalid for
any reason by a court of competent jurisdiction, the validity of the remaining provisions shall not
be affected.
SECTION 13. EFFECTIVE DATE. This Ordinance shall take effect and be in force upon its
passage and publication_

SUMMARY PUBLICATION. Pursuant to Minnesota Statutes, § 412.191, a summary of
an ordinance may be published. While a copy of the entire ordinance is available without
cost at the office of the City Clerk, the following summary is approved by the City
Council and shall be published in lieu of publishing the entire.. ordinance:
Ordinance 111 regulates door-to-door sales and canvassing activity and transient
merchant sales within the City. The Ordinance defines terms. Peddlers and transient
merchants engaged in for -profit activities must obtain a license from the City to offer
merchandise for sale. The Ordinance establishes standards and procedures for the
application and approval of licenses, and the revocation and denial of licenses. Solicitors
of orders for for -profit businesses must register with the City, but do notneed to obtaina
license. Canvassers and people engaged in door-to-door advocacy of political, social or
religious organizations or causes are exempt from registration, though professional
fundraisers for any of these causes must still register. Certain other sales exempted by
State law (farm sales, perishable goods sales, newspaper delivery) are also exempt. A
property owner or tenant is entitled to placard their property with signs denying entry to
any uninvited peddler, solicitor, canvasser or advocate. Violation of any portion of the
ordinance, including disobedience of a private property placard, is a misdemeanor.
Ordinance 111 is effective upon its publication.

Re: 2010.Proposed General Fund Budget and Property Tax Levy
The Gem Lake City Council approved a preliminary tax levy of $464,655 at their August
18, 2009 meeting. This levy included $412,055 for General Fund operations and
$52,600 for the City Hall bonds.
Mayor Uzpen and 1 have met and refined the 2010 Preliminary General Fund budget.
These refinements included adjustments for services that we now have a better basis
for costs as well as the elimination of some anticipated costs for development that if
they do occur, will be offset by revenues paid by the developer.
Those refinements and adjustments resulted in a reduction of the 2010 preliminary levy
to $392,248, a reduction of $72,407 and decreased the preliminary tax capacity rate
from 39.286% to a projected 33.1271%. The new proposed tax capacity rate is
approximately 6.89% less than the actual 2009 rate of 35.58%.

Re: 2010.Proposed Sewer Operating Fund Budget
The annual budget process includes the review of the Sewer Operating Fund to
determine whether the rates that charged to customers are sufficient to cover expenses
and build for replacement of the aging sewer system.
The current charge to sewer customers is $43.00 per residential equivalent per quarter.
The total number of sewer customers is 87 and is made up of 52 residential customers
and 35 commercial customers. Total residential equivalents charged each quarter are
261 for quarterly sewer billing of $11,223.00 or $44,892.00 per year.
I have attached two spread sheets for the Sewer Operating Fund as follows:
Sewer Operating Budget — Actual 2005 to Proposed 2010:
This budget includes the final transfer of $125,000 from the General Fund in 2009 and
anticipates the same number of customers and residential equivalents in 2010 as in
2009..The costs for collection and treatment of sewage by the Metropolitan. Council
Environmental Services (MCES) include the increase for 2010 as provided by the.
MCES last week. Also included in the costs for 2010 is costs associated with billing
(WBT time and costs of billing supplies and postage), locates, audit services, repairs
and maintenance of lines and sewer flushing. I have also included the annual
depreciation of approximately $12,000 for 2009 and 2010..This budge DOES NOT
include the transfer amount for the sewer lining project currently being done on
Scheuneman Road.
Based on these estimates, the 2010.Proposed Sewer Operating Budget shows an
excess of expenditures over revenues of approximately $11,000. This is a direct result
of including depreciation in the costs and while it is a non -cash item it is advisable to
include depreciation so that a replacement fund is established and cash is available
when repairs to the system become necessary.

This budget includes all of the same assumptions as the previous page BUT pro1ects
that out to 2014.

The MCES budget for 2011 was increased by approximately` 12% over 2010 in
anticipation of reallocation. of demand charges to be passed to users by the MCES in
2011,. The projected increase from 2012 to 2014 was 5%.
While the City Engineer has provided as list of capital projects that may need to be done
in the next 5 — 15 years, these projects costs have not been incorporated into these
projections. The projects included in the list would be funded through sewer availability
charges or special assessments and would have minimal impact on the attached
projections.
The Council is anticipating approving the fees and charges for 2010 in December.
Based on the attached information, it may be advisable to leave the rates where they
are and adjust in the future based on further analysis of future connections and MCES
charges. Using the current rates into the future, they do not cover the depreciation and
beginning in 2011 would not cover the basic operating costs of the system.

Gem Lake Planning Commission Meeting
6 October 2009
The regular meeting of the Planning Commission of Gem Lake was called to
order by Chairman Craig Rafferty on Tuesday, October 6, 2009 at 7:02 p.m. in
the Gem Lake City Hall meeting room.
The following members were present; Chairman Craig Rafferty, Planning
Commission members Beth Herzog, Derek Wippich and Daniel Marier.
APPROVAL OF AGENDA AND MEETING MINUTES
Planning Commission Agenda: Chairman Rafferty asked for any changes,
deletions or added agenda items. None was given, so proceeded to move
forward with the meeting.
Planning Commission Minutes: Chairman Rafferty called to approve the
September Planning Commission meeting minutes. The September Planning
Commission minutes were discussed and upon motion by Marier and seconded
by Herzog, the September minutes were approved. Ayes — 4, Nays — 0.
NEW BUSINESS.
South Road Owners Association of Gem Lake: A letter was sent to the
Planning Commission regarding changing the name of County Road E to Private
Property, Daniels. Farm Road. Planning Commissioner Beth Herzog had
concerns about the development of land in that area. The Planning Commission.
discussed the topic and decided to support and encourage the name change for
the association and pass this on to the City Council for their approval.
Pigeon Ordinance: The Planning Commission reviewed the revised ordinance
for adjustment on the number of pigeons at residence, There were a few
complaints regarding pigeon droppings and where they are being disposed.
Resident has fixed the problem and has had no issues since then.

PUBLIC HEARING
The Public Hearing opened at 7:25 p.m. and no residents were in attendance.
Hearing was closed at 7:30 p.m.
Upon motion by Commissioner Herzog and seconded by Commissioner Marier,
Ordinance was approved by Planning Commission with conditions that applies
with the animal nuance ordinance. The Planning Commission will send it back to
the City Council. Ayes — 4, Nays - 0..
Sign Ordinance: The sign ordinance was presented to the Planning
Commission for their approval. It was reviewed and the Planning Commission
felt the language was acceptable. Upon motion by Commissioner Marier and
seconded by Commissioner Wippich, the new sign ordinance was passed to
replace existing ordinance.
Fee Schedule Review: Chairman Rafferty didn't have the new schedule with
him, so scheduled this discussion for the November Planning Commission
meeting.
OPEN FORUM
Hanson Properties: N❑ one representing the Hanson properties attended the
meeting. Some of the issues with this property are: Lilac Lane, and Daniels
Farm Lane. Have plans to build senior living and senior assisted living in the
area by County Road E. Wants to take away some of the trees surrounding
County Road E and the Planning Commission wants to keep the tree line and
maybe thin out trees to keep them healthy. Also using English Street as an
entrance street.
Zoning Ordinances: Working towards getting that set up for the City of Gem
Lake. Working with White. Bear Township to adapt their ordinance to fit Gem
Lake.

ORDINANCE NO. 110
AN ORDINANCE TO PERMIT AND REGULATE THE KEEPING OF PIGEONS IN
THE CITY OF GEM LAKE, AMENDING ORDINANCE NO. 69.
THE CITY COUNCIL OF THE CITY OF GEM LAKE ORDAINS:
SECTION 1. Intent and Purpose. It is the purpose and intent of this ordinance to permit the
keeping, maintenance and flying of certain registered pigeons as a recreational sport and hobby,
subject to -regulations hereinafter set forth. The keeping, breeding, maintenance and flying of
fancy, racing and sporting breeds of pigeons, as defined herein, is determined not to be a
nuisance and is not detrimental to the public welfare, if regulated as hereafter set forth. It is
recognized that the keeping, breeding, maintenance and flying of such pigeons is now mainly
engaged in by members of local, district and national organizations, and such persons keep their
pigeons in suitable permanent structures constructed and maintained for such purpose, and keep
such structures in a clean and sanitary mariner, and do not permit their pigeons to remain at Large
in the community m such manner as to disturb their neighbors or to prevent the full enjoyment of
property rights by their neighbors.
SECTION 2. AMENDMENT. Section 2.3 of Ordinance 69 is amended; to add the following
definitions:
Pigeon. A member of the family Coluinbidae, and shall include "Racing Pigeons",
"Fancy Pigeons" and "Sporting Pigeons" as defined in this ordinance.
Pigeon - Fancy Pigeon. A pigeon which, through past breeding, has developed certain
distinctive physical and performing characteristics as to be clearly identified arid accepted
as such by the National Pigeon Association, the American Pigeon Club, or the Rare
Breeds Pigeon Club. Examples: Fantails, Pouters, Trumpeters.
Pigeon - Loft. A structure for the keeping or housing of pigeons.
Pigeon - Mature Pigeon. A pigeon aged six months or older.
Pigeon - Racing Pigeon. A pigeon which, through selective past breeding, has
developed the distinctive physical and mental characteristics as to enable it to return to its
home after having been released a considerable distance therefrom, and which is accepted
as such by the American Racing Pigeon Union, Inc, or the International Federation of
Racing Pigeon Fanciers. Common names are Racing Homer, Homing Pigeon, or Carrier
Pigeon.
Pigeon Sporting Pigeon. A pigeon which, through selective past breeding, has
developed the ability to fly in a distinctive manner, such as aerial acrobatics or endurance
flying. Examples: Rollers, Tipplers.
SECTION 3. AMENDMENT. Section 3 of Ordinance 69 is amended to add the following
sub -sections:
Section 3.12 Keeping of Pigeons. The keeping, breeding, maintenance and flying of pigeons
may be permitted subject to the following:
3.12.1 A loft must be constructed and maintained to keep and confine the pigeons. The
loft. must provide at least nine cubic feet of space per bird. The loft must be enclosed
with wire netting or equivalent material that will preventpigeons from escaping the
confines of the loft. Lofts must be elevated a minimum of six inches and a maximum of
twelve inches above grade to ensure free -way beneath the loft. Lofts shall rest upon.
concrete footings, cement blocks, or other suitable foundation material. A loft may have a
maximum height of nine feet.
3.12.2 The loft must be constructed and maintained so as to be rodent -proof.
3.12.3 The owner may construct pigeon lofts up to a cumulative maximum floor area of
200 square feet. Any single loft with over 120 square feet in floor area requires a
building permit, as with other accessory structures.
3.12.4 Pigeon lofts may be located in the rear yard only and shall be at least 50 feet from
adjacent habitable structures.
3.12.5 Pigeons shall be confined to the loft except when they are released for exercise,
performance, training, or to return from areas outside the City of Gem Lake forthe
purpose of engaging in a race or returning from training flights.
3.12.6 All pigeons shall be fed within the confines of the loft on the premises on which
the pigeons are housed.
3.12.7 All grains: and food stored for the use of the pigeons ona licensed premises shall
be kept in a rodent -proof container.
3.12.8 Pigeons must be banded in a way to identify each pigeon as kept by its owner.
3.12.9 All premises on which pigeons are kept or maintained shall be kept reasonably
clean from filth, garbage, and any substances which attract rodents. The loft and its
surroundings must be cleaned daily.
3.12.10 No one shall release pigeons to fly for exercise, training or competition within
the City of Gem Lake except an owner of pigeons who is a member in good standing of
an organized pigeon club, such as the American Racing: Pigeon Union, :Inc., the
International Federation of Racing Pigeon Fanciers, the National Pigeon Association, the
.American Tippler Society, the International Roller Association, the Rare Breeds Pigeon.
Club, or a local club which has rules that will help preserve the peace and tranquility of
the neighborhood.
SECTION 4. AMENDMENT. Section 4 of Ordinance 69 is hereby amended to add the
following sub -sections:
Section 4.2. Pigeon Keeping License. No person shall own, keep or harbor pigeons within the
City of Gem Lake without first obtaining a license. Applicant shall complete an application form
provided by the City. The application shall include, but not be limited to the following
information: a site plan showing the location and size of the premises, and the location size and
type of all pigeon lofts, and demonstration that said lofts will comply with City zoning
requirements; a statement of the maximum number of pigeons to be kept on the premises at one
tirne; and an agreement by the applicant that the premises may be inspected by the City at all
reasonable times so as to assure compliance with the conditions outlined in Section 3.12. Only
one license may be issued per property,
4.2.1 Duration of License; Fee. Each license issued hereunder shall expire one (1) year
after issuance unless sooner revoked. A license must be renewed annually to continue
the keeping of pigeons. The City Council shall set the annual fee for a license by
ordinance with other City fees. Fees shall be paid at the time of the making of the
application for license or renewal.
4.2.2 Number of Animals. The number of pigeons permitted to be kept under an
approved license is calculated by dividing the volume of loft space by nine (minimum
space per bird). The maximum number of pigeons allowed to any licensee, regardless of
capacity, is 120 birds from March 1 to May 31, and 90 birds during the rest of the year.
4.2.3 Denial or Revocation. The pigeon -keeping license may be revoked, or renewal
denied, if the licensee fails to comply with limits on number of pigeons or any of the
conditions outlined in Section 3.12.
SECTION S. Severability. Should any section, subdivision, clause or other provision of this
Ordinance be held to be invalid in any court of competent jurisdiction, such decision shall not
affect the validity of the. Ordinance as a whole, or of any part hereof, other than the part held to
be invalid.
SECTION 6. Effective. Date. This Ordinance shall take effect and be in force from and after its
passage and publication.

NEW BUSINESS
Conditional Use Permit Review for 3622 Schueneman Road: Dennis
Newcomb and Rick Wilson attended the meeting to introduce themselves to the
Planning Commission and to explain a little bit about their businesses. A memo.
written by Tom Riedesel from White Bear Township was passed out along with
pictures of what the completed project will look like. Both Mr. Newcomb and Mr.
Wilson got up to speak about their involvement with the businesses. Mr.
Newcomb will do the auto sales end of it and Mr. Wilson will do the auto repair.
The name chosen for the business is Four Seasons Automotive Service and
Sales. Discussion with the Planning Commission was iri regards to hours of
business, minimum/maximum of cars for sale on the lot. They will be adding
additional security lights. They have applied for a dealer's license, but not
received it yet. They would like to have thepublic hearing as soon as possible.

Commissioner Marier raised an issue of placement of the sign that is currently
there. It needs to be redone and brought up to code due to the current sign
leaning. All parties agreed to correct the issues that were addressed. Upon
motion by Commissioner Marier and seconded by Commissioner Herzog, the
Planning Commission recommends presenting to the City Council, pending the
requirements are properly met so the City. Council can officially act on it: Ayes —
3, Nays — 0.
Sign Ordinance: Chairman Rafferty is scheduled to meet with Bill Short from
White Bear Township the week of September 7th. Will need to get the sign fee
and ordinance established. The City Council will discuss this issue at the
September 14, 2009 workshop.
OPEN FORUM
Potential Development Projects: Chairman Rafferty has had a few phone
calls, but nothing coming forward yet. Discussion was about there is some
funding for senior housing and senior living, but have to do a lot of phone calling
and investigating.
Green City Concept: Commissioner Herzog was at the Minnesota State Fair
and got some information from a company demonstrating solar wind power.
Discussion was made on having a presentation to the Planning Commission/City
Council discussing different ways to go green. Chairman Rafferty suggested
"Green Education Night" to make residents aware! Also, put information in the
Gem Lake newsletter. Decision was made to add this subject to the October
agenda.

ORDINANCE NO. 111
AN ORDINANCE REGULATING THE CONDUCT OF PEDDLERS, SOLICITIORS,..
AND TRANSIENT MERCHANTS WITHIN THE CITY OF GEM LAKE
THE CITY COUNCIL OF THE CITY OF GEM LAKE ORDAINS:
SECTION 1.. PURPOSE AND INTENT. The purpose of this Ordinance is to ensure citizens'
privacy rights in their homes and protect residents from fraud and other crimes. This regulation
is intended to regulate the appropriate time, place and manner of door-to-door or transient
business methods employed within the City. In doing so, the Ordinance shall be applied without
regard to the affiliations or messages of any person engaged in these practices. It is not the intent
of this ordinance to prohibit or place any prior restraint on a person's freedom of speech, religion
or association, and any conflict between this Ordinance and those interests shall be resoled in
favor of the speech, religion or associative interest.
SECTION 2. DEFINITIONS. Except as may otherwise be provided or clearly implied by
context, all terms shall be given their commonly accepted definitions. For the purpose of this
ordinance, the following definitions shall apply unless the context clearly indicates or requires a
different meaning.
CANVASSER. A person who goes door-to-door for the purpose of obtaining or
attempting to further advocacy of a religious, social or political organization or cause
through collection of signatures, donations, memberships,other financial support, or
taking orders for goods to be delivered at a later date in order to raise money for the
supported not -for -profit organization or cause.
DOOR-TO-DOOR. Where used, this tern, refers to the act of going from house to house,
business to business, street to street, or any other type of place -to -place movement within
the City of Gem bake in furtherance of activity described within this Ordinance, without
prior invitation by the owner or occupant of each of the places visited for that purpose.
NON -COMMERICAL DOOR-TO-DOOR ADVOC,4TE. A person who goes door-to-
door for the primary purpose of disseminating religious, political, social, or other
ideological beliefs, through personal interaction, distribution of written materials, or both.
PEDDLER. A person engaged in for -profit business with no fixed place of business, but.
goes door-to-door for the purpose of offering for sale, displaying for sale, selling or
attempting to sell the goods, wares, products, merchandise, or other property that the
person is carrying or otherwise transportingfor delivery immediately upon sale. For
purposes of this ordinance, the term peddler shall have the same common meaning as the
tern "hawker."
PERSON. Any natural individual, group, organization, corporation, partnership, or
similar association.
PROFESSIONAL FUNDRAISER. Any person, including a corporation or other entity,
who, for compensation, performs any solicitations or other services for a religious,
politician, social, or other charitable organization.
REGULAR BUSINESS DAY Any day during which the city hall is normally open for
the purpose of conducting public business. Holidays defined by state law shall not be
considered regular business days.
SOLICITOR. A person engaged in for -profit business who goes door-to-door for the
purpose of obtaining or attempting to obtain orders for goods, wares; products,
merchandise, other personal property, or services for which delivery or performance shall
occur at a later time.
TRANSIENT MERCHANT. A person who engages in temporary or transient for -profit
business in the city selling or attempting to sell goods, wares, products, merchandise or
other property, and who for the purpose of carryingon such business hires, leases,
occupies or uses a vehicle, trailer, boxcar, tent, portable shelter, or vacant Tot for the
exhibition and sale of such items, or who leases or intends to occupy a building or portion
thereof for fewer than four (4) months for the exhibition and sale of such items.
SECTION 3. EXCEPTIONS TO DEFINITIONS. For the purpose of this chapter, the terms
PEDDLER, SOLICITOR, and TRANSIENT MERCHANT shall not apply to:
3.1 Non-commercial door-to-door advocates and canvassers. Nothing within this
ordinance shall be interpreted to prohibit or restrict non-commercial door-to-door
advocates and canvassers. Person engaging in such activity shall not be required to
register as a solicitor under Section 7.
3.2 Any person selling or attempting to sell at wholesale any goods, wares, products,
merchandise, or other personal property to a retail seller of the items being sold by the
wholesaler.
3.3 Any person who makes initial contacts withother people for the purpose of
establishing or trying to establish a regular customer delivery route for the delivery of
perishable food and dairy products, such as baked goods or milk.
3.4 Any person selling products of •a farm or garden. Which that person occupies and
cultivates.
3.5 Any person making deliveries of newspapers, newsletters, or other similar
publications on an established customer delivery route, or when publications are
delivered to the community at large, even if the publications contain advertising or
solicitations for a for -profit business.
3.6 Any person conducting the type of sale commonly known as garage sales, rummage
sales, or estate sales.
3.7 Any person participating in an organized multi -person bazaar or flea market.
3.8 Any person conducting an auction as a properly licensed auctioneer.
3.9 Any officer of the court conducting a court -ordered sale.
Exemption from these definitions shall not, for the scope of this chapter, excuse any person from
complying with any other applicable statutory provision or requirement provided by another city
ordinance. A person exempt from these definitions must still obey a placard posted by a
property owner or tenant as described in Section 10.
SECTION 4. LICENSING; EXEMPTIONS.
4.1 County license required. No person shall conduct business as a transient merchant
within the city limits without first having obtained a Transient Merchant License from
Ramsey County.
4.2 City license required. Except as otherwise provided for by this Ordinance, no person
shall conduct business within the City of. Gem Lake as a peddler or a transient merchant
without first obtaining a license from the City. Solicitors need not be licensed, but are
required to register with the city pursuant to Section 8.
4.3 Application. An application for a city Iicense to conduct business as a peddler or
transient merchant shall be made at least fourteen (14) regular business days before the
applicant desires to begin conducting a businessoperation within the city. Application for
a license shall be made on a form approved by the. City Council and available fromthe
office of the city clerk. All applications shall be signed by the applicant: All applications
shall include the following information:
(a) The. applicant's full legal name.
(b) Any and all other names under which the applicant has or does conduct
business, a.r to which the applicant, will officially answer to:
(c) A physical description of the applicant (hair color; eye color, height, weight;
any distinguishing Marks .or features, and the like).
.(d) Full address.of applicant's. permanent residence.
(e) Telephone number of applicant's.per�manent residence.
.(f) Tull.. legal name of .any and all business operations. owned, managed, or
operated by applieant,.or for which the applicant is: an employee or :an agent.
:(g) Full address .of.applicant'-s. regular place of business, if any exists.
(h) Any and all business -related telephone numbers of the applicant, including
cellular phones and facsimile (fax) machines:
(i) The type of business for which the applicant is applying- for a license.
(j) Whether the applicant is applying for an annual or daily license.
(k) The dates during' which the applicant intends to conduct business.. If the
applicant .is applying for a daily license,. the number of days he or she will be
conducting business within the city, with a.maximurn of fourteen (14) consecutive
days.
(1) Any and all addresses and telephone..nunnbers where .the applicant can be
reached while conducting business: within the city, including the location .where a
transient merchant intends to set up his .or her business.
(m)A statement. as to whether or not the applicant has been convicted with the last
five (5) -years of any felony, gross misdemeanor or misdemeanor for violating. any
state or federal statute or any. local ordinance, other.than minor traffic offenses.
(n) A list of the three (3) most recent locations where the applicant has conducted
business. as a peddler or transient merchant..
(o) Proof of any required. county license.
(p) Written permission of the property owner or the property owner's agent for
any location to be.used by a transient merchant.
(q) A general description of the items to be sold or. services to be provided.
(r) Any and all additional information 'as maybe. deemed necessary by the City
Council.
(s) The :applicant's driver's license. number or other acceptable fortn. of
identification.
(t) The license plate number; registration information, vehicle identificatiOn
number (VI'N) and physical description for any vehicle to be used in conjunction
with the licensed business operation.
4.4 Fee. All applications for a license under this chapter shall be accompanied by the fee
established in. the city licensing fee schedule as it may be amended from time to time:
4.5 Procedure. Upon receipt of the application and payment of the licensefee, the city
clerk will, within two (2) regular businessdays, determine if the application is complete..
An application will be considered complete if all required information is provided. If the
city clerk determines.. that the application is incomplete, the city clerk must inform the.
applicant of the required, necessary information that is missing. If the application is
complete, the city clerk must order any investigation, including background checks,
necessary to verify the information provided with:. the application. Within ten (10) regular
business days of receiving a complete application the city clerk must issue the license
unless grounds exist for denying the License application under Section 4, in which case
the clerk must deny the request for a city peddler or transient merchant license. If the city
clerk denies the license application, the applicant must be notified in writing of the
decision, the reason for denial and the applicant's right to appeal the denial by requesting,
within twenty (20) days of receiving notice of rejection, a public hearing before the City
Council. The City Council shall hear the appeal with twenty (20) days of the date of the.
request for a hearing. The decision of the City Council following the public hearing can
be appealed by petitioning the Minnesota Court of Appeals for a writ of certiorari.
4.6 Duration. An annual License granted under this ordinance shall be valid for one
calendar year from the date of issuance. All other licenses granted to peddlers and
transient merchants under this ordinance shall be valid only during the time period
indicated on the license.
SECTION 5. LICENSE INELIGIBILITY. The following shall be grounds for denying a
peddler or transient merchant License:
5.1 The failure of an applicant to obtain and demonstrate proof of having obtained_ any
required county Iicense.
5,2 The failure of an applicant to truthfully provideany information requested by the
city as part of the application process.
5.3. The failure of an applicant to sign the license application.
5.4 The failure of an applicant to pay the required fee at the time of application.
5.5 A conviction with the past five (5) years of the date of `application for any violation
of any federal or state statute or regulation; or of any local ordinance, which adversely
reflects upon the person's ability to conduct the business for which the license is being
sought in a professional, honest and legal manner. Such violations shrill include, but are.
not limited to, burglary, theft, Larceny, swindling, fraud, unlawful business practices, and
any form of actual or threatened physical harm against another person.
5.6 The, revocation with the past five (5). years of any license issued to an applicant for
the purpose of conducting business as a peddler, solicitor, or transient merchant.
5.7 Established bad business reputation. Evidence of a bad business reputation shall.
include, but is not limited to, the existence of more than three (3) complaints against an
applicant with the Better Business Bureau, the Office of the. Minnesota Attorney General
or other state attorney general's office, or other similar business or consumer rights office
or agency, within the preceding twelve (12) months, or three (3) complaints filed with the
City against an applicant within the preceding five (5) years.
SECTION 6. LICENSE SUPENSION AND REVOCATION
6.1 Generally. Any license issued under this section may be suspended or revoked at the
discretion of the City Council for violation of any of the following:
(a) Subsequent knowledge by the city of fraud, misrepresentation or incorrect
statements provided by an applicant on the application form..
(b.) Fraud, imisrepresentation or false statements Made during the course of the.
licensed activity.
(c) Subsequent conviction of any offense to which the .granting of the license
could have been denied under Section 4.
(d) Engaging in any prohibited activity as provided under Section 8 of this
ordinance.
(e) Violation of any other provision of this ordinance:
6.2 1Vlultiple persons under one license. The suspension or revocation of any license
issued for the purpose of authorizing multiple persons to conduct business as peddlers or
transient merchants on behalf of the licensee shall serve asa suspension or revocation of
each authorized person's authority to conduct business as a peddler or transient merchant
on behalf of the licensee whose,license is suspended or revoked.
6.3 Notice. Prior to revoking or suspending any license issued under this chapter, the city
shall providea licenseholder with writtennotice of the alleged violations.. and inform the
licensee of his or her right to a hearing on the alleged violation. Notice shall be delivered
in person or by mail to the permanent residential address listed on the license application,
of if no residential address is listed, to the business address provided on the license
application.
6.4 Public Hearing. Upon receiving the notice provided in section 6.3, the licensee shall
have the right to request a public hearing. If no request for a hearing is received by the
city clerk within ten (10) days following the service of the notice, the city may proceed
with the suspension or revocation. For the purpose of a mailed notice, service shall be
considered complete as of the date the notice is placed in the mail. If a public hearing is.
requested within the stated time frame, a hearing shall be scheduled within twenty (20)
days from the date of the request for the public hearing. Within three (3) regular business
days of the hearing, the City Council shall notify the licensee of its decision.
6.5 Emergency. If, in the discretion of the City. Council, imminent harm to the health or
safety of the public may occur because of the actions of a peddler or transient merchant
licensed under this ordinance, the City Council may immediately suspend the person's
license and provide notice of the right to hold a subsequent publichearing as 'prescribed
in section 6.4.
6.6 Appeal. Any person whose license is suspended or revoked under this section shall
have the right to appeal that decision in court.
SECTION 7. LICENSE TRANSFERABILITY. No license issued under this chapter shall be
transferred to any person other than the person to whom the license was issued.
SECTION 8. REGISTRATION.
8.1 All solicitors shall be required to register with the city prior to engaging in those
activities. Registration shalt be made on thesame form requiredfor a license application,
but no fee shall be required. Immediately upon completion of the registration form, the
city clerk shall issue to the registrant a certificate of registration as proof of the
registration. Certificates of registration shall be non-transferrable.
8,2 Individuals that will be engaging in canvassing or non-commercial door-to-door
advocacy shall not be required to register.
8.3 Professional fundraisers not exempt. A professional fundraiser working on behalf
of an otherwise exempt group or person shall not be exempt from the licensing
requirements of this ordinance.
SECTION 9. PROHIBITED ACTIVITIES. No peddler, solicitor, canvasser, transient
merchant, non-commercial door-to-door advocate, or other person engaged in other similar
activities shall conduct business in any of the following manner
9.1. Calling attention to. his or her activities..or the items to be sold by.. means of blowing
any • horn or whistle, .ringing. any bell, crying out, or by any •other• noise, so as to be
unreasonably audible: within an enclosed .structure.
9.2 Obstructing the free flow of traffic, either vehicular or pedestrian, on any street,.
sidewalk, alleyway, or other public right-of-way.
9.3 Conducting themselves or their business in a way as to create a threat to the health,
safety, and welfare of any specific individual or the general public.
9.4 Conducting business before 8. a.m. or after.8 p.m.
9.5 Failing to provide proof of license, or registration, and identification when
requested.
9.6 Using the license or registration of another person.
9.7 Alleging false or misleading statements about the products or services being sold.
including untrue statements of endorsement. No peddler, solicitor, or transient merchant
shall claim to have the endorsement of the city solely based on the city having issued a
license or certificate of registration to that person.
9.8 Remaining on the property of another when requested to leave.
9.9 Otherwise conducting themselves or operating their business in any manner that a
reasonable person would find obscene, threatening, intimidating or abusive.
SECTION I0.. EXCLUSION BY PLACARD. Unless specifically invited by the property
owner or tenant, no peddler, solicitor, transient merchant, canvasser, non-commercial door-to-
door advocate, or other person engaged in other similar activities shall enter onto the property of
another for the purpose of conducting such business when the property is marked with a sign or
placard that is:
(1) At least tour inches long;
(2) At least four inches wide;
(3) With print of at least 48 point in size;
(4) Which states "No Peddlers, Solicitors or Transient. Merchants," "Peddlers, Solicitors,
and Transient Merchants Prohibited," or other comparable statement.
No. person other than the property owner or tenant shall remove, deface, or otherwise tamper
with any sign or.placard under.this section.
SECTION 11. PENALTY. Any individual found in violation of any provision of this.
ordinance, including disobedience of a property placard, shall be a guilty ofa misdemeanor.
SECTION 12. SEVERABILITY. if any provision of this ordinance is found to be invalid for
anyreason by a court of competent jurisdiction, the validity of the remaining provisions shall not
be affected.
SECTION 13. EFFECTIVE DATE. This Ordinance shall take effect and be in force upon its
passage and publication.

Ordinance 110 amends City Ordinance 69 to permit the keeping of pigeons on property in
the City. The ordinance creates standards and conditions for pigeon facilities and
maintenance. A city license is required, allowing up :toa maximum of 120 pigeons
during peak season, and 90 at other times of the year. Only one license is allowed per
property. Ordinance 110 is effective upon its publication.

Ordinance. 109 revises .the sign regulations .applicable to .signs:. placed within Gem Lake:
The signregulations. in Ordinance. 43K are repealed. The updated sign code is intended
to promote an attractive visual environment and promote free and effective
communication through signage. A permit is required for all signs, except for small
signs, flags and temporary signs specifically exempt from the permit requirement. Sign
permits arereviewedand approved by the Zoning: Administrator. The Zoning
Administrator is responsible.. for inspecting approved' signs .and removing signs in
disrepair or signs erected in violation of the regulations. The City Council may impose a
civil penalty on violators of the sign regulations, in addition to abatement action and
misdemeanor citation. The regulations generally permit three types of sign: "wall signs,''
"freestanding signs," and "window signs." The rules concerning height, size and
installation of signs distinguish between residential areas and nonresidential areas.
Approval to light signs or use electronic signs (dynamic: displays) may be obtained in
certain districts of the. City by application to the Planning Commission. Certain features
are prohibited on signs, and sign types which are not specifically permitted or specifically
exempt are prohibited. The ordinance sets construction standards, maintenance
standards, and defines terms used within the regulations. Ordinance 109 is effective upon
its publication.

ORDINANCE NO. 109
AN ORDINANCE ESTABLISHING SIGN REGULATIONS IN THE CITY OF
GEM LAKE, AND REPEALING PRIOR VERSIONS OF SIGN REGULATIONS.
'FITE CITY COUNCIL OF THE CITY OF GEM LAKE ORDAINS:
SECTION 1. Purpose and Intent. The purpose of Gem Lake sign regulation is to
promote thecreation of an attractive visual environment in the City. The regulations are
Intended to promote a healthy economy by allowing businesses and individuals to
effectivelyinform, identify, direct and communicate with the public using rights of way
in Genf Lake. This aim is balanced with an equal intent to foster public safety and
maintain an attractive built environment in the City by encouraging the appropriate
design, scale and placement of signs in the City. The regulations are intended to
encourage the orderly placement of signs, to assure that the information displayed on any
sign is clearly visible for its intended purpose, and tO allow the fair and consistent
enforcement of the sign regulations by the City of Gem Lake.
SECTION 2. Findings. The City Council concludes that it is necessary to regulate
signs in the City in order to promote and preserve public health, safety and welfare. That
conclusion is based upon the following findings:
2.1. Signs provide an important medium through which individuals and
businesses may convey a variety of tnessages..
2.2. Signs can create hazards to motorists and pedestrians, particularly
when inappropriately designed or placed signs interfere with necessary sight
distances, divert the attention of drivers and pedestrians, or obscure directional
guidance or traffic control devices.
A positive sense of place and community image is important to the
health and welfare of individuals and businesses in Gem Lake. Community
image and aesthetic is also a key component of property values in the City.
Permanent and temporary signs have a direct impact on and relationship to the
image and aesthetic of thecomnmunity..
2.4. UncontroIIed aid unlimited signs result in roadside clutter and
obstruction of views forr motorists and pedestrians, and diminish the ability of any
sign to effectively convey its intended message.
2.5. Properly regulated signage can create an atmosphere of prosperity,
stimulate positive commercial activity and consequently lead to increased.
employment, higher property values and a healthier tax;base.

2.6. Citizens have different expectations for the aesthetic environment of a
residential area compared with that of a commercial area. Signs should be smaller
in scale and their use generally more restricted in residential areas than in
commercial areas where the public expects to see a variety of signs.
SECTION 3. Permit Required. No sign shall be erected, altered, reconstructed,
maintained or moved in the City without first securinga permit .from the City. The
speech content of the sign shall not be considered when approving or denying a sign
permit; however, the content mustbe submitted to properly evaluate the signage area,
design and. placement. A proposed sign with a .structure requiring a building permit or
electrical permit must obtainthose permits in addition to a sign permit.
3.1 Exemptions. The following signs .shall not require a permit, but
remain subject to the standards of these regulations concerning erection,
maintenance and removal, and the standards of any other applicable law or
ordinance.
a) A. sign, of less than four (4) square feet in display area, indicating
the address of a building.
b) A sign on a residential property, of less than four (4) square feet in
display area, stating the name of the owner or occupant in addition to the
address of the property.
c) Traffic control signs, related directional aids, and traffic control
devices installed by a unit of government having authority over the.
adjacent right-of-way, or at the direction of such a government.
d) Signs not visible from a public or private right-of-way.
e) Newspaper boxes.
Flags, up to a combined total of 35 square feet, with no one flag
larger than .15 square feet in size.
g) Official notices posted on a property at the direction of a court,
publicbody, or public safety official.
h) A sandwich board, menu board, A -frame, T-frame or sirnilar sign
which does not exceed six (6) square feet in size, is not illuminated, is
located within 15 feet of the primary building entrance of the owner or
tenant placing the sign, and is only displayed during hours of business
operation. No more than two signs may be placed by any single owner or
tenant at any given time. Signs of this type must be placed in a location
where they will not impede foot traffic
i) A temporary sign or signs, up to a .total.: of ten (10) squarefeetof
display space, erected by the owner or rental tenant of the property on
which the sign is placed.
j) A temporary sign directing people to an event or occurrence
located on the property of the person erecting the sign. Such signs are
limited to six (6) feet or less of display space and must be installed so that
they are less than four (4) feet in height. If placed on property not owned
or rented by the person erecting the sign, the property owner must give

express permission to erect a sign on the property. A maximum of five (5)
such signs may be placed in the City for any given event or occurrence.
Such signs may be :erectedup to two: (2) days prior to the event or
occurrence, and shall be removed within two (2) days following the event.
or occurrence. In no event shall such a sign remain in place for more than
seven (7) days.
k) A change in the message content (words, logos, ❑r similar
graphics) of an existing permanent sign, without change in any other
characteristics of the sign.
3.2 Operation of Minnesota Election Law on Regulations. For the period
beginning August 1 in a State general election year and ending ten (10) days
following the general, election, or thirteen (13) weeks preceding a special election
until ten (10) daysfollowingthe special election, these regulations shall have no
effect upon the size or number of non-commercial signs within the City. Signs
placed during this period shall be removed by the person responsible for erecting
themwithin the 10 days following the election. Signs may be placed upon private
property with permission of the property owner, but may not be placed within the
public right-of-way or within a sight triangle. The City retains the right to remove
and destroy any such signs so placed.
3.3. Permit Application. Application for a sign permit shall be made upon.
the City's application form, and shall contain the following information:
a) Name, signature, address and phone number of the property owner.
b) Name, signature, address and phone number of the applicant, if
different from the property owner.
c) The address or property identification number of the property
where the sign is proposed to be erected.
d) An inventory of existing signs on the site and combined display
area.
e) A complete set of plans showing elevations, distances, setbacks
from lot lines, location of buildings and other signs, size of the proposed
sign and structure, and other details to fully and clearly represent the
construction and placement of the sign.
f} PIans and specifications relating to the method of construction,
attachment to buildings, and/or placerinent upon the ground.
g} A to -scale drawing or illustration showing proposed height, width,
shape, layout, colors, lighting and other relevant details of the sign, from
all perspectives in which the sign is intendedto be viewed.
Applicants shall submit one application and supporting materials for each sign,..
unless submitting a Comprehensive Sign Plan as described in Section 3.7.

3,4. Fee. Sign permit fees and any impoundment fee shall be set by the
City Council by ordinance, as amended from time to time. The required lee shall
accompany any sign permit application
3.5. Review. The Zoning Administrator shall review applications for
compliance with these regulations. A decision to approve or deny should be made
within 30 days of receiving a complete application. Applicants shall be informed
of the decision in writing. Decisions to deny a permit shall be accompanied by a
statement of reasons for the denial.
3.6 Variance and Appeal. An appeal from a sign permit denial shall be
taken in the manner of zoning appeals, using the procedure stated in Section 17.7
of the Zoning Ordinance.. Requests for variance from these sign regulations shall
be made and considered in the manner of requests for zoning variance, using the
procedure stated in Section .1.7.4 of the Zoning Ordinance.
3.7. Comprehensive Sign Plan. An applicant seeking approval for signs in
connection with new building construction, remodeling, or re -development may
submit a comprehensive sign plan with the other required submittals in lieu of
making individual applications for sign permits. All information required in
Section 3.3, (d) through (g), is required to be representedin the supporting
documentation supporting thecomprehensive sign request. In acting upon the
comprehensive sign plan, the Planning Commission and City Council may permit
consideration of unique conditions, flexibility and creativity in the design and
placement of signs, to the extent such leeway promotes the purposes and goals of
any design standards in the underlying zoning district. If a comprehensive sign
plan is. approved, the Zoning. Administrator may issue sign permits for individual
signs in the plan without further review, upon payment of the applicable sign
permit fee.
SECTION 4. Inspections and Enforcement. All signs shall be subject to inspection by
the Zoning Administrator, or other official designated by The Zoning Administrator, The
Administrator or designee must be allowed entry upon the property on which the sign is
located to ascertain compliance with the termsof these regulations and the technical.
specifications provided with the permit application. Such entrance shall be made during
business hours unless an emergency exists.
4.1 Signs in Disrepair: The Zoning Administrator or designee may order
the removal of any sign that is not maintained in accordance with the.
requirements of these regulations. Upon failure to.comply with such order within
the time specified, the. City Council may declare the sign a public nuisance and
directthat the nuisance be abated under theproceduresset forth in Gem Lake
Ordinance No. 86.
4,2 Impoundment of Signs on. Public Property. The. . City may at any time,
and without notice, remove and impound signs which have been erected on public

property or within a public. .right-of-way or easement. Thesign's owner may
retrieve the sign from the. City upon payment of a $50 impoundment fee. If the
same owner has a subsequent sign impounded within the same calendar year, the
impoundment fee is doubled. The City shall not be held liable for any damage to
an impounded sign. If a sign is not retrieved within thirty (30) days, the City may
dispose of it..
4.3 Sign Without a Permit or in Violatibn of Regulations. The Zoning
Administrator or designee may order the correction or removal of any sign which
has been erected without a permit, or has been erected or altered such that the sign
is in violationof these regulations.
a) The person responsible for the sign may apply for a sign permit
"after the fact," paving double the applicable sign permit fee, if the only
violation is lack of a permit.
b) If an order is not remedied or complied with in the time specified,
the City Council may declare thesign a .public nuisance and direct that the
nuisance be abated under the procedures 'Set forth in Gem Lake Ordinance
No. 86.
c) In addition to the above, the. City Council may give written notice
to the person responsible for the sign that the Council will consider civil
penalties for the violation: The written notice shall contain a summary of
all facts the Council intends to consider, and state the date and time at
which the Council will consider a penalty. If the person receiving the
notice appears at that date and time, the Council must give the person
reasonable time to present tnatters in defense or mitigatio. n of the alleged.
offense. If, in the Council's discretion, the alleged violation is supported
by the evidence presented to it, it may order the payment of a civil penalty
using the following as guidelines:

A person with outstanding unpaid civil penalties shall not be eligible to
receivepermits or licenses, of any kind, from the City of Gem. Lake until
the penalty is paid.
d) Violation of these regulations shall be a misdemeanor. Each day
on which the condition giving rise to the violation exists shall constitute a
separate offense. None of the other enforcement options described above
shall preclude the City from issuing a citation and prosecuting any
violation of these regulations as a misdemeanor.

SECTION 5: Applicable. Standards..
Measurement Standards.
a) Sign Area•and•Dimensions.
1) For a wall sign which is framed, outlined, painted or otherwise
prepared and intended to provide a background for a sign display,
the area and dimensions shall include the entire portion within such
background or frame.
2) For a wall `sign comprised of individual letters, figures or elements
on a wall. or similar surface of the building or structure.:the area
and dimensions of the sign shall' encompass a regular geometric
shape or a. combination of regular geometric. shapes which form, or
approxinnate, the perimeter of .all elements. in the display,. the
•franie, .and any applied background that is not part of the
architecture of the building. When separate. elements are organized
to form .a•single sign, but:are separated by open space, the sign area
and dimensions shall .be calculated by determining, the .geometric
form, or combination of forms, which comprises all of the display
areas, including the space between different areas: Minor
appendages to a particular regular shape, as• determined by the
Zoning Administrator, shall not be included in the total •area of a
sign.

3) For a freestanding sign, the sign area shalt include the frame, if
any, but shall not include a pole or other structural support unless
such pole or structural support is internally illuminated or
otherwise so designed to constitute a display device, or part of a
display device. Architectural features that are either part of the
building or part :of a freestanding structure,and not an integral part
of the sign, and which may consist of landscaping, building or
structural forms complimenting the landscaping in general.
4) When two identical sign faces are placed back to back so that both
faces cannot.. be viewed from any point at the same time, andare
part of the same sign structure, the sign area shall be computed as.
the measurement of one of the two faces_ When the sign has more
than two display surfaces,the areaofthe sign shall be the area of
largest display surfaces that are visible from any single direction.
b) Sigh Height.

1) The height of a freestandingsign shall be measured from the base
of the sign or supportive structure at its point of attachment to the
ground, to the highest point of the sign. A freestanding signon a
man-made base, including a graded earth mound, shall be
measured from the grade of the nearest pavement or top of any
pavement curb.
2) Clearances for freestanding and projecting signs shall be measured
as the smallest vertical distance between finished grade and the
lowest point of the • sign, including any framework or other
embellishments.
c) Frontages and Frontage Lengths.
I) The. length of any primary or secondary building frontage shall be.
the sum of all wall lengths parallel, or nearly parallel, to such
frontage, excluding any such wall length determined by the Zoning
Administrator to be clearly unrelated to the frontage presence of
the building.
2) For buildings with two or more frontages, the length of the wall
and allowable sign area shall be calculated separately for each such
building frontage.
3) The building frontage for a section of any building (e.g. retail
tenant spaces) shall be measured from the centerline of the party
walls defining the building section.
5.2 Development Standards.
a) Wall Signs. Wall signs are permitted on buildings located in the
Neighborhood General, Neighborhood Mixed -Use, and Neighborhood.
Center subzones of the Gateway District: Walt signs, other than those
exempted from regulations as stated above, are not permitted in
Residential zoning districts and the Neighborhood Edge subzon.. of the.
Gateway District.
1) The basic allowance for. wall signs. shall be.limited to 2 square feet
of sign area for each lineal foot. of building or tenant frontage.
.2) Each owner. or .tenant may have multiple wall signs as..long as the
total wall. sign area does. not exceed the allowances established for
wall. signs. If multiple. signs are used on a building .facade, the
display method {i.e. individual letters; box and panel, etc-) .shall be
the same. for the entire facade.

3) Wall signs. stall not be greater than eighty (80%) of the length of
the. tenant space.. or the length of the building frontage.
4) Each building. frontage or frontage .section may be evaluated
separately or in. combination; but primary and secondary frontages
will not be combined :for purposes of .determining allowable sign
size.
5.) [nn. addition to wall signs otherwise permitted by these regulations,
an additional sign.may he. permitted up to a ,maximum of 40% of
the wall sign area allowed for the building for the purposes of
identifying owners or tenants. that :occupy upper.floors or do not
have outside building frontage:
6) An arcade or gallery may have sign space on it relating to the
activities. of owners or tenants whose entrances are under the
arcade or gallery. 1f the .sign on the arcad. e or gallery is
illuminated, 100% of the sign space. is .deducted from the total
available :area for wall signs. if the sign space on the arcade or
gallery is not. illuminated, 50% is deducted •from the area available
for wall signs.
7) Projecting signs are permitted in addition to any allowances for
wall signs when the projecting signs are designed and placed for
the purpose of identifying the owner or tenant for a pedestrian
walking along the same side of the streetas the sign, or undera
continuous arcade or gallery. Projecting signs shall have a
maximum area of eight (8) square feet. The bottom of the sign
shall be a minimum of eight (8) feet above the sidewalk. The sign
may project a maximum of six (6) feet from the wall of the
building, or be centered under any arcade, awning or canopy.
Projecting signs shallnot be closer than fifteen (15) feet fromany
other projecting sign.
8) Wall signs shall not be installed on a roof surface or otherwise
project above the topof a building facade.
b) Freestanding Signs. Freestanding signs are permitted in all zoning
districts. Such signs may only be erected byan owner or a tenant of .a
building located on the property for which the sign is proposed.
1) Residential Zones and Neighborhood Edge subzone. Freestanding
signs in residential zoning areas may be erected up to a cumulative
maximum of ten (10) square feet in display area, and up to six (6)
feet in height.

Al] Other Zones. Freestanding signs in the remaining zoning areas
of the .City may be erected up to fifty (50) square feet per owner or
tenant entrance to a building. Permitted sign area may he
aggregated into fewer and larger signs at the election of the
property owner, provided that the size of any single sign does not
exceed one hundred and fifty (150) square feet. Freestanding signs
shallnot exceed thirty-five. (35) feet in height, and signs over
fifteen (15) feet in height shall be no closer than seventy-five feet
to any other sign. Instructional or directional signs of up to.six (6)
square feet in area inay be erected to satisfy a clear instructional or
directional purpose without counting against the.. total freestanding
signarea allowed :for the property.
3) Freestanding signs shall .be set back a minimum of five •feet from
theright-o.f-way line.
4) No portion of a sign shall be in, or project over, a public right-of-
way.
5) Signs may beintegrated into the design of a permanent canopy, if
one is otherwise allowed on the property, with the sign area on any
side of the canopy not exceeding one (1) square foot per lineal foot
of the side.
c) Window signs. Permanent window signs are permitted in the
Neighborhood General, Neighborhood Mixed -Use and Neighborhood
Center subzones of the Gateway District. Temporary window signs are
permitted in all districts. Permanent window signs shallnot exceed
twenty-five percent (25%) of the area of the window on which it is.
installed; the total of all permanent and temporary window signs may not
exceed fifty percent (10%) of the totalwindow area of any building
frontage.
d) Illumination; Electronic Message Center and Changeable Copy
Signs. Illuminated signs (internal or external) and signs with changeable.
copy are not permitted in Residential zoning : areas and the Neighborhood
Edge subzone of the Gateway District. In districts where illuminated signs
or electronic signs are permitted, the use of lighting, electronic message.
center, or dynamic display as an element of a sign is a conditional use.
Application for approval of lighting or electronic features shall be made in
the mannerof a conditional use permit, using the procedure stated at
Section .I 7.5 of the Zoning. Ordinance.
1) Illumination. Internally illuminated signs are permitted in the
Neighborhood . Mixed -Use and Neighborhood Center subzones
only. Externally lit signs shall use lighting that is directed

downward and away from adjacent properties and: rights -of -way.
Lights used for external illumination shall be shielded or screened
from any roadway, and shall not be visible from. the roadway or
sidewalk.
2) Changeable Copy, Changeable copy by non -electronic means may
be utilized on any permitted .sign in areas where allowed. The
changeable. copy area shall not exceed forty percent (40%) of the
total permitted area for any sign.
3) Electronic Message Center (EMC) or Dynarnic Display signs.
EMC or dynamic display signs are permitted if erected within fifty
(50) feet of the right-of-way for J-Iighway 61 or County Road E
within the City of Gem Lake. Only one.(1) such sign is permitted
per property, regardless of the number of tenants. Motion is
permitted for up to eight (8) seconds for any single set of
changeable copy, but the changeable- copy may not change or be.
repeated by flashing more than once every sixteen (16) seconds.
EMCs: and dynamic displays must have an automatic dimming
capability that adjusts the brightness to the ambient light at all
times of day or night.
4) Any changeable copy area (manual, EMC or dynamic display) may
not exceed 40% of the total freestanding sign area permitted to the
owner or tenant.
e) Features Prohibited on Signs. No sign permitted by these
regulations, with or without a permit, shall have: moving, rotating or
revolving parts; flashing, rotating or oscillating lights: (except for EMCs
and dynamic displays where permitted); neon lights; beacons or
searchlights; attached materials such as pennants or streamers; exposed
raceways, ballast boxes or transformers; or other clearly similar features.
Signs Prohibited if Not Expressly Permitted. Any type of sign or
method of sign construction or display that these regulations do not
expressly perrnit, or expressly exempt, is hereby prohibited within the City
of Gem. Lake.
5.3 Construction Standards. The construction,erection, safety and
maintenance of all signs shall comply with the Minnesota State Building Code
and Electrical Code and all of the following:
a) Signs shall bestructurally sound andlocated so as to pose no
reasonable threat to pedestrian or vehicular traffic.

b) All permanent freestanding signs over four feet in height shall have
self-supporting structures erected on or permanently attached to
concrete. foundations. A freestanding sign shall not use guy wires for
support.
c) Freestanding signs shall be designed for wind pressure of not less than
thirty (30) pounds per square foot.
d) Signs should not obscure windows or other architectural features of the
buildingwith which they are associated.
e) Signs shall not be placed in locations, that interfere with safe vehicular
and pedestrian circulation or public safety signals and signs. Signs
will not be placed in the sight triangles of intersections.
f) No sign shall be erected or maintained so as to obstruct and fire.

Signs shall be structurally designed in compliance with ANSI and
ASCI standards. All signs using electricity shall be constructed
according to the technical standards of certified testing laboratory.
h) Signs using electricity must directly connect to wiring that is.
integrated intothe building structure: or buried underground;: no. cables
or extension cords should run over .theground or upthe side of a
structure to power a sign.
5,4 Maintenance Standards. All signs shall be maintained in accordance
with the followings
a) The property owner or tenant shall maintain the sign in a condition
appropriate to the intended use.
h) Signs shall advertise or identify a legal business or other activity
currently taking place, or which will take place in the near future,
within the City of Gem Lake. Obsolete signs shall be removed by the
property owner within a reasonable time, no longer than two months,
after the sign becomes obsolete. A property owner or tenant may
apply to the City Council for exemption if the sign removal will be
unduly difficult to achieve (example: the sign.. is part of thebuilding
structure).
Signs shall be maintained in a safe, presentable and good structural
condition at ail times, including the replacement of defective parts,.
cleaning and other items required for the upkeep of the sign. There.

shall be no accumulation of rubbish or debris, or uncontrolled:
vegetation, under or near any sign.
SECTION 6. Definitions. The following words and phrases used inthese regulations
shall have the following meanings;
Arcade.. Continuous, occupied cover (such as a balcony) over the entrance or
entrances to a building.
Canopy. A freestanding permanent roof -like shelter no attached to or requiring
support from an adjacent structure.
Changeable Copy. The letters, symbols, logos or other graphics which make up
a sign's communicative message, if they are placed on the .signby electronic or
electrical means (a message center or dynamic display) or which can be replaced
manually through use of letters and symbols in a panel mount or track system.
Dynamic Display. Any characteristics of a sign that appear tohave movement or
that appear to change, caused by any method other than physically removing and
replacing the sign or its components, whether the apparent movement or change is
in the display, the sign structure itself, or any other component of the design. This
includes a display that incorporates a technology or method allowing the sign face
to change the image without having to physically or mechanically replace the sign.

intended to guide traffic entering, exiting, and: traveling to particular locations on
the property.
Mural. A picture on the exterior surface of a structure. A mural is only a sign for
purposes of these regulations if .it is related by language, logo or pictorial
depiction to the advertisement of any product or service or the identification of
any business.
Projecting Sign. A sign which projects from and is supported by a wall, parapet,
arcade or galleryy of a building with the display surface of the sign perpendicular
to or approximately perpendicular to the wall.

Sight Triangle. A triangle beginning at the corner of two intersecting street
rights -of -way, shaped by two lines extending 30 feet along .the edge of each right-
of-way and the line connecting the two resulting points_
Sign. Any name, figure, character, outline, display, announcement, or device, or
structure supporting thesane, or any other device of similar nature designed to.
attract attention outdoors, and shall include all parts, portions, units and materials.
composing the same, together with the frame, background, and . supports or
anchoring thereof. A sign shall not include any architectural or landscape features
that may also attract attention.
Sign Face. An exterior display surface of a sign including non-structural trim
exclusive of the supporting structure.
Temporary Sign. A sign which is installed for a period not to exceed sixty (60)
days, not illuminated, and not installed upon a foundation.
Wall Sign. Any sign attached to or painted on the wall of a building or structure
in a plane parallel or approximately parallel to the plane of said wall.
Window Sign. Anyy sign viewable through and/or/affixed in any manner to a
window or exterior glass door such that it is intended to be viewable from the
street, including signs located inside a building but primarily visible outside of the
building.
SECTION 7. Repealer. This Ordinance is intended to: replace priorsections of the
Zoning Ordinance, Number. 43K, which regulated signs, to wit: Section 19 in its entirety,
all definitions within Section 3 defining the word "sign" in different forms, and any other
definitions in Ordinance. 43K. contrary to the definitions contained herein.
SECTION 8. Severability.. Should any section, subdivision, clause or other provision
of this Ordinance be held to be invalid in any court of competent jurisdiction, such.
decision shall not affect the validity of the Ordinance as a whole, or of any part hereof,
other than the part held to be invalid.
SECTION 9. Effective Date. This Ordinance shall take effect and be in force from and
after its passage and publication.

3rd. Quarter 2009 Financial Report
The year is already over three quarters complete. Through the 3rd quarter of the year
the General Fund revenues are above anticipated levels, while expenditures are slightly
below anticipated levels. Budgeted transfers to the City. Hall Construction Fund and
Sewer Funds areincluded as of January Vend were actually made in July with some
amendments to transfer an additional $100,000 to the Sewer Fund. Revenues are
slightly above 2008 revenues while expenditures are above 2008 expenditures due to
the increased transfer to the Sewer Fund.

The City has received 101.16% of their revenue anticipated for the first three quarters of
2009. This amount represents 52.75% of the annual budgeted revenues. The City
received its tax settlement advance from Ramsey County in June, which is the main
reason revenues levels are as high as they are. Revenue sources that are ahead
budgeted amounts are general business licenses, which had not been budgeted for,
cable franchise fees in intergovernmental revenues, as well as investment related
revenues.

If expenditures were spent evenly throughout the year the City should have spent 75%
of its budget. The City has spent 93.30% of their anticipated budget for the first three
quarters of 2009. The reason for this is due partly to the fact that the transfers to other
funds are budgeted in January; however the actual transfers took place mid -year. There
are activities that appear to be over and under budget, but it is due in part to the cyclical
nature of some of the activities. The bottom line is the City has spent only 54.22%.of its
total 2009 budget without including the additional $100,000 transfer to the Sewer Fund.

Overall, I believe the City's expenditures will finish the year below or near budgeted
amounts while revenues will be above budgeted revenues.
The only activity the Parks and. Playgrounds Fund had during the third quarter was the
allocation of interest earnings from the pooled investment fund.
The City's maintains three debt funds: the 2004 and 2006 Bonds which were issued for
road and sewer improvements and are paid by special assessments and the 2007
Bonds which were issued for the construction of Heritage Hall and are paid through
property taxes. There were principal and interest payments totaling $151,392 paid in.
2009. There are no additional payments for principal and interest, however there may
be some nominal fiscal agent fees to pay before the end of 2009.
The City currently has one active construction fund which is the Scheuneman Road &
Utility Improvements. This Fund currently carries a deficit balance which will be covered.
through reimbursements from the Sewer Fund, from Ramsey County out of turn -back
funds and through specialassessments to the benefiting property owners.

Revenues for the first three quarters of 2009 are significantly higher than anticipated due
to the additional transfer of $100,000 from the General Fund to completely pay off the
interfund loan. Without the additional transfer, revenues would be ahead of the same
period for 2008 but less than budgeted. This is due in part to the recording of utility
receivables on the cash basis until year-end when accrual adjustments are made.
Expenses are actually lower than anticipated, with no expenditures made this year for
engineering or contractual repairs and maintenance which make up over 33% of the
expenditure budget. These expenditures do not include any transfers to the
Scheuneman Road & Utility Improvement project. Again I would anticipate the Sewer
Fund's expenses to finish the year below or near budgeted amounts.
Finally, the City had cash and investments of $821,197 invested as of September 30th.
