HomeMy WebLinkAbout2011 06-21 CC MINUTESCITY OF GEM LAKE, MN 4200 Otter Lake Road Gem Lake, MN 55110-3227 Telephone 651-747-2790 E-mail Citv(a,gemlakeMN.org Minutes of Gem Lake City Council Meeting 21 June 2011 The regular meeting of the City Council of the City of Gem Lake was called to order by Mayor Uzpen on Tuesday, June 21, 2011.at 7:00 pm in the Gem Lake City Hall meeting room. The following members were present: Mayor Robert Uzpen, Councilmembers James. Lindner, Gretchen Artig-Swomley, Richard Bosak and Thomas Rasmussen. Members of the public attending per the sign iri sheet sent around the room. APPROVAL OF AGENDA AND MEETING MINUTES. City Council Agenda: Mayor Uzpen called for additions, deletions and corrections to the agenda. Upon motion by Councilmember Rasmussen, and seconded by Councilmember Artig-Swomley, the agenda was approved for June 21, 2011. Ayes-5, Nays-0. City Council May Meeting Minutes: The May 2011 minutes were presented and corrections were needed. Upon motion by Councilmember Artig-Swornley, and seconded by Councilmember Bosak, the minutes of May 2011 were accepted with corrections being made. Ayes — 5, Nays — 0. Planning Commission Chair Report: Chairperson Faith Kuny, 9 Daniels Farm Road, spoke in front of the City Council to update them on current issues. Mr. Brian Hansen called Faith June 16, 2011 regarding a new bill signed by the governor. Property owners can once again initiate annexation proceedings meaning you only need one party to agree to the annexation. Mr. Hansen feels that if the city brought anything against him for the use of agriculture practices on his land, he would view that as unreasonable to the development of his land and would petition for annexation. Mayor Uzpen stated that The Hansen's have never brought a development plan to the City for approval. The City has gone through the annexation before with Mr. Hansen and at this time, the City has the Gateway District Ordinance in place. The City has taken great strides since 2006 to help developers if they desire to develop in Gem Lake. Councilmember Artig-Swomley stated that the City makes rules and all landowners need to follow these rules. Gem Lake City Council Meeting Page2of6. The Planning Commission has approved the Overlay Ordinance. With corrections requested by the council. OLD BUSINESS Newsletter: Councilmember Artig-Swomley suggested the July issue have an article on the National Night Out and an article on the audit report, letting the residents know how the City is spending their money. In addition, an article on the traffic report received June 20th showing the stops on June 18th regarding the DUIs. Councilmember Rasmussen suggested putting in the newsletter an article on the. residents attending the Workshops each month. Mayor Uzpen suggested writing about incentives to developers coming to the City of Gem Lake to review and report on the Gateway District and how to develop or redevelop property in the city. Councilmember Lindner reported that the MS4 Report was filed on time for 2011. In addition, there should be a news item letting the residents know about the Public Hearing at the Planning Commission in July regarding variances. PUBLIC HEARING None. NEW BUSINESS Audit Report: The company Larson Allen has done the City of Gem Lake's audit report for the past four years. Tom Koop and Michelle Hoffman provided the 2010 report and. presented the information to the City Council, highlighting certain important sections of the audit. Mr. Koop stated that there are some uncorrected mis-statements regarding the investment income, the numbers being different from what is carried through the City's books. Small adjustments were made stating utility income for 2010 instead of 2011. Ms, Hoffman went through the report. Ms. Hoffman called attention to pages 31- 32, a paragraph regarding internal control over financial reporting. Page 33 was regarding the Minnesota Legal Compliance and did not find any issues regarding the main categories. Page 3 is the business view of the City's capital assets arid page 4 is the net assets comparing 2009 to 2010. The City of Gem Lake is financially sound. Page 12 is the Profit & Loss Statement, which are related to the sewer line and repair maintenance. The City of Gem Lake has a solid cash reserve. The auditresults were very clean and a positive result. Good financial results. There are copies available at the Gem Lake City hall for residents to view or also will be on the city's website. Claims for June: The bills for June were discussed and authorized to pay. Councilmember Rasmussen asked why a service call was needed for the building. Councilmember Lindner and seconded by Councilmember Artig-Swomley, motion passes. Ayes — 5, Nays — O. Monthly Financial Reports: The City Council received and reviewed the report. No questions were asked from the council. Tangwell/Larkin Ordinance 43 — Section 21.3 Violation: Building Inspector Mike Johnson, from White Bear Township sent a report to Mayor Uzpen and the City Council and. Mike is recommending turning over the Tangwell/Larkin issue to the City Prosecutor Robb Olson. Councilrnember Bosak stated that it has been two years and the council should move forward with further action. Upon motion from Councilmember Bosak and seconded by Councilmember Lindner, the Tangwell/Larkin Ordinance 43 — Section 21.3 violation will be turned over to the City Prosecutor Attorney Robb Olson. Ayes — 5, Nays —g.. S.G.S. Holdings, LLC Conditional Use Permit Violation: The conditional use permit was issued last fall to S.G.S. Mayor Uzpen laid out the map that was given with their proposal. The cars are not being parked in the area that was approved by the City Council and agreed upon by S.G.S. Holdings. Mayor Uzpen talked to the owner last December about the problem and asked how long would it be and Mayor Uzpen was asked if they could have until spring. Mayor Uzpen visited Vera Auto Sales in March and they asked for more time. Mayor Uzpen went back May 20th Mayor Uzpen spoke to the owner at each visit and pointed out the violations. Mayor Uzpen advised the owner that if they did not move the cars as per the Conditional Use Permit (CUP) they would have to appear before the City Council for possible revocation of the CUP. Councilmember Bosak stated that the remodeling should not interfere with the parking of cars on County Road E. Councilmember Rasmussen stated when this permit came. up for vote; he received feedback from some residents that they did not want parking on County Road E. City Attorney Trevor Oliver stated that he would write a letter to S.G.S. Holdings stating that the City Council will go forth with a Public Hearing in July regarding the Conditional Use Permit. Overlay Ordinances-- Number 122: The Planning Commission approved The Overlay. and forwarded it to the City Council. Mr. Tom Hansen is requesting that the Council take no action at this time towards the Ordinance. He is out of town and wants to discuss this at the July City Council meeting. Mr. Hansen has sent emails to the Council and Mayor Uzpen responded that the Council would discuss the issue at the June City Council meeting and make a decision then regarding postponing the matter to July. Some of the Councilmembers asked the question as to why Mr. Hansen's lawyer was not at the meeting. Mayor Uzpen has sent a copy of the Ordinance to Tom and Bryan Hansen. Mayor Uzpen requested that Attorney Oliver work on a separate Ordinance dealing with wetland rules. A discussion took place about the trees that were cut down. Considering the number of total trees on the lot including the boulevard there is no violation to the tree Ordinance. After some discussion, it was decided by the City Council to table this Ordinance until the July City Council meeting. Upon motion by Look for us: on the World Wide. Ayes-3, Nays-2. OPEN 1TEMS FROM. THE CITY COUNCIL Councilmember Lindner informed the City Council that he completed the MS4 Report and the form was different this year. Section on the Minimal Control, Number three, Item ID — "Have you established an Ordinance or other regulatory mechanism to prohibit. illicit discharges and/or non -storm water discharges from entering the MS4." Councilmember Lindner put yes for an answer on that. After speaking to Justin Gese from SEH, he felt the City has something relating to that and will check on it. Attorney Oliver stated that Gem Lake has a storm water section in the zoning ordinance. Councilmember Lindner stated that Nelson -Marine had an oil leak, reported that was cleaned up. Councilmember Rasmussen and Planning Chairperson Kuny both had conversations with Brian about debris and garbage on his property and how he wanted to hire to clean up the area. They went to look at the debris and decided to wait until fall when there is less foliage in that area. Councilmember Artig-Sworriley reported that her solar panels are now working through XCeI.
