The regular meeting of the City Council of the City of Gem Lake was called to order by Mayor Uzpen on Tuesday, September 20, 2011 at 7:00 pm in the. Gem Lake City Hall meeting room. The following members were present: Mayor Robert Uzpen, Councilmembers. James Lindner, Gretchen Artig-Swomley, and Richard Bosak'. Councilmember Thomas Rasmussen was not present. Members of the public attending per the sign in sheet sent around the room. APPROVAL OF AGENDA AND MEETING MINUTES City Council Agenda: Mayor Uzpen called for additions, deletions and corrections to the agenda. Robert Scruggs request for Interim Use Permit was removed from the agenda. Upon motion by Councilmember Bosak, and seconded by Councilmember Artig-Swomley, the agenda was approved for September 20, 2011. Ayes 4, Nays-0. City Council August Meeting Minutes: The August 2011 minutes were presented and corrections were needed. Upon motion by Councilmember Lindner, and seconded by Councilmember Artig-Swomley, the minutes of August 2011 were accepted with corrections. being made. Ayes 4, Nays — 0. Planning Commission August Meeting Minutes: The Planning Commission August minutes were tabled until the October City Council meeting. Planning Commission Chair Report: Chairperson Faith Kuny presented to the council regarding future meetings the Planning Commission will work on the goals for 2012. The Planning Commission will go over the goals for 2011..It was discussed the Planning Commission meetings are important for any future developers or business people who want to build or open a business in the City of Gem Lake. The City Council is also requesting that a written report be presented from Chairperson Kuny versus an oral report and send the report to the City Council members, Bill Short from White Bear Township and Gem Lake's administrative assistant. OLD BUSINESS Gem Lake City Council Meeting Page 2 of 5 Newsletter: Councilmember Artig-Swomley has been trying to interview the leaders of families that are gardening the Hansen fields for the newsletter but has not been able to be in contact with them. Mayor Uzpen suggested sending a note. Mayor Uzpen received a report from the Sheriff's department containing the rough draft of their 2012 budget and shows what Gem Lake pays the Sherriff per month. .Another item would be the outcome of the Overlay from the City Council meeting. In addition, Mayor Uzpen suggested writing an article regarding leaf clean up and not putting them into the street. City Attorney Trevor Oliver suggested having a meeting with the citizens of Gem Lake to see what they want happen with the Gateway District. It could be held at a City Council Workshop, City Council meeting, or both so everyone could attend. Mayor Uzpen suggested the 2012 fees, authorizing administrative procedures for expenses and passing the 2012 budget be discussed at a Public Hearing for the November City Council meeting. PUBLIC HEARING None NEW BUSINESS Resolution 2011-06 Sewer Certification: This is for the sewer delinquent accounts that will go on the owner's property taxes. Upon motion by Councilmember Artig-Swomley and seconded by Councilmember Bosak, Resolution 2011-06 passes. Ayes — 4, Nays — 0. Resolution 2011-07 Fire Inspection Certification: This is for businesses only in the City of Gem Lake from 2010 or prior. Upon motion by Councilmember Lindner and seconded by Councilmember Artig-Swomley; Resolution 2011-07 passes. Ayes - 4, Nays -- 0. Resolution 2011-08 Septic System Certification: The Resolution was discussed and upon motion by Councilmember Bosak and seconded by Councilmember Lindner, Resolution 201 1-. 08 passes. Ayes — 4, Nays — 0. Hansen LLC Applications for Overlay District Zoning Request Application: Hansen Investment LLC is requesting that their property be zoned under the Garden Overlay zoning, Attorney Oliver said that the Garden District Overlay lapses after a certain amount of time if not used. If the land were sold, the Garden District Overlay would expire and go back to the original zoning. Upon motion by Councilmember Lindner and seconded by Councilmember Bosak, the Hansen Investments LLC application to rezone property to Garden Overlay District was approved. Ayes — 4, Nays — 0. Mayor Uzpen feels the way the Ordinance is written that the property today is out of compliance. The council agreed that a letter should be sent stating what is required for next. year. Permit Application for 2011: Upon motion by Councilmember Artig-Swomley and seconded by Councilmember Lindner, the application from Hansen investments LLC for an Interim Use Permit for 2011. This Interim Use Permit will need to be renewed in 2012. Ayes -- 4, Nays 0. Mayor Uzpen stated that Mr. Hansen paid the fees and escrow. When all the bills are turned in and paid, any escrow left will be sent back to Mr. Hansen. Tangwell/Larkin Discussion: Mayor Uzpen sent the email from the Prosecutor to the council members and Mayor Uzpen has a meeting on Friday with Mike Johnson, Inspector, and Bill Short from White Bear Township, and Rob Olson regarding this case. Bill Short received an email from Rob Olson and Mr. Olson wants this meeting. At this time, the lake is high and put some of his property under water and the City Council approved the permit after the fact. Both property owners filled in wetlands and Christine Jensen from VLAWMO did the inspection on the land. The Ordinance was violated and when City Council requested them to fix the property, nothing was done. Attorney Oliver feels this is a state law violation. The City Council needs to be clear on what was done to the properties. The council agrees and feels. these needs to be pursued and move forward. Claims for September: The claims for September were discussed and authorized to pay. Mayor Uzpen stated a check was written to Wells Fargo for investment purposes. Upon motion by Councilmember Artig-Swomley and seconded by Councilmember Bosak, motion passes. Ayes -- 4, Nays-- 0.. Monthly Financial Reports: The. City Council received and reviewed the report. No questions were asked from the council. PRESENTATIONS FROM THE PUBLIC None OPEN ITEMS FROM THE CITY COUNCIL. Councilmember Bosak wants to request a deer hunt as he feels there are too many deer in the City of Gem Lake. Mayor Uzpen read the Hunting Ordinance stating that the City Council may issue the permits and such permits shall only be issued to individuals participating in a hunt organized by either Ramsey County or Minnesota Department of Natural. Resources. Said permits shall be issued only during the appropriate season. Hunting permit granted under this paragraph shall only authorize a discharge of firearms or use of bow and arrow on a specified parcel of property of five acres or larger. :The permit should only be issued when the individual or the entity organizing the hunt produces written consent to hunt on the land from the property owner or on a form approved by the City. The permit is for three weeks and has to be issued from the City Council. Councilmember Bosak would like Ramsey County to be involved. Councilmember Artig-Swomley suggested revisiting this Ordinance and making a few changes. Attorney Oliver suggested taking a draft copy of permit and putting rules on it Look for us on the World Wide Web at gemlakernn.org Gem Lake City Council Meeting Page 4 of 5 before it is issued or, on the other hand, amending the Ordinance with the same rules that Ramsey County has. Attorney Oliver will look into it. No decisions were made. Mayor Uzpen needs bids for plowing this winter. He asked for a bid from the White Bear Township and from White Bear Lake. Schifsky is the only bid received at this point. Each municipality made it clear that their own areas would be plowed first. Mayor Uzpen stated the heating system at City Hall needs to be replaced. It was suggested to also install a water heater at the same time. The price would be $7,000. The warranty on the heating system was for one year. The building is four years old. FUTURE COUNCIL MEETINGS Workshop Meeting: October 3, 2011 at 7:00 p.m. City Council Meeting: October 20, 2011 at 7:00 p.m. ADJOURN The September 20, 2011 regular meeting of the City Council adjourned at 8:41 p.m. Upon motion by Councilmember Lindner, and seconded by Councilmember Artig-Swomley, the City Council meeting was adjourned.
