Minutes of Gem Lake City Council Meeting
15 November 2011
The regular meeting of the City Council of the City of Gem Lake was called to order by Mayor
Uzpen on Tuesday, November 15, 2011 at 7:00 pm in the Gem Lake City Hall meeting room.
The following members were present: Mayor Robert Uzpen, Councilmembers James Lindner,
Gretchen Artig-Swomley, Richard Bosak and Thomas Rasmussen. Members of the public
attending per the sign in sheet sent around the room.
APPROVAL OF AGENDA AND MEETING MINUTES
City Council Agenda: Mayor Uzpen called for additions, deletions and corrections to the
agenda. Upon motion by Councilmember Artig-Swomley, and seconded by Councilmember
Bosak, the agenda was approved for November 15, 2011.
Ayes-5, Nays-0.
City Council October Meeting Minutes: The October 2011 minutes were presented and
corrections were needed. Upon motion by Councilmember Artig-Swomley, and seconded by
Councilmember Lindner, the minutes of October 2011 were accepted with corrections being
made. Ayes —5, Nays — 0.
Planning Commission October Meeting Minutes: The Planning Commission October
minutes were presented and corrections were needed. Upon motion by Councilmember
Bosak, and seconded by Councilmember Lindner, the October Planning Commission minutes
were accepted. Ayes — 5 Nays — 0.
Planning Commission Chair Report: Chairperson Faith Kuny was absent, but sent the
report to the City Council.
OLD BUSINESS
Newsletter: Councilmember Artig-Swomley is going to do an article on the Budget and fees
for 2012. Also a story on the new sign for the City of Gem Lake. Councilmember Artig-
Swomley will be writing a story on the Public Safety Ordinance. It was suggested doing a story
on the wild Life and the residents who document the animals that go through Gem Lake.
There will be an article reminding the residents that the streets will be plowed when the
snowfall is two inches or more.

PUBLIC HEARING
2012 Fee Schedule: There was no discussion regarding the 2012 fee schedule.
Public Hearing Opened at 7:07 p.m.
No input from the public.
Mayor Uzpen stated there is no increase in the 2012 fee schedule. There was one item added
to the fee schedule and a copy will be sent to White Bear Township.
Public Hear Closed at 7:08 p.m.
Upon motion by Councilmember Lindner and seconded by Councilmember Artig-Swomley
Resolution No. 2011-11 passes. Ayes — 5, Nays — 0.
2012 City Budget: Treasurer Jessie Hart gave a presentation to the public and City Council
with handouts regarding the 2012 budget. The residents will receive their tax statement by
November 18, 2011. She went through what the City will be spending for road repairs,
maintenance for the year.
Public Hearing Opened at 7:09 p.m.
No input from the public.
Public Hear Closed at 8:08 p.m.
Upon motion by Councilmember Lindner and seconded by Councilmember Artig-Swomley
Resolution No. 2011-12 passes. Ayes 5, Nays — 0.
A voice vote was taken: Mayor Uzpen — yes, Councilmember Bosak — yes, Councilmember
Lindner — yes, Councilmember Rasmussen — yes, and Councilmember Artig-Swomley — yes.
NEW BUSINESS
Resolution No. 2011-10 Charitable Contributions: The City Council was given a packet by
Mayor Uzpen and it was decided that $500 would be given to the White Bear Lake Food Bank
and $250 going to the Union Gospel. Upon motion by Councilmember Rasmussen and
seconded by Councilmember Bosak, Resolution No. 2011-10 passes. Ayes - - 5, Nays — 0.
Conditional Use Permit for SmithlGetler Garage: The Planning Commission had a public
hearing and recommended approval and passed it on to the City Council. Mr. Smith explained
the new garage would be attached to an open breezeway. The new garage will be 1250 feet,

which will be a decrease from the old garage. Upon motion by Councilmember Lindner and
seconded by Councilmember Artig-Swomley, the Conditional Use Permit for Smith/Geller
garage passes. Ayes — 5, Nays — 0.
Claims for November: The claims for November were discussed and authorized to pay.
Upon motion by Councilmember Artig-Swomley and seconded by Councilmember gosak,
motion passes. Ayes — 5, Nays — 0.
Monthly Financial Reports: The City Council received and reviewed the report. There were
no questions from the City Council.
Ordinance 124 Hunting: City Attorney Trevor Oliver did the modifications to the Safety
Ordinance. There was discussion among the City Council members with input from Tom
Bolfing. The modification is the resident will get the permit to hunt deer on their property via
written permission to the hunter. The hunter will then get a State license and a City license.
The permit will be for three (3) weeks. The hunter will have an escrow account to cover any
violation of the permit and the City Council can then fine the hunter if there are any violations.
If not the money will be returned. If a hunter shoots a deer and the deer goes onto private
land, the hunter can retrieve the deer, but cannot bring their weapon with them. Upon motion
by Councilmember Artig-Swomley and seconded by Councilmember Bosak, motion passes.
Ayes-4, Nays-1.
A voice vote was taken: Mayor Uzpen — no, Councilmember Bosak — yes, Councilmember
Lindner -- yes, Councilmember Artig-Swomley — yes, and Councilmember Rasmussen — yes.
Resolution 2011-13 Deer Hunting Fee: The deer -hunting fee starting 2011 will be $100.00
per permit. Upon motion by Councilmember Artig-Swomley and seconded by Councilmember
Bosak, motion passes. Ayes — 5, Nays — 0.
PRESENTATIONS FROM THE PUBLIC
Resident Tom Bolfing thanked the City Council for reviewing and rewriting the wordage for the
Deer. Hunting Ordinance.
OPEN ITEMS FROM THE CITY COUNCIL
Councilmember Artig-Swomley asked Mayor Uzpen when the new sign for the City of Gem
Lake would be done. Mayor Uzpen stated it would be delivered and installed four weeks from
the date it was ordered.

The November 15, 2011 regular meeting of the City Council adjourned at 8:38 p.m. Upon
motion by Councilmember Rasmussen, and seconded by Councilrnember Artig-Swomley, the
City Council meeting was adjourned. Ayes -- 5, Nays — 0.
