City Council Meeting – December 15, 2020
Meeting Minutes
Acting Mayor Artig-Swomley called the meeting to order at 7:02 p.m. Councilmembers Amlee, Cacioppo,
Kuny, and Lindner were present. Also present: Justin Gese, City Engineer, City Attorney Patrick Kelly, City
Finance Director Tom Kelly, Ben Johnson, Planning Commissioner Chair and a number of call-ins not
identified.
December 15, 2020, Agenda
A motion was made by Councilmember Lindner, seconded by Councilmember Cacioppo to approve the
agenda, Voice vote taken, all voted yes, motion passes. Agenda approved.
Minutes
A motion was made by Councilmember Lindner, seconded by Councilmember Kuny to approve the
November 17, 2020, City Council minutes. Voice vote taken, all voted yes, motion passes, minutes
approved.
Committee Reports – Planning Commission
Commissioner Johnson gave an overview of the Planning Commission meeting on December 1st, 2020.
The commission discussed accessory structure building heights, (Ordinance 131) looking at all zones of
the city setting the heights to 18 - 20 feet, still accommodating set-backs and/or setting the heights for
executive resident to 25 feet depending on set-backs, in no case would the accessory structure be
higher than the main residence, (ordinance 85) what is permitted and not permitted in Ordinance No.
85, oversight for the amount of square footage a business within a homeowners home is allowed,
commercial traffic or traffic in general, what residents are currently using their properties for in a
business setting, discussed what other municipalities surrounding Gem Lake allows, current ordinance is
well written but should explore other municipalities ordinances.
Old Business
Newsletter ideas –newly elected council, goals for 2021, audit items, passing of Richard Arcand, long
time Gem Lake resident, special election.

New Business
Resolution 2020-0022 – Transfer of Funds, Tom Kelly, Finance Director
Mr. Kelly presented an overview of the transfer of funds for the 2021 budget. A motion was made by
Councilmember Lindner, seconded by Councilmember Amlee to support Resolution 2020-0022, transfer
of funds. A voice vote was taken, all voted yes, motion passes.
Resolution 2020-0017 – The Country Lounge Liquor License Renewal
A motion was made by Councilmember Lindner, seconded by Councilmember Kuny to support
Resolution 2020-0017, renewal of The Country Lounge’s liquor license renewal for 2021.

Councilmember Amlee recused herself from the vote and discussion. A voice vote was taken, all voted
yes, (except Councilmember Amlee) motion passes.
Resolution 2020-0018 – Black Sea Restaurant – Wine License
Table for January, 2021, discussion. Council will have a discussion at the January, 2021, City Council
meeting to decide how to charge liquor licenses for the 2021 year, due to COVID restrictions. A motion
was made by Councilmember Lindner, seconded by Councilmember Amlee to support Resolution 2020-
0018, tabling this item until January, 2021. A voice vote was taken, all voted yes, motion passes.
Resolution 2020-0019 – Gem Lake Hills, LLC, Liquor License
A motion was made by Councilmember Lindner, seconded by Councilmember Kuny to support
Resolution 2020-0019, Gem Lake Hills, LLC, liquor license. A voice vote was taken, all voted yes, motion
passes.
Resolution 2020-0023 Mutual Aid Agreement
A motion was made by Councilmember Lindner, seconded by Councilmember Kuny to support
Resolution 2020-0023, Mutual Aid Agreement. A voice vote was taken, all voted yes, motion passes.
Resolution 2020-0024 Country Lounge – Charitable Gambling and Tobacco License
A motion was made by Councilmember Lindner, seconded by Councilmember Kuny to support
Resolution 2020-0024, Councilmember Amlee recused herself. A voice vote was taken, all voted yes
(except Commissioner Amlee), and motion passes.
Metro Net Joint Powers Agreement
A motion was made by Councilmember Lindner, seconded by Councilmember Kuny to approve the
Metro Net Joint Powers Agreement. A voice vote was taken, all voted yes, motion passes.
Resolution 2020-0025 Ramsey County GIS Users Group JPA
A motion was made by Councilmember Lindner, seconded by Councilmember Kuny to support
Resolution 2020-0025, Ramsey County GIS Users Group JPA. A voice vote was taken, all voted yes,
motion passes.
Approval of 2021 City of Gem Lake Fee Schedule
A motion was made by Councilmember Lindner, seconded by Councilmember Kuny to approve the 2021
Fee Schedule for the City of Gem Lake. A voice vote was taken, all voted yes, motion passes.
2020 Sanitary Sewer Manhole Condition Assessment – Justin Gese, S.E.H.
City Engineer Justin Gese provided an overview of the city manhole conditions. Overall good, an
assessment should take place every ten years. A report is on file at the Gem Lake City office.
Scheuneman Road Elevation Survey and Hydraulic Analysis – Justin Gese, S.E.H.
City engineer provided an overview of the Scheuneman Road Elevation and Hydraulic Analysis. The
project is anticipated to need a larger effort and S.E.H. will present a revised proposal at the January,
2021, City Council meeting.

Developers Agreement - Gem Lake Villas – Justin Gese S.E.H.
A few items are left on the punch list, road was signed off on.
Approval of 2021 Score Agreement
A motion was made by Councilmember Lindner, seconded by Councilmember Cacioppo to approve the
SCORE Agreement with Ramsey County. A voice vote was taken, all voted yes. Motion passes.
Claims
A motion was made by Councilmember Lindner, seconded by Councilmember Cacioppo to approve the
claims for December, 2020. A voice vote was taken, all voted yes. Motion passes.

Councilmembers
January meeting, conflict of interest document, open meeting laws, goals for 2021, development guide
from Ramsey County related to county roads. January, 2021, meeting will be virtual.

Adjournment
Being there no further business, following a motion from Councilmember Lindner, seconded by
Councilmember Cacioppo, the meeting adjourned at 8:29 p.m.
