City Council Meeting – March 19, 2019
Meeting Minutes
Mayor Uzpen called the meeting to order at 7:00 p.m. Councilmembers Artig-Swomley, Cacioppo, Lindner
were present. Councilmember Kuny was absent (excused). Others in attendance: City Attorney Patrick
Kelly, Planning Commission Chair Ben Johnson, residents/business/property owners John Birkeland, Craig
Edmonds, Paul Emeott, Laurel Hynes Amlee, Pete Oswald, Shawn Pehrson.
March 19, 2019, Agenda
A motion was made by Councilmember Lindner to add the S.E.H. agreement for MS4,
Schifsky/Snowplowing, drainage on two properties to the agenda and with that change Councilmember
Lindner made a motion to approve the agenda, seconded by Councilmember Artig-Swomley, motion
passed. Agenda approved.
Minutes
A motion was made by Councilmember Artig-Swomley, seconded by Councilmember Cacioppo to
approve the February 19, 2019, City Council minutes, with Mayor Uzpen abstaining. Motion passes,
minutes approved.
Committee Report- Planning Commission
Planning Commission Chair Ben Johnson reported on the March 5, 2019, meeting. Two public hearings
were held, 3540 Highway 61, overflow parking for CarFit and proposed change to zoning ordinance for
property at 3516 Highway 61. The planning commission recommends approval.
Newsletter
Rush Line article to be written by Councilmember Lindner, flooding concerns in Gem Lake, recycling
report, HyVee construction dates, false alarms, Water Gremlin.
New Business
Request from John Birekland for Conditional Use Permit, 3540 Highway 61
A motion was made by Councilmember Lindner, seconded by Councilmember Artig-Swomley to approve
the conditional use permit for 3540 Highway 61. Motion passed, CUP approved.
Approve Yearly Liability Coverage for Gem Lake
A motion was made by Councilmember Lindner, seconded by Councilmember Cacioppo to approve the
yearly liability coverage for Gem Lake, not waive. Motion passed, Yearly Liability Coverage form
approved.
Contract for Reading Meters
A motion was made by Councilmember Artig-Swomley, seconded by Councilmember Cacioppo to
approve a contract to hire an individual to read the water meters. Motion passed, Contract approved.
New Letterhead Design
Tabled to April, 2019, City Council meeting.

Discuss/approve Request to sell Oswald Property to The Luther Group
Tabled to April, 2019, City Council meeting.
MS4/2018/2019 Agreement with S.E.H.
A motion was made by Councilmember Lindner, seconded by Councilmember Artig-Swomley to extend
the contract with S.E.H. to 2020, seconded by Councilmember Lindner. Motion approved, contract
extended to 2020.
Claims
A motion was made by Councilmember Cacioppo, seconded by Councilmember Artig-Swomley to
approve the claims to March, 2019. Motion passes, claims approved.
Presentations from the public
Paul Emeott, Scheuneman Road, drainage problems on Scheuneman Road in the residential area, some
residents depositing snow from their property into properties across the street from them, who is
responsible for cleaning the culverts? City engineer to address. Consolidated land use ordinance,
regarding a chain link fence for parking pad, John Birkeland, appreciation of permit, wants to be
considered equally with other permits for similar situations.
Shawn Pehrson, 4140 Otter Lake Road, wants to hook up directly to the Met Council interceptor on the
private road, near 4140 Otter Lake Road. (Notes from previous meeting – October, 2017, City Council
meeting for reference. Council visited this item in October, 2017, and agreed that the property at 4140
Otter Lake Road can hook up to the Scheuneman Road manhole provided that the fees of $17,000 are
paid in advance).
Open Items for the Councilmembers to bring up
There is drainage issue with the property located at 15 Hillary Farm Lane, affecting property at 1430
Goose Lake Road. City Engineer will visit both properties. Winter snow plowing gouged street on Big
Fox Road, snow plow contractor Schifsky will be called to repair.
Next Meetings/Workshop
April 8, 2019, workshop cancelled.
Adjournment
Being there no further business, following a motion from Councilmember Lindner, seconded by
Councilmember Artig-Swomley, the meeting adjourned at 8:39 p.m.
