HomeMy WebLinkAbout2019 05-21 CC MinutesCity of Gem Lake City Council meeting minutes May 21, 2019 Page 1 City of Gem Lake City Council Meeting – May 21, 2019 Meeting Minutes Acting Mayor Uzpen called the meeting to order at 7:00 p.m. Councilmembers Artig-Swomley, Cacioppo, Kuny and Lindner were present. Others in attendance: City Attorney Patrick Kelly, Residents/Students/Planning Commission Members: Laurel Amlee, Kyleigh Bacon, Rick Bosak, Carter Collins, Don Cummings, Hannah Ertle, Bill Flaspeter, Kaylee Gilbert, Lauren Jurek, Dan and Mary Jane Marier and Grant Miller. May 21, 2019, Agenda A motion was made by Councilmember Cacioppo to add to the agenda, The Luther Company, LLLP, Conditional Use Permit, Variance for Set Backs and VLAWMO JPA Amendment for Insurance Change, seconded by Councilmember Lindner. A motion was made by Councilmember Cacioppo, seconded by Councilmember Lindner to approve the agenda with changes, motion passed. Agenda approved. Minutes A motion was made by Councilmember Lindner, seconded by Councilmember Cacioppo to approve the April 16, 2019, City Council minutes. Mayor Uzpen abstains. Motion passes, minutes approved. Newsletter Set to print June/July, The Luther Company, LLLP, new Planning Commission members, recycling report, False Alarms, Tree Trust – Water Gremlin fund allocation. New Business The Luther Company, LLLP, Conditional Use Permit and Variance for Set Backs A motion was made by Councilmember Artig-Swomley, seconded by Councilmember Linder to approve the Conditional Use Permit with the additional of a developer’s agreement for the road. Motion passed, a voice vote taken, all members voted yes, The Luther Company, LLLP, C.U.P. with developer’s agreement added and Variance for Set Backs approved. JPA VLAWMO Amendment for Insurance Change VLAWMO would like amend their 2017 JPA with their partner cities to allow for the organization to apply for insurance coverage with the League of Minnesota Cities. By making this change VLAWMO will save about 20% and have better coverage. A motion was made by Councilmember Artig-Swomley, seconded by Councilmember Cacioppo to approve the amendment to the JPA. Motion passed, JPA amendment approved. $2.00/hour raise for City Support Staff The City Support Staff’s job duties have increased with staff now in the role of the Acting City Clerk. Therefore a change in salary should be made. A motion was made by Councilmember Cacioppo, seconded by Councilmember Artig-Swomley to raise the city support staff salary $2.00/hour. Motion passes, voice vote taken, all members voted yes, raise approved. City of Gem Lake City Council meeting minutes May 21, 2019 Page 2 Dan Marier, 40XX Scheuneman Road In 2001, City Staff approved a 1,350 square foot pole barn for the Marier property. Observations were made recently that Mr. Marier has added to this pole barn without a permit. Since 2001 another garage has been added to the property. Noted: Mr. Marier stated that demolition of a previous garage took place and he had a permit for the new garage. In addition, a complaint was received that Mr. Marier has been driving a golf cart/ATV on city streets. Noted: Mr. Marier states he does not own an ATV, but does have a golf cart he uses for transportation to his rental property to do maintenance at the home. City Attorney Kelly suggested that the council recommend having the building inspector check the property records and assimilate a report on the property to present to the council. A motion was made by Councilmember Artig-Swomley, seconded by Councilmember Linder to direct the building inspector to prepare a report for the council on the property. Motion passed. Golf cart discussion took place about motorized golf carts, state statutes, and whether they allowed on city streets, they are not. City Attorney will research and look into an ordinance for the city for golf carts. Council agreed a permit would be needed for such. Water Gremlin Settlement Discussion Tabled for June, 2019, City Council meeting. Hazard Mitigation Plan Tabled for June, 2019, City Council meeting. Grass Cutting and Snow Plowing and Heritage Hall – Change of Vendor Request Currently White Bear Township mows the lawn and plows the snow at Heritage Hall. A vendor, Greenline Services submitted a bid for grass cutting for $85.00 per week, currently this is billed at $134.62 per week, with a charge for fertilizer and trimming. Snow plowing from the township averages to $120.00 per week, depending on equipment, personnel, salt etc. Greenline Services would charge a rate depending on the depth of the snow. A motion was made by Councilmember Artig-Swomley, second by Councilmember Lindner to obtain a contract with Greenline Services for grass cutting, snow plowing and clarification on fertilizer application. Services with White Bear Township will end on June 28, 2019, and Greenline Services will begin on July 1, 2019. Motion passes. Appointment for New Planning Commissioners – Resolution 2019-005. A motion was made by Councilmember Artig-Swomley, seconded by Councilmember Linder to approve Laurel Amlee and Don Cummings to the Planning Commission. Motion passed, resolution approved. JPA discussion with Vadnais Heights on the Luther Project Council discussed a JPA with Vadnais Heights. Agreed to not have a JPA, enter into a developer’s agreement instead. Claims A motion was made by Councilmember Lindner, seconded by Councilmember Artig-Swomley to approve the claims for May, 2019. Motion passes, claims approved. City of Gem Lake City Council meeting minutes May 21, 2019 Page 3 Open Items for the Councilmembers to bring up Discuss a donation the White Bear Lake Food Shelf, summer lunch/backpack program. A motion was made by Councilmember Artig-Swomley, seconded by Councilmember Cacioppo to make a $2,500 donation to the White Bear Lake Food Shelf for the Summer Lunch Backpack program for youth. Motion passed, donation approved. Update on Water Gremlin. They are using a new alterative to TCE, a water based solvent. Open Items for Public A letter was introduced to the council by Mr. Henry, 12XX Little Fox Lane, in regard to barking dogs on the back corner of his property (Yorkies) and the western edge of his property (German Shepard). City Attorney Kelly will speak to the City Prosecutor about the situation, suggested sending a letter to both residents addressing the matter. Noted that the residents with the yorkies have four dogs, only three dogs are allowed per City Ordinance No. 69, in addition, city ordinance states it is unlawful for any owner or harborer to keep or harbor any animal which barks, howls, or the like continuously for a period of five (5) minutes without a thirty (30) second pause or whose general conduct otherwise creates a nuisance. Next Meetings/Workshop June 10, 2019, workshop cancelled.
