HomeMy WebLinkAbout2019 08-20 CC MinutesCity of Gem Lake City Council meeting minutes August 20, 2019 Page 1 City of Gem Lake City Council Meeting – August 20, 2019 Meeting Minutes Mayor Uzpen called the meeting to order at 7:00 p.m. Councilmembers Cacioppo, Kuny and Lindner were present. Others in attendance: City Attorney Patrick Kelly, City Engineer Justin Gese, Planning Commission Chair Ben Johnson, Residents/Others: Emily Erdahl, S.E.H., Michelle Hoffman, CliftonLarsonAllen, Erik Johnson, Dan Marier, and Karl Stuemke. August 20, 2019, Agenda A motion was made by Councilmember Artig-Swomley, seconded by Councilmember Linder to adjust the agenda to change the minutes from June to July, 2019. Motion passed. Agenda approved. Minutes A motion was made by Councilmember Artig-Swomley, seconded by Councilmember Lindner to approve the July 16, 2019, City Council minutes. Mayor Uzpen abstained, Motion passes, minutes approved. Committee Reports – Planning Commission Chair Ben Johnson gave an overview of the Planning Commission meeting on August 6. The commission discussed the additional wording to ordinance 131, Section 9.6.5, a conditional use permit for 3660 Scheuneman Road, golf cart ordinance and engineering of the proposed sidewalk on County Road E. Newsletter White Bear Meadery grand opening, HyVee, Luther Cadillac, Sidewalk, MS4 written by Jim Lindner, Tree Trust, Len Cacioppo, Gem Lake Villas Sales report, Changes in Ordinance 131, Water Gremlin update, pet etiquette, golf cart survey. Public Hearing – MS4 – Emily Erdahl Councilmember Artig-Swomley made a motion, seconded by Councilmember Linder to waive the reading of the public hearing notice. Ms. Erdahl gave an over of the City of Gem Lake’s NPDES Phase II, Storm Water Permit Program. Councilmember Lindner made a motion to open the Public Hearing at 7:25 p.m., seconded by Councilmember Artig-Swomley. Councilmember Artig-Swomley asked Ms. Erdahl if she was aware that Gem Lake levels have increased substantially, Ms. Erdahl stated she was. Councilmember Lindner asked a question about outfall. Councilmember Lindner made a motion to close the public hearing at 7:27 p.m., seconded by Councilmember Artig-Swomley. Public hearing closed at 7:27 p.m. New Business City of Gem Lake 2018 Audit Report Michelle Hoffman, CliftonLarsonAllen gave an overview of the 2018 Audit. Councilmember Artig- Swomley made a motion to accept the audit, seconded by Councilmember Lindner. Motion passes. 2018 Audit Report accepted. City of Gem Lake City Council meeting minutes August 20, 2019 Page 2 Resolution 2019-007- Donation to Willow Lane School A motion was made by Councilmember Artig-Swomley, seconded by Councilmember Lindner to approve Resolution 2019-007 – Donation to Willow Lane School. Motion passes, resolution approved. Golf Cart Survey The council and residents discussed the survey of surrounding communities and their handling of golf carts on roads and in Gem Lake. VLAWMO Second Amendment A motion was made by Councilmember Artig-Swomley, seconded by Councilmember Lindner to approve the VLAWMO Second Amendment change order. Motion passes, Second Amendment approved. Ordinance 131, Section 9.6.5, to allow usage of a non-conforming material and approve CUP for 3660 Scheuneman Road A motion was made by Councilmember Artig-Swomley, seconded by Councilmember Lindner to approve the proposed language change from the Planning Commission’s recommendation. Motion passes, language change approved. A motion was made by Councilmember Artig-Swomley, seconded by Councilmember Lindner to approve the CUP for 3660 Scheuneman Road with additional language recommended from the Planning Commission. Motion passes, CUP for 3660 Scheuneman Road approved. Claims A motion was made by Councilmember Artig-Swomley, seconded by Councilmember Lindner to approve the claims for August, 2019. Motion passes, claims approved. Open Items from the Council Members to Bring Up Councilmember Artig-Swomley yard continues to be flooded from the spring rains/winter snow. She has applied for a permit from VLAWMO to build a berm and pump. Councilmember Cacioppo stated that there is a public meeting scheduled for Tuesday, August 27, 7:00 p.m. updating citizens about Water Gremlin. The MPCA and MDH are hosting the meeting. Councilmember Lindner asked about the status of the Comp Plan and when would Rush Line be presenting an update. They will be presenting at the September, 2019, meeting. Councilmember Artig-Swomley asked about the sidewalk. Mayor Uzpen stated Phase I is being worked on, Phase II is on hold. Claims A motion was made by Councilmember Lindner, seconded by Councilmember Cacioppo to approve the claims for July, 2019. Motion passes, claims approved. Next Meetings/Workshop September 9, 2019, workshop cancelled.
