City of Gem Lake
City Council Meeting – April 17, 2018
Meeting Minutes
Mayor Uzpen called the meeting to order at 7:00 p.m. Councilmembers Artig-Swomley, Cacioppo, Kuny
and Lindner were present. Others in attendance: City Clerk Tori Leonhardt, City Engineer Justin Gese,
City Planner Tom Riedesel, Nathan Fair, Fritz Magnuson and Steve Varley.
April 17, 2018, Agenda
A motion was made by Councilmember Artig-Swomley, seconded by Councilmember Lindner to approve
the agenda for April 17, 2018, motion passed. Agenda approved.
Minutes
A motion was made by Councilmember Lindner, seconded by Councilmember Cacioppo to approve the
March 7, 2018, special city council minutes, motion passed. Minutes approved. A motion was made by
Councilmember Lindner, seconded by Councilmember Artig-Swomley to approve the minutes for the
March 20, 2018, city council meeting, motion passed. Minutes approved.
Committee Reports
None.
Newsletter
May/June, published mid to late May, Villas, Scheuneman Road business district street project, comp
plan update, contributions, city clerk profile.
New Business
Resolution 2018-06 – A Resolution Supporting Local Decision Making Authority
A motion was made by Councilmember Artig-Swomley, seconded by Councilmember Linder to approve
Resolution 2018-06. Motion passes, Resolution approved.
Pehrson – septic issues/settlement update. Add to the agreement, work needs to be completed by
October 1, 2018, city can make arrangements to complete. Item tabled till May, 15, 2018, City Council
meeting.
Resolution 2018-08 – Willow Lane Elementary School – New Playground Equipment
A motion was made by Councilmember Lindner, seconded by Councilmember Artig-Swomley to approve
Resolution 2018-08. Motion passes, Resolution approved.
Resolution 2018-09 – Assessment Approval for Scheuneman Road Project (business district)
A motion was made by Councilmember Artig-Swomley, seconded by Councilmember Lindner to approve
Resolution 2018-09 with the additional of period of 15 years, (paragraph 2), interest rate not to exceed
7%. Motion passes, Resolution approved.
Resolution 2018-12 Resolution for Hearing on the Proposed Assessment – Scheuneman Road Project
A motion was made by Councilmember Lindner, seconded by Councilmember Artig-Swomley to hold an
assessment hearing for the Scheuneman Road project May 15, 2018. Project will be awarded on May
15, 2018, if no appeals. Motion passes, Resolution approved.

Resolution 2018-10 – Change the July, 2018, City Council meeting to July 10th
A motion was made by Councilmember Lindner, seconded by Councilmember Artig-Swomley to change
the July, 2018, City Council meeting from July 17, 2018, to July 10th, 2018. Motion passes, Resolution
approved.
Resolution 2018-11 Approval of the Water and Sewer Service Agreement with Vadnais Heights
A brief discussion in regard to right-of-ways took place. A motion was made by Councilmember Artig-
Swomley, seconded by Councilmember Lindner to approve Resolution 2018-11 Approval of the Water
and Sewer Service Agreement with Vadnais Heights. Motion passes, Resolution approved.
Resolution 2018-07 Approval of the Landmark Development Project
A brief discussion took place regarding the landscaping plan and other agency approvals. A motion was
made by Councilmember Lindner, seconded by Councilmember Cacioppo to approve Resolution 2018-
07, with the following statement. The City Council hereby approves the Developers Agreement in
substantially the form submitted, and the Mayor and City Clerk are hereby authorized and directed to
execute the Developers Agreement on behalf of the city. The approval hereby given to the Developers
Agreement includes approval of such additional details therein as may be necessary and appropriate
and such modifications thereof, deletions therefrom and additions thereto as may be necessary and
appropriate and approved by the City officials authorized by this resolution to execute the Developers
Agreement. The execution of the Developers Agreement by the appropriate officer or officers of the
city shall be conclusive evidence on the approval of the Developers Agreement in accordance with the
terms hereof. A voice vote was taken, 5- yes votes, 0 no votes. Motion passes, Resolution approved
with changes.
Comp Plan Update
In process, arrange public hearing with Planning Commission.
Open Items for the Councilmembers to Bring Up
County Road E mil and overlay, early May. Transit station in Gem Lake, County Road E – council agreed
too busy of intersection, move station further north. Inquiry from HyVee, Co. Road E and Hoffman
Road, conceptual plan meeting to take place April 26, 2018.
Claims
A motion was made by Councilmember Linder, seconded by Councilmember Cacioppo to approve the
claims. Motion passes. Claims approved.
Adjournment
Being there no further business, following a motion from Councilmember Linder, seconded by
Councilmember Artig-Swomley, the meeting adjourned at 8:47 p.m.
