Others in attendance: Ron Bartosch, City Attorney Patrick Kelly, City Finance Director Tom Kelly, Joshua Eckton, Honey Bear Meadery, Paul Emeott, Todd Hagen, Ehlers, George Jungmann, Chris Knopik, Clifton Larson Allen, Dan Marier, Dennis Olson, Pete Oswald, Don and Sheila Waldoch. June 19, 2018, Agenda A motion was made by Councilmember Artig-Swomley, seconded by Councilmember Cacioppo to approve the agenda for June 19, 2018, motion passed. Agenda approved. Minutes A motion was made by Councilmember Lindner, seconded by Councilmember Artig-Swomley to approve the May 15, 2018, City Council minutes. Motion passed, minutes approved. Committee Reports None. Newsletter June/July, published mid to late June, Carol Nordstrom profile, update on the Villas, picture of the playground equipment at Willow Lane School, auditors report, summary of police report and calls for service, no solicitors sign, road construction update, policy on special events. New Business 2017 Audit Presentation – CliftonLarsonAllen, Chris Knopik, presenter Chris Knopik presented an overview of the City of Gem Lake 2017 audit. A motion was made by Councilmember Lindner, seconded by Councilmember Artig-Swomley to accept the 2017 auditor’s report for the City of Gem Lake, motion passes, audit accepted. High Tech Auto- Conditional Use Permit – Revoke – Company has gone out of business A motion was made by Councilmember Lindner, seconded by Councilmember Artig-Swomley to revoke the CUP for High Tech Auto, due to the company going out of business. Motion passes, CUP revoked. 3660 Scheuneman Road – Discussion to Condemn Property The property is currently vacant and has had on going blight conditions for a number of years. A motion was made by Councilmember Artig-Swomley, seconded by Councilmember Kuny to give a notice of corrective action and verify property titles. Motion passes, Corrective Action process to proceed following Minnesota Statutes. Liquor Ordinance The current liquor ordinance needs to be updated. Liquor ordinance will be worked on by the Planning Commission. City of Gem Lake City Council meeting minutes June 19, 2018 Page 2 HyVee Update – Don Waldoch, Property Owner and Mayor Uzpen Mr. Waldoch, owner of 3579, 3585, 3595, 3599 Hoffman Road, 1568 E. County Road E and 3588 Highway 61 North, updated the council on his progress of having a small piece of his property that is in Vadnais Heights annexed to Gem Lake. He agreed to pay Vadnais Heights for the lost tax revenue. Both cities are in agreement to the annexation. Annexation to proceed following Minnesota Statute 414.061. Mayor Uzpen - City of Gem Lake may have to pay Vadnais Heights legal fees, estimate $3,000-$5,000. July Planning Commission land use ordinance will be updated, will go to the City Council July 10 for a vote, S.E.H. will do a small traffic study on Hoffman Road. A motion was made by Councilmember Artig- Swomley, seconded by Councilmember Kuny to authorize the City Attorney to start the process of annexation with Vadnais Heights, get an estimate on Vadnais Heights’ legal fees for annexation. Voice vote taken, all yes votes. Motion passes. A motion was made by Councilmember Lindner, seconded by Councilmember Cacioppo to authorize S.E.H. to conduct a traffic study on Hoffman Road costs not to exceed $900.00. A voice vote was taken, all yes votes. Motion passes. Resolution 2018-18 Awarding the Sale of Bonds for the Scheuneman Road Project Todd Hagen, Ehlers, provided an overview of the sale report for the bonds for the Scheuneman Road Project. A motion was made by Councilmember Artig-Swomley, seconded by Councilmember Lindner to Award the Sale of the Bonds to the Winning Bidder for the Scheuneman Road Project. A voice vote was taken, all yes. Motion passes, Resolution approved. Resolution 2018-19 – Amend Land Use Ordinance 131 Tabled. A motion was made by Councilmember Artig-Swomley, seconded by Councilmember Lindner to table the Amendment of the Land Use Ordinance. Motion passes, Resolution tabled. Elm Trees on Boulevard Discussion Council discussed who is responsible for boulevard or right-of-way trees. Council will gather policies /information from other municipalities, review and develop a city wide policy. Discussion on City Policy for Special Events A motion was made by Councilmember Artig-Swomley, seconded by Councilmember Cacioppo to approve the special events policy for the City of Gem Lake. Motion passes, Special Events Policy approved. Claims A motion was made by Councilmember Linder, seconded by Councilmember Artig-Swomley to approve the claims. Motion passes. Claims approved. Open Items/Residents Comments Joshua Eckton, Honey Bear Meadery, proposed business for 1595 E. County Road E, Gem Lake, presented a proposal for a meadery at 1595 E. County Road E, Gem Lake. The council directed Mr. Eckton to the city planner and to attend the July 9, Planning Commission meeting. Noted that parking for customers will need to be addressed. August Workshop, discuss lessons learned for next development. Ordered a report from S & S Tree to look at the trees at the Villas development, some of City of Gem Lake City Council meeting minutes June 19, 2018 Page 3 the trees are leaning towards County Road E. Discussed hours of work time at Villas development, complaint log exists, call City Hall if you observe violations.
