Citya,gemlakeMN.org Minutes of Gem Lake City Council Meeting 21 December 2010 The regular meeting of the City Council of the City of Gem Lake was called to order by Mayor Uzpen on Tuesday, December 21, 2010 at 7:01 pm in the Gem Lake City Hall meeting room. The following members were present: Mayor Robert Uzpen, Councilmembers James Lindner, Gretchen Artig-Swomley, Richard Bosak and Thomas Rasmussen. Members of the public attending per the sign in sheet sent around the room. APPROVAL OF AGENDA AND MEETING MINUTES City Council Agenda: Mayor Uzpen called for additions, deletions and corrections to the agenda. Upon motion by Councilmember Lindner, and seconded by Councilmember Bosak, the agenda was approved for December 21, 2010. Ayes — 5, Nays — 0. City Council November Meeting Minutes: The November 2010 minutes were not received by all council members, so will look at them at the January, 2011 meeting. Planning Commission November Meeting Minutes: There was no Planning Commission meeting in November 2010. OLD BUSINESS Newsletter: Councilmember Artig-Swomley started on the January newsletter and is doing an article on Hillary Farms with diagrams and an article on the tree clearing on Goose Lake Road and Big Fax Road. Also doing an article on T.A. Schifsky's & Sons, Inc., explaining what is plowed first after a snowfall. The council received calls about who is plowed out first when there is a storm. Also an article on accomplishments in 2010, for the City of Gem Lake. PUBLIC HEARING Ordinance 121: Mayor Uzpen asked the council if there were any questions or comments regarding this ordinance, which covers the use of wind towers in Gem Lake. Public Hearing opened at 7:16 p.m. Gem Lake City Council Meeting Page 2 of 5 No comments from the public. Public Hearing closed at 7:18 p.m. Upon motion by Councilmember Lindner and seconded by Councilmember Bosak, to approve Ordinance 121. Ayes -- 4, Nays 1. NEW BUSINESS Resolution 2010-21 Fee Schedule: Mayor Uzpen explained that the council forgot to. add a non -sufficient fee of $30 if a check is returned. In addition, Sunday on -sale liquor license fee should be $200, as state law requires versus $500 that Gem Lake stated. Upon motion by Councilmember Artig-Swomley and seconded by Councilmember Rasmussen, Resolution 2010-21 passes. Ayes — 5, Nays — 0. Ordinance 121 - Wind Tower Summary: The council discussed the summary and upon .motion .by Councilmember Lindner and seconded by Councilmember Artig- Swomley, Wind Tower summary is approved. Ayes —.5, Nays — 0. Gem Lake Hill 2011 Liquor License: The council reviewed the packet that Mayor Uzpen sent out and upon motion by Councilmember Lindner and seconded by Councilmember Artig-Swomley, the liquor license for 2011 passes. Ayes — 5, Nays — 0. Country Lounge 2011 Liquor, Tobacco and Charitable License: The council reviewed the packet Mayor Uzpen sent out and upon motion by Councilmember Bosak and seconded by Councilmember Rasmussen, 2011 license passes. Ayes — 5, Nays — 0. Claims for December: The bills for December were discussed and authorized to pay. Mayor Uzpen discussed the November Mechanical bill regarding repairs to the heating system. Upon motion by Councilmember Artig-Swomley and seconded by Councilmember Lindner, motion passes. Ayes — 5, Nays — 0. Hillary Farms: A discussion with Justin Gese, from SEH, Tom Riedesel, from White Bear Township and the City Council regarding the Hillary Farms sub -division application. Tom is looking at the. PUD ordinance requirements. Justin will review the storm water design changes and the sewer design from the old plan. Will also look at the roadway modifications. Hillary Farms has a hammerhead (T-road) instead of a cul- de-sac on one of their roads. He will talk to the developer regarding this issue. Justin is. also reviewing the development as a whole and what changes need to be done to the development as planned. If approved, will amend new plan. The sewer is set up to run down Scheuneman Road. The sewer analysis is part of the new sewer analysis submitted and might need extensions. Hillary. Farms feels smaller lots will bring in affordable homes for the current market. City Attorney Trevor Oliver discussed the ordinance and if. approved by the City Council, this will be in effect for two years_ This will allow the sub- division to be built. The Public Hearing will be heard at the a Planning Cornmission meeting on Tuesday, January 4, 2011. Councilmember Rasmussen requested to have a time -line checklist. Attorney Oliver discussed the issues regarding the 60-day rule on rezoning and sub -division Plat primarily approval. The council can extend the 60-day rule if the time -line needs to be extended, Mayor Uzpen asked if the Planning Commission should be writing the rules with Mr. McNulty, Attorney Oliver said the Planning Commission is a place to start. Mr. McNulty wants to use a PUD. There are some problems with Gem Lake's R3 zoning. Some of the calculations are wrong and need to re -calculate. The calculation affects zone . R3 due to smaller acre lots. If amending that, the council needs to have a Public Hearing at the January City Council meeting. Attorney Oliver discussed the PUD rezoning using a Conditional Use Permit. Councilmember Lindner discussed the open space and wetlands being compromised by the PUD. Attorney Oliver recommends that Gem Lake take the time to look at and use as a Conditional Use Permit or rezoning. The staff for this project needs to be in place to work on rezoning and conditions of the sub -division. If rezoning to one -acre Lots, the more lots that are sold will be a increased tax base for the City of Gem Lake. The Planning Commission needs to have all information in order for the. January Planning Commission meeting for a logical review before forwarding to the City Council. This will affect the present and the future of Gem Lake, so it needs to be done right. Tom Riedesel from White Bear Township commented on the buildable area .of 75%. The definition seems to be stricter than what he has seen in other city plans.. Administrative Assistant Replacement: Councilmember Lindner asked the status on the open position. Mayor Uzpen has a meeting on January 11th regarding the open position. It has not been decided if the position will be part-time or full-time. OPEN ITEMS Mayor. Uzpen received a call from a resident that is :getting married in the summer and having a DJ play at the reception outdoors at their place. They had questions regarding the time limit and was wondering what the ordinance was for noise. The noise. ordinance does not state the noise level or time to be done. PRESENTATIONS FROM THE PUBLIC Councilmember Lindner asked Justin if there were any street or culvert improvements in 2011. There is some cracking on Big Fox Road and Tessier Road, so will look at those roads in the spring to evaluate.
