WHEREAS, the City of Gcm Lake pirovides services as well as d isseminatioh. of public information to all persons in accordance
with l.lniicd Statcs. State of Minnesota, County of Ramsey,. and City of Gcm Lake laws and .ordi.nances; and

the rates and fees set. forth in the "CITY OF GEM LAKE2001. FEE SCHEDULE" attaehed hereto for the -use of the City staff
in providing said services and information, said rates to -become effective retroactive ta:the first day of January 2001 and to be
reviewed annually thereafter unless .otherwise tVquiired,

residents,. and

(iw1GES) annually based upon it's costs of operation, and
"WHEREAS, current and future, mahitenanee.costs-afe the sespprisihility of the City of Gem Lake. and
WH>FREAS, funding of operatin- acid maintenance. costs is. derived from -local sewer user charges establishetiby*resoluiion of
the Gent Lake City Council.
NOW THEREFORE BE IT RESOLVED that the City. Council of the City.of Gent.Lake does hereby approve: the rates and

AGREEMENT
LAW ENFORCEMENT SERVICES
This is.an Agreement. between the County of Ramsey (hereinafter..referred to as the
"COUNTY"). and the City of Gem Lake (hereinafierrefeirred to as the:"MUNICIPALITY"),
to provide law enforcemcnt services to the MUNICIPALITY for -the period commencing
January 1, 2001.
WITNFSSETH:
WHEREAS, the COUNTY has a historical and legal -obligation �p provide police
Protection to the MUNICIPALITIES.
WHEREAS, the COUNTY has contracted to provide lawenforcement services to the
cities of Arden Hills, Gem Lake, Little Canada, North Oaks; Vadnais Heights, and White
Bear Township. (hereinafter referred to as the "MUNICIPALITI'ES"), and it would. be
advantageous, to the MUNICIPALITY to also contract with the COUNTY for similar law
enforcement services, thereby allowing for the. allocation of overhead and other
administrative costs over a larger population; and
WHEREAS., the parties to this Agreement intend to contract. with the COUNTY for
law enforcement functions within the political boundaries of the MUNICIPALITY through
th,e Itamsey County Sheriff and
WHEREAS; the:COLJNTYis agreeable to renderingsuch sexvices on;the terms.and
conditions hereinafter set forth; and.
WHEREAS, such contracts -are authorized and provided for. by. -the provisions .of
.vlinnesota Statutes Sections 471:59 and 436.05, and Laws 1959, Chaptei 372.
NOW, THEREFORE TN CONSIDERATION OF themutual �mdertakittgs set forth.
herein, the COUNTY and the M(JN.ICIPAI.;ITY agree.as follows:
I. SCOPE.OFSERVICES
l . The COUTiTYagrees, through the Ramsey County Sheriff's Department, to
provide law enforcement services to the MLJNICIPALLTY whi6b -wih
iinolude, but not be fitnited to, the following:
A, Patrol services. with randora patrolling of residential areas,
businesses,. parks; And other public prdperty areas.;.
13. Enforcement of Minnesota. State Statutesand the ordinances of the
MUNICIPALITY.
C 'Traffic Enforcement incfudii* the regular use. of radar or laser as a
speed deterrent;
D. Crime Prevention Programs such as neighborhood watch; as well as
other business. and residential crime prevention programs;
E. Criminal investigative and criineslab-services;
F. Vol low -up on reported crimes with persons who reported the crime
including routine notification by telephone:or mail. as to the status of
the investigation;
G. Responses to medical, fire,. and other emergencies;
11. Dispatching and other necessary communication services;
1. Coordination of Volunteer Program such as the: Community Affairs
Officer and. Reserve Programs;
J.*. Ddver's license inspections, background .checks -arid license
ehRircement services as called for. under applicable statd law and
ordinances of the MUNICIPALITY;
K. .special event traffic patrol -and patrol services for community
*festivals or pthi r special events; and
L. Attendanee*at Public Safety or City Council meetings as requested by
the MUNICIPALITY.
?. The COUNTY and MUNICIPALITY may prepatt* Plan of Service which
veil] . be. reviewed -annually and agreed upon by the COUNTY and
MUNICIPALITY.
3. The manner and standards of performance, the discipline of officers, and
.other matters incident .to the provision of services under this Agreement, and
.tlie bontrol of personnel. so employed; shall. be stibjebt-solely to the control of
the COUNTY; In the event of a dispute between the -parties as. to the extezit
of the duties and functions to be rendered hereunder, or the level Or manner
ofperformance of such service, the determinatign. thereofma le by -the Sheriff

4. In the event the MUNICIPALITY; through its elected body or authox-ized
agent, notifies the COUNTY that -it is dissatisfied with the aissignmeht of
personnel. for the perforinancc ofservices under this Agreement and requests
.a change in personnel, the COUNTY shall make every effort to effect a
change imthe assignment of personnel, provided that such. a. change does not
jeopardize the --ability of the COUNTY to provide services to other areas of
Ramsey County ilea tiiuely and efficient manner.
.5: The COUNTY' S contractual obligations under this Agreement- ao not lessen
the COUNTY'S obligation to. provide patrol and police proteciion.seryiees
to Bellaire.'Beach, area lakes, Ramsey Couti y- open space areas:, and regional
-park areas owned or operated by Ramsey County mid all other areas under
COUNTY jurisdiction located within* the political *boundaries of ' the
MUNICIPALITY. The COUNTY'S contractual obligations under this.

Agreement shall. also recognize the underlying; historical obligations that
Ramsey County has to provide police protection to the MUNICIPALITY.
G. Services shall be provided 24 h drs.per day. and shall be performed by the
number of deputies :and other personnel budgeted for in the COU'NTY'S
current year Budget Estimate, attaghed hereto as Exhibit A and.made a part
dF this .Agreeiilent,
7. To facilitate the COUNTY'S.performance pursuant to this Agrement, the
MUNICIPALITY agrees that the COUNTY shall have full cooperation and
'assittance from the MM. CIPALITY, its officers, agents and. employee$.
The MUNICIPALITY shall. designate. a liaison to the Ramsey County
Sheriffs Department. The liaison shall attend meetings of the Sheriff's:
Contract Communities Committee and shall represent their respective
MUNICIPALITY *attbeir meetings. The purpose of these: meetings is to.
develop short-term and long range plans and to coordinate and analyze police
service and other related public service issues. The Sheriffs Contract
Communities Committee shall. also review any disputes which arise between
the MUNICIPALITIES and/or. Sheriff's Department and recommend a
resolution.
The COUNTY shall furnish and supply all necessary labor; supervision,
equipment, communication facilities and dispatching„ and supplies necessary
to -provide services pursuant to. *this Agreement.
9. All deputy sheriffs; clerks, dispatchers, and all other COUNTY personnel
performing duties pursuant to tWs Agreement shall at -all -times beconsidered
ernployees.of the COUNTY f6r all purposes.
10. The name:ofeach of the MUNICIPALITIES. that contract with. the Sheri Ws
Department for law enforcement sei°ices shall be affixed to all squad cars
and other major pieces of equipment. used* primarily Within these
MUNICIPALITIES.
IL ASSUMPTION OF LIABIL.ITIES/INSURANCE
Except as otherwise provided,. the MUNICIPALITY shall not be called upon
to assume any liability for the direct payment of any salaries, wages, or either
compensation taany.OUIvTYpersonnelperforming services hereunder f'or
said MUTIICIPAI.ITY, and the COUNTY hereby assumes. said liabilities.
2. Except as. -herein othenuise specified, the MUNICIPALITY shall not be liable
for compensation: or. -itidemnity to any COUNTY employee for injuly. or
sickness arising"out of this eimployment, and the COUNTY hereby agrees to
hold harmless the MUNICIPALITY against any such claim.
:i.. The MUNICIPALITY, .its officers, and employees, shall- -not be deemed to
assume any. liability for.the intentional or negligent acts of the COUNTY or
the C01)NTY'S employees-peifbrining services.pursuantto this Agreement,
and the COUNTY shall hold the MUNICIPALITY, its officers, and
cinployecs harmless from and shall defend and. indemnify the
MUNICIPALITY, its officers, and employees against any claim for damages
arising put -of the COUNTY'.$ performance of this Agreement..
4. The COUNTY,.its*officers, and-eniployees shall nat be deemed to assume
any liability t'or intentional or negligent acts of the MUNICIPALITY or of
anv ether officers, agentgr employee thereof, -and the MUNICIPALITY shall
Bold .the COUNTY and its officers W employees harmless. from and shall
defend and indemnify the COUNTY -and its-offtcers and employees .against
any claim for damages arising out of the MUNICIPALITY'S performance of
this Agreement.
5. Ramsey County agrees to. maintain, during the term of this Agreement,
automobile -general liability, workers' compensation, and professional
liability insurance. in amounts deemed appropriate. by :Ramsey County
through its Risk. Manager. Ramsey County shall dame the MUNICIPALITY
as an additiopal insured on these policies oxcept :.for the workers'
compensation policy. The 1VL.UNICIPALI'1'Y agrees. to pay, as a part of the
actual cost as provided in Section IV below; a pro rasa share of the
COUNTY'S insurance costs. These costs shall include the costs for.:any
assessments and credits. for any dividends by participating in any insurance
poo is or trusts. Ramsey, County may. elect to self -insure -all or -any portion. of
these risks. If Ramsey County cannot obtain insurance and/oi.elects to self -
insure, the MUNICIPALITY shall pay a pro. rata share of the costs ofself
insurance, based on each MUNICIPALITY'S share of the approved annual
budget. Insurance costs as they* relate.. to. insurancecoverage shall include*
premiums -and deductibles. Costs of self-insurance shall.include reserves,
claims and damage.payments; and administration costs required to mahAain
self-insurance.
6. The MUNICIPALITY acknowledges that Ramsey County may, in an effort
to provide the best insurance coverage at the roost economical cost,.become
a member. :of -the Minnesota Counties Insurance* Trust or some similar
organization: and the MUNICIPALITY further acknowledges. that
mernbership in such -an organization rriay be.for a fixed minimum term and
may expose Ramsey County to some type of contingent cost .liability; such
as debts, obligations- and liabilities,. in the event: that Ramsey County
withdraws its 'membership: The. MUNICIPALITY agrees to reimburse
Ramsey County for the "ICIPALITY'S pro rata share of any such.
.contingent cost liability arising during the: term of this. Law Enforcement

Service Contractand assessed against Ramsey County. Upon notificatian to
Ramsey County of any such contingent cost *liability, Ramsey County will
notify the MUNICIPALITY. in a timely Manner.
.111. TE9M OF AGREEMENTITERMINATION
This agreement shall commence - Japuary L 2001 and shall be in effect
through Deee nher 31, 2003.
2. Either party may terminate this Agreement *by. notifying the COU`NtY and
other MUNICIPALITIES in writing oftheir intentto terminate the agreement
9 .calendar months prior to the end of the calendar year.
3. Notice to the COUNTY shall be given to the County -Manager and Ramsey
Cotinty Sheriff, and NotiEe*to the MUNICIPALITY shall .�e. giver. to the
M'UNICIPALITY'S City Manager.
W, PAYMENT
The MUNICIPALITY agrees to pay the COUNTY the actual cost. of
providing all services cowered by this -Agreement. Actual cost:shall mean. -the
MUNICIPALITY rata share of the COUNTY'S total costof providing
patrol and police protection services to. the MUNICIPALITIES with which
the COUNTY has agreements for the currerit contractyear, including, but not
limited to the-foilt)wing: salaries of'ehiployees engaged in performing said
services, including vacation. and sick Ieave mileage, uniforms; public
employees rethement contributions; workers' compensation, automobile,
general liability and police.prMfesaional liability insurance costs or the -cost
of self-insurance; general overhead, includirig'indirect expenses and supplies,
radio. unit expense, and health and welfare expense. Costs as used herein
shall nat include items of expense attributable to services or facilities
normally provided or available. to all cities within the COUNTY 0s pant ofthe
COUNIrY'S obligation to enforce state law. Computation of actual costs
hereunder shall be •made by the Ramsey County Budgeting. & Accounting
Division based on- informaiion* provided :by -[he Sheriff.
2: The COUNTY shall azulually.submit a Budget Estimate using the District
Plait format for -the following year of services to the MUNICIPALITY no
later than August 1 of the current year. Such Budget Estimate shall, upon
issuance, be incorporated into:and-made apart ofthis agreement by reference;
Said Budget Estimate wilt be for the -limited purpose of better enabling the
MUNICIPALITY to estimate its annual budget and tax levy. It is understood
by the parties to this Agreement that said Budget Estimate shall in no way
prevent the COUNTY from charging its actual costs. The MUNICIPALITY
must annually indicate its acceptance of the upcoming year Budget Estimate
in writing prior to December 31 of the current -year.
s. If the MI.JI�TICIPALITY does not indicate its. acceptance of the Budget
Estimate. the Mi.JNICIPALIT `andtthe COUN'1. Y must meet by January- l]
of the budget year in gtie[ion 'to review and reach agreement an
rmodi.fications to service ieveis provided by the COUNTY that. are consistent
with the MUNICIPALITY'S budget and that recognize. -.the impact.of these
service level changes to outer MUNICIPALITIES that contract with the
COUNTY for tl%se services.
4. The COUNTY shall bill the MUNICIPALITY on a monthly basic in an
amount equal to one -twelfth. (1112) of the Budget Estimate. for services to tile
MUNICIPALITY. The.MUNICIFALITY shall pay.the COUNTY within 45
days: of receipt of the monthly statement. At the close of the contract year,
the COUNTY -will reconcile the current year Budget Estimate and current
year actual.costs and shall either give a credit to the MUNICIPALITY or.bill
the MUNICIPALITY for additional costs in excess of the -Budget Estimate.
V. GENERAL PROVISIONS
i. .It is understood that prosecutions for violations df` ordinances or Aiite-
statutes, together with disposition ofall fines collected pursuant thereto; shall
be hi -accordance with state statutes; state rules, and judicial orders.
2. The Ramsey County Sheriff's Office shall submit to the MUNiCIPALITY
.quarterly activity reports detafling the.activjties of the:Sheriff-s-office under
this agreement within the MUNICIPALITY. Said reports shall contain,.at a
minimum, the number ofcalls answered and.the numberbfcitatioris.issued.
However, no information vAll be provided which would violate the State'
Data Practices Act.
3. The MUNICIPALITY may contract with the COUNTY fair additional law
enforcement scrvices-above and beyond those provided.in this agreement.
4: Any alterations; variations, modificationq, qy waivers of *provisions of fhis
Agreement shall only be valid when they have been reduced to writing,
signed by authorized representatives of 'the COUNTY and the
MUNICII?ALITY-and attached to the original of this Agreement.
