Meeting Minutes
Mayor Gretchen Artig-Swomley called the meeting to order at 7:00 p.m. Councilmembers Jim Lindner, Len
Cacioppo, Ben Johnson, and Joshua Patrick were present. Also present: City Attorney Martin Norder, City Treasurer
Tom Kelly, Acting City Clerk Melissa Lawrence, Gem Lake business owner Max Vannelli, The Lakes Dispensary,
and residents Daniel Epelboim, Tom Bolfing, and Jim Wilson.

All items on the consent agenda were reviewed by the Council. Councilmember Lindner introduced a
motion to approve all the items listed on the consent agenda, seconded by Councilmember Cacioppo.
Motion carried 5-0.
Committee Reports
Planning Commission Chair Don Cummings was unable to attend the meeting but sent the mayor a summary of
what happened at the planning commission meeting. The Planning Commission is recommending an update to the
Consolidated Land Use Ordinance No. 131 and Appendix A. The updates are the result of excellent staff work by
TKDA, led by CJ Sycks, and thorough, successive discussions over spring and summer Planning Commission
meetings and a Public Hearing. The Commission will be addressing the "Gateway District" portion of the Land Use
Ordinance separately in meetings ahead and in conjunction with beginning work on the next round of
Comprehensive Plan work. The Planning Commission would also like to strongly endorse the appointment of Daniel
Epelboim to the Gem Lake Planning Commission. Mr. Epelboim brings a strong interest in our city's future, a
thoughtful style of engagement, and executive level experience in large organizations. He has attended many City
Council meetings and most recently Planning Commission meetings related to the Land Use Ordinance. Chair
Cummings also wanted to make sure that the city was addressing the recent attempted fraud incident that happened
after the last Planning Commission meeting.

The August edition of the Newsletter has been printed and mailed. Acting City Clerk Melissa Lawrence has
been working on putting stories into the next edition of the Newsletter to get it started.

Code Enforcement Issues Discussion
All code enforcement issues have been resolved at the moment for the one property located along
Scheuneman Road.
Potential Water System Planning along Labore Road/Goose Lake Road
At the July City Council meeting the Council approved SEH to begin the planning phase of the project.
Obtaining soil borings is the first step that SEH is taking. The more shovel ready the city is with the project
the better opportunity the city has at receiving funding and start the next phase of planning and public
hearing.
New Business
1599 County Road E East – Conditional Use Permit for a Wall Mounted Illuminated Sign
The applicant is requesting a conditional use permit (CUP) for 1599 County Road E East to erect an
illuminated sign on the wall of The Lakes Dispensary. Roger Vannelli is the applicant and owner of the
business. The sign is proposed to be 24 feet long by 5 feet tall with the text “The Lakes Dispensary” and a
logo on the left-hand side of the text. The lighting is to be illuminated internally by LED tubing.
Signage is regulated by Ordinance 131, Consolidated Land Use Ordinance Section 19. Sign permits are
required and are typically issued administratively. Section 19.5.2.4 outlines the standards for Illuminated
signs and states, “Application for approval of lighting or electronic features shall be made in the manner of
a conditional use permit, using the procedure stated at Section 17.5 of this Ordinance.”
Section 17.5 outlines the procedures for Conditional Use Permits. Conditional use permits are reviewed by
staff, reviewed by the Planning commission at a Public Hearing, and forwarded to the City Council with a
recommendation for action.
1599 County Road E East is located in the Neighborhood Center Sub-Zone of the Gateway District. The
property is located at the intersection of Scheuneman Road and County Road E East. The building also
includes Al’s Gun Shop. Ryan Podewils Properties LLC owns the property. The parcel is 0.52 acres in size
and addressed 1601 County Road E East County GIS, however the southern building is considered 1599
Country Road E East.
The Planning Commission reviewed the request during a public hearing on 8/12/25. The Commission
discussed the impact of “soft, low lumen, LED lamps" on the surrounding areas and evaluated the criteria.
The Planning Commission recommends approval of the requested Conditional Use Permit Amendment for
1599 County Road E East, with the following conditions:
1. The Applicant is permitted to install an illuminated sign in the size and to the dimensions
proposed, consistent with the plans received by the City on July 22, 2025, and reviewed with this
request.
2. The Applicant shall obtain all necessary local permits prior to construction, including but not
limited to building, electrical, and sign.
3. The Applicant shall adhere to all other applicable local, state, and federal requirements.
4. The Applicant shall pay all fees and escrows associated with this request.
Resolution #2025-023 Approving CUP for The Lakes Dispensary
Councilmember Lindner introduced a motion to approve the resolution #2025-023 with the
conditions listed above, seconded by Councilmember Cacioppo. Motion carried 5-0.
Ordinance No. 131 – Sections 5-10, 16 Amendments and Appendix A Definitions Update
The Planning Commission and City Planner reviewed the City’s zoning ordinance, referred to as the
Consolidated Land Use Ordinance No. 131.
Updating Ordinance No. 131 will increase zoning and permitting clarity among residents of Gem Lake.
Amending the existing language and formatting will enhance the ease of use of the ordinance.

The Commission began discussing proposed updates and providing staff guidance on further improvements
to the Ordinance and its appendix of definitions in June 2025. At a public hearing on August 12, 2025, the
Planning Commission discussed the Ordinance updates for a third time and recommend adoption of the
proposed Ordinance.
Ordinance No. 131 was enacted in 2017, replacing Ordinance No. 43K (Zoning Ordinance). There are 30
Sections within Ord. No. 131. The definitions are found in Appendix A. The first four sections of
Ordinance No. 131 provide a background to the purpose of the document and the related rules. Maps are
provided to visualize each zoning district. Each zoning district is described in individual sections (section 5
through section 10), including the district purpose, permitted uses, and lot regulations. Concerns with the
current ordinance include inconsistent formatting, combining conditional and interim uses, frequent back
referencing, and unclearness.
Amendments were made to provide clarity on permitting within each zoning district. This includes updated
formatting, language, and division of sections, as well as the minor changes of writing conventions. To
better understand the progress of these revisions since June 2025, please review the Planning Commission
meeting minutes and packets.
The restructuring of Sections 5, 6, 7, and 8 and clarification on Conditional vs Interim Uses was addressed.
The changes can be found in the City Council Packet located on the city’s website or at Heritage Hall upon
request. Appendix A included some additions to relevant definitions.
This proposed update to Ordinance No. 131 focuses on enhancing clarity surrounding the permitted,
accessory, conditional, and interim uses in each residential district. Additional changes proposed go hand-
in-hand with this focus, such as structure setbacks.
Staff recommends that additional desired Ordinance No. 131 updates be done concurrently with the
upcoming Imagine 2050 Comprehensive Planning process. Updating the Comprehensive Plan and
Ordinance 131 at the same time will ensure consistency between the two documents and ensure the City’s
mission and goals are being accurately and effectively carried out. If additional and substantial changes to
Ordinance 131 are desired, Staff will begin making note of those sections.
The Metropolitan Council adopted the Imagine 2050 regional development guide. The City of Gem Lake
will need to begin their comprehensive planning process at the start of the new year. A comprehensive plan
update often requires updating the zoning ordinance to reflect any changes in future land use designations,
allowable uses, etc.
Councilmember Lindner introduced a motion to approve the amendments to Ordinance No. 131 and
Appendix A updates, seconded by Councilmember Cacioppo. Motion carried 5-0.
VLAWMO Joint Powers Agreement (JPA) for City Council Consideration
A memo from VLAWMO Administrator, Phil Belfiori, summarized how VLAWMO is working to update
its Joint Powers Agreement (JPA) in conjunction with its work to develop the 2027-2036 Watershed
Management Plan. The current JPA was adopted in 2016 and will expire on December 31, 2026. While the
current JPA will not expire until next year, VLAWMO determined the concurrent review and update of the
JPA, and the Watershed Management Plan is the most efficient and will help ensure the documents are
properly aligned.
VLAWMO staff would respectfully request City Council consideration and action on the JPA by Friday,
September 26, 2025, if possible. This timing would allow for best “fit” and alignment with the anticipated
timing with the upcoming VLAWMO Board consideration of the next version of the VLAWMO
Watershed Management Plan later this Fall /Early Winter.

Resolution #2025-024 Approving a Joint Powers Agreement (JPA) for the Continued
Operation of the Vadnais Lakes Area Water Management Organization (VLAWMO)
Councilmember Lindner introduced a motion to approve resolution #2025-024, seconded by
Councilmember Cacioppo. Motion carried 5-0.
City Clerk Position
Mayor Artig-Swomley shared with the Council and those in attendance an overview of the hiring process
for the new City Clerk. There were 18 applicants, with 4 withdrawing their application for various reasons.
9 of those applicants were given a Microsoft Teams interview by the mayor and current Acting City Clerk,
and of those 9 applicants, 4 moved on to the in-person interviews conducted by the mayor, current Acting
City Clerk, and City Treasurer, Tom Kelly. The mayor discussed with each Councilmember individually
before the meeting on who to offer the position to.
Councilmember Lindner introduced a motion to hire the applicant suggested by Mayor Artig-Swomley,
seconded by Councilmember Cacioppo. Motion carried 5-0.
Gem Lake Trail Policy
The purpose of the Gem Lake Trail policy is to establish consistent guidelines for the use and maintenance
of the public trail. The guidelines were established by City Staff and White Bear Township Public Works
recommendations. The policy and procedures related to such use and maintenance are contained in the
following statement:
The City of Gem Lake intends to create an inviting environment for all Gem Lake residents and non-
residents that come to use the public trail. The city has a responsibility to maintain the trail as it sees fit to
encourage use and maintain public health and safety.
Councilmember Lindner introduced a motion to adopt the Gem Lake Trail Policy, seconded by
Councilmember Cacioppo. Motion carried 5-0.
Cancellation of September Planning Commission Meeting
Mayor Artig-Swomley shared that the planning commission would like to cancel their September meeting
and pick back up in October on the first Tuesday of each month. Mayor Artig-Swomley agreed that it
would be ok to cancel the September meeting if nothing comes up.
Application for Planning Commission and Approval of Alternate
Mayor Artig-Swomley again summarized the planning commissions endorsement of Daniel Epelboim to
the Planning Commission. This applicant will replace the member that was appointed at the February City
Council meeting but failed to make an appearance at all the meetings that took place in 2025.
Councilmember Lindner introduced a motion to appoint the addition of Daniel Epelboim to the Planning
Commission beginning with the October 7, 2025, meeting, seconded by Councilmember Cacioppo. Motion
carried 5-0.
Future Charitable Gambling Donations
White Bear Lake Emergency Food Shelf
Mayor Artig-Swomley suggested that the Council make a donation in September in the amount of
$1,500.00 to the White Bear Lake Emergency Food Shelf. Councilmember Lindner introduced a
motion to request a donation in the amount of $1500.00 for the White Bear Lake Emergency Food
Shelf, seconded by Councilmember Cacioppo. Motion carried 5-0.
Community Outreach to Other Cities and Government Bodies
Mayor Artig-Swomley shared that the recent meeting with the City of Vadnais Heights went well. A compromise is
being worked out regarding the rate at the Villas of Gem Lake and the new unit being built along Labore Road is a
chance to work with Vadnais Heights and bring water down Labore Road. More information will be forthcoming.

Resident Tom Bolfing brought up the recent power outages in Gem Lake and the correlation between the trees along
the easements that need to be trimmed to help prevent future power outages.

RE: 2026 Preliminary Property Tax Levy.
State Statutes require Cities to certify their preliminary property tax levies by September 30th this
year. Once the preliminary property tax levy is approved and certified to the County Auditor, the
City can lower the levy during the remaining budget process but cannot exceed the certified
preliminary levy. For this reason, most Cities certify a preliminary levy using worst-case budget
scenarios, which is the case with the City’s 2026 preliminary property levy and budget.
The 2026 preliminary property tax levy is proposed at $768,005, which is a 4.667% increase
from the 2025 certified preliminary property tax levy. The 2026 preliminary property tax levy
consists of a debt levy of $85,778 (an increase from 2025 preliminary debt levy of $2,042) and
the general operating levy of $682,227 (an increase of 4.955% from the 2025 preliminary tax
levy).
The following changes were made from the 2025 adopted budget as a basis for the 2026
proposed preliminary property tax levy:
1. Based on the 2015 Refunding Bond schedule the debt levy for 2026 is set for $77,763. In
addition, in 2018, the City issued bonds for the improvements on Scheuneman Road and
the 2026 debt levy for this issue is $8,015. These two debt levies make up the City’s
2026 debt levy of $85,778.
2. City Council contingency was increased to $15,000 (was $9,000).
3. Clerk/General Government budget includes $55,000.00 for wages and $9,900 for health
insurance coverage.
4. Planning & Zoning budget increased $15,000.00 based on past expenditures.
5. Police budget increased 4.16% to $153,537 based on the City of White Bear Lake budget
provided to us and includes $139,470 for police services and $14,067 for debt payments
on the new public facilities building.
6. The cost of fire services increased 1.22% to $53,474.00. It includes $35,196 for fire
services, $9,087 for fire marshal services, and $9,191 for depreciation on the new public
facilities building.
a. Overall, the City of White Bear Lake would like you to pay $23,258 for the next
20 years for their new facility.
7. Road Maintenance budget includes $20,000 for road maintenance/repair and $8,000 for
trimming boulevard trees.
8. Salt/sand increased $1,500 to $25,000 and snow plowing and sanding based on past
expenditures.
9. Heritage Hall budget includes $20,000 for building improvements and $10,000 for other
equipment/improvements.
10. Included a park maintenance budget of $10,000 for maintaining the park area of the
Villas of Gem Lake.
11. The 2025 budget includes $20,000.00 for future improvements.
12. Other revenue and other expenditure line items adjusted based on past history.
These changes result in the city proposed preliminary tax levy of $768,005 for 2026. This
compares to 2025 preliminary levy of $733,757 and 2025 final levy of $718,736. Using a 2026
property tax levy of $768,005 and the City’s 2026 estimated tax capacity ($1,884,274) and
median valued home ($460,750) for Gem Lake, that median valued home, would pay City
property taxes of $1,806.40 in 2026 compared to 2025 preliminary levy of $1,725.55 (an
increase of $80.85) and the 2025 final levy amount of $1,680.37 (an increase of $126.03).
Again, as the City prepares its final 2026 budget the property tax levy can be lowered from the
preliminary levy but not increased above the preliminary levy.
The action requested tonight is for the City Council to adopt the resolution adopting the 2026
preliminary property tax levy of $768,005.

WHEREAS, the City Treasurer has presented a (Proposed) General Fund Budget of
$755,032.00 which includes a (Proposed) General Tax Levy of $682,227.00 and a Debt Tax
Levy of $85,778.00 for fiscal and calendar year 2026 based upon best estimates of costs for
running the City of Gem Lake in 2026; and
NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of Gem Lake does
formally adopt the 2026 Preliminary Tax Levy as follows

BE IT FURTHER RESOLVED that the City Clerk is charged with Certifying said Tax and

WHEREAS, the City of Gem Lake distributes these funds to local 501(c)(3) tax-exempt
organizations
WHEREAS, the City of Gem Lake City Council suggested a donation at their August 19, 2025,
meeting in support of the White Bear Lake Area Food Shelf.
NOW, THEREFORE BE IT RESOLVED, by the City of Gem Lake, Minnesota, the City
Treasurer is authorized to send $1,500.00 to support the White Bear Lake Area Food Shelf for
the month of September 2025.

We are pleased to present the Municipal Water Extension Feasibility Report for the City of Gem Lake.
This study evaluates the proposed extension of the water main from the City of Vadnais Heights.
Previous feasibility studies, completed in 2006 and 2022, examined the potential for a centralized water
distribution system within Gem Lake to provide a safe and reliable water supply for all residents and
businesses.
In addition to centralized service, the earlier studies explored smaller, localized water supply projects that
could be phased in to address areas with known well water quality concerns. These localized systems
would connect to the nearest surrounding community’s distribution network, helping to minimize both cost
and complexity.
This report builds on those efforts by specifically assessing the extension of the Vadnais Heights water
main at the Labore Road connection, previously identified as Priority 1, Option 1. Since Gem Lake does
not plan to develop its own water source, the City must rely on neighboring communities to supply water
to its distribution system.
While earlier studies focused on evaluating water demand, quality, and the capacity of nearby community
systems, this report is intended to advance the project through potential grant funding and by initiating the
429 process to assess the benefiting properties for the proposed water main.

Executive Summary
The City of Gem Lake ordered this feasibility study to evaluate extending municipal water service to
properties along Goose Lake Road, Tessier Road, Haven Lane, Big Fox Road, and Little Fox Lane in
response to recent well testing that detected 1,4-dioxane, a likely human carcinogen, above health-
based guidance levels. (see figure ES-1 below) Most residents currently rely on private wells, with
limited municipal service provided through earlier connections to Vadnais Heights and White Bear
Lake. This study identifies extending a 12-inch water main from Vadnais Heights along Labore Road,
with connections at Little Fox Lane and Goose Lake Road and supporting 6-inch mains to local
streets, as the most cost-effective and feasible option. Vadnais Heights has adequate supply capacity
and delivers safe, treated water that meets all standards, while looping options to the Gem Lake
Villas water main should also be considered to improve system redundancy. The improvements will
provide residents with potable water, reliable pressures, and fire protection capacity, with construction
anticipated to remain largely within existing rights-of-way. Project costs are proposed to be funded
through special assessments to benefiting properties, City contributions, and grant funding, with an
independent appraisal confirming assessable benefit values. If approved, the City Council can
proceed under Minnesota Statute 429, beginning with an Improvement Hearing in fall 2025, with
bidding in early 2026 and construction scheduled for April through July 2026. The study concludes
that the improvements are necessary, feasible, and cost-effective, and recommends that the Council
accept the report, hold the Improvement Hearing, and move forward with design, bidding, and
construction.

Prepared for City of Gem Lake, Minnesota
1 Background
This feasibility report outlines a plan to provide municipal drinking water to Gem Lake properties
located along Goose Lake Road, Tessier Road, Haven Lane, Big Fox Road, and Little Fox Lane.
The report was authorized by the City Council at their regular meeting on Tuesday, June 17,
2025.
Short Elliott Hendrickson Inc. (SEH®) prepared a Municipal Water Supply Feasibility Study in
2006 and again in 2022 for the City of Gem Lake. That study reviewed options to provide a
municipal water supply system throughout the entire city of Gem Lake.
Recently the Minnesota Pollution Control Agency (MPCA) and Minnesota Department of Health
(MDH) completed sampling for 1,4-dioxane, a likely known human carcinogen, in private wells in
Gem Lake. Results of the sampling showed levels above the MDH health-based guidance value
for 1,4-dioxane in some of the private wells in Gem lake.
The proposed improvements include extending a water system from the City of Vadnais Heights
along Labore Road, which was previously described as Priority 1 option 1 in the latest 2022
Feasibility Study.
2 Existing Conditions
Currently, most residents and businesses in Gem Lake rely on private wells for their water
supply. Exceptions include AutoNation, the White Bear Montessori School, and the Villas off
County Rd E which receive water from Vadnais Heights, as well as properties served by the 2016
water main extension along Scheuneman Road, supplied by White Bear Lake.
The proposed project area includes Labore Road, a rural county roadway, along with several
local rural streets primarily centered within the existing right-of-way. Portions of these streets
pass through wooded areas adjacent to the roadway.
3 Proposed Improvements
The 2022 study recommended connecting to the City of Vadnais Heights for several reasons.
Vadnais Heights is currently working with a developer to extend a 12-inch water main within the
ditch along the west side of Labore Road up to Little Fox Lane, providing a convenient
connection point for the proposed extension. Installing the water main within the ditch will also
help minimize impacts to Labore Road, a county roadway that was resurfaced only a few years
ago.

Vadnais Heights has the capacity to meet Gem Lake’s projected water demands and provides a
water supply that meets all applicable State, Federal, and Minnesota Department of Health
standards. Water quality data was reviewed using the City’s Consumer Confidence Reports
(CCRs), which are annual drinking water quality reports required by the U.S. Environmental
Protection Agency.
Vadnais Heights draws its water from three deep wells, 470–495 feet, tapping the Prairie Du
Chien–Jordan and Jordan aquifers, with an additional well available for emergency use. The
water is treated with chlorine for disinfection, fluoride for fluoridation, and polyphosphate to
control iron and manganese, helping to maintain taste and appearance. The water is not softened
and has a hardness of 12 grains per gallon, which is considered hard.
3.1 Little Fox Lane Connection
The proposed Little Fox Lane connection will be installed within the western ditch of Labore
Road, consisting of a 12-inch ductile iron water main. From there, an 8-inch main will extend
across Labore Road to a water meter and manhole, which will be used to monitor usage.
Continuing from the meter and manhole, the main will run along the north side of Little Fox Lane
to minimize impacts at the Little Fox Lane/Big Fox Road intersection. It will then cross Little Fox
Lane, proceed north along the west side of Big Fox Road, and terminate just north of the existing
cul-de-sac. The proposed watermain will be installed at a depth of 7.5’ deep and installed
approximately 4’ from the edge of the bituminous pavement to again minimize roadway impacts.
3.2 Goose Lake Road Connection
The proposed Goose Lake Road connection will be installed within the southern ditch of Goose
Lake Road, the water will extend from the same Labore Road future water main extension from
The City of Vadnais Heights. The Goose Lake Road extension will consist of a 12-inch HDPE
water main which also will be metered through a water meter and manhole. The 12- inch HDPE
will extend to the east approximately 3200’. Several 6” lines will serve isolated streets along the
route. The first tee to 6” main will be located at the Tessier Road intersection that will run along
the east side of the roadway to its terminus at the end of the cul-de-sac. The second tee will be
installed at the Haven Lane intersection and will extend down the east side of haven Lane to the
end of the cul-de-sac. To again minimize impacts, the proposed watermain will be installed at a
depth of 7.5’ deep and installed approximately 4’ from the edge of the bituminous pavement.
3.3 Connection to the Vadnais Heights System
The City of Vadnais Heights has been in contact with the City of Gem Lake regarding both
connections along Labore Rd. Based on the preliminary demand projections, they have the
supply and storage capacity to serve the Gem Lake water system. With the current connection at
the Gem Lake Villas, the City has experience with billing and any maintenance requirements.
The hydraulic analysis and computer modeling performed as part of the 2022 report indicated
that connection to the Vadnais Heights water system would produce adequate pressures and
flow rates in Gem Lake. The lowest household pressure seen was 35 PSI however most of the
homes were in the 60 PSI to 70 PSI range. If the pressure is too low in one of the households, a
booster pump can be installed when the home decides to connect to the system. This is within
the acceptable range for a water distribution system.

Vadnais Heights billing rates are established in the municipal ordinance related to the water
system (Chapter 36, Article II, Division 3) and are shown below from the 2025 Water Fee
Schedule. For larger connections, fees are noted in the ordinance to be determined by the City
Engineer based on the costs for installing the service. The connection fees noted below are
approximate and were calculated with a 2% inflation factor from the 2018 Gem Lake Villas
Agreement.

Gem Lake would need to pay Vadnais Heights for water used. As property owners connect to the
new Gem Lake Water System they would be responsible for obtaining a plumbing permit along
with the costs associated with disconnection or abandoning their well. The resident will also be
responsible for connecting their current plumbing to the new municipal main line in the right of
way.

3.4 Additional Connection Options\Looping
The City’s primary goal in extending the watermain is to provide safe drinking water to residents
along the project corridor. However, both proposed extensions would terminate as dead ends, so
the City should also evaluate opportunities to loop the system. The previous report identified
potential connections to the Gem Lake Villas water main system (Vadnais Heights Service). The
water main would extend south from Goose Lake Road, continuing between the parcels to
connect midway at the end of the unimproved right-of-way east of Little Fox Lane. From there,
the watermain would extend to the northwest corner of the Villas development, creating a looped
system. A reference figure is provided below with the suggested loop shown as the pink dashed
line.
4 Right of Way and Easements
The construction of the proposed improvements in this report are anticipated to fall within existing
right of way of the project roads. If the system is extended and looped in the future to the Villas
Development, the City would have to acquire easements to those connections.

5 Cost Recovery
5.1 Benefits and Assessments
The City intends to levy special assessments to the benefiting properties in accordance with
Minnesota Statute 429. This state law allows the City to assess adjacent properties for the costs
associated with the project improvements.
In addition to special assessments, the City will be utilizing a Grant to fund the remainder of the
project.
Following the 429 Statute, once the feasibility report is received by the City Council, a Public
Improvement Hearing will need to be ordered and held. Within six months of the Public
Improvement Hearing, a Council vote to adopt a resolution ordering the improvement will need to
be taken or another hearing will need to be held. “Ordering” the improvement means authorizing
the preparation of the plans and specifications and moving ahead towards bidding and
construction.
5.2 Special Benefit Analysis

7 Conclusions and Recommendations
7.1 Conclusion
From the results of our study, we conclude that:
• The proposed improvements are necessary to provide the City with potable water and
flows capable of fire protection for the neighborhoods.
• Given the City’s desire to connect to Vadnais Heights’ water system and the location of
the properties requesting municipal water. The proposed improvements are feasible and
cost effective compared to other options.
• The City should consider a second connection to the Vadnais Heights System with
Vadnais Heights in the near future to limit the time this portion of the City would be on a
dead-end-main.
• The project cost of $XX,XXX would be assessable.
7.2 Recommendation
• The City Council accepts this report and schedules the improvement hearing to receive
public comment on the project should the Council decide to proceed with the
improvements.
• The improvements proceed as outlined in this report.
• A portion of the costs for these improvements will be recovered from benefiting properties
through special assessments, City contribution, and Grant funding. The ability to assess
the amounts proposed should be verified.

Gem Lake Trail Policy
Purpose
The purpose of the Gem Lake Trail policy is to establish consistent guidelines for the use and
maintenance of the public trail. The guidelines were established by City Staff and White Bear
Township Public Works recommendations. The policy and procedures related to such use and
maintenance are contained in the following statement.
The City of Gem Lake intends to create an inviting environment for all Gem Lake residents and
non-residents that come to use the public trail. The city has a responsibility to maintain the trail
as it sees fit to encourage use and maintain public health and safety.
Use of the Trail
Gem Lake residents and visitors are encouraged to take advantage of the Gem Lake Trail. When
enjoying the trail, please keep the following rules in mind:
Give Pedestrians the Right-of-Way
Those operating bicycles, skateboards, scooters or rollerblades should take caution and
alert walkers or joggers as they approach. Faster trail users should pass on the left side.
Manage Your Speed
Trail users (bikes, roller blades, push scooters) must travel at a safe speed based on the
trail environment and presence of other users on the trail while under complete control
with the ability to safely stop or slow down when needed.
Do Not Use Motorized Vehicles
Motorized vehicles - including golf carts, all-terrain vehicles (ATV’s), segways and
motorized scooters—are not allowed on city trails. Exceptions are motorized wheelchairs
and electric-assist or pedal-assist bicycles (per Minnesota State Statute).
Keep Pets on a Leash
Gem Lake City Ordinance requires all pets to be leashed whenever off the private
property of their owner. In addition, owners are responsible for cleaning up after their pet
In addition, please consider these trail etiquette guidelines:
In general, keep to the right of the trail and be prepared to yield to other trail users.
If you are wearing headphones, keep the volume low enough that you can hear your
surroundings and other trail users announcing they are passing.
Walkers and joggers should stay to the right of the trail and limit space taken up by larger
groups to allow others to pass.
Maintenance of the Trail
The City of Gem Lake and White Bear Township Public Works oversee maintaining the public
trail. To keep the trail clean and enjoyable for all visitors, the following will be implemented:
Winter Snow Removal of Gem Lake Trail
From November 1 through April 1, winter maintenance will be performed on the Gem
Lake Trail. Snow Removal will be done on regular workdays (Monday through Friday) as
needed. The standard width for general use in less frequently used parks or trails with
limited grooming is 6 feet. White Bear Township Public Works will remove snow from
the trail from edge to edge. Markers will be placed along the trail to ensure proper snow
removal widths.
Summer Mowing of Gem Lake Trail
The months of July and September, summer and fall maintenance will be performed on
the Gem Lake Trail. Mowing will be done on regular workdays (Monday through
Friday). The trail will be mowed out approximately four (4) feet foot from the edge on
each side of the trail to remove encroaching vegetation and invasive species. Areas
around the signs and benches will also be moved and trimmed at the same time.
Invasive Species
From time to time, volunteer efforts will be organized to eliminate cottonwood and
willow invasive plants in the trail area. These efforts will be approved in advance by the
City Clerk or Mayor. Yard waste resulting will be placed in a designated area and hauled
away by the public works department.

Dear Ms. Lawrence,
The City of Gem Lake (Gem Lake) has contracted with the City of White Bear Lake (White Bear
Lake) for fire services for many years. Per the 2023-2028 Fire Services Agreement, White Bear
Lake is required to provide Gem Lake with the costs budgeted for the following year and the
most recent figures for tax capacity valuation and population by September 1 of each year.
Enclosed you will find said information in addition to costs for fire inspection services
specifically for Gem Lake in 2026.
The Fire Department provides a high level of service to the communities we serve. This has
been achieved by recruiting and retaining highly skilled personnel as well as continuous
improvement, which is ongoing. Services that we provide include fire suppression, rescue,
Advanced Life Support (ALS) ambulance service, inspections, investigation and ongoing public
education. To support these operations, replacement of vehicles and improvement of facilities
is necessary for the health and safety of firefighters. This has been , and will continue to be,
done in a fiscally responsible manner. The proposed 2026 Fire budget includes the replacement
of a 20-year-old rescue truck, equipment, personnel costs, as well as much needed repairs to
the South Fire Station training tower.

RE: Setting the Date and Time of the 2025 Budget Meeting.
State Statutes require Cities with a population of 500 or more to hold a public meeting where the
budget and property tax levy will be discussed, and public input is allowed. This meeting must
occur after November 24th and before December 28th and must start after 6 pm. The budget and
levy cannot be approved by City Council until this meeting is held, but can be the same meeting.
On or before September 30th, the date, time, location and who to contact with questions must be
provided to the County Auditor, who will send out parcel specific notices with the hearing
information on them. These notices would be mailed between November 11th and November
24th.
Since the only scheduled City Council meeting between November 25th and December 28th is
scheduled for December 16th at 7:00 pm it would be my recommendation to hold the hearing on
December 16th at 7:00 at Heritage Hall.
