and.Lindner we`re present, Councilmember Kuny was absent (excused). Also present: Justin. Gese, City
Engineer, City Attorney Patrick Kelly, City Finance Director Tom Kelly. and Emily Jennings, &E.H., Ben Johnson,

Planning Commissioner Don Cummings :asked: -about redevelopment change. The council agreed that

to Be Raised by Property Taxation fort Year 2021-Tom Kelly, Finance Director
Mr. Kelly gave an overview of the budget. Councilmember Lindner made a motion to approved
Resolution 2020-012-Adoptirig the PreliminaryAmount.to Be. Raised by Property Taxation for the Year
2021, second by Co lnelmemberAmlee, Voice Vote, all yes,-roWution adopted.
2019 Audit Presentation
Michelle Hoffman from CiiftonLarsonAllen presented the aiiditfor2019, Cbuncilmember Lindnermade
a motion to accept the Audit,.seconded by Councilmember Amlee, Audlta.ccepted.
Gerry Lake Villas Develo ers Agreement Update
Last month the curb sections were replaced and driveways repalred. Trees missing should be replaced
(hopefully) by the end of the month. If the trees,are not planted then.the Developers Agreement will.
not be accepted.
Hoffman Road Discussion.
Briefly discussed the mill and overlay, council agreed this is the last time the city will do a mill and
overlay. The next. step is to. -authorize SEH to prepare proposal. to review. Councilmember Lindner
made a motion to authofize SEH to. prepare a proposal for a mill and overlay for Hoffman Road,
Councilmember Amleee-seconded the motion. Voice vote taken, all yes, motion passes.

Briefly discussed*the distance that.a deer stand.can.be from a.:home. Tabled further conversations to
the October, 2020; City Council meeting.

Rick Bosak, xxxx .Goose: Lake Road, the results of*the water testing. from Welter -Gremlin showed that.
three wells had dioxin in them. Not sure where the dioxin is comingfrom, It could either go away or get
worse. Planning Commissioner Ben Johnson— asked that HyVee be invited to the planning commission
meeting in October to discuss the future of -the property and the commission would like to review the
comp plan.

Mayor Artig Swomley -- a claim against the city has beeiabrought forth fora copy right infringement for
a.n image taken from Microsoft office. This-Wasnot intentional and the city'wili besettling the.claim for
$1,150.00. Mayor Bob's bench has. two pistential sites in the Villas -property; will be earma.rked.on

WHEREAS; Ramsey County and the. City of:Saint Paul established a joint master plan for the Bruce Vento
Regional Trail in 1989; :and
WHEREAS, Ramsey County has.submi.tted a master plan update toupdate the Bruce Vento Regional
Trait master plan section..be:tween Lapenteur Avenue and .County Road J; and
WHEREAS,. the 2020 master plan:update incorporates several cha.nges.to the regional trail corridor
between Larpente:ur Avenue and County Road J to address, boundary expansion and acquisition, trail
alignment changes, long -Term -site and infrastructure improvements, recreation improvements, and:
additional recreational opp.ortunities.thro.ughout the Ramsey County section of the Bruce Vento
Regional Trail corridor; and
WHEREAS, the City of Gem.Lake's City .Council have reviewed the plan and supports the master plan
update for the Bruce Vento Regional Trail corridor between Larpenteur Avenue and County Road J; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Gem Lake, Minnesota, supports
the Bruce Vento Regional Trail Master Plan update within the City of Gem Lake.

Consideration Approval of.Audit Service Agreement. (TIC)
{ A. . REFERENCE AND BACKGROUND:
The City has used CliftonLarsonAllen (CLA) for audit services since 2007. Also over that period,. we Have had.
a number principals overseeing the Tow -Ws audit. This past two years, the firm tried performing more .cif the:
audit functions remotely and spent.less time on site., There have been problems with the: auditors being able to
complete the audit on time. The audit was completed and presented.to-the Cooncil the past two years after the
J,une.30`i' deadline. In addition, the .:uditrs made some corrections to previous years audits. (prior period
adjustments were needed). The audit costs continue to increase each.year, with the 2019: audit. costing
S 12,1.00.00 compared to $11,5 00 and $11,000 for 2019. and 2017 respectively.
Because of the difficulties this past -tx&,o: years and because the City had not coiiipleted a RTP for audit services
and a. very long time, staff sent out -a RFP to. 7.Audit Firms Who specialize in governmental audits, including
CLA. Of the 7 firms, S have.offrces iri the Metro Area and 2 in the St Cloud Area. The City received 4
proposals. The tables .below oatli=the estimated hours to complete theau.dit and the cost .for each.fir.m.

you go by estimated hourly rate, MMKR & Co. would, be the lowest; Both.firins I believe would do a fine job
for the City.

Snowplowing Policy
1. Introduction
The city of , Mesota, finds that it is in the best interest of the residents. of the city to
dv
assume basic responsibility for control. of snow and ice on-Oty streets. Reasonable ice and
snow .control `is necessary for routine.travel and emergency, services. The city will attempt to
provide such. control in a safe and cost effective manner, keeping in. mitid'.safety; budget,
personnel, hd environmental concems. The city will use city employees, -equipment and/or
private. contractors to provide this service.. This policy does not relieve the operator of private
vehicles, pedestri ans, property owners, residents and, all others that may be using public
streets, of their responsibility to act in a reasonable, prudent: and cautious mariner, given the
prevailing' street conditions.
2. When Will the City Start Snow orIee Control Operations?
The.Street Superintendent will decide when to begin snow or ice-vontrol operations. The
criteria. for that decision are:
A. Snow.aeomulation of three (3) in&es•onnnore;
B. Drifting of snow that: causes proble=forih�vel;
C. Icy conditions which seriously affect travel; and
D. Time of snowfall in relationship to heavyuse of streets,
Snow and ice control operations are expensive: and involve.the use.of limited personnel and
egiupment. Consequently,.snowplowing operations will no�t.generally be conducted -for
snowfall ofless than three. (5) inches.
3. Flow Snow w.iil be Plowed
Snow will be plowed in. a manner so as to minimize traffic obstructions. The center of the
roadway wiil.beplowed first. The.snow shall then be pushed from left to right on *t*o-way
streets. On one-way:streets or where there is a center boulevard, snow tray be pushed44
either. direction. The discharge . ha11 go ontothe boulevard are4 of the street. Snow on cul-de-.
sacs will. normally be plowed to the center In an attempt to provide the largest turning radius
possible for emergency vehicle ingress and egress. When aplow goes on a bridge, the driver
shall: slow down so snow does not go. over the.bridge, if possiblo: In times of extreme
snowfall, streets will not always immediately. be able to be:completely cleared of snow.
4. Snow Removal
The Street.Superintendent will determine if and when snow will he removed from the area by
truck. 5uoh snow removal will occur in areas where there:.is no room.on the boulevard for
snow storage and in areas where accumulated piles of snow create a hazardQus condition.

S, Weather Conditions.
Snow and ice control operations will be. conducted.only when weather conditions do not
endanger the safety of snowplow operators and equipment. Factors that. may delay snow and

ce control operations include: severe cold,. significant winds, and limited visibility,
.9. Use.of Sand, Salt; and Other. Chemicals
The city will use sand, stilt, and other chemicals when there are hazardous ice or slippery
conditions. The: cityis:concerned about the effect. .of such chemicals on.the:environment and
will limit its use for that reason.
10. Sidewalks
The city will maintain some of the sidewalks in the bity.-The list of those sidewalks. is
attached, As there are a limited numberr of personnel available, the city will only maintain
these sidewalks after the.streets have.been plowed.. It is the responsibility of the resident
and/or property owner to remove all accumulated snow from all other sidewalks along public
streets adjoining their property. This includes any snow plowed from public streets onto the
kdewalk.
11. Mailboxes
Damage to a mailbox is a risk that snowplow operators face during their winter plowing
requirements. The city will conduct a. review of eachmailbox damage elaim to determine
whether the city -has any legal responsibility for the damage and, if so, to replace.or provide
reimbursement fbr the mailbox. If the-city.,.in its discretion, determines that reimbursement or
replacement is .appropriate, then city. -rnay:
1) At the mailbox owner's request, replace the mailbox with a standard size;..tion-decorative.
metal mailbox and replace the support post as necessary with a 4" x 4 % decay. resistance
wood support post; both which will be installed by the city;
2) Provide reimbursement in a reasonable amount for the -mailbox and support posts. that.
meet the city's ordinance standards, as well as state and federal. requirements for mailbox
size, support and placement..
12. Complaint -Procedure
Complaints w}IT be recorded on telephone logs. Calls retluiring servicewill be transferred to
P,work request and forwarded to the appropriate. supervisor for scheduling: Emergency
complaints will be handled. in an expeditious rnanner as resources are available.
l3. Deviation from Policy
The Superintendent of Streets may deviate from. this policy when in his or her judgment it is
in the best interest of the city or is necessary because of budget needs or other circumstances.
Changes in priorities (lasting more than 4 hours) will be docuTnented as to what causedsuch
actions, why the change was necessary, and for how long the change is to. be in.eifect. Those
city employees and/or contractors affected will be. notified immediately byr'adio or cell
phone of such changes with all communications logged. Information logged w0l,include the
time -and date.ofthe communication, name of employee contacted$ and.hovihey were
contacted. Any changes of priorities lasting more than 24 hours should be made:.in a written.
record and the public should be informed of such.changes through normal methods'used by -

SidewaDk-Ingpection and Maintenance Policy
1. Introduction
The -city -of , Minnesota has .miles of publig4dewalks.. Public sidewalks vary in
age and in quality of eondition. Not every triere inequality or irregularity in the~ surface of the.
sidewalk rises to the level of:a. defect. The cityrecognizes that some sidewalk conditions.
create unreasonable hazards for pedestrians and other sidewalk users.
The city has limited employee:and financial resources and cannot -reasonably replace all
sidewalks needing replacement or repair in. the same year the sidewalk is identified as
needing replacement and repair. Sidewalk replacement and repair can be costly,
Comprehensive sidewalk surveys aid expensive and require the use of limited city personnel
a nd other resources. Under.appropriate circumstances, some or all of the cost of sidewalk
replacement maylie.paased to the adjaicentproperiy owner.
Accordingly, the city and its -Public Works Depanrrmnt must exercise both discretion and
professional judgment in determining whether and --when sidewalks need to be replaced or
repaire&The city expects -that its. a igonts;.empidyees, and city offiaidgwill exercise
discretion in identifying .conditions mquii ng replacement and.repair-jh the scheduling of
replacement and repair and in establishing.priorities for replacement. -and repair.
2. Sidewalk inspection procedures
The (Insert.Street Superintendent /Ditector PfPO11; .Works / GYty.EFngineer or other
applicable staff member) shall establish pt+ocedutes forregular sidewalk inspection. Those
procedures will include;
A. An i4al-city-wide sidewalk survey to be completed by (Insert date)
.B. - A adhedule for routine sidewalk inspections on a regular basis
C;. Criteria for determining whether a. particular sidewalk condition.is.ia-need of
replacement or repair. Those criteria. will include, but not necessarily late limi* to;

We are pleased to submit this letter proposal for preparing construction plans, design, assisting the City
with bidding, and construction services. of the: pavement replacement of Hoffman Road :between County
Road E and. Highway 61. These improvements will. include a 2" mill and replacement of the existing
pavement on Hoffman Road between County Road E..and Highway 61. This lettersupplements:the
Agreement for Professional Services between the City of Gem Lake, Minnesota (Owner), and Short Elliott
Hendrickson.Inc..(SEH10) (Consultant), for providing professional services.
Scope of Work
We. understand the project.to consist of preparing the construction plans fora mill and overlay of Hoffman
Road, from County Road E,. south.to Highway 61. The anticipated improvements would include milling
and a new bituminous pavement section along with several infrastructure mainienance repairs.
A preliminary range of construction. -costs for the mill and overlay of Hoffman Road is between $80,000 to
$.100,000 dependent on the bidding. climate.
Our scope of work for the Sche.uneman. Road Improvements described above would be as follows:
• Perform a.structure survey of the project area for use in preparation of the construction plans.
•. Prepare an estimate of probable construction costs and proposed projectschedule.
• Prepare construction: plasm and specifications for the improvements as described above.
Coordinate with MnDOT, Ramsey County public works to identify conflicts with the proposed
improvements.
• Review construction .documents with the City prior to..the advertisement for bids.:
• Assist the City .during the bidding process .(advertisement for bids, bid opening, and contract award
processes).
• Shop drawing review
Resident Project representative construction observation (est. 25 hrs. a week for 6 weeks)
• Construction Administration

drainage system ditch may not constructed without the .director's approval of the hydraulic capacity.
Subd, 2. Road authority responsibility. Bridges and culverts oil public roads required by tha'coristruction or improvement oft
drainage project or system rnust.be constructed and maintained by the road authprity responsible forkcaeping the road in repair, except

Subd. 3, Notice; charging cost: The auditor shall notify the state and each railroad company,.corporatioh, or political
subdivision that they are to construct a required bridge or culvert on a road or right of -way under their jurisdiction, within a
reasonable time as stated. in the notice, If the work is not done within the prescribed time, the.drainage authority may order the bridge

Agreement Between Ramsey County
And the City of Gem Lake for Election Services
This is an agreement between the Copnty of Ramsey, through the Ramsey aunty Elections Office, 90
West Plato Boulevard, 5; Paul; MN ("County"), and the City of Gern 14 <e ("ClW") for the provision of
election services by the County ("Agreement")
1. Term
This Agreement will be in effect for theperiod from Janvary 1, 2021 through December 3.1,:2026
("Initial Term"),. unless earlier terminated. pursuant to the provisions of this Agreement.
2. Renewal and Termination
this Agreement may be renewed for one additional two-year period by written agreement*ofthe
parties, 10 the. form of an amendment to this Agreement. An amendment for renewal ofthis
Agreement.musf be executed by. all parties no. later. than June 1, 2026
This Agreement may be terminated by any party by written noticato the other parties no later than
June 1 of any year, effective on January 1 of the following year. l:Jpon termination of.this Agreement,
the City -owned voting equipment and materials previously owned bythe City related to elections
will be returned to the City.
3. General Agreements.
a) This Agreement only applies. to precincts located solely within Ramsey:County.
b) This -Agreerrrent-only applies tp regularly scheduled elections.
c) The Cotirity:will conduct all special elections required.by law during theterm of this Agreement
on. behalf of City. The costs of all. special elections that are not hWd-concurrentlywith a regularly
scheduled. State, County or City election will .be billed to the City�for the. actual cost realized to
conduet-a special.electioni1he. City will also pay ell costs applicable to any state. speclal:elections
ttmtt are rL'mt-conducted on the date of a regularly scheduled City of state, election.
d) If a City primary is required, the City will pay all costs appllcSable'.to the primary. The CountyshalI
invoice the. City separately for the costs of the primary.
e) The costs for Recounts for City elections will be billed separately from this agreermentfor the
actual costs realized.
f) The costs for Ranked Voting Reallocation for the -4Itywill be. billed- iepa rately from this
agreement forthe actual costs realized.

n) Conduct :recounts for City offices an.d ballot.questions.
o) Prepare, post, and publish notices of filing and election as required. by Minnesota Statutes
sections 205.13 and 205.16. Publish; post, and provide. the sample ballots as required by
Minnesota Statutes section 205.16
p) Ad.minister all aspects of absentee voting carried out by the Clerk in Minnesota. Chapter 20313,
including all in -person absentee voting activities at -absentee voting.locations. determined by the
Ramsey County Auditor.
q) Administer campaign finance reporting and economic disclosure activities designated to the city
clerk in accordance with Minnesota Election Caw.
r) Perform all duties of the candidate filing officer, indud1ngthe.acceptance of affidavits of
candidacy and. petitions.
s) .Mainta1n.a database and prepare maps of election districts and precinct. boundaries,. Provide
maps in digital and print formats, available to the public:
t) Retain all election records in accordance.with.Minnesota Election Law and data retention
requirements.
u) Conduct civic engagement events regardiirig voter registration, absentee voting, election judge
recruitment, and election related civics,
v) Recruit student elections judges and teacher liaisons as part of Ramsey County.'s Student
Election Judge.P:rogram.
5. City Responsibilities
The City will perform the following election -related. responsibilities:
a) Rrovide the County witK an inventory list. of voting equipment acid election related. materials,
owned by City, to be returned by the County uponterminat"son of.Agreement.
b) Conduct the canvass of.election results following every City election.
c) issue Certificates.of Election in accordance with Minnesota Statutes sections 205.185. &
211A.05,
d) Attend annual pre -election meetings held by the County and complete trainings require..d.for
state election officials as. ;determined.by the Minnesota Secretary of State.
e) .Send required mailed. notice of levy referendum in accordance with Minnesota:Statutes section
126C.17, subd. 9(b).
8: Voting.Systems
The cost of the operation and maintenance of the voting system is. not included in this Agreement
.and is the.subject of a separate agreement.
9. Insurance
Each party shall rnaIintair! such insurance as will protect such party from claims. whichmay arise out
of; or result. from, the partyis actions under this Agreement. During the term of .this Agreement, the.
County a.nd.City will rnaintaIn, through commercially available insurance or on a self-insurance basis,
property Insurance coverage on the voting equipment each owns, for the repair or replacement of
the voting equipment if .damaged or stolen. Each party shall be responsible for any deductible under
its respective policy. Each party. hereby waives and releases the other:parties; their employees,
agents, officials, and -officers from ail claims; IlaWRY.,'and causes of action .for.loss, darn age to or
destruction of the waiving party':s property resulting from fire or other perils covered in the. standard
property insurance. coverage maintained by the parties. Furthermore, each party agrees that it will
look to its own property insurance for reimbursement for any loss and'sha11 have no rights of
subrogation against the other partles.
10. Indemnification
Each party to this Agreement will be responsible for its own acts and omissions, and the acts and
omissions. of its o..fficials,.-employees, and agents, and the results thereof; to the extent authorized by
law and shall not be responsible for the :acts of the other party, its officials; employees, and agents,.
and the results thereof. Liability shall be governed by applicable law. Without limiting the foregoing,
liability oft .he parties shall be governed by the provisions .of Minnesota Statutes Chapter W (Tort
Liability, Political Subdivisions) or other applicable law. This provision shall not be construed nor
operate as a waiver of :any applicable limits of or exceptiions.to liability. set by law. This. provision will
survive the termination of this Agreement..
M1: Data Practices
All data created, collected; received; maintained; or disseminated for any purpose in the ccurse.of
this Agreerhont:iis governed. by the Minnesota Government Data Practices Act, any other applicable
statute,. or any rules adopted. to impiem.ent the Act or statute, as WeII as federal.statutes and
re.guiations on data privacy.
12. Alteration
Any alteration, variation, modification; or waiver.of the provisions. of this Agree.m.erit shall be valid
only after it has been reduced to writing and duiy signed: by all parties. Any amendment must. be
.approved no later than June 1 of any year for implementation on January 1 of the following year.
13. Dispute.Resolutio.n
The Agreement shall. be interpreted and construed according tothe laws of the State of Minnesota.
All litigation. regarding this Agreernent.shall be venued.in the appropriate State or Federal District
Court. 1n Ramsey County, Minnesota.
