Taxation: public hearing, and that they public would have a. chance to provide input on the topic..
Councilmember Lindner introduced .a motion to. open the Truth -in -Taxation public hearing at 7:03 p.m:,.
seconded by Councilmember Johnson. All in favor, motion carried.
City Treasurer Tom Kelly .gave an overview of the MI.. budget and property .tax Ievy for the. City of Gem
Lake. The City Council is asked to approve (pass) Resolution 20?2 0031, Adopting the,Final 2023 General
Fund Budget and Property Tax Levy; The 2023 Budget for expenditures is. proposed at $674,829, which is
a 29.10% increase from the 2022 Budget. Major or large changes from the 2022 Budget to the 2023
Budget are as follows:
I. Based on the.2015. ReRinding Bond. schedule the debt levy fo.r 2Q23 isset for 577,873.00. In addition,
in 2018, the City, issued bonds far the: improvements on Scheuneman Road and the 2023 debt levy for.
this. issue is $6,5.45.00. The two of these debt.levies makes up the City's 2023 debt levy of S84,41 S.
This is. a decrease of $2,864,
?. City Council contingency was increased from $8,000 to $97066.
3: Clerk/General Government budget includes a 5% COLA increase and $10,.350:f6r health insurance
coverage.:

4, Budget includes S751815 for new financial and. permit software of which $35,270 will be paid from
ARPA (Covid) funds.
5.. Police budget was increased 21.2661. to � 1.15,200 based on budget numbers.provided by the City of
White Bear Lake.
6. The cost of fire .services.could increase..[ 5.96.% to $34,025.00.
7. Building lnspectivns eliminated the part-tiine inspector, Which resuIts.in.a budget reduction of
$20.559.
S. Road ,Maintenance budget includes $22,000 for sca[ca.ating roads and. $15,000 far trimming boulevard
trees.
9. Salt/sand and snow plowingexpenditures left at $15,000 and S 11,000.
10: Included a park maintenance budget of $7,000 for maintaini n1g park area of the Villas .of Gerd Lake.
11. The 2023 budget includes $20,000.00 for future improvements.

Based on the changes.Iisted above the City's proposed 2023. property tax .levy Would $669,I 15., which

The total City levy is proposed to. increase 19.869%. The other piece to the tax levy puzzle is the City's tax
capacity, Which increased 12.287% to $1,601,998. In addition, the median ]Tome value increase from
$352,000 to $ 395,800. Based on these increased tax capacities and the City's proposed taa levy, the
median valued home.:wauld linve a City property tax increase. of $242.24 or 19..3.8.4%.

Councilmentber Lindner .introduced a motion to close the Truth -in -Taxation pub lie hearing at 7:24 p.m.,
seconded by Councilmember Johnson. Voice vote taken; all in favor, motion passes; the public hearing is
closed at 729 p.m.

Resolution #2022-0031 Approving 2023 Budget & Levy
City 'Treasurer Tom Kelly created. a resolution for the City of Gem Lake to approve the 2023 Budget &
Levy -The City Council was requested to pass.a resolution adopting the 2023 property tax levy of
$674,829.00.'rI,e foregoing. resaIutian,was offered by.CounciIineinber Linder and was.sup ported by
Councilmember Johnson. and Was declared. adopted based uponunanimous vote in favor.

The C'i.ty:Counci1.has the discretion to. Use unrestricted City. funds in the hest interest of.tha.City. From time
totime, the City transfeers. money from one fund to another for var1ous. reasons. [n.order to complete these
transfers, the City must pass a resolution authorizing these transfers prior to the: end of the Fiscal year.
CounciImember Lindner introduced a rndtion to approve the transfer of funds, seconded by CounciImember
Amlee and wag -declared adopted.based upon unanimous vote in favor.
BS&A Contract Proposal Approval
The..CouneiI reviewed all the: possible options. -for .the new ofhce.soft ware and decided. that it was best to
approve. the quote for ail soft-ware.p ackages.which include Finance.lulanage inent, Pers.onai Management,
Community Development and BS&A. online in: the total of$81,165:00: The COVID.funds the city has left

Gem Lake Infrastructure Issues
BNS)' Contract for.Drainage Pipe update
Thecantracl.witIt BNSF is valid..for .two nty-five (25.) years upon acceptance. The City and BNSF
have been negotiating a license fee with an initial request of $7:,600.00 and .$2,0.00.00 far
insurance down to only a $.1,250.00 license fee.a.nd'$860.00 for services.

Due to the drainage pipe issue that the City had, John Birkelands Iots five (S) and seven. (7) were
impacted. Mr. Birkeland retained. an attorney and negotiated. an casernent. 'rhe ainount negotiated
for the easeMent.was .d.eterriiined to be the approximate value of the legal services provided to Mr:
Birkeland, as determined by Birkeland's attorney. It also determined to be appropriate when
compared to the oost. of purchasing easements in similar. situations.

residential perniits.. were changed from valuation to. a flat feeand many items were added to the fee
schedule that were not previously mentioned but the City had permits for.

THC Ordinance Discussion
The City of White Bear Cake is currently looking at the City of Woodbury.'s TH.C:.ordinance as.a template
for theirs. A this time the City Of Gem Lake will hold offon adopting an Ordinance until White gear Lake.
approves theirs. Ma.yor.Artig SwontI.ey is asking the Council to look at. the City of Woodbury" s.Ordinance
and read it as though Gem Lake Is adopting it and think of anything that could be changed or added, The
City will hold off until April or May before adopting an Ordinance.
Purple Line Discussion
The City of Vadnais. Heights created. a Resolution withdrawing their. support of the. Purple: Line. The City of
Gem Lake did not approve the I 5% plan review and will not approve the. 30% plan review.
Corridor Project Final Report
Thefinal draft of the report is still being finalized. Council member Johnson will put something together
that can be mentioned in the City Newsletter. Mayor Artig-Swoinley has. asked. Councilmerber Johnson to.
reach out to the.committee again to see.if they can attend.a meeting and give the City and overview of the
project. Councilmember Johnson A+ill reach out. and get bacto the Mayor with their response.

quarlerly.biII to the City. Gem Lake is considering the proposal and is happy with the progress being. made.

The City is currently in the renewal process of its property and liability insurance
package with the League of Minnesota. Cities Insurance Trust (1.MCIT). As part of this.
renewal process the City must decide if it wishes to waive or not waive the statutory tort.

claimants could recover would be limited. to $1,5001000. These l'irnits would be on only
those claims which the statutory tort limits apply,

and Miscellaneous Business regulations.

DIVISION 1. GENERALLY
Sec. 11-510. Purpose.
The purpose of this Section is to regulate the sale of legalized adult -use -of cannabinoid
products: and that meets the requirements to be:sold for human or animalconsumption under
Minnesota Statutes, section i5j..72 for the following reasons:
(a) The City recognizes that, based on the most reliable and up-to-date scientific
evidence, the rapid introduction of newly legalized adult=use THC.products;
presents a significant potential threat to. the.public health, safety,:and welfare of
the residents of Woodbury, and particularly to youth.
(b) The City has the opportunity to be proactive and make decisions that will mitigate
this threat and reduce exposure of young people to the products or to the marketing
of these products and improve compliance among cannabinoid product retailers with
laws prohibiting the sale -.or marketing of cannabinoid products to minors.
(c) A local regulatory system for cannabinoid.p.roduct retailers is appropriate to ensure
that retailers comply -A ith cannabinoid product laws. and business standards of .the
City of Woodbury to protect the health,safety, and welfare of our. youth. and most
vulnerable residents.
(d) State law requires cannabinoid product retailers. to check the identification of
purchasers to verify that they are at least.21years of age (Minn. Stat. § 151.72, subd.
3(c)), comply with certain packaging and labeling requirements to protect children.
and youth (1d., subd. 5), and meet certain .potency and sek-6ng size.requirements Cld.,
subd. 5a).
(e) State law authorizes the Board.of Pharmacy to adopt product and testing standards.:
in part to curb the illegal sale and distribution of cannabinoid products and ensure
the safety and :compliance of commercially available cannabinoid products. in the
state. of Minnesota.
(f) State law does not.preempt the authority of a local jurisdiction to adopt and. enforce
local ordinances to regulate cannabinoid product businesses including, but not limited
to,. local zoning and land use requirements and business license requirements.
(g) A requirement.for. a cannabinoid product retailer license will not unduly burden
legitimate business activities of retailers who sell or distribute cannabinoid products
to adults but will allow the. City of Woodbury to regulate the operation .of lawful
businesses to discourage violations of state and local cannabinoid Product -related
laws.
In.making these findings and enacting this ordinance, it is the intent of the Woodbury City
Council to ensure. responsible. cannabinoid product retailing,. allowing legal sale. and. access.
without promoting increases:.in.use, and to discourage violations of cannabinoid product -
related laws, especially those. which.prohibit or discourage the marketing,: sale or
distribution of cannabinoid products to. youth under 21 years of age.
Sec. 11-611. Def1nit!ons and_Interpr_etati_a :
Except as may otherwise be provided .or clearly.implied by context, all terms shall be given
their commonly accepted definitions. The singular shall include the plural and the plural shall.
include the singular -The masculine shall include the feminine: and neuter; and vice -versa. The
term "shall' means mandatory and. the. term "play" means: permissive. The following terms shall
have the definitions given to them:
cannabinoid. Any edible cannabinoid product or nonedible cannabinoid .product authorized
for sale in Minnesota Statute.
Cannabidiol/M. Any non -intoxicating cannahidiol not containing tetraliydrocannabinol
(THQ
Cannabinoid-related devices. Any equipment, products or materials of any kind which. are
used, intended for use, or designed for use it! repackaging, storing, smoking, vaporizing, or
containing cannabis; or for ingesting, inhaling, or otherwise introducing cannabis or cannabis
products: into the human body:
Certified hemp.. Hemp plants that have. been. tested and.found to. meet.tlie requirements of
Minnesota Statute Chapter 1,8K and the rules adopted thereunder by the. state of Minnesota.
Compliance. checks. The processor protocols the city uses -to. investigate. and ensure that those
authorized to sell Cannabinoid products are following: and complying. with: the requirements of
law. Compliance checks shall involve the use of .persons under the age of 21 as authorized by this
article. Compliance checks shall also -mean the use of persons under the age of 21 who attempt to
purchase cannabinoidproducts for educational.researeb and training purposes as authorized by
state and federal law. Compliance .checks.may also be conducted. by other units of government
for the purpose of enforcing appropriate federal, state -or local laws:and regulations relating to
cannabinoid products.
Delivery sale. The sale of any cannabinoid products to anyperson for personal consumption
and not for resale when the sale is conducted by any.means other than an in -person,: over-the-
counter sales transaction in a licensed retail establishment. Delivery sale 'includes, but is not
4r . limited to, the sale of any cannabinoid products when the sale is conducted by telephone, other
voice transmission, mail; the internet, or app-based service. Delivery sale includes delivery by
licensees or third parties by any means, including curbside pick-up.
Edible Cannabinoidproduct. Any product authorized for sale under Minn. Stat.151.72 that is
intended to be eaten or consumed. as a beverage by humans; contains. a cannabinoid in
combination with food ingredients, and is not a drug.
.exclusive Cannabinoid/Ibbacco store. A brick. and. mortar retail store -which .derives a
majority: of its: revenue from tobacco, tobacco products, CBI], and/or cannabinoid products, and
which cannot be entered at any tune by persons younger.than 21 years of age except as provided
herein.
Exclusive Liquor Store. An establishment that meets the definition of exclusive liquorstore in
Minnesota Statutes; section.g4.oA.iai, subdivision lo.
Hemp. The plant Cannabis sativa L. and any part of the plant, whether. growing. or not,
including the plants seeds, and all the plane's derivatives; extracts, carinabinoids, isomers, acids,
salts, and salts of isomers; whether growing. or not, with a delta-c) tetraliydrocannabinol
concentration of .not more than.o.S percent on a dry weight basis. Industrial hemp is not.
marijuana as defined in Section.152.0.1, subdivision.g.
Label. The meaning given. in Minnesota Statute Section 151.oi, subdivision i8.
Labeling. All labels and. other written, printed; or graphic: matter that.are:
(1) affixed to the immediate container in which a product -regulated under this Article
is sold;
(2) provided, in any manner, with the immediate .container,.including but not limited
to outer containers, wrappers; package inserts, brochures, or pamphlets.; or
(3) provided on that portion of a manufacturer's website that is linked by a scannable
barcode or matrix barcode.
Licensee A. human person licensed under this Article.
.Licensee's clerk. A person employed by a licensee to work at a sales or service counter or
otherwise snake sales to the licensees customers.
Marijuana. All parts of the.plant:of any species of the genus Cannabis, including all
agronomical: varieties,.w.hether growing .or not; the. seeds thereof; the resin extracted from any
part of such plant; and every compound, .manufacture, salt, derivative., mixture., or preparation
of such plant, its seeds or resin, but:shall not include the mature stalhs.of such plant, fiber from
such stalks, oil or cake -made from the seeds of such plant, any other compound, manufacture,
salt, derivative, mixture, or preparation. of such mature stalks, except the resin extracted
therefrom, fiber, oil, or cake, or the sterilized seed of such plantwhich is incapable of
germination.
Matrix Barcode. A code that stores data in a two-dimensional array of geometrically shaped.
dark and light cells capable of being read by the camera ona: smartphone or other mobile deyi'ce.
Minor. Any person who has not yet reached the age of 18:.years.
Moveable plaee of business. Any form of business operated.out.of a truck, gran, automobile,
trailer, or other type of vehicle or transportable shelter And not a fixed address store front or
other permanent type of structure :authorized for. sales transactions.
Nonedible Cannabinoids. Include, but are not limited to tablets, .capsules, solutions,
tinctures, or other products meant for oral administration/.ingestion; creams, lotions;
ointments;. salves, .or other products.meant .for topical administration; .products meant to be M.
inhaled, smoked,.vaped, sprayed into nostrils, or insufflated.(sniffed).; and hemp flowers and
buds.
Nonintoxicating Cannabinoid. Substances -extracted from certified hemp plants.that .do not
produce intoxicating effects when. consumed by any route. of administration.
Retail establishment. Any place of business where cannabinoid:products or cannabinoid-
related devices :are available -for sale to the .general public. The phrase shall. include but not
limited -to, grocery stores, -convenience stores, restaurants. and drugstores.
Sale. Any transfer of goods for money, trade, banter or other consideration.
Self-service merchandising. Open. displays of licensed product in any manner where any
person shall have access to the licensed product without the assistance or intervention. of the
licensee or the licensee's employee. Such assistance or intervention. shall involve the actual
physical exchange. of the licensed product between the customer %and. the licensee or employee.
Self-service sales are: interpreted as being any sale where there is not an actual physical
exchange of the,productbetween the clerk and the customer: "Self-service merchandising" shall
not include. vending machines.
Vending machine. Airy mechanical; electric or electronic,.or other type.of self service device
which, upon the insertion of money, tokens or other form of payment, dispenses the licensed
product and includes vending. machines equipped with manual, electric or electroniclocking
devices,
Sec. 11-612. Scope.
(a) This Article: applies to the sale of any cannabinoid.product.
(b) This Article does not apply to the sale of any cannabidiol/CSD product as defined by this.
Article.
(c) This Article does not apply to any product dispensed,bya registered medical. cannabis
manufacturer pursuant to Minn. Stat.152.22 to 152.37,
Sgc. 11-613. License.
No person shallsell or offer to sell'any .cannabinoid products or cannabinoid-related
devices without.first having obtained a: license to do so from. the City.
(a) .Application..An application for a license to sell cannabinoid products or:cannabinoid-
related devices shall be made on a form provided by the city and filed, along. with all
required.fees, with the city clerk. The investigation fee is applied to the city's costs of
the background investigation of the retail establishment: and. all person or entities that
have at least a.five percent financial interest in the retail establishment, The,property
must be in compliance with all applicable laws and ordinances. The public safety
department shall conduct the background investigation before consideration.by the
city. All: applications shall thereafter be considered and approved or denied by the city
council.
(1} All applicants.
a.. Whether the applicant/.owner is an individual, corporation, partnership, or
other form of organization;
b. Full name, address, date and place of birth, and telephone number of the
applicant, all owners acid operators., including the designated. on -site
manager or agent of the applicant;
c. The address of the premises where the retail establishment: is to be located if
proposed to have:a fixed location in: which the retail services are pro)" ided
and if the applicant does not own the premises, a copy of the lease.:
agreement to occupy the premises;.
d. Statement of whether all.taxes and: special. assessments due and owing on
the premises on which the applicant.proposes to operate the.licensed
business are current, and. if tares are delinquent, the years for which the
taxes on the premises are delinquent (this information is required by the
applicant only if the applicant or other entity -in which the applicant has an
interest has the legal -duty to pay said, property taxes or assessments due and.
owing);
e. The name of the business if the business is to be operated under a nanie or
designation other than the name of the applicant. This shall be accompanied
by.a. certified copy of the certificate required by Minn. Stats. H 333.01 and
333.02;
f. Proof of general liability insurance;
g. The applicant shall.produce at time of filing application the applicant's proof
of identification which may be established only by one of the fol101Ail.lg:
i. A valid driver's license or identification. card issued by Minnesota,
another state, or a province of Canada, and.. including the
photograph and date of birthx of the license person;
2. A. valid military identification card issued by the United States
Department of Defense;
3.. A valid passport issued by the United States; or
4. In. the case of a foreign..national, bya.valid passport.
For.purposes.:of proof of identification;. the "applicant" shall mean the on -
site manager or agent for a retail establishment filing the application and the.
natural person signing the.application,for. a cannabinoid product license;.
h. The application shall identify the full name, address, date and placeof birth,
and telephone number of the natural person, designated by the applicant as
the cannabinoid product business's on -site manager or..agent, along with the
notarized written consent of such a. person to: (1) take. full responsibility for
the Conduct of the .license premises operation; and (2). serve. as agent for
service of notices and other process relating to the licenses;
i. With: respect to the,owner, operator; or any person who has a five.percent
financial Interest in the proposed licensed cannahinoi.d product sales
business and the appointed. on -site manager or agent of the applicant,
information as to any and all criminal convictions of anystate, county, or
local law or regulation;
j. Proof of Workers.' Compensation Insurance. as required by Minnesota.law
and
k. Information as. to any and all criminal conviction(s) of any state, county, or
local law or. regulation;
1. Such other information as the city shall require.
(2) Individual(s) (sole proprie..tor):
a. The full .name, address, date acid°place of birth, and telephone number of the
applicant;
b. Miether the applicant and on -site manager or agent have ever used or have
been known by a name -.other than his or her name on the -application, and:if
so, the name or names used and information concerning.dates and places
were used;
C. Whether the :applicant: is a United States citizen. or is legally.permitted to be
in the United States.and providing proof thereof;
d. The street and city addresses at which the applicant and on -site manager or
agent lied .during the preceding ten years;
e. Names, addresses; and date of the applicant's and on�site manager's or
agent's employers for the preceding ten years.;
f. Whether the applicant and on -site manager or agent have ever been engaged
in the operation of cannabinoid and/or tobacco product sales..if so, they
shall furnish information as to the name,. place, and length of time of the
involvement in such -an establishment; and
g. Such other informations as the city shall require.
& .Partnerships.
a. The full name(s), address(s), date and place of birth, financial interest of all.
general. partners and all of the information concerning.each general partner
that:is required of applicants in. provision (2) of this section;
b. The full narnes(s),. addresses,date and place of birth, and telephone number
of the.manager pa.rtner(s). and the. interest of each managing partner in the
business;
c. A copy of the partnership agreement shall be submitted with the application.
The license.shall be issued in the name of the partnership; and
d. Such other information. as the cityshall require.
(4) Corporations and other organizations:
a. The name. of the corporation or businessfirm, and if incorporated, the state
of incorporation;
b.. A copy of the certificate of incorporation shall be attached to the. application.
If the applicant is a foreign corporation, a certificate of authority as required
by Minn. Stats. § 303.06, sliall b:e attached;
C. The name of the manager(s), proprietor(s) or other agents(s) in charge of
the business and all of the information concerning each manager,
proprietor, or agent that is. required.of applicants in provision (2) of this
section;
A. A list of all persons who own or have a five percent or.more interest in the
corporation or organization or who are officers of saidcorporation or
organization, together -,N itb their addresses and all the information
regarding such persons as.is.required in.paragrapb (2) of this section; and
Such other information as the city shall require..
(b) Action. The council may either approve or denythe license,.or it may delay action for
such reasonable period of time as necessary to complete any investigation of the
application or the applicant.it deems necessary. If the council shall approve the
license, the city.clerk.shall issue the license to the applicant. If the council denies the
license, notice of the denial shall lie given to the :applicant along with notice of the
applicant's. right to.appeal the. cotincil's.decision.
(c) License period and renewal. A license issued under this chapter shall be an annual
license., expiring. on December 31 of each year.
Any existing business selling cannaMpoid products within the city as of the effective
date of this article, shall file all required license, applications hereunder, along with the
license andinvestigation fees, no later than. September 30, 2022.
A license.rnaybe annuallyrenew.ed,. provided the licensee.complies with the renewal
application process as follows:
(x) The.licensee shall complete the.renewal application materials provided by the
city;
(2) The completed renewalapplication materials, along with the license fee, shall .be
filed with city clerk no later. than November 8o of the renewal year;
(3) The. licensee shall provide all information regarding:business ownership interest.
If ownership interests have Changed, an additional investigation fee is required.
(d). License and investigation fees. The license and investigation fees shall be determined
by the City -Council as set forth in Woodbury City Code Chapter. 2, Administration.
(7.) All licenses shall. expire on the last day of December in.each year. Each license
shall beissued.for a period of one year, except that.if a portion of the license year
has .elapsed when the application. is made., a. license may be. issued for the
remainder of the year for a pro rata fee. In: computing such :fee, any unexpired.
fraction of a month shall be counted as one month.
(e) Revocation or suspension. Any license issued under this article. may be revoked or
suspended as provided in.s.ection 1.1-522 violations and penalties, of this article.
(f) Transfers: All.licenses issued under this article shall be valid only on the premises for
which the license was issued and only for the person(s) or entity to whom the .license
was issued. Any attempt at transfer toanother -location, person, or .entity shall
invalidate the license.
It is the duty of each business licensee to notify the City in. writing of any change in
ownership in the business. Any change.in the ownership or control of the business
shall be deemed equivalent to an attempt to transfer the license, and any such license
shall be -revoked 3o days after any such change in ownersliip:or control .unless the
licensee has notified the City of the change in ownership: by submitting a new license
application for the new owners,. and the Council, has approved.the new license.
Any. time an additional investigation is required because of a change in ownership or
control of a business, the licensee shall pay an additional investigation fee. to. be
determined by the City. The City may at any reasonable tune examine the transfer
records and minutebooks. of any business licensee .to verify and identify the owners.,
and the City may examine the business records of any other licensee to the .extent
necessary to disclose.the interest which personsother than the licensee have in the
licensed: business. The Council may.revoke any license issued upon its determination that a change of ownership of a licensee has actually resulted in the change of control
of the licensed business so as materially to affect the integrity and character of its^
management and:its operation, but no such actionshall he taken until after a hearing
by the Council on notice to the licensee.
(h) Moveable place of husiness.•No license:shall be issuedto a. moveable.place of business.
Only fixed location businesses: shall be eligible to be licensed under this article.
(i) Home business. No license shall be :issued to a home. business.
(h) Display of license:
(1) The. license of the cannabinoid product: salesestablishment shall be displayed in.an
open and conspicuous place on the premises and shown to law enforcement
officers upon request.
(.2). All exclusive C.annabinoid/Tobaccostore establishments shall post a notice
prohibiting the -entering of the store by .persons.under 21 years of age which notice
shall be in.plain. view of the general public on. the, licensed public on the licensed
premises. The notice shall be at least 81/2 inch by rr inch in. size.
(i) rssuance:.as privilege and n.at a right:. The issuance of a license issued under this
article: shall be considered a privilege. and.not an absolutexight of the applicant and
shall not entitle the holder to an automatic. renewal of the license.
[j) .Exclusive liquor stare. Pursuant to Minnesota Statute; section. 34oA:412, subd.14, no
license shall be .issued,to an exclusive liquor store.
(k) No licenseshall be granted for any business which principal. building is within Soo feet
of any school, licensed. day care center, park, or playground.
(1) No.license.will be approved unless the premises proposed to be: licensed complies. with
all applicable zoning requirements.
(m) Refunds..No. part.of the fee -paid for:anylicense issued under this Article shallbe.
refunded except in the following instances upon application to the City within 30 days
from the happening of the event. Upon written request, a pro rata share, based on the
number of maiiths the business ceases to conduct business; of an annua 1. license fee for
a retail license, may be refunded to the licensee or to the licensee's .estate if:
[i) The business ceases to operate because of destruction or damage;
(2) The licensee dies;.
(3) The business ceases to be lawful for A. reason other.than a license:: revocation;
(4) The licensee ceases to carry on the licensed business under the: license; or
(8) The business ceases to operate, or is unable to fully use its license to operate.,
because of a declared local, state. or national emergency. A written request by the
licensee is not required.
Sdc: 11&14. Basis for _denial of license.
The following shall be grounds for denying the issuance or renewal of a license under this
article; however, except as may otherwise be :provided by law; the existence.ofany particular
ground for denialdoes not mean that the. city roust deny the license. If a license is.:mistakenly
issued or. renewed to a person, -it shall :be revoked upon the discovery that the person was
ineligible. for the. license under this section.
(a) The.applicant.or owner(s): is under the age. of.21 years:
(b) The applicant, owner(s), the appointed on -site manager or agent of the applicant, or
any person who has at Ieast five. percent interest in theproposed licensed business
has a:
1. Conviction for, .or was charged with, but. convicted of a lesser charge of a
crime, or is under a stay` of adjudication from a charge involving a violation
'of any cannabinoid. and/or tobacco related regulation in any other
jurisdiction, theft, felony drug.affense, any crime of violence as defined by
Minnesota Statutes, or any other similar crime or offense within five years of
the. date of application;. and/or
2. Three (3)or more license violations, citations, fines; or administrative
penalties issued by the. City of Woodbury or any other jurisdiction within. the
preceding fibre .(5) .years. relating to cannabinoids, tobacco, or alcohol related
ordinances, laws, or regulations for. a business.ovvned or operated by the
applicant, -owners, manager,: or. agent.
(c) The:applicant or owner(s) has had a license to sell cannabinoid and./or tobacco
products suspended or revoked, in the 0ty of Woodbury or in any other place,
within the preceding io years of.the date.of application.
(d) The applicant or owners(s) fails to. provide any.information required on the
application, or provides false or misleading information.
(e) The cannabinoid sales business is proposed to be operated on premises on which
property taxes, assessments, or other financial claims by the state, count
y or city
are. due, delinquent, and unpaid, provided the applicant or owner(s).or other
entity :in which the applicant or .owner(s) has. an interest has the legal duty to pay
said taxes, assessments, or claims due and owing..
(i) The. applicant or owner(s) was. charged A th. a crime that if convicted would. render
them ineligible for a license under this chapterbut entered .into a plea agreement
providing.:for the.continuance;of the. charge for dismissal or other delayed.
disposition. In such case.the applicantshall be.disqualified and ineligible for a
license under this chapter until such time as the charge: is finally dismissed.
(g) The applicant or owner(s). has been denied a license under this chapter within .
the preceding 12 months.
(h) The applicant is a business that does.not have an operating officer or manager who
is. eligible pursuant to this chapter..
(i) The application is for a home business or a moveable place of business.
(D Other unforeseen circumstances.or conditions. exist such that the issuance of a
license may unreasonably endanger thehealth, safety, andwelfare of.the public..
See. Prohibited Acts.
(a) In general. It shall be a violation of this article for any person to self or offer to sell
any cannabinoid products or cannabinoid-related devices::
(1) By means of'any type:of vending machine.
(2) By means of.self-service merchandising.
(3) From any form of movable place of business.
(4) Containing controlled substances as. defined in Minn. Stat, Ch..152.
(5} .By delivery sale.
(6) By any employee -under the age of i8.
(7) To an obviously intoxicated person.
(8).By any other: means. or to any other person,prohibited by federal,. state, or
other local law, ordinance, provision;. ornther regulation.
fib) Legal.Age. No person shall sell any cannabinoid products or cannabinoid-
related devices to any person under the age of 21 years.
(1) Proof of.age for purchasing or consuming cannabinoid:.products. or cannabino id -
.related devices may be established only by that allowed by Minnesota:Statute
including but not limited to a valid driver's license or state identification card,
a valid military identifcatiion card issued by the United States Department of.
Defense, or by a valid passport.
(2) Signage..Notice of the legal sales age and age verification requirement must
be .posted prominently and in plain view at all times at each location where
licensed products are offered for sale. The required signage, which .will be
provided to the licensee by the City; must be posted in a rnanner that is clearly
, isible to anyone who is or is considering making a purchase.
(c) Samples Prohibited. No:person shall distribute samples of. any licensed product :free
of charge. or at a nominal cost.. The. distribution of cannabinoid. products as a free.
donation is prohibited.
(o) Hours of Sales: No sales of cannabinoid products will be.allowed. at the
licensed.premises. after-lo:oo p.m. and before 8.:oo a.m. daily
(e) Self -Checkout. No sales of cannabinoid products or cannabinoid-related devices may
becompleted through self -checkout. A Iicensee or licensee's: cleric must process each:
transaction at a point of sale.
.Sec. 11-51S. Storage and Dis play.
It shall be unlawful for a licensee under this Article to allow the sale of cannabinoid
products or cannabinoid-related devices by:.any means whereby a customer may have access
to such -items without having to request the item from the licensee or the licensee's employee.
and whereby there is not a physical exchange of the cannabinoid product or cannabinoid-
related devices. between the. licensee or his clerk and. the customer. All cannabinoid;product
or cannabinoid-related devices shall either be stored behind a counter or other area not
freely accessible to customers, .or in a case or other storage unit not left open and accessible
to the general public. This section does not apply to exclusive.cannabinoid/tobacco stores.
All licensees under this article shall be responsible for the actions of their employees in
regard to the sale, offer to sell, and furnishing of licensed products on the licensed.premises,
and the sale, of` such an item.by an employee shall also beconsidered. a sale by.the license.
holder.
Nothing in this section: shall be construed as prohibiting the city from also subjecting the clerk
to. whatever penalties .are appropriate under this article,. state or federal law, or other
applicable law or regulation.
Sec:,11-51 & Pricing and_Disc_vun#ins€,
(a). Prohibition on the sale of cannabinoid products for less than the listed price..
No cannabinoid retailer shall:.
(i) Honor or accept a price. reduction instrument in. any transaction related.to
the. sale .of cannabinoid products. to; a consumer;
(2) Sell or offer for sale cannabinoid products through any multi -package discount
or otherwise provide a cbnsumcr any cannabinoid products for less.than the
Listed Price in exchange for the purchase of any other cannabinoid product;
(3) Sell, sell at.a discount; offer for sale, or otherwise provide any product other
than cannabinoid products in exchange for or in consideration of the purchase
of cannabinoid products;
(4) Sell .for- a nominal price or provide free.of charge any cannabinoid product
or cannabinoid-related devices; or
(5) Otherwise sell., offer for sale, or provide cannabinoid products for less than the
Listed Price. In. addition, cannabinoid retailers must sell, offer for sale, or
piovide cannabinoid products for the same listed price. every day of the week in
a given week.
Sec. 11-619. Compliance checks and inspections.
All licensed premises shall be open to inspection by the. city public safety officers, or
other authorized city.official during regular business hours: From time to time, but at least
once per year, the city shall conduct compliance checks by engaging, with the. written consent
i of -their parents or guardians for individuals under age 18, persons over the age of fifteen (15)
years but less than twenty .one (21). years, to enter the.licensed prernises.to attempt to
purchase cannabinoid products. Persons used for the purpose of compliance checks shall be
supervised by city designated public safety officers of other: authorized city official. Persons
used for compliance ehecks shall not be guilty of the unlawful purchase or: attempted purchase
or the..unlawful possession.cannabinoid products when such items are obtained as part of
compliance check. Nothing in the. section shall prohibit the city from conducting compliance;
checks in accordance with state and. federal law.
Sec. 11-620. Criminal acts.
Unless otherwise..proyided, the following acts shall be amisdemeanor.
(a) Sales: It. shall be a violation of this article far any person to. sell any
cannabinoid products to any person under the age of 21.
(b) Possession, It shall be a violation of this article for any person under the age of 21
to have. in his or. her possession. any cannabinoid product. This subdivision shall
not. apply to persons: under the.age"of 21 lawfully -involved in a compliance check.
(c) Use. It shall beaviolation of this article for any person.under age 21 to use
any cannabinoid. product.
(d) .Procurement. It Shall"be.a violation `of this article for any person under age 21 to
purchase or sell. or attempt to purchase or sell or otherwise obtain any
cannabinoid.product and it shall be, a violation of this article for any person to
purchase or -sell to: or. otherwise.:obtain such items on behalf .of a person.under the
age of 2L It shall further be'a violation for any person to coerce or attempt.to
coerce.a.person under the age :of 21 to illegally.purchase or otherwise obtain or
use any cannabinoid product. This, subdivision shall not apply to persons under^
the age of.21lawfully involved in a. compliance check.
(a) Administrative procedures. Any violation of this article may be penalized by
the issuance of an administrative citation and resolved in accordance with
chapter 26, article III, administrative citations .and civil penalties, of the: City
Code:
(b) Misdemeanor prosecution. Nothing in this section shall prohibit the city from.
:seeking criminal prosecution under Minnesota Statutes. Whoever violates any
provision of this article shall be. guilty of a misdemeanor: if the city elects. to seek
misdemeanor prosecution, no:administrative penalty shall be imposed.
(c) Cpntinued violation. Each violation, and every day in which a violation occurs
or continues, .shall constitute separate offense.
Sec. 11-522. Penalties..
(a) .licensees. Any retail license or permit issued or approved under this chapter shall
be.suspended for a period of time. determined by subsection {bj .or revoked upon
finding tbat within one calendar year, the retail licensee is:responsible for three
violations which fail to comply with applicable statutes,. rule or article related to
the. sale, possession and use of cannabinoid products or .cannabinoid-related
devices. No suspension or.revocation shall take effect until the licensee or permit
holder has.received. proper notice and has been afforded an opportunity for a
hearing before the city's selected impartial examiner. The: city council may-impose
penalties provided in this Article.on the retail licensee who sells cannabinoid
products or cannabinoid-related.devices products as. defined in: this article to any
persons under the age of 21 years. Nothing in this section shall prohibit the city
from seeking an administrative penalty as provided by resolution of the city
council.
(.h) Penalty.terrtzs. If a licensee ar an employee of a licensee is :Found to have. violated
this article, thelicensee:" shall be subject to an administrative penalty as. follows:
(1) First violation: The city shall impose a civil fine established in Article I Sec. 2-
3. in addition, the. city may suspend. the license for. a period up: to 6o days.. The
city may agree with the. licensee. to waive up to.ten days of suspension at a rate
of two days :for every eight. hours of community service performed by
licensee's employee.
(!a) Second violation: The city shall impose a civil f ne-established in Article I Sec. 2-
3 , In addition, the city may suspend the license for a period up to :go days. The
city may agree with the licensee to waive up to ten days of suspension at.a rate
of two days for every eight hours of community service performed by
licenseo' employee.
{3) Third-dolation: The city shall impose a civil fine established in Article.I Sec.
2-3 and suspend the. license fora minimum period of x8o days, not to exceed
One year:
(c) Other individuals. Other individuals, other than persons under the age of 21
regulated by See. 11-520 of this article, found. in violation of this article shall be.
charged an administrative penalty as.provided.byordinance:of the city council.
Sec. 11 -523Appeal.
(a) Notice of action: If the city.clerk:or designee denies the issuance of a license or
revokes a.license that has been issued, the applicant must benotified in Writ ing.of
the decision the reasons for the denial or revocation and the applicant's right to
appeal the denial or revocation by requesting, within 20 days of: receiving. notice of
the denial or revocation, a hearing before the. city's §elected impartial examiner. The:
city's selected.impartial. examiner shall hear the appealwithin. 20 days of the date of
the request. The decision of the.city's selected impartial examiner can be appealed
by petitioning the Minnesota Court of Appeals for a writ of certiorari.
Sec. 11-524. Severability.
If any. sectionar.provision of this ordinance is held invalid, such invalidity will not affect
other sections or provisions that can be given force and effect without the invalidated section or
provision.
Sec. 11-525. Effective Date.
This ordinance shall take.effect.frorn and aftef its passage and publication: as.required by
law.

AN ORDINANCE DEFINING NUSIANCES, PROHIBITING THEIR CREATION OR MAINTENANCE
AND PROVIDING ITOR•ABATE MENT AND PENALTIES FOR VIOLATION THEREOF.
THE CITY COUNCIL.OF T1IE CITY OIL GEIVI LAK.E.ORDAINS:.
Section 1. Public Nuisance Defined, A public nuisance.is a thin&.act., or use. of property which shall;
1. Annoy, injure, -or endanger the health, safety, conifgrtq or repose ofthe pub[ic;
2. Offend.public decency;
.3. Unlawfully interfere with the use of of obstruct, or tend.to obstruct or render dangerous for passage,'a
public Water, park, sq unrc,. street, alley, or highway;
4; Depreciate the value. of the property of the inhabitants of the City.of Gem Lake or of a.considerabl:e.number
thereof;. or
5. In anyway. render the inhabitants of the City of .Gem Lake; or a considerable number thereof insecure in
Iii.fe or. in. use pf property.
Section 2. Definitions.
L The term "City" as used herein means the City of Gem Lake,
1 The term "person" as used hcrein includes. any person, firm, or corporation, and the singular.shall include
the plural.
3. Where references are.made. herein to particular officers,councils: boards, or. agencies, such officers,
councils, boards, or agencies are thoseof the. C'.ity..of Gem Lake,
4. The term "C.aunciI" as. used Herein means the City Council of the City of Gem Lake.
Section 3, Puhiic Nuisances Affecting I-1ealth, Safety, Comfort; or Repose. The foliowing.are hereby declared to
be public nuisances, affecting:health, safety, comfort, or repose:
1. All decayed or unwholesome food offered for sale to the public;
2: A]Idiseaseu.animals running at large;
3. Mi.]k which is produced by cows. which. have riot been tested and .found free of tuberculosis within the
year previous .to the offering of such .milk for sale to the public;
4. Carcasses of all itnals not buried or destroyed within 24.3tours. after death;
5. Accumulations:af manure or rubbish;
G. Privy vaults and garbage.cans which are not fly -fight;
.7. Dumping: the contents of any cesspool, privy vault, or garbage call except at places authorized by law;
S. All noxious weeds and other rank growth;
1. An accurnulation:oftin cans, bottles, o.rtrash or debris .ofaa.ynature.ar description; and the.throwing;
dumping, or depositing 6fany dead 'animals, manure, garbage.; waste, &cay.nig matter, ground, sand,
stones, ashes, rubbish, .tin.cans, or other materials of any kind on private property;
1.0. Dense smoke; noxious fumes, gas, and soot.or cinders in unreasn.nabl.e.gpantities;

Section, 4. Public Nuisances Affecting :YIorals and Decency. The following. are hereby declared to be public
nuisances affecting: public morals. and decency.
1. All ..gambling devices..sIot machines, and punch boards;
2. Betting, bookmaking, and all. apparatuses.used in such occupations;.
3. All houses kept for the purposes of pros fitution'or promiscuous sexual intercourse, gainbling.houses,
houses of ill fame,.and bawdy houses.
4. All places where intoxicating liquors are man ufactured..sold., bartered,.or given away in violation of law,
or where persons are permitted to. re sort for the purpose :of drinking intoxicating liquors a$ a beverage.
contrary to lawor where intoxicating liquors are kept far sale, barter, or disftibution;in yivlation af..law,
and all Iiquor bottles, kegs, pumps, bars, and,other property kepi at and. used. formaintaining such'a
place;
5. Any vehicle used for the illegal transportation of intoxicating liquor or any immoral purpose;
G. All indecent or obscene pictures.. books, pamphIets,.magazines ; newspapers, and billboards;
7. The public use of profane'or obscene language;
8. The looking into or peeping through doors, windows, or.open ings or private.honies by inetliods of stealth
acid without proper authority and by surreptitious methods, Or what is commonly known as "window
peeping": and.
9. All 'other things, acts, omissions, or .occupations that may be considered detrimental to tlic moral.
wellbeing of the: inhabitants of the City or a considerable number thereof.
Section S. Pit41ic:Nuisances Affecting Peace and Safety: The fallowing are declared to be nuisances affecting
Public peace and safety:
1. All snow and ice not removed from publicsidewaiks twelve ( 12) hours after the snow and ice:.has ceased
to be deposited thereon;
2. Ail wires. which ate strung: less. than Fifteen (15) feet.above the surface of any public street or alley;
3. All buildings, walls, and other.struetures which have. been damaged by:f re, decay, or otherwise to an.
extent..exceedijig one ha..If:the.ir.original.value:or w.hich;are so situated as to endanger.tlic safety of the.
public;
4. All explosives, inflammable Iiquids, and other dangerous substances of inaterials stores or accumulated
in any manner or in any amount other than that provided by 1aw:or ordinance;
5. All tine of dispIay:of fireworks exccpt as provided by. law or ordinance;
G.. All unnecessary noises and annoying vibrations;
7. All buildings and all alterations to buildings made or erected in violation of fire..ordin.ances concerning.

8. Obstructions and excavations affecting the ordinary use of the.public of streets, alleys; sidewalks, or
public grounds, except under such conditions as are provided by ordinance, and any other excavation left

11. The use of property abutting on a. public street or sidewalk, or any use of a public. street or sidewalk,
which cause large crowds of people to gather, obstructing traffic and the free use of public.streets or-
si dewalks:
12. All hanging signs, awnings, and other siinilar.strr ctUres over public streets or sidewalks; or so situated as
to endanger public safety, not conslrui ted:and maintained as provided by I.aw.or ordinance or without
proper permit'.

18. Making repa'ii's to motor vehicles or tires in p ub!ic streets or alleys, excepting only emergency repairs
when it.rvill not unduly impede or interfere with traffic;
19. Throwing, placing, depositing, or burning leaves, trash, lawn clippings, weeds; grass, or other material in
the streets, alleys, or gutters;
24. 1~recting, painting, or placing of unauthorized traffic signs or advertising signs in streets or alleys aeon
sidewalks;
21. All unnecessary interference and disturbance of radias.or TV sets caused by defective electrical
appliances. and,equipment or improper operations thereof and

Section G. Traffic and Vehicles
6.1 Snowmobiles
1. 1ncorporatiou by Referenee. The provisions afMinnesota Statutes; Sections 84:84 through 84.90, and the
provisions: o.fthe.Regulations of the Minnesota Com mission er of Natural Resources contained in Sections
74G.0...5100 and 7460.5200.. of Ntinnesata Rules 1989, and. any.arnendmonts to: thase.statutes or regulations
or substitutes for those statutes or regulations that may from time to .time become effective, are: hereby
Adopted and incorporated herein by reference.
2. ,Liinitation of 0perati6m No person shall operate a snowmobile in the City of Gcih Lake except on public
trails, waterways, and highways specifically designated for such use„or on pr i vat c. property where lawful
permission has:been obtained from the property owner; occupant, or lessee: No.snowinobile shall be
operated within any public right-oPway or on a public sidewalk: or trail provided or used for pedestrian..or
bicycle travel.
3. Hours of Operation. No person shall operate a snowmobile in the City of Gem Lake between the hours of
eleven (1 1) o'clock.p;inI and seven (7) o'clock an. time in Ramsey County; Sunday through
Thursday, And from one (1.) o'clock a.m. to seven (7) o'clock a:TM on other days, including the day
preceding a national liol'iday,

4. Speed. No person shall. operate.a snowmobile in the City of Gem Lake.ar a speed in .excess of limits
specifically posted for such use or as a speed in excess of fifteen (15) miles per hour with in one.hundred
fifty (150) feet .of any fisherman, fish house, pedestrian, skier, skater, skating rink, sliding.area, ski tow
area, or other areas where such aperatian would conflict with or endanger other persons or property:
5. Taw Bars. No. person shall operate a snowmobile so as to tow any person, sIed;:or other conveyance,
except by the use. of a rigid low bar attached to. the rear of such srtowinobile. Persons towing disabled
snowmobiles shall .be exempt.
G. Mandatory. Lights. No person shall operate a snowiiiobile unless such vehicle is equipped with ahead
light and taillight that are illuminated. :at all times:during such .operatiQn. Snowmobiles equipped with an
engine of five (5) horsepower or less shall be exempt..
7, Mandatory Pendant. No. person shall operate a snowmobile unless such vehicle is equipped with a red or
orange blare pennant flag of at least forty (40) square inches in area and displayed at a hcight of not less
than five (5) feet above the roadway.
8: Autharixed Sno► mobiles. Authorized snowmobiles may be used on any public property within the City
for rescue, emergency or law enforcement purposes.
6.2 All -Terrain Veh icles:— (A,rvs)
1. Limitation o.f` Opt ration. No person shall operate an all -terrain vehicle in the City:of Gern Lake except on
public tra.i Is; waterways, and.h ighways specifically designated for suclr use, or on private property where.
lawful permission has be en obtained from the property.owner, occupant, or lessee. No aII-terrain vehicle
shall be. operated within any public right-of-way or .on a. public sidewalk or trail provided or used for.
pedestrian or bicycle travel.
Z Hours Of Operation: No person shall operate -an a] 1-terrain veh icle in the City of Gem Lake between the
]tours of eleven. (11) o'clock p.rn. and seven (7) o'clock a.m.. prevailing time in Ramsey County, Sunday
through Thursday, and rrom one:(.] ) o'clock a.m..to.seven (7) o'clock a. In. on other days,.incfuding the:day
preceding a national Holiday.
3. Speed. No person shall operate an all -terrain. vehicle in the.0ty of Gem Lake at speed In excess of limits
specifically posted for such use or as a..speed in excess of fifteen (t5).miles per. hour within one hundred
fifty (150) feet of any fisherman, fish house. pedestrian; ski er,:skater. skating rink, sliding. area, ski tow
area; or other areas where sucIT:operat ion would conRict with or endanger other persons OC propertyy.
4. Authorized Al1-Terrain Vehicles. Authorized all -terrain vehicles may be used on any public property
within the City for rescue, emergency or law cnfomentent purposes.
6.3 Use of Streets and Highways; Incorporating State Traffie.Laws
I. Highway Traffic Regulation Act Incorporated by Reference. The regulatory provisions. of ,.M innesota
Statutes, Chapter 16.9, and any amen. dnrents.thcreto or substitutes therefor that may from tirne to tune
become effective, are hereby adopted as a traffic Ordinanceregulating the use of highways, streets; and
alleys within the City of Gem Lake and are hereby incorporated in and Macle.part of this code as completely.

2. Penalty. Any violation of the statutes adopted by reference. in 6.2.1 is a violation of this..Code: when it.
occurs within the C:ityof Gem Lake.

6.4 Parking Tiegulations
1. In General. It is unlawful for.any person to stop, stand or.park a vehicle, except when necessary to avoid
conflict with other traffic.or in compliance with the specific directions of a poIice officer or traffic control
device, in any of the following places,
I) ❑rt a sidewalk;.
Z) 111. Front of'a public. or private driveway;
3) Within an intersection;
4). Within ten (1.0) feet -of a fire hydrant;
5) On a crosswalk;
6) Within twenty.(20) feet of a crosswalk at any in temect i oil;
.7) In a sign -posted fire lane;
8) Within thirty (30) feet upon the approach to.Ali y flashing beacon, stop sign or traffic control signal
located atth.e side .of a roadway;
9) Within fifty (5.0) feet ofthe.n.earest rail.ofa railroad crossing;
10) Alongside. or opposite;aity street excavation or obstruction when such stopping, standing or
parking would obstruct traffic.,
0) On the roadway side of any vehicle..stopped or parked at. ti1e edge or curb of a street;
I2) On any bridge or elevated structure. ofa.street;
I3). At any place where official signs prohibit stopping;

I Passenger Vehicles.. No passenger vehicle shall be parked. oil any street. within the:.City of Getn Lake for
more than.seventy-two.(77) consecutive hours.
3. Winter Parking. Restrictions. The parkin; of any motor vehicle. upon any.road or street in G.em Lake is
prohibited between the hours of2:00 a.m. and 6:00 a.m. from Novernbee I'through April 111 of each year.
4: Snowfall Rest rietions:.No inotor vehicle shall .be parked .on any street or bouIe.vard:.within the City of Gent
Lake after.a.snowfall of one (1) inch or more which.necessitates the plowing and removal of show front the
streets and. boulevards .in. the City until such: time. as the plowing and. snow removal is completed. No motor
vehicle,. trailer, or other obstruction shall .be. located within two (2) feet of any street or boulevard afie r.a

5. .Enforcement. When any Cominuility Service Officer finds a vehicie.stnnding or parked on.any street in
violation of this Ordinance, such officer is hereby authorized to move such vehicle or require the driver or
other person in charge.of.the vehicle to move the same. When any.Police 'Officer finds a vehicle unattended.

Section 7. Weapons
1. No person in the City of Gem Lake shall have in his possession., except within his oven domicile, or carry;
use, or discharge any air gun,."BB" gun, gas -operated or spring gun, or any other sirnilar:type instrument
for the purpose oftIt row ing or projecting inissiles of.art y kind whatsoever, whether such instrument is
called by arty naive set forth orany other name,
2. The prohibition of 1,1 .above shall apply in. private grounds or premises under circumstances v%,hen such
instruinent.can be.and is fired, discharged, or operated in such a inamrer as to end.anger.persons, property. or
iviId animals or birds; and further provided that nothing herein contained shall be construed to prevent the
carrying. of any #ype duii whatsoever when unloaded and properly cased.
3. Aity persan wishing to:discliargc any iitstmrnentrefor rcd to in 7.1.For sotme.special reason or purpose must
secure a.written permit From the City Council.
Section 8. Curfew for Minors
1. Restrictions. on Minors. It.shall.beunlawful. for any minor under the age of s.irteen (16)years:to loiter,
idle, wander, stroll, or play in or upon. the public streets, highways,. road. s,.aIIeys, park s;.pl.aygrounds,.publ.ic
places and public buildings; places of entertainment -an d amusentenf, vacant lots,:and other.unsupervised
places in the City of Gem Lake between the hours of fen WeIock p,m. and. five o'clock a.m. the following
day. It shall be unlawful for -any minor who is:sixteen (16) or seventeen (17.) years of age to loiter, idle,
wander, stroll, or play in or upon public streets, highways;. roads, alleys, parks, playgrounds, public places,
and public buildings, places of eitteTtainincrit anti amusement, vacant lots, and other.unsupervised places iri
the: City. of Gem lake between. the:hours of twelve o'clock midnight and five o'clock the following
morning, Provided, however, that the provisi.ons.of this section do not apply to. a rninor accoi A p an i ed. by his
or ]ter guardian,. or other adult person having the care and custody of the ininor. to a minor who is upon.an
emergency errand :or other legitimate business directed by Iris or her parent, guardian, or other adult person
having the care and custody .of the minor, or where the. presence: of said minor in said place or places -is
connected with and required by some legitimate business directed by his or her parent, guardian, or other
adult person having.the.care and custody of the.irtinor, or wherethe presence of said minor in said place or
places is connected with arequired by. soine.legitimate..busittm, trade, profession., oroccupation in which
said minor is perinitted.by law to be on. gaged;
2. Duties Of Parents or Guardians. It shall be unlawful for the parent, guardian, or:other adult person having
charge of a minor under the Age of eighteen (1.8).years to. permit such .minor. to Iviter, idle, wander, stroll, or
play in or upon the public streets. [Iighways, roads, alleys,. parks; playgrounds, public places and public

Gem Lake during the hours prohibited by this: Ordin ance;. provided, however, that the provisions of this
section do.not:app]ywhen..the minor is accoin pan1ed by ]I is or her parent,.guardian, or 'other adult person
haviitg the. care: and custody of the minor, where the :miitor is upon art emergency errand or legitimate
business. directed.byItis or leer parent, guardian., or other adult person hating the care:and custody of the.
minor, or where the presence.of said. minor in said place is connected with and required by some legitimate
business, trade,:profession, or occupation in which said minor is permitted bylaw to be engaged.
3. Minors in Amusement Places. No person, operating & in charge of any place ofamusement,
entertainment,: or reftesliment shall perm it any minor under the age: of eighteen (13.) years to remain in such
place during the.hOurs prohibited by. this Ord iriance; provided, however, that the provisions of this section
sha]1.itot apply when such minor is ace ornpan ied by his. or her parent, guardian., or other adult person
having the care.and .custody ofthe: minor.
Section 9.. Duty.of owners: aitd occupan ts.; removal. of nuisances by City

sidewalk shall use diligence to keep such walk. safe for pedestrians: No such owner or.oceupant. slialI allow
snow, ice, dirt, leaves,.or rubbish to remain on the sidewalk longer than 24 hours after its deposit.
I. Weeds.. Any weeds, whether noxious. as defined by law or not,:growing upon any lot.or parcel of land
outside the traVeIed.poi*fion of any public street or. a]Iey in the. City to a freight of six (G.) inches or greater or
which have..gone or are about to go to seed are. hereby declared a nuisance. The owner and the occupant
sha..II abate. or prevent the nuisance on the.property and on. Iand outside the travel ed.portion of.the public
street or alley abutting: on public property. The City shall give the owner and occupant written notice
directing the abatenient of such weeds, and stating that if not destroyed by the City at the expense of the
owner; and that, if not paid, the charge.for such work shall be made.a special assessment against the
property concerned.
3. Removal by City. The City Public Works Supervisor may cause removal of the nuisances specified in 9.1
and 9.2 upon expiration. of the period of:time.. given the owner and.occupant in those sections to remove the
nuisance, The City Public Works Supervisor shall keep.a record shoving the cost of the removal adjacent,
to each ;separate lot and. parcel.
Section 10. Portable Storage l Disposal Con tanler Unit,
1. Definition. The. following definition shall apply to. this ordinance:
1) Portable Storage l Disposal Container Uiiit� shall mean any enclosed or open container
constructed of any material used for temporary or longterm storage of personal property or any
container used.to dispose oFsolid waste; construction debris; or any other refuse:
2. No property owner or. person shall Store .on.a,residential propertya portable storage 1 disposal container unit
more than thirty (30) days in any 12-month period starting with the day I date. thecontainer unit is first
moved -on -site: All portable storage 1 disposal container units must. be stores.on an. impervious surface. on
the. property. The City may grant a time extension of an additional sixty (60) days .provided the property
owner gets City Council approval for the container from the City, In no case shalI a portable storage 1
disposal container unit be stored.on a property more than. ninety (96) days in any 1.2-1 uonth. period..This:
pro -Vision applies to all residential properties includingsingle family homes, townhouses; condominiums,
and multi- farnilycoinplexes.
3. Portable storage I disposal container units stored on residential properties. in conjunction with a building
perniit 0r home improve inent project are exempt from theseprovisions, exeept.for th e: req uireni en t to keep
the container unit on an impervious surFacc..ln such case, the property own er.shaII make every effort to
adhere to a 120 day maximum time limit,.
4. Portable storage l disposal container units .meeting the definition set forth in Section 1.6. L.I which are used
for reguIar refuse and recycling pick-up on commercial or industrial properties shall be exempt.
Section 11. Methamphetamine Labs.
1. Purpose and Intent.
The purpose.ofthis. Section js to protect. the publichealth, safety and welfare anal roduce public exposure to
health risks where law enforcemen.t.officers (rave dcterm.ined:thAt hazardous chericals from a. suspected
clandestine.drug lab or chemical. dump site may.exist. These conditions present.health and safety risks to
occupants and visitors of such structures and land through fire, exp los ion. an d. skin. and respiratory exposure
to chemicals. The -City Council funds that such sites may contain hazardous:chemicals, substances, or
residues that pIace.pcop le, particularly children or adults of 6hild;bearing age,. at risk of exposure througli
inhabiting theproperty, visiting the propertyor using or being exposed to. contaminated personal property..
2. 17efinitians.
1) ChiId -- means any person less .than 18 years of age.

lab. site includes any dwellings; accessory structures, buiIdings, a chemical dump site, a vehicle,
boat, trail:er or other similar appliance or any other area, Iand:or location.
.5) Cleanup — means proper removal and/or containment of substances hazardous to humans andlor
the environment at a clandestine drug lab site or chemical dump site.
GJ Controlled substance •-means any drug,. substance or immediate precursor in Schedules 1
through V of lvlinncsota Statutes.5ec(ion 152.02. The term does not include distilled spirits, wine,
malt beverages, intoxicating Iiquors. .or tobacco.
7.) 9wner—.nzeans..any person, firm, eorporation,..ar other entity wha owns, in who]e or in part,. the

S) Public health Nuisance - means a nuisance. as defined above or under Ntinnesota Statute Section
145A.02, subdivision 17.
9.) Rente(1iAtion - means methods sudh as.assessrnent, evaluation, testing, venting; detergent
scrubbing, enclosure, encapsulation, .demolition, and/or rernmat of contaminated materials. From a
clandestine drug lab site or chemical dump. site.
3. Declaration of Property as a Public Health Nuisance.
1) Any property containing a clandestine drug labor chemical dumpsite willl bedecl.ared. a public
health nuisance.
2) No person may occupy,. enter or aIIow occupan cyar entrance to property declared a public health
nuisance under this Section until such declaration is vacated or modified to. allow occupancy.
4. Law Enforcement Notice to Other Authorities.
Upon identification of a:clandestine.drilg lab site or chemical dump site deemed to place neighbors; visiting
public, ar present and ttiture occupants of the affected property at risk for exposure to harmful
contaminants and other associated conditions, law enforcement officials .shall notify the. City
Environmental Health Ol'ficiat. and other appropriate municipal, child protection, and. public.lieaith.
authorities of the.prop erty Iacation. the property owner: if known, and conditions found.
5. Seizure. of Property.
l.) If a clandestine drug labor chemical dui rzp site is located inside a vehicle; boat, trailer, or oilier
form of moveable personal property, law enforcement authorities may immediately seize such
property and transport.it to a more secure location.

the dwelling or property.

iii. Neighbors within close proximity. that can be reasonably affected by the conditions
fou nd;:
iv. The.Rains ey County Sheriff's Department; and
v.: Other state .and local authorities, such as the Minnesota Pollution Control Agency acid the
Minnesota.Departmentof Public .Health, which are known to have public and
environmental protection responsibilities:applicable'to the situation.
4) Any rental license. issued by tile City for the property is. immediately suspendedupon issuance of
the Declaration of Public Health Nuisance.. Stich..license will be. reinstated only alter full
compl fiance with an abatement order,
5) After issuance of the Declaration of Public Health Nuisance, tile City.Environmental.Lfealth
Official will issue an order to the property owner to abate tl.ie public health nuisance. The
abatement order will include the following:
i. A copy of tlie: Declaration of Public Health Nuisance;
ii. An order to immediately vacate those portions of the.property, including building or
structure interiors; which inay place the occupants or visitors at risk;
M. Notification ofsuspension of th e r6ital. I icense, if applicable;
W. A.su.nimhry of the.own er's and occupaft t's responsibilities;.
v. Intbrm.ation on locating professional services necessary to remove and abate the -public
health nuisance status as provided. in this:Ord inanceand Mim)esota. Statute:Section

7. Responsibilities:ofOwner.
1.) Up.on receipt of an a bate merit order by the C.ity's .Environmental Health official, the property
owner must, at the owners expense.
L .1mniediate Iy.vacate those portions of tile property, including building or structure
interiors that may place the occupants. or visitors at risk. This includes dwellings,
buiIdings, motor vehicles, trailers, boats, appliances or any other affected. area or
Iocation. .hi o person sha]I occupy, enter or allow occupancy or entrance to a building or
structure declared a.Pub[ic.Health Nuisance until.suchdeclaration is vacated or modified
to. allow occupancy;.
B. Properly secure and post warning signs on the.periineter of any contaminated areas on the
property in an. effort to avoid exposure to uns.uspectirig . pat! ies;
iii. Promptly contract wi.th-on e.or more acceptable env 1 ronniental Hazard testing and cleaning
firms (acceptable firms are those that leave provided assurance. of appropriate equipment,
procedures, and personnel, as determined by the Minnesota Department of Health) to
acconiplish the following:

contamination of the personal. property therein;
2: Soil testing of the site and testing of all. propertyand soil in proxiinity to the site

3. A. complete cleanup of all properly and soil at the. site and lit proximity'to the
site that is found. to be affected by conditions found at the site (in c.ludit g but not
limited to, the cleanup or removal of contaminated plumbing, ventilation
systems; fixtures an.d contaminated soil) or a demolition of the site all a
complete cleanup ofthe.demolislied site;
4. Remediation testing and follow-trp testing to determine all health risks are
sufficiently reduced.,accoroi#ig to: the Minnesota Department of Health
guidelines, to.allow.:safe h.unzan occupancy and use of the site and use ofthe.
personal property.thereir3.
iv.. Regularly notify the (iiy of actions taken and reach agreementwith-th6.City on .the
cleanup schedule, The.Gty shall consider practical limitations and the availability of
contractors in approving the schedule for cleanup; and
v. Provide Nvritten.docuinentation to the City of the. cleanup process, including a signed,
written statenient that the property is safe for hurnart occupancy and that the cleanup was
conducted in accordance.%vith Minnesota Departient of Health guidelines.

8. Owner's Responsibility for Costs.

drug lab sire or elicit ical dump site, including,. but not limited.to, costs for:
1). .Ernergency Response;
2) Posting and physica] security of the site;
3) N•otificati.ons.ofaftected parties;
4) Expenses related.to the recovery of costs, including the assessment. process;
5) Laboratory Fees;
6) Cleanup. services;
7} Administrative fees; .and
8) Other associated costs
9. City Authority to iitiate. Cleanup and Recovery of Costs.
1) I.f; within.ten (1.4) days: a..fter.service of notice of the Declaration of Public Health Nuisance. the.
City :is unable to Iocate the property owner or ifthe City Envirannienta]H.ealth Dffcial deterni I Re s

accordance With .N1innesota Statutes.Chapter 463, Section 14 of this Ordinance or by any other

recover a]I costs associated with such abatement plus an: additiona] 25%p of the Citys costs for

against the person or persons who own%the property in the.matt er.that taxes and special
assessments Are. ccrtif.ed:and collected pursuant to Minnesota Statutes Section 4B.101.
10. Authority to Modify or Remove Declaration of Public Health Nuisance..
1] The En v ironm en ta I Health Official is authorized to. modify the Declaration conditi.ons..or remove
the. Declaration of Public Health Nuisance.
2} Such modifications or removal of the Declaration shall. only occur after documentation from a.
qualified environmental or cleaning firm stating that the health and safety risks, including those to
neighbors and potential dwelling occupants, are sufficiently abated or corrected to allow safe
occupancy of the dwelling.
Section 12..Enforcement. It shall be the dutyofthC.Co..uncil to enfor. Cc. the provisions of this Ordinance, and the
Council may; by resolution, delegate to other officers or agencies power to enforce particular provisions.:ofthis
Ordinance, including the.p.ower to inspect. private premises,. and.theofficers charged with enforcentent..of this.:
Ordinance shall take all reasonable precautions to:.prevent the. cominission.and in aintenance.vf public.nuisances:
Section 13. Powers of.Ofticers. Whenever, in the judgement of the officer charged with enforcement, it is.
determined upon investigation that public nuisance is being maintaiiied.or exists within the City. such officer shall
notify in writing the person committing or maintaining such public iuisance and require hirri to terniiriate and abate
said nuisance.and to remove such conditionsor remedy such defects: Said written notice shall .be served on the
persori.committing or maintaining said.nuisance, in person or by registered. mail. If the. prcin ises are not occupied
and the address. of the:owtter is unknown, service. on the owner may be had by posting a copy of the notice on the
premises. Said notice shall .require the owner or occupant. of:such premises, or :both, to take reas on a b I d. ste. p s and.
tirne to be. designated in said notice, butthe maximum time for the removal or said nuisance after service. -of said
notice shall not in any event exceed thirty t3[i.} days. Service of notice maybe proved by tiling an affidavit. of
service. in the oflice of the City Clerk setting forth the manner and time thereof.
When an order so.g ven is not.coinplicd with.. such noncompliance shall be reported forthwith: to the Council .for
such action as may be necessary and deemed advisable in the name of the City to abate and enjoin the further
continuationof said nuisance.
Section .14. Abatement of Nuisance by Council.
1. Normal procedure. If, after such service of notice, the person served fails to abate% the.nuisari cc or make
the necessary repairs, alterations, or changes -In accordance with the. direction of the ` Council, .the Council
may cause such.nuisance to.be abated.at the:.expense of the CounciI and recover such expenditure, plus an
add itionaI twenty --five percent (?5%a) of such expenditures, by civil action against the person or persons
served., or of service has been had upon the owner or occupant by ordering the Clerk to extend such sum,
plus twenty-five percent (2S.°/o) thereof; as a special tax against the. property upon which thcnitiSan ce
existed and to certify the.sarnei to tlte'couaty auditor -of Ramsey Cotiitty; Miin esota, for collection i» the
same inanner as..taxes and.spce1aI assessments are certified and collected.
2. Summary enforcement:1a cases: where the. del ay in. abate mentrequire d to complete the.noticc and
procedure requirements set forth in sections 1.3 and 1.4.1 will permit a continuing nuisance to. unreasonably
endanger public licaIth, safety or welfare, the Council may order summary enforcement and.abate the
nuisance. Tlte:officer charged with enforcciaent shall determine: that a public. nUiwicc exists. or is being
maintained on premises in the City.and that.delay in abatement of the iitiisance will unreasonably endanger
public health, safety. or welfare. The enforcement officer shall notify in. writing the occupant .or.owneror
the premises of the nature of the auisance,and.of the City's decision to seek summary enforcement.and the
time and place of the Council meeting to consider. the question.of sunnnary enforcement. The Council shal I
determine whether or not the condition identified in. the itotice. to the own er..oroceuPat] t is a nuisance.

3. Emergencies. The Cilymay, without notice or other process;. immediately abate any condition which poses.
an imminent and serious hazard to human life or safety.
4. Re s 1) onsi b i I i ty fo r cost. Ili. cases of summary or emergency en faccement,. the owner of premises on which
a nuisance has been abated by the.City shall .be personally .liable for the cost to. the City of:the. abatement,
includirig .adnunistrative costs. The Clerk shall prepare a bill once costs have been determined and present
it to the..Rwner, due ZRd payable immediately.
Section 15. Assessment. On or before September l o . f each year, the Clerk shall. list al the total .unpaid charges ror
nuisances' abatement and .for each type of current service and charge described hereubder against each separate lot
or parcel to Mi. ich. they are attribinable tinder this Ordinance. The:CotmciI may then Ievy the..charges against:.the
properly ben cfited.as a%special assessment undei• Minn. Stat. § .42.9;101 and other pertinent statutes for certification
to :the county aud itor and collection aloe;g with current taxes the fallowing.year ill annual installments, not exceeding
ten; as the Council may determine in each case. Assessments may be. levied for :charges, including,. but not limited
to:
1. Abatement ofpublic nuisances affecting health, morals and decency, peace and safety, and public property
as described above.
2. Removal. or treatment of snow, ice, dirt, rubbish, weeds, diseased trees or public. health and .safety as
described above.
3. Installation orrepair of water service lines, street sprinkling, street flushing; light street oiling or other dust
treatment of streets; repair ofsid6vaIks acid alleys; and Ilse operation of street lighting system.
The City Council of Genii Lake:authOrizes Ili e.Ramsey County Auditor and the Ramsey County Treasurer to act as
ageltts for the. City of Gem Lake in Ramsey County to collect remaining balances o.Fassessments for improvements
in.cooperation with tha City Clerk and City Treasurer.
Section .16. PenaIties. in addition to any tines, costs, or.assessments provided for by tins Ordinance or other City
Ordinances, the City may prosecute a violation of any provision of this Ordinance as a misdemeanor; and a person,
ifcon vidied, in ay be punished by the niaxirnuill fina and term ofimprisonment provided by Minnesota Statutes§
609.02,.subd: 3, as that statute may be. amended from time to:tinte;
Section 17. Repealer. This Ordinance supersedes; repitiees and repeals.all prior OM!nances.relating to the same
subjects contained within this Ordinance. Any portion. of such prior Ordinances not. incorporated within this
Ordinance is expressly repeated,
