As a part of MMKR's audit of the City's f nancial statements for the year. ended December 31, 2022,
MMKR performed procedures to follow-up on the findings and recommendations that resulted from the
prior year audit. .The prior auditor reported the following findirgs that are no longer findings in the current
year audit of the City:
e Minnesota Statutes require prompt payment of local government bills within':a standard. payment
period of 35 days from the receipt.ofgoods and services for governing Boards that -meet at least
once a month. If such obligations are. not paid within the appropriate time period, local
governments must pay interest on the .unpaid obligations at the rate. of 1.5. percent per.m.orith or
part of a month..One..of twenty-five dis.btlrsements tested was..not.paid within the statutory time
limit. This is not a finding in the currentyear,

Executive Director Perry Petersen shared .with the council how much the need for. the food she If has grown
since.COVID began. The White Bear Area Food Shelf has served as a critical resourcefor.families
experiencing.food. insecurity since 1977. Providing food and.suppoa to over 1,800 families each month,
they work toward elirninating barriers that have traditionally limited access to healthy food for families
living:on a low.or.fixed income.

Joint City Clean -Up Day Results
The joint event was successful. Twelve (1?) Gem (Lake residents took: advantage of the event, one o.f wh.ich
who made three (3) trips. The City plans to partner with.White.Bear Township again next year and will. try
to promote the event even more .to get more participation.
Tessier Road Condition Strategy
At this time no quotes have.been received for the job on. Tessier Road, White Bear Town ship.PubIic Works
is in the process of getting. these. Once. the quotes have been received the City will be informed and the.
Council will have the opportunity to vote on which contractor the City would Ii.ke. to use.: Quotes are. being
received for.reconstr.uction with concrete curbs and with asphalt curbs.
Irrigation Regtiest Update
White Bear Township's Executive Committee is on boardwith putting in an irrigation system at Heritage
Hall, Acting City Clerk Melissa Lawrence is in the.process of requesting a second quote for the project.
Councilmember Lindner doesn: feel that an irrigation system is necessary and that: it is ok for the yardto
be a little crunchy.
Councilmeinlier Cacioppo introduced a motion to present the irrigation requests to White Bear Township,
seconded by. Mayor Artig-Swoiriley. Voice vota taken 4 voted yes. and 1. Voted no. Council member Lindner

Senator Heather Gustafson sent'an email out to all Ramsey County Cities informing them about:z tax
ominous bill being•passed which will grant$3.00 million in public safety aid to every city, county:, and
Tribal nation in. Minnesota. The City of Gem Lake has been granted $23,3b8..00, The money may be used
to provide. public: safety, incluoi.ng. but not .1imited'to community violence prevention and .intervention
progmins,.community engagement, mental health crisis responses., victim services, training programs, first.
responder wellness, or to pay .other personnel or equipment costs.

government the: authority to create an interim ordinance that may. regulate, restrict, or prohibit the operation

like to pass the interim ordinance and create a lnoratorium.to give the Council.a chance.to studythe concept

County. Road E Corridor Update.
The City of White Bear Lake. applied for a grant through Ramsey County that was approved —Meetings will
begin shortly to discuss the next steps.
Nuisance Ordinance Update
There are several different issues in Gern Lake currently that the. City is .trying to address with the help of
City Code Enforcement Officer Mike Johnson. Several visits have been made to one house in particular.. At
this time the City is working on creating enough language to better enforce the. current nuisance Ordinance.

idea to,change the rental license terms. from a biennial license to an annual license. Councilmember

motion to .request a donation in the.amount of $150000 for the White.Bear. Lake Emergency Food

Acting City Clerk will request a donation to be.approved at the .July 'City Council meeting.

City Planner's recommendations.

City :Planner Evan Monson removed the sections regarding vehicles rrom the Nuisance. ordinance -and
created its.own.standalone ordinance. The new ordinance will be discussed at the August Planning

TRANSPORTING, DELIVERY, AND DISTRIBUTION OF CANNABIS PRODUCTS UN THE CITY OF GEM LAKE
"me Cem Lake City Council ordains:as follows:
Section.l. Background.
1, In 202,.the.lv1irgimta..L.egis1ature amended M.S. § I5I,M2 to pennit the sale. of edible. and nonedible.cannabinoid
products That contain no more than 0.3%6f Tetrahydrocannabinol, commonly known as TFIC.
2. The 2023 Legislature approved 2023 Session Law Ch. 63 expanding both the legalization of types of THC and
.cannabis products and.also the types:ofTtIC and cannabis businesses perrnitted.
3. The final. bill establishes a regulatory frarnmork for.adul.t=use cannabis, as well as the lower potency hemp edibles;
moyes the medical cannabis program. under a newly created state agency. called. the OtTicc of Cannabis Managemegt;.
establishes taxes on regulated products; creates grants to assist individuals entering. into. the .legal cannabis market;
amend criminal..penalifes; provide for. expungetnent and resentencing of eertain'convictions; provide for temporary
regulation of hemp -derived edible cannabinoid products; reschedule. marijuana and appropriates money.
4. The state.licensing agency became effective on 7uly 1.. 2023 and will, among others. tasks, establish a model ordinance
for cities, which the City. of Gem Lake would.benefit. from reviewing and analyzing.before. making any decisions
related to cannabis:businesses:and products in the city.

authorized pursuant. to its general poiice .powers,.set forth in Minn. Stat. §:421,221, subd. 32; the City may enact and
enforce regulations or restrictions On Cannabis -Products within the City to protect the public. safety, healtlt: and welfare,
including restrictions and a.moratorium on the sales, testing,.manu facturing, cultivating, growing; transporting, delivery
and distribution; during the pendency. of a study to determine theneed for police power regulations, including but not
necessarily limited to any.addition a] licensing arid perm ittingthatntay bc.allowed,.1f.any, by the. State.

parfof the pi ant of.the genus Cannabis plant;.containirig cannabis concentrate; infused With camatiinoids (incltding but
not Iimited to tetrahydrocan nabinol); extracted...or der ived.froin cannabis plants a can n ab i s. Nwer; synthetically
derived can n ab ino id s, or lower potency hemp edibles that contain more .than 0;3% of Tetrahydro Conn abi no 1, before
January 1, 2025.

PORTION OF THE CHARITABLE GAMBLING. FUNDS TO. THE WHITE BEAR
LAKE AREA FOOD SHELF..
WHEREAS, the City of Gent Lake participates in the. distribution of charitable gambling fun&.
received from the Country Lounge
WHEREAS, the.City of Gem Lake distributes.these funds. to local 501(c)(3) tax exempt
organizations
WHEREAS, the City of. Gem Lake City Council suggested a donation at.their June 20, 1023
mepting i11 support of the White Bear Lake Area Food Shelf.
NOW, THEREFORE BE IT RESOLVED, by the City of Gem Lake, Minnesota, the City
Treasurer is authorized to send $1,500.00.to support the White Sear Lake Area Food Shelffgr
the month of July 2023.
The motion for adoption of the foregoing Resolution was duly introduced by Councilrnernber

2. Access to Property. The Price is based upon completion of

provide Contractor clear and continuous access to the Property

increases if any failure to provide. reasonable access interrupts
Contractor's: Work. Owner shall make toilet facilities available to

hazardous materials, asbestos-containingmaterials, mold; insect
or rodent infestation, or similar conditions.. Contractor has no
responsibility to determine the presence or absence of any Hidden
or Hazardous Conditions affecting the Work. The Price does not

against, dispose of or remedy. Hidden or Hazardous Conditions.

In no event shall the total number of occupants exceed 2 times the number of habitable rooms, iess kitchen, in the
dwelling unit.
2. One Family per Dw e11ing Unit. Not more than one family, except for temporary guests, shall occupy a dwelling unit.
Minimum Ceiling Height. In order to qualify as habitable. rooms shall have a clear ceiling height of not less than 7
feet, 6 inches, except that in attics or top -half -stores used for sleeping, study, or similar activities, the ceiling height
shall be not less than 7 feet, fi inches over at least 40% of the floor area. In calculating the floor area of such rooms in
attics or top -half -stores, anly those portions of the floor area in the room having a clear ceiling height of 5 feet or more
may be included.
4. Access through Sleeping Rooms and Bathrooms. No dwelling unit built after 1940 and containing two or more
sleeping rooms shall have a room arrangement such that access to a bathroom or water closet compartment intended for
use by occupants of more than one sleeping room can be gained only by going through another sleeping room, nor sha[I

room. A bathroom or water closet compartment shall not be used as the only passageway to any habitable room, hall,

1. License Fees. Fees for rental unit licenses shall be as set forth by the City Council in a fee schedule, which the Council
shall pass by ordinance from time to time. The fees shall be due 60 days prior to the license expiration date; in the cases
of new unlicensed dwellings, license fees shall be due upon issuance of the certificate of occupancy; in the cases of
licensing periods of less than two years, license fees shall be prorated monthly:
1. A delinquency penalty of 5 % o f the license fee for each day of operation without a valid license shall be charged
operators of rental dwellings. Once issued, a license is nontransferable and the licensee shall not be entitled to a
refund of any license fee upon revocation or suspension-

constituted agent. Application forms may be acquired from and subsequently filed with the Compliance Official. The
applicant shall supply:
1. Name, address, and telephone number of dwelling owner. owning partners if a partnership, corporate officers if a
corporation.
2. Name, address, and telephone number of designated resident agent, if any.
3. Name, address and telephone number of vendee, if the dwelling is being sold through a contract for deed.
4. Legal address of the dwelling.
5. Number of dwelling units within the dwelling.
6. Description of procedure through which tenant inquiries and complaints are to be processed.
3. Resident Agent Required. No operating license shall be issued or renewed for a non-resident owner of rental dwelling
units (one who does not reside in any of the following Minnesota Counties: Hennepin, Ramsey, Anoka, Carver,
Dakota, Scott, or Washington) unless such owner designates in writing to the Compliance Official the name of his
resident agent (one who does reside in any ofthe following Minnesota Counties: Hennepin, Ramsey, Anoka, Carver,
Dakota, Scott, or Washington) who is responsible for maintenance and upkeep and who is legally constituted and
empowered to receive service of notice of violation of the provisions of the City Ordinance, to receive orders and to

b. One additional initial inspection is performed at the same location within a consecutive
twelve-month period after the first initial inspection for which a notice of violation was
served; and
c. During each of the inspections described above, the enforcement officer finds new
violations of the Gem Lake City Code; or
d. Written notice of a violation is served on the property owner following an initial
inspection; and
e. The enforcement officer conducts an inspection after the due date for compliance on the
notice and determines that the violation still exists.
