Public Hearing
THC Interim Ordinance No. 09 Moratorium
City Attorney .Kevin. Beck shared with the Council and those in attendance that according. to Minnesota
Session. Laws. —?023, Regular Session, Section 13.[34?.13] Local Control, a local unit -of government may
not prohibit the possess.ion.. transportation, or use of cannabis flower, cannabis products, lower -potency
hemp edibles, or hemp -derived consumer products. The. Office of Cannabis Management is still being
developed as it is a new State Agency being created from the ground up. Mayor Artig-Swomleyinf&hied
those in attendance that the. Council would begin the public hearing, and that those .in attendance. would
have the -chance to ask questions..
Councilmemb.er Lindner introduced a motion to opeli.the. public hearing on the THC.lnterim Ordinance No..
39 Moratorium at. 7:06 p.m., seconded by Councilmember Cacioppo. Voice vote taken, at in favor, motion.
carried.
Gem Lake Business owner Chris Bettis, of the Smoke .Den; asked the Council if CBD is allowed .to be sold
as the local Idyvee:is selling it or if it is included in th. d.proliibited items. City Attorney Kevin Beck
responded informing Chris that CBD is included in the list orprohibited ifenis and .the .Hyvee is
grand fat tiered iri as they were given permission to. sell the..prod uct tiefore it became prohibited. The state.
specifically includes'.that type of product,
Gem .Lake resident Pat Rottach asked. about. outdoor growth.. City Attorney Kevin Beck shared that at this
time outdoor growth is prohibited: He also stated that Section 9,.Subdivision 2, home cultivation of
cannabis for personal use.states that up to eight (8):cannabis. plants, with no snore than four being mature,
.flowering plants may be grown at a.single residence; including.the curtilage or yard, without a licetise.to
cultivate cannabis issued provided that cultivation takes.plAce.at the primary residence of an individual.2.1
years of age or. older and in an enclosed, locked -space that is not open.to public view.
Gem Lake Business owner Chris Bettis asked about the sale of plant seed and ifthat is possible.. City
Attorney Kevin -Beck responded informing Chris that the sale of plant: seed is also prohibited.
Councilttiernber Lindnerintroduced a motion to close the public :hearing on the THC.lnterim Ordinance
No. 39 Moratoritttn.at 7:22 p.m..,.semided. by Council member Cacioppo. Voice vote taken, all in favor,
motion carried.

Resolution ##2023-0013 Order to Abate.a Public Nuisance for 162.1 Goose Lake -Road
The'City.of Gem Lake City Council .has been.asked bythe City. Attorney.to adopt a resolution deeming
t521 Goose Lake Road a nuisance -for having a storage container on their property. The resolution is giving
the Code Enforcement: Officer the authority to do what he sees necessary to enforce the City's ordinance
and resolve.the issue. Counciilmernber Linder introduced Resolution #2023=001.3 and: move for its. adoption,.
seconded by Councilrhember Amiee. Voicc:yote taken, al in favor, motion carried.
Rental License Term Discussion
The Gem Lake City Council wants to change the language in Section .10 of Ordinance No. 83 regarding the
licensing of recital units. It. was suggested at the June -Council meeting that the language .far'the terms be
changed froin'a two (2) year license to a one.(1) year license. CounciImember Lindner introduced a motion
to.approve the revised language, seconded by Councilmenrber Arnim Voice vote taken, all in favor,
motion carried.
The. Council also discussed the. possibility :of charging a.penalty for each inspection needed to enforce. that:a
violation complaint. has been: resolved,. City Attorney ltievin ;Beck shared some language from the City of
St. Paul for the Council to review. The Council will continue to look into this solution more into the future.
Deer Survey Results
Ramsey County con ducted:a fly over of all Ramsey County cities in. early 2021.Sased 0n the report:
conditions were. poor duririg .the inid-February survey, whi0h.prompted there -survey ofc0rtain.are as in
early March..The earIy.Mare h conditions. were. fai to poor in.certain areas. Survey con ditivns:should be.:
taken into.con side.ratio n when: makirig management decisions. The survey showed. that 23 deer were
counted in Gem Lake:
Future Charitable Gambling Donations
Willow Lane Elementary
Mayor Artig-Swomley.suggested that:the Council make a donation in Augustin the.amount of
S506..00.to Willow Lane Elementary to use. at their discretion and then another $5.0OM for the
Acting City Clerk.and.Mayor to.go out and.get.schoal supplies.
White Sear Lake Emergency Food Shelf
Mayor Artig-Swornleysuggested that the Council make a donation in August in the aiinount of
$1.600.00 to..the.White Bear Lake Eiergency Food Shelf.
CounciInierriber Lindner introduced.a motion to request the donations in the amount of.M.00.00
for the White Bear Lake Emergency Food Shelf and Willow Lane Elementary, seconded by
Councilnrember.Cacioppo, Voice vote taken,. all in favor, motion: carried, Acting City Clerk will
request the donations to be approved..af the August City Council meeting.
Community Outreach to Other Cities and Government Bodies
The Mayor has been working with White Bear Township to clarify the JPA between .tbe City and Town. Currently
under review is what falls into the: shared 50150 expense category: and what. falls under the .80120 expense: category.
City Attorney Kevin Beck has been assigned to reach out to Vadnais Eleights:regard rig the ongoing water request.
VLAWMO will be at the'. August inecting to'go over their annual report.
C.ouncil.rneniber Johnson attended. the. RCLLG meeting. At."this tiine the. corridor project team is. workirig. on trying
to find a consulting company to help with municipal .branding between the three(3) cities: Cauncilmember Johnson
then shared with those in attendance that it is.anapen request: to those in attendance and to reach. out to him if they
should have any suggestions.

Planning Commission Chair Joshua Patrick called the.nieeting to order at 7:01 p.m. Commission
Members Art Pratt, Derek Wippich and°Stephanie Farrell were present. Not. -present was Don Cur linings.
Also present: City .Planner Evan Monson and Acting City Clerk Melissa Lawrence.

The Commission has gone over the Nuisance: Ordinance inch -by inch and feeis:that more thought
has .gone into this revision than hm in the. last 60 years.. Improvements have been made regarding
the regulation of the. ordinance .and sections werq removed and turned into stand-alone
ordinances.
Cornmissibn Member Wippich introduced. a motion to recommend approval .to the City Council;
seconded by Commission Member Pratt. Voice vote taken, all voteo.yes, motion carried.
Final Review of.Nefv Clandestine Drug Lab. Ordinance No. 143.
This Ordinance was created by removi.ng.it froin.the :old Nuisance.. Ordinance. No changes were
made to the .1 anguage.
Commission Member. Wippich introduced a tnotioff to recommend approval to the City Council,
seconded by Commission Member Pratt.. Voice vote taken, al voted yes,. motion carried.
Finalreview of .New Traffic and Vehicles Ordinance No. 1.44
This Ordinance was created by removing it from the old Nuisance Ordinance. Some additional
language was added regardinggolf carts and enforcement.
Commission Member Wippich introduced a motion to recommend approval to the -City Council,
seconded. by Commission Member Farrell. Voice vote taken, all voted yes, motion carried..
New Business
Short Term Rental Discussion
The Commission discussed aspects of:short..term rentals in the City. The Commission does not
see the City. of Gem Lake to be. in high demand forShort term rentals and would like to table
discussion on this topic untl1.the: City is contacted regarding short term rentals.

Re: Second Quarter 2023. Financial Report
The City's audit is complete and the 2"d quarter is also over. The year is flying by. The City's
General Fund revenues are above budget and expenditures are below budget. Part of the
reason revenues are above budget is business- and. iiquor licenses, along with the SCORE
Grant and Cade Franchise Fees already exceeding their 2323.budget. The bad news. is these
are one-time fees paid at the beginning of the year and have been. paid. The key to the City's
finances are that even though we are 50% through the year, revenues and expenditures do not
flow evenly though the year. There are some one-time expenditures,. which are spent at the
beginning of the year, and expenditures for snow plowing activities, which are:spent.during the
first and fourth.ouarters of the year, which makes the City look like it may over or under spend
its budget, but over the course of the year, will actually be in line with budgeted amounts.
Likewise, on the revenue side sewer and water billing. revenues. are.only received once a
quarter. Below is a chart comparing budget to actual revenue and expenditures for the years
2023 arid 2022..

If expenditures were spent evenly throughout the year; the City should have spent 50% of its
budget. 8o far no General Fund activity that is over 50% spent of their budgets after the 2111
quarter. The Public Safety budget is only 48.24% spent so far and is the activity closest to 50%
spent. The public works department:at 25.46°/o is well under their budget through the second
quarter; but the City could have some street: patching expenditures and. in the 411 quarter there
could be some expenditures for salt/sand and snow plowing activities. The general government.
activity is 37.26% spent: Finally, the City budgeted $7,000 for park maintenance (maintenance.
around the trial in the Villas) and so far has not spent ahy of these funds. The second quarter
expendituresare shown. in the chart on the following page.
Overall, the sanitary sewer and water funds should finish the year with revenues near budget
and expenses below budgeted amounts.
CASH AND INVESTMENTS
Finally, the City had $1,426,089.07 invested as of .tune 3051• This compares to $1,230,172,28
invested fast year at this time. The investments had an average interest rate of 1.93°Iu
compared to 1.62°]a last year, Interest rates remain low with the highest. interest rate on a
municipal bond of 3.73%. The chart below shovers the City's invested Rands for the last four
yeas.

The other factor and equally important as funds invested is the City's cash in the. bank_ These
.are the funds the City uses to pay its bills each month. Since the City receives the majority of its
money in twice a year from tax settlements, it is not unusual for the: City to have a large amount
of cash available in the middle of the year and the end of the year with the funds being drawn
down in the proceeding months. Depending on expenditures and. other revenues collect the
City may draw on its Investments to help Meet its cash needs. The increase in cash in June is
frorrm the advancement of the July tax settlement. The chart below demonstrates the cash flow
for the City.

SPECIAL ASSESSMENT POLICY YOR
STREET IMPROVEMENTS

The Town of White Bear has adopted an. Assessment Policy for the purposeof establishing a stable and
continuing source of funding to accommodate repair and reconstruction ofthe Town's streets. Minn. Stat. §
429 grants the Town.. the authority to make. public improvements such as streets,. sanitary sewers, storm
sewers, and water systems. The statute sets. forth the procedure tar assessing the property benelitted by the
improvement. The statute places on the. Town the responsibility, with the assistance of the Town Engineer,
Town Attorney, and Appraisers or other qualified personnel, the duty td establish an equitable method for
cost sharing among the properties.beriefitted.
Pu rpose-
The.purpose ofthis Policy is -to assure uniform and.consistent treatment of affected properties when preparing
assessment roils.
Policy.:
Assessable Costs
The.assessable costs of an improvement shall be defined as those costs in which the Town Board,
after due con s1derail on, :determines are related to the. proposed improvement and the benefits derived
from the improvement. The `'Assessable.Costs" s.houId incIude:tfte total.cstimated..co nstruction:cost
Plus Town administrative costs,. engineering; legal, fiscal;. interest accrued during. construction,
assessment roll preparation and contingencies.. Because the amount assessed is related to the `benefit
received; the appraisal report: is a:guide to the amount of costs that can be assessed.
+ Assessment Period and Interest
Assessments are.to be collected in equaLannual installments. aver a period of tune determined by
the Board. but not to exceed 34 years. The interest rate. is determined at the. discretion of the Town
Board.

■ Land not included imthe Assessment
The. Town. reserves the right to delete land: within the assessable area from. the Assessineut rotas if,

benefit at the time the. Assessment Proceedings have commenced. The Town.shaII have tha right to
reassess the property at the tiine a plan to deveIop..the. property is presented fo the Town. - No permit
shall be issued until a resolution certifying an assessment roil has been adopted:.
Certification of Assessment Roll
At the lime. the. Assessment R611s.are adopted'by the Torun Board, the. property owner may pay the
entire .assessmOt against their property in full at White .Bear Township..Administrative. Off -ices,
1281 Hammond Road, within thirty Q0) days. without interest charged. Beyond :tbirty (30) 'days,
but, prior. to certification to the County, full payment (principal. plus interest from the Assessment
Roil date) can.be.made at the White. Bear Township Administrative 0fficas, 1.281:Harn.ma.nd Road,.
After cei-tiiication of Assessment to the County is made; a resident may make a. payment directly at
the Ramsey County Government Center; GO West Plato Boulevard, 5t. Paul. Interest charges apply
effective from the date of Town Board approval of the Assessment Roll.

Appeals to the District -Court
A. With i1r 30 days after:the adoption:of the as..sessment roll, a property owner who has properly

notice with the district court within 10 days of that. service.

JOINT POWERS AGREEMENT
BETWEEN THE
CITY OF GEM LAKE
AND
WHITE BEAR TOWNSHIP
THIS AGREEMENT, made and entered into this day of , 2023, set forth
between WHITE BEAR TOWNSHIP, a statutory Township under the Laws of the State of Minnesota
(TOWNSHIP), and the CITY OF GEM LAKE, a statutory City under the laws of the State of Minnesota (CITY).
RECITALS:
WHEREAS, the TOWNSHIP is the owner of certain real property, hereinafter referred to as the
"Premises," located White Bear Township, County of Ramsey, State of Minnesota, more particularly described on
"Exhibit A" attached hereto and by reference made a part hereof; and
WHEREAS, the CITY wishes to construct a new municipal government center for its operations on the
Premises; and
WHEREAS, both parties are political subdivisions organized under Minnesota Statutes, with authority to
enter into joint ventures and joint powers agreements; and
WHEREAS, pursuant to all of the terms and conditions herein, the parties wish to enter into a Joint Powers
Agreement (JPA) for the planning, construction, and operation of the facility.
PURPOSE:
Minnesota Statutes, Section 471.59, provides that two or more governmental units, by agreement entered
into through action of their governing bodies, may jointly or cooperatively exercise any power common to the
contracting parties or any similar powers, including those which are the same except for the territorial limits within
which they are exercised.
AGREEMENT:
Now therefore, in consideration of the foregoing recitals and mutual undertakings, set forth herein, the
TOWNSHIP and the CITY agree as follows:
I. DUTIES AND RESPONSIBILITIES
a. The TOWNSHIP shall provide a site for the construction of the Municipal Building.
b. The TOWNSHIP shall execute a quit claim deed for the Premises naming the TOWNSHIP and
CITY as fee owners in joint tenancy.
c. The TOWNSHIP and CITY shall utilize the Municipal Building for meeting rooms, polling
places, or administrative offices.
II. DESIGN AND IMPROVEMENT
At the time of the design of said Municipal Building, the TOWNSHIP and the CITY shall consult
regarding such designs and, before said designs are implemented shall be submitted to both the CITY and
the TOWNSHIP for approval, which approval shall not be unreasonably withheld. All capital
improvement costs will be shared by the Township and Gem Lake 50150.
III. CONSTRUCTION
The CITY and TOWNSHIP shall be responsible for the construction of the Municipal Building. The
selection of the general contractor shall be performed in accordance with Minnesota Statute Section
471.345, the Uniform Municipal Contracting Law. The CITY and TOWNSHIP shall agree to appoint a
construction manager or, alternatively, an architect.
d. if one party alleges lack of performance by the other party, both parties agree that the issue will be
settled in arbitration.
VII. NOTICES
Any and all notices and demands by or from the TOWNSHIP, or by or from the CITY, shall be in
writing and shall be validly given or made if served either personally or if deposited in the United States
mail, certified or registered, postage prepaid, return receipt requested. If such notice be served personally,
service shall be conclusively deemed made at the time of such personal service. If such notice or demand
be served by registered mail or certified mail in the manner herein provided, service shall be conclusively
deemed made forty-eight (48) hours after the deposit thereof in the United States mail addressed to the
party to whom such notice is to be given.

Force Maieure
Neither party shall be held responsible for performance of this Contract if the party's performance is
prevented by acts or events beyond the party's reasonable control including, bait not limited to: severe weather
and storms, earthquakes, tornados, or other natural occurrences; strikes and other lahor.unrest, power failures,
electrical power surges or current fl u ctti ati ons, nuclear or other civil or military cmergenc.ies,..or acts of

Section-8 a. Curfew for Minors.
1. Restrictions on Minors. It shall be unlawful for any minor under the age of sixteen (16) years to loiter,
idle, wander, stroll, or play in or upon the public streets, highways, roads, alleys, parks, playgrounds, public
places and public buildings, places of entertainment and amusement, vacant lots, and other unsupervised
places in the City of Gem Lake between the hours of ten o'clock p.m. and five o'clock a.m. the following
day. It shall be unlawful for any minor who is sixteen (16) or seventeen (17) years of age to loiter, idle,
wander, stroll, or play in or upon public streets, highways, roads, alleys, parks, playgrounds, public places,
and public buildings, places of entertainment and amusement, vacant lots, and other unsupervised places in
the City of Gem Lake between the hours of twelve o'clock midnight and five o'clock the following
morning. Provided, however, that the provisions of this section do not apply to a minor accompanied by his
or her guardian, or other adult person having the care and custody of the minor, to a minor who is upon an
emergency errand or other legitimate business directed by his or her parent, guardian, or other adult person
having the care and custody of the minor, or where the presence of said minor in said place or places is
connected with and required by some legitimate business directed by his or her parent, guardian, or other
adult person having the care and custody of the minor, or where the presence of said minor in said place or
places is connected with a required by some legitimate business, trade, profession, or occupation in which
said minor is permitted by law to be engaged.
2. Duties of Parents or Guardians. It shall be unlawful for the parent, guardian, or other adult person having
charge of a minor under the age of eighteen (18) years to permit such minor to loiter, idle, wander, stroll, or
play in or upon the public streets, highways, roads, alleys, parks, playgrounds, public places and public
buildings, places of entertainment and amusement, vacant lots, and other unsupervised places in the City of
Gem Lake during the hours prohibited by this Ordinance; provided, however, that the provisions of this

5. Judicial Remedy. Nothing in this section shall prevent the City from seeking a judicial remedy when no
other adeq irate administrative rentedy exists.
Section 4-54.47. Recovery of Costs.
1. Record of abatement Cost. 'ncc C ity shall keep a retard of the costs of abatements including
administrative costs, done under this ordinance and shall report monthly all wort; done to the appropriate officer for
which assessments are to be made stating and certifaing the description of the land lots arcels involved and the
amount assessable to each.
2. Personal Liability. The owner of Premises on which a nuisance has been abated by the City, or aperson
who has caused a public nuisance on property not owned by that person shall be personally liable for the cost of the
abatement incl udi ng administrative costs. As soon as the work has been completed and the cost determined the
Cit • shall prepare a bill for the cost and mail it to the owner. Thereupon, the amount shall be immediate) y due and
payable at the Cit 's administrative office.
3. Assessment. After notice and heari rug as provided in Minnesota Statutes Section 429.061as it may be
amended from time to time, if a nuisance is a public health or safety hazard on private or public the City Clerk shall,
on or before September 1 next foIlowingabatement of the nuisance, list the total unpaid charges along with a€l other
such charges as well as other char es for current services to be assessed under Minnesota Statutes Section 429.101
against each separate lot Or Darcel to which the charges are attributable. The City Council may then spread the
charges against the propertLunder the provisions of Minnesota statutes Section 429 and any other pertinent Statutes
for certification to the County Auditor and collection along with current taxes the folIowing year or in annual
installments, not exceeding, ten as tltl e_City Council may determine in each case.
Section 4"58. Penalties. In addition to any fines, costs, or assessments provided for by this Ordinance or other
City Ordinances, the City may prosecute a violation of any provision of this Ordinance as a misdemeanor, and a
person, if convicted, may be punished by the maximum fine and term of imprisonment provided by Minnesota
Statutes § 609.02, subd. 3, as that statute may be amended from time to time.
Section 4-7-49. Repealer. This Ordinance supersedes, replaces and repeals all prior Ordinances relating to the same
subjects contained within this Ordinance. Any portion of such prior Ordinances not incorporated within this
Ordinance is expressly repealed.
Section 4S4-710. Severn bi lity. Should any section, subdivision, clause or other provision of this Ordinance be held
to be invalid by any court of competent jurisdiction, such decision shall not affect the validity of the Ordinance as a
whole, or of any part thereof, other than the part held to be invalid.
Section 4#Ul 1. Effective Date. This Ordinance shall take effect and be in force from and after is passage and
publication.

AN ORDINANCE REGARDING CLANDESTINE DRUG LABS AND PROVIDING FOR ABATEMENT
AND PENALTIES FOR VIOLATION THEREOF.
THE CITY COUNCIL OF THE CITY OF GEM LAKE ORDAINS:
Section 1. Purpose and Intent.
The purpose of this Ordinance is to protect the public health, safety and welfare and reduce public exposure
to health risks where law enforcement officers have determined that hazardous chemicals from a suspected
clandestine drug lab or chemical dump site may exist. These conditions present health and safety risks to
occupants and visitors of such structures and land through fire, explosion and skin and respiratory exposure
to chemicals. The City Council finds that such sites may contain hazardous chemicals, substances, or
residues that place people, particularly children or adults of child-bearing age, at risk of exposure through
inhabiting the property, visiting the property or using or being exposed to contaminated personal property.
Section 2. Definitions.
For the purpose of this Ordinance. the foilowina terms or words shall be interpreted as Follows:
1. Child — means any person less than 18 years of age.
2. Chemical dump site — means any place or area where chemicals or other waste materials have been
located.
3. Clandestine drug lab — means the unlawful manufacture or attempt to manufacture controlled substances.
4. Clandestine drug lab site - means any place or area where law enforcement has determined that
conditions associated with the operation of unlawful clandestine drug lab exist. A clandestine drug lab site
includes any dwellings, accessory structures, buildings, a chemical dump site, a vehicle, boat, trailer or
other similar appliance or any other area, land or location.
5. Cleanup — means proper removal and/or containment of substances hazardous to humans and/or the
environment at a clandestine drug lab site or chemical dump site.
6. Controlled substance — means any drug, substance or immediate precursor in Schedules l through V of
Minnesota Statutes Section 152.02. The term does not include distilled spirits, wine, malt beverages,
intoxicating liquors or tobacco.
7. Owner — means any person, firm, corporation, or other entity who owns, in whole or in part, the land,
building, structure, vehicle, boat, trailer or other location associated with a clandestine drug lab site or
chemical dump site.
8. Public Health Nuisance — means a nuisance as defined above or under Minnesota Statute Section
145A.02, subdivision 17.
9. Remediation — means methods such as assessment, evaluation, testing, venting, detergent scrubbing,
enclosure, encapsulation, demolition, and/or removal of contaminated materials from a clandestine drug lab
site or chemical dump site.
Section 3. Administration
1. Declaration of Property as a Public Health Nuisance,
1) Any property containing a clandestine drug lab or chemical dump site will be declared a public
health nuisance.
2) No person may occupy, enter or allow occupancy or entrance to property declared a public health
nuisance under this Section until such declaration is vacated or modified to allow occupancy.

v. Information: on locating professional services necessary to remove and abate the public
health nuisance: status as, provided in this Ordinance and Minnesota Statute Section
145A.14; and
A. Information. about the. potentially hazardous condition. of -the clandestine drug lab site or
chemical dump site.
5. Responsibilities of Owner.
1) upon receipt of an abatement order by. the City's Environmental. Health Official,Ahe property
owner must, at the owners expense:
i. Immediately vacate those portions of the property, includingbuilding or.structure.
interiors that. may place the occupants.or visitors afrisk. This includesdwellings,
buildings, motor vehicles, trailers, boats, appliances or.any other affected area or
location.. No person shall occupy, enter or allow occupancy or. entrance to a building or
structure decIared.a Public Health Nuisance until such dbelaration is vacated or mod ifed
to. allow occupancy;
ii.: Properly secure.and.poA warning signs on the perimeterof..any contaminated areas on the:
property in an effort to avoid exposure: to unsuspecting parties;
iii. Promptly .contract with One or mcire..acceptable environmental hazard testing andcleaning
firms (acceptable firsts are those that have -provided. of appropriate equipment,
procedures, and -personnel, as determined by the Minnesota Department of Health) to
accomplish the foilowing;
1. A detailed on -site assessment Ofthe .extent of contamination at the site and the
contamination of the personal property therein;;
2. Soil .testiiig of the site and .testing;of all property and soil in proximity to the site
that.the environmental hazardAestitig and cleaning forrn determines may Have
been affected by the: conditions found at. the site;
3, A. compl ete. cl ean up. o f all property. and soil at the site:and in. proximity to the
site.that is found to be affected by conditions found at.the site. (including but. not
limited to, the cleanup or removal of contaminated plumbing,. venfilation
systems,.#ixtures and contaminated soil) or a demo Iition.of.the site and.a
complete :cleanup of the demolished site;
4. Remediation:testing and follow-up testing to determine all health risks are
sufficiently reduced; according to the Minnesota Department .of Health
guidelines, to. allow safe human occupancy and use of the site and use of the
personal property therein.
iv. Regularly notify the City of. actions taken and reach. agreament'With the City on the
cleanup. schedule. The Cityshal1. consider practical limitations and the availability of
contractors in. approving :the schedule for cleanup; and
Y. Provide written documentation to the City.of the cleanup:process, ucluding a signed,
written statement that the property is safe for human occupancy and. that the. cleanup was
conducted: in accordance.with Minnesota Department of Health guidelines:

statement in paragraph. (1)(E, and has confirmed that the property has:been cleaned in:accordance

AN ORDINANCE REGARDING CLA,NDESTINE..DRUG LASS AND PROVIDING FOR ABATEMENT
AND' PENALTIES FOR VIOLATION THEREOF.
THE CITY COUNCIL OF THE CITY OF`GEM LAKE.ORDAINS:
Section 1.. Purpose.and Intent.
The. purpose of this Ordinance:. is to protect the public health, safety and welfare and reduce public exposure
to health risks where law enforcement ofticers.have.determined that.haaardous chemicals from a. suspected
clandestine drug lab or -chemical dump site may exist. These conditions present Health and safety risks to
occupants and visitors of such structures and land through fire, explosion and skin and respiratory exposure
to chemicals. The.City Council finds that.such sites: may containhazardous chemicals, substances; or
residues that. place'people, :particularly children or adults .v.f child-bearing age; at.risk .of exposure. through
inhabiting the property, Visiting the property or using or. being exposed to contaminated personal property:
Section 2. Definitions.
For the purpose of this Ordinance, the following terms or words shall be interpreted as follows:
1.
Child -- means any person less than 18 years of age.
2.
Chemical dumb site -- means any place or area where chemicals.or other waste materials have been
located:.
3.
Clan des. tine drug lab — means.the unlawful manufacture or attempt to manufacture controlled substances.
4.
Clandestine drug lab site.- means any place or. area where law enforeement.lias.detertnined that
conditions associated Avith.the operation of unlawful clandestine drug lab exist; A. clandestine drug lab site
includes any dwellings, accessory structures, buildings, a chemical. dump site, a.vehicle, boat, trailer or:
other similar appliance or any other area, land or location.

Cleanup —:Weans proper removal and/or comainment of substances hazardous to humans and/or the
environment at a clandestine drug lab site or chemical. dump site.

Controlled substance-- means any.drug,.substance `or. imrnediate precursor. in Schedules i through V of
Minnesota Statutes Section 152.02: The term does. not include distilled:spirits, wine, malt.beverages,
intoxicating liquors or tobacco..

Owner — means any person. firm, corporation, or other entity who owns, in. whole or.in part, the :land,
building, structure, vehicle, boat, trailer or other location associated with a. clandestine drug lab Site or
chemical dump site.

Public Ilealth Nuisance — means a nuisance as defined above or under Minnesota.Statute Section
145A.02, subdivision 17.

Remediation -- means methods such as assessment; evaluation; testing, venting; detergent scrubbing,
enclosure; encapsulation, demolition, and/or removal of contaminated materials from a clandestine drug lab
site.or chemical dump site.

3. Administration:
I.
Declaration of Property as a .Public Health Nuisance.
1) Any property containing a clandestine drug lab or chemical dump site will be declared.a public
health nuisance
2) No person may occupy., enter or.allow: occupancy or entrance to: property declared a.public health
nuisance under this Section until such declaration is. vacated .br:modified to,allow. occupancy.

v. :information onlocating professional seryices. necessary .#o remove and abate the public
health nuisance status as provided in this Ordinance and Minnesota Statute Section
1.45A..14, and
vi. Information about the potentially hazardous condition of the clandestine drug.lab site or
chemical dump site.
5. Responsibilities. of Diener.
1) Upon receipt of an abatement order by the City's Environmental Health Official, the. property
owner must,.attlie owners expense::
1. .immediately vacate those portions of the. propertyi , ncluding baiIdirig. or structure
interiors that may place .the.occupants or visitors at risk; This includes dwellings,
buildings; motor vehicles, trailers.;.boats, appliances or any other affected area:ar
location, No: person.shalI occupy, enter oral low occupancy or entrance to a.bui[ding or
structure declared a Public' Health Niuisance until such declaration is vacated or modified
to allow occupancy;
ii. Properly:secure:and post warning signs on the perimeter of any contarninated areas on the
property in an effort to avoid exposure to unsuspecting parties;
iii. Promptly contract with one. or more acceptable environmental hazard testing. and cleaning
firms.(acceptanle firms are those that have. provided'assuran ce of appropriate equipment,
procedures, and personnel, as.detc rniined. by the Minn0sotaD6partment:0f Health) to
accoir ipIish. the :following:
1. A detailed on;site assessment.of the extent' ofcontamination at:the siteand the
contamination of the personal property therein;
I Soil testing ofthe site and testing of all property and soil. in proximity to the site
that the environmental hazard testing and .cleaning. form determines may have
been. affected by the conditions found at the site;
3. A complete cleanup of all property and soil at the.site• and in proximity to the
site that is found to be affected by conditions found at the. site.'{includifig but riot
limited to; the cleanup., or removal. ofcontaminated:pIumbing, ventilation
systems; fixtures and contaminated soil] or a de.inoIition of the site and a
comp lete.cleanup.ofthedemolish..ed site;
4. Remediation testing and follow-up testing tadetermine all health risks are
sufficiently reduced, according to tile. Minnesota Department of Health
guidelines to allow safe human occupancy and Use of the site and use of the
personal property therein.

cIeaitup schedule. The:City.shaII consider practical limitations .and the avai.labiIityof
contractors in approving.tlie schedule for cleanup; and

1) Section 1..Purpose and Intent
The purpose of this ordinance is to protect public safety, reduce interference with publictravel, and allow for
the orderly use of vehicles within the City. This ordinance is intended to.protect life; property; and to prevent
public nuisances.
2) Section: 2. Traffic and.Vehicles.:
a). Snowmobiles
i) Incorporation by Reference. The provisions of Minnesota Statutes, Sections 84.84 through 84.90,
and the provisions of the Regulations of the'Minnesota Commissioner of.Natural Resources contained
.in Seections 7460.51.00 and 7460.5 20 0 of.Minnesota Rules .1989j.and any amendments to those statutes
or regulations or:substitutes for:those statutes .orxegulations that:may from time to time become
effective, are hereby adopted and incorporated herein..by reference.
ii} .Limitation 'of Operation.. No.person shall operate a snowmobile in the City of Gem Lake. except.on
public trails, waterways,. and highways specifically desgnated.;for such use, or on private property
where lawful permission has. beenobtained from the property Owner, occupant, .or lessee. No
snowmobile shall be.operated within any public right-of-way or on:a public sidewalk.or trail provided
or used for pedestrian or bicycle travel.
iii) Hours of Operation. No person shalloperate: a snowrnobile in the City of Gem Lake between .the:
hours ofeleveh (l.J:) o'clock p.m. and seven.(7:) o'clock a.m. prevailing:.tinie in Ramsey County,

including the day preceding a national holiday.
iv) Speed. No person shall .operate. a: snowmobile in the City of Genf Lake at..speed in excess of limits
specifically posted for such use .or as a speed. in excess of fifteen (15) miles: per. ho.ur within. one
hundred.fly (150) `feet:of any rishe..rman, fish house, pedestrian, skier, skater, skating rink,:sliding
area, ski:tow area,. or other areas where. such operation would conflict with or endanger other.persons
or property,
v} Tow Bars. -No: person shall:operate:a snowmobile so. as to tow any person, sled, or other conveyance,
except by the use of a rigid low bar.attached to the rear of -such snowmobile. Persons towing disabled.
snowmobiles shall be exempt.
vi) Mandatory Lights. No person shall operate a snowmobile unless such vehicle. is equipped with ahead
light and. tail light that are illuminated at all times during such operation. Snowmobiles equipped with
an engine of five (5) horsepower or less shall be.bxempt.
yii) .Mandatory Pennant. No person shall operate a snowmobile unless such: vehicle is.equipped with a
fed or orange blaze pennant flag of at least forty (40) square inches in area. and displayed at.a height. of
not. less than five (5) feet:above the. roadway.
viii) Authorized .Snowmobiles.. Authorized.snowmobiles may be used on any public property within the
City for rescue, emergency or law enforcement :purposes.

The Planning Commission has spent the last -few months looking at ways to improve the City's Nuisance:
Ordinance. Through discussion with the Building Inspector/Code Enforcement Officer, the public, and the
commissioners, the:praposed. draft.ordinance has resulted in revised language on whatis and is not.a
nuisance, and has revised language on enforcement.and ahatement of. nuisances based on language our
Attorney has used with other communities. The 'clandestine drug lab' language from the existing
nuisance ordinance was removed -and placed in a standalone ordinance,. as it.has its own. definitions,
processes, and enforcement/abatement language, The traffic and vehicle. language was also removed
from the existing nuisance ordinance and placed in a standalone ordinance, The `g:olf cart' ❑rdinance was
also added into this new ordinance.
The.Planning Commission reviewed'the latest drafts at their meeting.on August 9; 2023; and
recommended approval of each. The Council is able to approve and adopt the ordinances, or can make
further c.hanges.and revisions.

There.are a couple things to consider in terms of what, if any, regEJlati.ons should be adapted in rQgards to

Some comniunities have gone.sc, far.as to not allow short term renting .af residential properties at all,

of such an ordinance would likely -require someone to monitor listing sites for listings p.f stays within the

be. necessary to not allow them? There Is also the possibility that such a restrictive ordinance could be
rendered moot by the State in the future if they decide to make it a use that must be allowed.

Presumably this: serves as a way to help.prevent guests frorr getting rowdy.during their slay, though
