The proposed.levy will be. used .to produce parcel -specific taxpayer notices, also referred to as truth -in -taxation notices, which tiviII be. distributed to taxpayers in Noveinber. If a city .fails to certify its. proposed levy to the: county by September 30, the county auditor is required to use the authority's previous:year's f.naI.levy.as the levy for the following year. The City reviewed their request and. approved two goats .on the property through an interim use permit (IUP.). Said IUP would run for one year and would have to be renewed. The one-year period was chosen to allow the City to see if issues would arise with the proposed use, as loan animals: are not a common .occurrence in the city nowadays. The Planning Commission reviewed and recommended. approval at the September.2022. Planning Commission meeting;. acid the City Council approved th6 requ8t per.the cominissi0n's. recommendation .at their September 20, :2022, meeting. The applicant has submitted all application to. renew their f.UP for two goats on their property; with an. added request to allow two additional. goats an the property fo.r a:totaf of four goats. The city's Consolidated .Land Use Ordinance. permits both Housing of farm animals .and agricultural structures for housing of farm animalsthrougheither a Conditional Use Permit (CUP), or an Interiin Use Permit ([UP). Conditions of approvalcan be added to both types of permits;: an [UP can also have an end date for the -use, in which the.applicant Would have to reapply to continue. -the interim use. the applicant are proposing to continue using an existing barn on. the site to house two goats, and would like to house. two additional goats as well. The applicant's property is over the one acre in size, so this requirement is met. Section 7.313 notes that agricultural structures are. able to be permitted to house farin.animals; such as. goats. The site already has .an existing barn that was previously used fin rhousing farm animals: The barn 'd6cs.not conform to the agricultural buildiiig,setback of100 feet. from property lines or neighboring dwellings, as required in 7..3.3(13),:so iti" nonconforming. While the:structure can continue.as a nonconformi ng agricultural structure, it would not be.. able to. expand in.size. The.IUP last year permitted the barn can be used to house goats but could not be enlarged due to:its nonconforming status. With the parcel at 1..85 acres in .size, dedicating 1.5 acres to pasture would take up nearly 81% of the property,. and could significantly standout from neighboring single family residential uses. A fenced in.area for the two. goats totaling 1,854 SF would.be installed east of the barn. The existing barn is approximately 430 SF in size, and was.previously used under preyious owners for housingfarm animals. (horses) as well. Consolidated Land Use Ordinance Requirements The Consolidated Land Use .ord.inance. outlines. what.uses are. permitted in -each zoning district. Section 7.3.1 notes that a CUP or IUP can be issued.for "the harboring and housing of agricultural animals on lots greater than one (1,.D) acre". The applicant's property is over the one acre in size, so.this requirement is met. Staff reviewed city files, and found that there :are not many -permits or records of properties in the city having farm. animals, so this: is a bit of a unique .or uncommon request. The.site already has.an existing barn that was previously used for housing farm animals. We are looking to get 2 little goats as pets (and for landscaping in the field) and would keep them on our field we have behind the house. I know that this property previously had 2-3 horses at a time on the field and they kept them in the bam at night. We would have the fenced area going up to the bam door so bad weather, night-time and winter time they could be brought in there for their safety. I have attached a map of the property and the space they would be in; with all measurements. The goats will be registered with the state of MN through the National Scrapie: Eradication Program, which is required in Minnesota for anyone owning. a goat. The fenced in area. would have 4 foot fencing (Solidlock Pro High Tensile Fixed Knot Fence, 12.5 ga.) which is held in with metal T posts(which. go about a foot to two feet in the ground.) in the fenced in area they would have a .goat house.for some shelter if they want during the day and to climb on. When talking about having goats as pets it's like comparing them to owning a few larger type dogs (even though these goats would more likely be smaller than a large dog, More the size of a. medium dog maybe). They produce. similar amounts of waste, are. as vocal as dogs acid are fenced in like dogs in residential areas.. Being as vocal as dogs: they are quieter than dogs because they would not be barking at cars, people and noises they hear, like the dogs we hear in the neighborhood now. The purpose of this section is to provide for the health, safety, and general welfare of the citizens ofthe City of Gem Lake through the regulation of non -storm water discharges to the storm drainage system to the maximum extent practicable as required by federal and state law. This section establ ishes methods for controlling the introduction of pollutants into the municipal separate storm sewer system (M S4) in order to comply with requirements of the National Pollutant Discharge Elimination System (NPDES) permit process. The objectives of this section are: L To regulate the contribution of pollutants to the MS4 by storm water discharges by any user. 2. To prohibit illicit connections and discharges to the MS4. 3. To establish legal authority to carry out all inspectionr surveillance, monitoring, and enforcement procedures necessary to ensure compliance wish this section. 2. Applicability. This section shall apply to all water entering the storm drain system generated on any developed and undeveloped lands unless explicitly exempted by the City of Gem Lake- 3- Responsibility for Ad ministration. The City of Gem Lake shall administer, implement, and enforce the provisions of this section_ Any powers granted or duties imposed upon the City of Gem Lake may be delegated in %riling by the Gem Lake City Administrator of the City of Gem Lake to persons or entities acting in the beneficial interest ofor in the employ of the City of Gem Lake- 4- Compatibility with Other Regulations. This section is not intended to modify or repeal any other section, ordinance, rule, regulation, or other provision of law. The owner or operator of any activity, operation, or facility which may cause or contribute to pollution or contamination of storm water, the storm drain system, or waters of the United States shall provide, at their own expense, reasonable protection from accidental discharge of prohibited materials or other wastes into the municipal storm drain system or watercourses through the use ofstructural and non-structural Best Management Practices Further, any person responsible for a property or premise that is, or may be, the source of an illicit discharge, may be required to implement, at said person's expense, additional structural and non-structural BMPs to prevent the further discharge of polItuants to the M S4. Compliance with all terms and conditions of a valid NPDES permit aulhonzing the discharge of storm water associated with industrial or construction activity, to the extent practicable, shall be deemed compliance with the provisions of this section. These BMPs shall be part of a Storm Water Management Plan (SWMP) as necessary for compliance with requirements of the NPDES permit. 12. Notification of Spills. Notwithstanding other requirements of law, as soon as any person responsible for a facility or operation_, or responsible for emergency response for a facility or operation has information of any known or suspected release of materials which are resulting or may result in illegal discharges or pollutants discharging into storm water, the storm drain system, or waters of the United States, said person shall take all necessary steps to ensure the discovery, containment, and cleanup of such release, at their own expense. In the event of such a release cf hazardous materials said person shall immediately notify emergency response agencies of the occurrence via emergency dispatch services. In the event of a release of non -hazardous materials, said person shall notify the City of Gem Lake in person or by phone or email no later than the next business day. Nolifications in person or by phone shall be confirmed by written notice addressed and mailed to the City of Gem Lake within two (2) business days of the phone notice. If the discharge of prohibited materials emanates from a commercial or industrial establishment, the owner or operator of such establishment shall also retain an on site written record of the discharge and the actions taken to prevent its recurrence. Kennel Operation: Permitted Operations. 1. Personal Kennel Operation. Personal kennels that harbor no more than three (3) domestic animals of various types and which animals are solely owned by the occupants of the premise and which are over the age of six (6) months are allowed in the residential districts of the City of Gem Lake. The operators of such kennels are responsible to operate these kennels in compliance with all of the terms and regulations defined in this Ordinance - St rue ture. The kennel structure shall be made of suitable Fencing or other materials suitable for containment of the animal based upon the size and weight of the animal(s). 2. Location. The kennel structure shall be placed so as to be located as far as possible from neighboring residences and not less than fifty (50') feet from adjacent property lines. Section 7. Impounding Animals. 1. Impounding Animals. All law enforcement or animal control officers of the City or under contract to the city are hereby authorized and empowered to use such force as is reasonably necessary to take up, capture, or restrain and impound any animal found in violation of this Ordinance. All animals shall be impounded at a facility which is under contract with the City.
