Minnesota Legislative Session Update " Minnesota.Senator Heather Gustafson; District 36. DFL
Senator Gustafson wanted to come to a City. Council tiieeting to introduce herself and say hello. She lives
in Vadnais Heights and. is hereto help and is happy to represent Gem Lake. Senator.Gustafson shared with
the Council that she was proud of bill that recently passed. that' she authored which gave $3.00 million to
help with public .safety need in Minnesota Cities. From that, Gem .Lake received $23,368 to use.towards
public safety. She also. shared .that schools have received historic funding Willi a 7.4 million increase in.
public..education. finding for 2024 and 9.1 million increase for 2025.

Planning Commissiotier Chair Joshua Patrick shared with the Council that the Commission .lield a public hearing -for
the renewal of.a goat interim Use Permit (I UP). Based on the re0niniendations of the City Planner Evan Monson
and that the home owners -fix the fence area and remove the conex container. on their property, the Commission
suggests that the .IUP he. renewed for another year.. The Commission also heard frpm Barnett Kia on the refresh: they
would.like to do which involves demolishing the current building once the new one is built in a more practical
location on the lot. The. current Zoning Ordinance hoes not allow for this type of construction, so the Commission is
looking.at amending some language in the ordinance to make. it passible.. The -Commission received. from Emily
Jennings from SEH regarding some recorritn6ded changes to MS4 sections in OrdinanceNa. 1:31,:defiftitions in.
Ordinance No, 13.1 Appendix A, and language in Ordinance No. 140 to ensure: the City is. compliant. The
..Commission is also in the process of reviewing the current,garbage ordinance created 30 yearsago. The reason foT
the review is to update any language that:may have changed over the past 3p years and to bring it into the 21st
century.

The next -issue of the Newsletter will include pieces on the MPCA.presentation to the City Council, 2024:
preliminary budget, Tessier Road repaving project, County. Commissioners Report, MN Senators visit, dog
license renewal reminder, VLAW MO, White.Bbar Lake police: chief old and new, truth in .taxation hearing
date, trail improvements, and the garbage hauler survey.
Code Violation--1.611 Goose Lake .Road. Update
This code violation is getting closer and closer to. a: resolution. The homeowneris currently in default.
because they failed to respond to..Ihe court order. A hearing date is being scheduled. for a date in December
resulting in the removal of the trailer at that tithe. Neighbors have been very. patient with the whole process.
The homeowner was not. in attendance for the City Council meeting.
Municipal Water Fuinding Request Update
The City has grant proposals. out at the federal and. state level. Each of these are slow moving.. At this time
the. City is a finaliafor :the state funding. The. Ho..use.Cap ital Investment Committee stopped by Gem Lake
on September 28 to, tour the, City and to, get a betterid why the City is re.questing.funding. Gem Lake
was the 23rd:stop of .2 3 for the day, so the committee was quite.exhausted by the time they got to Gem..
Lake. Cookies and coffee were served while they. attended the presentation portion of the tour.
Update on Cannabis Law:. Issues. and Questions.
The City has one tobacco shop and they would like the opportunity.to sell. low dosage THC edibles and
drinks that.have no more than .3%THC. Their competitors. in neighboring cities have been authorized. to
sell this product..and because of this the tobacco shop is.rnissing.qut on sale. opportunities. The past
morator ium.the City adopted prohibited thi. sty pe.af request, the recent adopted one does:not. The City is
open to approving this request; but would like to adopt an ordinance before issuing any type of license.
White Bear Lake and Vadnais Height3 both have an application process the City can borrow. City Attorney
Kevin Beek suggests that the 'City propose an interirii hemp derived ordinance at the November meeting
and gather feedback from. Councilmernbers and the public..
Trail Sign Update
Thenew descriptive signs.have been set. up along the trail and look great: The trail entrance signs were
missed being ordered the first time .around and. the City has received a designand.quote for those.two (2)
signs:

Interim Use Permit First Year Review for Goats at:3944 Scheuneman Road
Homeowners Ted & Nikki Pak submitted an IUP renewal to harbor two (2) goats on their properly located
at 3944 Scheuneman Road, The renewal request was. first heard by the: Planning. Commission -on Tuesday,
October 10; 2023 Where a. public: hearing was held on the topic.. No complaints have been reported.
regarding:the property on the keeping of.goats over the last year. The homeowners areinterested in
harboring an additional two (2) goats an the:properly, but according to City ordinance: it: would only allyw
for one (1) additional:goat. The applic.ants:have been asked to do some researcli and submit it to the City
Planner. An amendment would then need to be made which would require a zoning request frrom. the
applicant as well.
The application. was recoritmended. for approval. by the Planning. Commission to the Cciuncil :at the October
17, 2023 City Council meeting, based on the conditions suggested by City Planner Evan Monson below:

1. The applicant is:perm itted to utilize the existing barn on -site to house up. to two goats.
2. Proposed fancing shall be placed at minimum -five feet from. property lines to the south, unless
written consent. and approval .is received froin the neighboring property owner to place the fence
on the property line.
3. The. I U.P. shall expire in one calendar year from the.date of approval, so as to allow the. Planning
Commission to. review the request again to ensure the use is in colnpliance. with conditions of this
approval, and other city ordinances have been met.
4, Additional goats or farin animals an the site shall require. an amendment. to the iUP.
S. The applicant. is required to adhere to all applicable local, State; or Fadera I regulations.
G. The applicant is required to acquire any other applicable focal, State; or Federal .permits for this
request.

MS4 Ordinance Changes
The N1PCA MS4 Permit was reissued oil November 16, 2020 requiring additional changes to the City's
Construction Site. Stormwater Runoff Control and Post -Construction Starrnwater Management program.

submitted to. the Planning Commission and .City Council .for review..

Updates to Ordinance No. 140 include.:

align with. the requirements of the MS4 permit.
The Council felt that all changes recommended by SEH Professional Engineer were reasonable based on
her professional experience in the area. CounciImcmb6r Linder introduced a motion to approve. the
recommended changes to the ordinances listed above, seconded by.Councilinember Cacioppo. Voice vote
taken, all voted yes, ::notion carried.
Garbage Hauler Survey
The.Pianning Commission is reviewing the current.garbage ordinance, since it.has not been rev iewed. inthe
fast 30 years. While that is.happening.Acting City Clerk.lvlelissa Lawrence has sent surveys.out to a]i Gem.
Lake residents and business owners to see who they currently use for a garbage hauler because the City
does. riot regulate tha. garbage haulers. This survey is being conducted to see how many different Haulers the
city has coming through to help defermine if the City should begin limiting..haulers and requiring haulers to
be.licensed. with the City. It will also tell the Council how the City feels about the possibility of contracting
out a garbage hauler. The 9urvey.co.11ection will end. -October 31 and..a summary will.b.e. presented to:.both
the Planning Commission and City Council at the November meetings.
Future Charitable Gambling Donations

Mayor Artig-S.womtoy . suggested that tiie Council make:A donation in November in the amount of
$1500.00 to the..White Bear Lake .Emergency Food. Shelf, Counc.ilmember: Lindner introduced a
motion to request a donation in the amount of $.1500.00 for the White. Bear Lake Emergbriq Food
Shelf, seconded by Councilmernber Cacioppo.. Voice vote taken, all voted yes; motion carried.
Community Outreach to .Other Cities and Government Bodies
City Attorney Kevin Beck shared that he has reached out to White Bear Townships attorney to express concern at
the increase in fire services from White Bear.Lake so that they could go in together.on a. Way to reach out to White
Bear Lake regarding the -situation. Mr. Beck learned that an email will be sent.to White Bear Lake on the topic;
Mr..Beck.has also heard from Vadnais Heights on the water.sitvation at the Villas.,.At this tirrie It is at :a standstill
while. Vadnaiswaits.on the DNR lawsuit to wrap:up. Once that has happened Vadnais will revisit the.request.

Meeting Minutes.
Planning Commission Chair Joshua Patrick called the meeting to order at 7::00 p.m. Comm ission. Members Art Pratt,
Stephanie Farrell and Don Cummings were present. Not present was Derek W.ippich. Also present: City Planner
Evan Monson, City Attorney Kevin Beck and Acting City Clerk Melissa Lawrence.

Commission. Cummings requested .that a section -of the minutes on page 2 be edited to state that the City should be
cancerned,.not.that he is only concerned about agricultural use in a residential area.
A rnotion was made by Commissioner Pratt.:to approve the August 9,2022, Planning Commission Meeting minutes.

Ordinance No, 45 Garbage and Refuse Diseussion arid .Survey Res uIts
City Planner Evan Monson gave: the Commission an overiview of the: results from the Garbage Hauler
survey Acting City Clerk Melissa Lawrence sent out to 'all reside..nts.and business owners in Gem.Lake. 206
residential surveys and 24 commercial surveys were sent.o.ut. The city received 6..6 responses from
residences, and.1.1 responses from businesses. This equates to. a'resporise rate of 32% for resident surveys,
and 46% for commercial .surveys. The survey asked respondents to answer the .following. questions:
name and address, their current hauler, satisfaction rating of their service (Extremely. Satisfied, Somewhat
Satisfied, Neither Satisfied 'nor Dissatisfied, Somewhat Dissatisfied, and Extremely Dissatisfied),
Approximate monthly cost; and whether the respondent thouaht.the city should contract garbage hauling
services in the future.
Responses to the survey are attached in a memo and PowerPoint presentation from City Planner E..van
Monson. Per Mr. Monson,. given the. split in opinion, the commissioners tray want to forward the
information to the City Council to see what direction the Council would like to move in with regards -to
contracting for hauling services. The commission can review other changes to make to Ordinance 45 in the
meantime. Per Acing City Clerk Melissa Lawrence; the. survey results discussion has: already been added to
the City. Council agenda far.November 21,.2023.
Commissioner Cummings shared soin.e topics.he thinks. the Commission should .address in the current
ordinance: which include language on the maximum size of:containers allowed. in the city, placement of
containers and the visibiIitylscre.ening of the containers.
Commissioner Patrick would like to wait and see what the C"i..ty.CoundI suggests regarding the results of
the survey before. the Commission takes a deep dive into the current.ordinance.
The Commission will.continue to look at the ordinance to.discuss. at firture meeting.

Commissioner Patrick surveyed the Commission, City Attorney, and .City .Planner to see if.the.second
Tuesday of each month still works for everyone's sclieduie. At this time that meeting schedule works for
everyone. Ifart election happens to fall on that.Ttiesday, the Commission is ok with pushing the meeting
one day or holding it in the Small conference room.

WHEREAS, the City of Gem Lake City Council suggested a donation at their October 17, 2023
.meeting in support of the White. Bear Lake Area Food Shel..f.
NOW, THEREFORE BE IT RESOLVED, by the City of Gera Lake, Minnesota, the City
Treasurer is authorized to send.$1,500.0. to support the White Bear Lake Area Food Shelf for
the month of November 2023.

A RESOLUTION DESIGNATING THE POLLING PLACES FOR THE 2024 ELECTIONS
WHEREAS, Minnesota.. Statute 20413.1.6 requires: the City Council to designate polling.places for the
upcoming yearby resolution;.and
WHEREAS; changes to the :pol1 ng.places locations. may be made at. Icast 90 days before. the. next
election if olie or more of the:authorized polling places becomes unavailable: for use; and
WHEREAS, changes to the polling places locations may be made in the case an emergency when it is
necessary to ensure a safe and secure. location for voting; and
NOW, THEREFORE, -BE IT RESOLVED, that the City Council of Gem Lake hereby designates the
following polling places for any elections conducted in the City in.2024:
Heritage Hall, 4200 Otter Lake Road; Gem Lake, KIN 551.10
BE IT FURTHER RESOLVED,.that the City Clerkis hereby authorized to designate a replacement
meeting the requirements. of the Minnesota Election. Law for any polling place designated in. this.
Resolution .that becomes unavailable for use by the City; and
BE IT FURTHER RESOLVED, that. the City Clerk is hereby authorized to designate an emergency
replacement po11ing.place meeting the requirements: of the Minnesota Election Law for any .polling place

WHEREAS, The City of Genf Lake currently operates a Municipal Curbside Recycling
Program. for all single family residences within the City; and
WHERE, AS., the City Council realizes that increased. public awareness,. education and
participation in this program is in the best interests of all citizens and wishes. to .expand the
current program within the adrninistrative guidelines established for current City staff-, and
WHEREAS, the Ramsey County Public. l lealth Department, Solid Waste Division, is providing
a grant of$.1,298.0-0 to the City of Gem Lake for the year 2024;
WHEREAS, the. City of Gern,.Lake. has completed the grant application which provides .a
breakdown of how the City of Gern Lake. will allocate their grant monies;

With the third quarter safely behind us already: The City's revenues are above where they
should be now and expenditures are little below, The key to. the City's finances are that even
though we are.75% through the year, revenues and expenditures.do not flow evenly though the
year. All debt. payments have been made so debt service. expenditures are 100% spent, but
snow plowing/sanding expenditures have not yet started for the end of the. year so genera[ fund
is under budget. Below is a chart comparing budget to actual revenue and expenditures for the
years 20 22 and 2023.

For the third quarter, revenues are still above budget projections and. expenditures are below
budget, which is shown in future charts. The chart on the following page shows how revenues
are below expenditures levels for the first three quarters of the year, which is typical. Until the.
December tax settlement is received. In addition, one can see how the City depends on
reserves (cash balances) until the December tax payments. are received.

For the year, the City has received 56.52% of the budgeted revenue through the first third of the
year, which as a percentage of budget is louver than last year. at this time when the City.had
collected 61.09%. Building permit revenue is dawn from the $10,549.55: in 2022 to $7,324.35. in
2023. Charges for services are above budget amounts and.2022 revenues, Overall., the City
has collected $4,040.47 for charges for services compared to a budget of $1,950.00. The City
did receive its first half property tax settlement in July. Property taxes account for 91.42% of
budgeted revenues for 2023. So far, the City has collected 53.20% of its property tax levy a
$311,088.40 .compared to a budget $584,697.M Revenues also include $9,557.84 for cable.
TV franchise fees, which was budgeted at $6,500 for 2023. The chart below compares budget
to actual revenues for the last three.Years, For this chart, the monthly revenues are 3141 of the
total revenue budget with the exception of property taxes., which are included in the July and
December budget numbers.only.

If expenditures were spent evenly throughout theyear, the City should have spent 75% of its
.budget.. The no activity has spent 75% of their budget as shown in the chart on the following
page. General GovOrnment activity has spent 54% of their budget so far in 2023 and this
includes. a. $27321..40 payment to BS&A Software for the new software system. Public. Safety
has paid for services through September and has spent 72% of their budget. While, Public
Works; has ❑nly spent 34% of it's budget with snow plwi ong being the largest expenditure.,
which will start having some charges in the 411 quarter of the year.. All departments should. finish
the year below budget based on current expenditure and past 4t' quarter expenditure levels,
with the exception of Public Safety, which should finish the year just below or near 2023 budget
amounts..

Overall, the General Fund appears to be in good shape through the first three quarters of the
year. If revenues and. expenditures fallow previous year collections and expenditure patters,
revenues should finish the year above budget amounts while expenditures finish below
budgeted amounts. Also revenue should exceed. expenditures. Both which seem likely now.
SPECIALREVENUE FUNDS
The City's Only Special RevenUe .Fund. is the Parks and Playgrounds Fund, which has interest
earnings of $1,104.49 through the 31d quarter of the year. There has been no expenditures s❑
far this year.
DEBT SERVICE FUNDS.
All scheduled debt :payments totaling $137,878.75 were paid. From the table on the first page it
would appear that the. Debt Service Funds.are over budget, but the budget is for 3i4 of the year
and the actual expenditures.are for the full year or 100% spent. Funding comes from property
taxes and special assessments, which the City received in July with the first half 2023 property
tax settlement for $77,436;37.. The City wilf receive the second half settlernent in December.
CAPITAL PROJECT FUNDS
Revenues for the Capital Project Funds total $47,118.47, which includes bond special
assessment collections for the waterline extension for $19,837.24, interest. earnings of
$7,281.23, andan operating transfer fromthe general fund of $20,000, The expenditures in
2023 are for the road. project, which total $140,81Q,00 so far.in 2023.
ENTERPRISE FUNDS
The City's Enterprise Funds oonsist.of the Sewer Enterprise Fund and the Water Enterprise
Fund. Revenues are above last year revenues and are above budget at 11.3:.40% of budgeted
revenues, with the 41h quarter still to be billed. Revenues totaled .$92,194.50 for the year
Compared to $73,931.57 last year. Expenses for the year are above last year's expenses and
are over 38,64% of budgeted expenditures. Keeping in mind that the expense budget for the
Sewer and W .ater Enterprise Funds includes depreciation, which is not recorded until year-end.
The main expense is the M.C.E.S. charges for sanitary sewer treatment. The City has a l7udget
of $53,500.00 and has paid 83.32% or $44,576.50 for this fine. item.
The. Water Enterprise Fund has revenues.of $38;808.93 so far. The larges expense is the water
bill from the City of Vadnais.Heights in the amount of $12,272.18. so far.
Overall, the l=nterprise. Funds should finish the year with revenues above budget and expenses
below budgeted amounts. If this happens, the Enterprise Funds will have operated at again,
CASH AND.INVESTMENTS
Finally, the City had $1,321,904.74 invested as. of September 3QMr This compares to
$1,227,717.66 invested. last year at this time. The investments had an average interest rate of
1.93% compared to 1.8 % last year. Interest. rates remain low with a 3.73°Io interest.rate on. a
municipal bond as its highest rate.of return. The chart below shows the City's invested. funds for
the last four years.

The other factor and equally important. as funds invested is the City's cash in the bank. These
are the funds the City uses. to pay its bills each month. Since the City receives the majority of its
money in July and: December from tax settlements, it is not unusual for the City to have a large
amount of cash available in those -months with the funds being drawn down in the proceeding
months. Depending on expenditures and other revenues collect.the City may draw on its
investments to help meet`its cash needs. The. chart on the following page demonstrates the.
cash flow for the City. One can see how the City's cash peaked. in July with.the receipt of the
July`tax settlement and the City has drawn down those funds since. The 2023 cash balances
are lower than previous years. because excess cash balance have been moved into investments
at the end.:of 2022 to earn a:higher interest rate than the checking :account rate. This is also
reflected in the investment chart above, which shows 2023 investments above .previous. years.

The City has had a normal first three quarters of the year financially. Through the third quarter,
it appears revenues. should finish the year above budgeted .amounts for most revenue sources,
while expenditures may end the year below budgeted amounts. The City has sufficient.cash
and investments to meet its obligations until.the City receives its second half tax settlement in
December, however investment earnings remains low, Therefore, the City continues to be in
good financial shape for 2023.

Key representatives from the Minnesota Pollution. Control
Agency'.(MPCA) provided an update on local. well
contamination during a special' presentation at the
September 19. Gem -Lake City Col meeting.
The presence of the chemical 1,4-dioxane was first
detected in 22 Gem Lake wells approximately two.years.
ago.as part'.of an area investigation of accidental
pollution released -by the Water Gremlin Company over
the course of: several years. Well testing. was first
conducted.on wells that were. one mile away from. the
headquarters on Otter Lake Road in White Bear
Township, This was later expanded to wells located 1.5
miles away from the headquarters. During this wider look
at area wells, 1,47dioxane .showed up in 22. wells,
Although the a.rnount. of contamination was considered
very. small (1-3 parts per billion {ppb}), it was still over the
Minnesota limit.of 1.ppb and needed to be dealt with.
Over the. course of. the next few years; the MPCA has
worked to find the. source of the pollution; educate the
public on the chemical and provide:bottled water to
affected homeowners.

The City of Gerry Lake will approve its final 2024 property
tax:levy and budget at a public hearing on December 19,
starting at 7:0.0p.m. The State of Minnesota requires that
cities approve a. preliminary' budget by September .29,
which.the Gem Lake City Council accomplished at its:city
councill.meeting on September 19. Cities then have until
the end of December to.approve a final budget, allowing
time for budget numbers to be refined: and finalized.
While a city can reduce its budget numbers for the final
budget, it cannot, by law, increase its proposed budget
levy from the numbers -approved in thepreliminary
budget. For this reason,. most cities certify a preliminary
budget using "worst -case" budget scenarios.
In September, the 2024 prelim inary.property.taX levy was
approved at. $717,742, which is'a 1,29% increase from
the 2023 certified preliminary property tax levy,

The. City of Gem Lake :began its own education
campaign, commissioned an updated water plan,
explore d:options for municipal water systems, and began
to apply for federal and .state funding to pay the cost of
installation, if deemed appropriate.
When the MPCA appeared at a council meeting earlier
this year, they -reported to the City that a possible source
for the contamination, had been discovered at..a nearby
manufacturing firm. The name of this firm is Cortec,
which is Located .just to the north. of Gem Lake in White
Sear Township..Cortec.is now fully cooperating with the
MPCA.tofind.out more and to mitigate any problem as
soon as possible.
The MPCA outlined a plan to do further well testing in the
affected area.and to. report back.wit h the results on.
,September 19. The goal was to continue to collect: data
in order to determine if the well contamination is
increasing or decreasing, as to see if it is moving to new
areas.
The results reported at the. September meeting were
somewhat surprising to the layman, but fairly predictable
to the experts. Samples were. collected from 39 wells. last
year, which generally encompassed. the.22 affected wells
and a variety of nearby wells, For the most current.
readings, data was captured from 34 of the same 39
wells.
Of these 34 wells, 26 had a declining amount of pollution
present, with two ofthose falling into the: Non�Detectable
category. Most of the declines were fairly: small, such as
a decrease at one address. from 1:8'ppb to 1.5 ppb. The
most dramatic decreases occurred at two. wells., one
declining in poilution:from 3.3 ppb to 2.1 ppb,and.the
other. falling from 2.,8 ppb to 1.4 ppb.
Right of the wells showed an increase of the presence of
I A4oxane, although most of the increases were
miniscule. For instance, one well went from a detection.
of 0.58 ppb .(which is under the State's.:standard for
contamination) to 0.65 ppb. The largest of the increases.
occurred .at a well that went: from 1.6 ppb to 2.1 ppb..
Although these: results sounds dramatically better, the:
MPCA. urges caution. According to the agency, these.
hum bers.ahow changes that are not as startling as they
may sound. The changes are actually quite small and
might.indicate that the pollution came from a one-time
release of the chemical, although that has not been.
confirmed. The importantthing to: consider is how the
chemical behaves in the ground over a long period of
time. The answer will lie.in regular testing, over a long
period. of time. More tests in the area, are planned for
next year.

The 2024 preliminary property tax levy is proposed. at:.
$71.71.7-44 which is .a 7:291 %. increase from. the 2023
certifiedpreliminary property tax levy. The.2024
preliminary property tax levy consists of a debt levy of
$8.1,554:00 (a decrease from 2023 preliminary debt levy
of $2,864.00) and the general operating levy of
$836,188.00 (an increase of 8.806% from the 2023
preliminary tax levy):
The following changes were made from the 2023
adopted :budget as a. basis for the 2024 proposed
preliminary property tax levy:
• Bas.edon the 2015 Refunding Bond schedule the.
debt levy for 2024 is set for $76,269.00. In
addition,. in. 2018; the City issued bonds for the
improvements on Scheuneman Road and the 2024
debt levy for this: issue is. $5,285.00. The two of
these debt.levies makes up the City's 2024 debt
levy of $81,554.
• This budget does not include small government aid
from the State, since the City no. longer qualifies.
This reduces revenues by $7,000.00..
■ City Council contingencywas:increased to $1.0,000
(.was $9,000).
Clerk/General. Government budget includes
$60,000.00 for wages and $11,000 for health.
insurance .Coverage.
■ ClerklGenerai. Government budget does not include
$75,815 for the new. software.
• Planning.& Zoning budget increased $5,000.00,
based on past expenditures.
• Police budget was increased 12.38% to $129,466
based on the City of White Bear Lake. budget
provided us.and includes $115,877Jor police
services and $1.3,589 for debt payments. on. the
new public facilities building.
The cost: of fire services could increase 43.04% to
$48,669.00. It includes $31,982 for fire services,
$7,746 for fire marshal services, and $8,941 for
debt. payments on the new public facilities building.
Overall, the City of Write Bear Lake would like .
Gem Lake. to pay $22,580. for the: next 20 years for.
their new facility.
• Road Maintenance budget includes $22,000 for
road maintenancelrepaiir and $15,000 for trimming
boulevard trees.
• Salt/sand reduced $3,000. to $12,OQ0 and snow
plowing contract decreased from $17,000 to
$15,000, both based on past expenditures..
• Heritage Hall budget includes $15,000 for building
improvements to the:.office doorsand front window
for security and $15,000.for the irrigation system.

The Minnesota Senator who represents: Gem Lake was
recently recognized for her leadership skills. Senator
Heather Gustafson was named as a 2823 Legislator of
Distinction by the League of Minnesota Cities.
The League named many accomplishments by
Gustafson that lead to the award. For instance, she
authored the Public Safety Aid Bill in 2.23, which
provided $21.[} Million in assistance to cities and then
assured that the final bill aided all. 855 cities. She was
recognized as being critical to achieving local -zoning
authority for Minnesota cities as part of the legalization
of adult -use cannabis, authoring an. amendment to
provide for local license limiting authority and zoning.
The League of Minnesota Cities specifically stated their
appreciation of Gustafson's awareness of -city needs.
Senator Gustafson was a guest speaker at the October
21 Gem Lake City Council meeting, during which she
was able to discuss the Public Safety Aid Bill in more
detail. She.also.touched briefly on other legislative
accomplishments and plans for the year ahead.

The Ramsey County Commissioner who represents
Gem Lake was a guest speaker at the August 15 Gem
Lake City Council Meeting. She took the opportunity. to
bring Council members and guests up.to date..on county
initiatives that affect Gem Lake.
These. 'include programs such, as:
• Appropriate Response Initiatives
■ Food Scraps Pick Up
Affordable Housing
■. Non public Safety Traffic Stops
For instance, there is a pilot project now underway in
Ramsey County to decide at the point of a 911 call,
whether the response should include: police officers,
social workers or a combination of the two. It is currently
in a test phase, with full roll out expected in the coming.

There is also an exciting new initiative in which
households can dispose of food scraps in: their trash pick=
up, by. using a special food scraps disposal bag. This bag
will be sorted out of the rest of the trash at the trash
processing site and composted properly, thus keeping it
out of the landfill. This program is. also in a pilot testing
phase and is.expected to he rolled out in the Next few
years in both Ramsey and. Washington Counties. To
participate; a household would order special disposal
bags online for weekly use in theregular trash pick-up.

Frethem touched on changes that are being initiated in
non-public safety traffic stops, Ramsey County Attorney
John Choi has elected to decline .filing:charges stemming
from searches related to pretextual stops. Various area
jurisdictions have stopped enforcing violations that are
related to nonpublic. safety traffic stops, such as expired
license tabs.

Last month, a series of five.beautiful signs were installed
on the Gem Lake Trail, .which is located.. near the
southwestern side of -the city. These signs are designed
to illustrate and provide information on the various native
grasses and plants that were placed alongside the trail.
They also provide examples of the native butteMies that
alight be. spotted in the .immediate area.
These signs were paid for through. a donation made to
the .city by. Luther Cadillac, as.part of a park dedication
process. that accompanied their recently completed
dealership. This dealership opened several months ago.
It is unique for many reasons, one of thern being
boundaries. The dealership is located in tWGCities, the:
main building is in Vadnais. Heights and the north parking.
lot is located in Gem Lake.

Police Chief, following theretirement of former chief
Julie Swanson at the end of August.. Stepping into the
position. is Dale Hager, who formerly served as the
White Bear Lake Police Department's Administrative.

Hager.brings 26years of law enforcement experience
to the job of Police Chief. He has served as a Narcotic
Task. Force Member; Firearms, Field Training and.

career. Prior. to being appointed as Administrative
Captain, Hager served as Sergeant at Lino Lakes
.Police Department.

the responsibilities of White Bear Lake's next Chief of

Hager follows Julie Swanson, who served as White
Sear Lake's Chief of Police. for the past nine years. The
City of Gem Lake utilizes White Bear Lake for both fire
protection and law enforcement services; making him
Gem Lake's police chief also. Gem Lake had the
opportunity to welcome. Hager in person when he
presented. a report. at. the November 21 City Cauncif
meeting. (See next story.)
Gem Lake's watershed organization gave.an annual
report at the August City Council meeting, focusing on
the partnership between the city and. the Vadnais Lakes
Area Watershed Management Organization.
(VLAWMO.).. Phil Belfiori, VLAWMOadministrator, began
by thanking the city for the. cooperation they..have shown
.all year.on joint goals, and rioting. that Council Member
Jim Lindner also serves on the.organization's board of
directors. He added that Gem Lake.resident Gloria
Tessier sits on the organization's Technical Committee.
VLAWMO was established in 1983. as a joint powers
authority (JPA) between 6 communities that makeup the
area the watershed covers.. These communities are
Vadnais Heights, White Bear Lake, White Bear
Township, Gem Lake, North Oaks and Lino Lakes. This
comprises about 24 square miles. About 94% of.Gem
Lake falls within VLAWMO boundaries. The: other 6
percent falls in. the : Ramsey. Washington Metro
Watershed. ❑istdct (RWMWa.)..
Programming that VLAWMO conducts focuses on water
quality of lakes and streams within its territory,.flood
Management, pursuing.grants that would beriefits those
in .the..district.for water projects, education and outreach,
etc,
In 2022, VLAWMO had. total expenditures of $1,029,394,
with 40% of this going to capital improvement projects for
Local lakes and streams, 17% going to landscape grate
programs, such as helping people build rain gardens in
the yards, and 9% going to lake and.stream water quality
monitoring. The rest of the expenditures were comprised
of operations and administration (16%)i engineering
review and research (9%), and education and outreach.

Belfiori Highlighted joint projects that VLAWMD has
worked on with the. City of Gem Lake. High up on the list
has been a Long range project to maintain and improve
the water quality in the water body of Gem Lake. As a
result, it has been removed from the state's list of
impaired lakes. In addition, the organization has provided
the city with :education materials on things like smart
salting and illicit discharge, :all of which can be used at
community events and in the city newsletter. VLAWMO
alsoheld a seminar for those considering building a rain
garden.. The course was called Raingardens 101, and
was held at Heritage.Ha.il Iast.April.

Trash is now on the agenda for Gem Jake's Planning
Commission. At the request of the City Council, the
commission began to look at the:city's. trash and
garbage ordinance, which .hasn't been updated for
decades.
As part of this effort. the acting city clerk, Melissa.
Lawrence, came up. with. a. garbage: hauler survey for
Gern Lake. residents and businesses and sent it out in
October_ Results of the survey are now in.
The city received 66 responses from residences .and 11
responses from businesses.. This equates to a response
mfe of 32% forresident surveys and 46% for
commercial surveys. The surveyasked.respondents to
identify their current hauler, ran k:their.satisfaction with
their hauler, list the approximate cost of their.service and
respond to whether or not they thought the city should
contract garbage hauling services in. the.future:
Resident Responses
Residents identified three providers for their trash
hauling; Waste Management, Republic Services, and
Gene's Disposal. Waste Management and Republic
each served 26 respondents, while Gene's served 14.
Overall, 6:7% of resident respondents were. extremely
satisfied with their service, and 20% were somewhat
satisfied. Six percent were: neithersatisfied nor
dissatisfied, Each provider had mast. resporident'.s. rate.
them as extremely satisfied. Generally, most resident's
responses noted rates of $25-$4:9:99 per month. In
terms of whether the city should contract with one hauler
for services, residents. showed a split opinion.
Respondents were almost evenly split between Yes
(47%) and N.o.(44°Io). Most comments noted supporting
the city .c..ontracting only if prices would stay consistent
or go down,..
Commercial. Responses
Of the businesses who responded, five different garbage
haulers provided services. These included the two listed.
above tWaste Management and Gene's.), as well as
Walter's Recycling and Refuse (two) RoadRunner (one),.
and Nitti Sanitation (one), Respondents were.satisfied
with their services, as.64% reported being somewhat
satisfied;.and 36% reported being extremely satisfied.
Monthly rates did not vary as much for businesses,
compared to. residential respondents. Nine of the
businesses. who. responded reported a monthly rate of
$150 or more.
Unlike residential responses, ten of eleven businesses
who responded said they were not interested in the city
contracting for garbage hauling services. The eleventh
respondent listed. themselves as indifferent to the idea.
The Planning Commission and City Council will discuss
these results and decide on any further course of action.
A public hearing will be. field on December 19 on Gern
Lake's. annual MS4 updates, which is a mandatary
hearing required by state. law, covering. stormwater flow
within city borders. At:the public hearing, an overview of
Gear Lak.e's stormwater situation and anything that would
have impacted it in the previous year will be presented,

City Staff sent out a. survey to residents and businesses within the city, looking to receive. feedback regarding their
garbage hauling provider. The responses received were reviewed, with the results summarized in this memo:.
SURVEY
206.residential surveys and 24 commercial surveys were sent: out. The city received 66 responses from
residences,.and 11 responses from businesses. This equates to a response rate of 32% for resident surveys, --and
46% for commercial surveys. The survey asked respondents to answer the fallowing questions:
name and address, their current hauler, satisfaction rating of their service (Extremely Satisfied,. Somewhat
Satisfied, Neither Satisfied:or Dissatisfied, Somewhat Dissatisfied, and Extremely Dissatisfied); approximate
monthly cost, and whether the respondent thought the city should contract garbage hauling services in the future.
Residential Responses
Residents identified three providers for hauling: Waste Management, Republic: Services, and Gene's Disposal
Services. Waste Management and Republic each served 26 respondents, while Gene's served 14. Table 1 below
summarizes how respon dents. rated their service provider.. Overall, 67% of resident. respondents were 'extremely
satisfied' with their.service, and 2Q%. Were `somewhat satisfied`, Six percent were neither satisfied nor dissatisfied

In terms of whether the city should. contract with a hauler for services, resident responses showed a split opinion.
Respondents were almost evehly split between 'Yes' (47%and Vo' (44%a); with a small number responding as
'Indifferent' (9%).
Seventeen comments were received from residential respondents. Mostcomments noted. supporting the city
contracting for hauling services, only if prices would stay consistent or go down.
Commercial Responses
Of the businesses who responded, five different garbage haulers provide. services:. Waste Management (serves
four respondents), Gene'.s.(three), Walter's Recycling &Refuse (two), RoadRunner.(one);.and Nitti Sanitation
(one). Responders were: sati - sfied with their services, as 64% reported being 'somewhat. satisfied% and 36% were
'extremely satisfied'..
Monthly rates did not vary as much for businesses compared to residential.respondents. Nine of the. business.
respondents reported a rate of $150 or more. The Montessori School reported a rate of between. $50. and. $74.99
with RoadRunner, while.another business responded that. their rate was $100 — $124.99 a. month with Waste
Management.
Unlike residential responses, ten of the eleven businesses who responded were not interested in the city
contracting for garbage hauling. One was `indifferent' to.the idea; they commented they would support the city
contracting for hauling services if the city can get a better price. No other comments were received from business
respondents.
NEXT STEPS
Given the. split in opinion, the commissioners want to forward the information to the City Council to see what.
direction the Council would Iike to move in with regards to contracting for hauling services, The commission can
review other changes to make to Ordinance 45 in the meantime...

AN INTERIM ORDINANCE REQUIRING A LICENSE AND IMPOSING RE GU LATIONS. ON THE
RETAIL SALE OF EDIBLE CANNAB.INOID PRODUCTS
THE CITY COUNCIL OF THE. CITY .OF GEM LAKE ORDAINS:
Section I. Purpose and Intent. The purpose ofthis.ordinance is toestablish licensing. and sale regulations for the
retail saie:of edible cannabinoid products derived from hemp as provided in Minnesota Statutes; section 15:1.72.
Section 2. Legislative Findings: The.Councilhereby finds and determines as follows:
I.. in 2022; the Minnesota:Legislature's amended Minnesota Statutes, section 151.72 to expressly allow the
sale of edible products that contain tetrahydrocannabinol ("TI C:") Without any..a..ssociated licensing
requirements:
2. The unexpected. change in: the law. the.[ack of licensing and. other regulatory standards, and the concerns
regarding!he.pvtential mpacts of the sale of edible.cannabin.oid products resulted in the City Council
.acting on September 27, 2Q22 to enact a one-year moratorium on the sale ofTHC products.
3. Since that time; the City has studied the issue And anticipated.the Legislature would provide Additional
guidance and. regulation during the.2p23: session on. the. sale of such products. While the Legislature did
adopt a:321-page cannabis bill, it essentially .maintained. the status qua regarding the sale of edible.
cannabinoid products under Minnesota Statutes, section 151.72 until the newly established Office of
C'annmis.Managenrent begins licensing cannabis business,
.. 4. Because the Office of Cannabis Management is not likely to begin issuing licenses to sell lower -potency
hemp products until early 2025, and faced with.conthming uncertainties associated with the sale of edible
cannabinoid products, the City Council determines it is. in the best interest of the City to require. ..license to.
Sell. such products And to impose related regulations until the Office of Cannabis -Management assumes the
[icensing.:of cannabis businesses.
SeetionI. Definitions. For the purposes of this ordinance, the following terms shall have the meanings:given them
in tliis.section. if a term is not defined herein, it shall have.the:.meamng given it in Minnesota: Statutes, section
151.72.or, if not defined herein;jhe definition given the term in the municipal code.
J. City. The. City of Gem Lake, Minnesota.
2. Compliance. Checks. The system the City uses td investigate and ensure that those authorised to .sell edible
cannabinoid prod uets are following and complying with .the requirements of this ordinance and state laws:
Compliancechecks involve the use of compliance:check minors; as authorized by this ordinance., who
purchase..or attempt to purchase edible cannabinoid products., Compliance checks may also be conducted by
the.City or other units of government for educational, research, and training purposes. or. for investigating or
enforcing federal, state, or local laws: and regulations relating: to edible cannabinoid.products.
3.. Delivery Sales. The sale of any edible cannabinoid product to any person for personal consumption and not
for resale when the sale is .conducted by any means other than an in -person, over -the. -counter sales
transaction in a retail establishment..Did ivery sales include, but are: not limited to, the sale of any edible
cannabinoid products when the sale is conducted by telephone, other voice transmission, mail, the. internet,
or app-based. service.. Delivery sales. include delivery by licensees or third parties by any means, including
curbside pick.=up.

5. Eligible Business. A business located within the City that has a current tobacco license to seil tobacco or
tobacco. products at retail issued by the. City under Ordinance No 68 :of the municipal code,:or that has A.
current on -sale or: :aff sale. liquor Iiicense to sell intoxicating liquor issued by the City under. Ordinance No.
09 of the municipal code.
6:. hemp or Industrial Hemp. Has the same meaning given the term in Minnesota Statutes, section 18K.02,
subdivision 3., as it may be amended.
7. babel. Has the same meaning given the term in Minnesota Statutes;. section 1.51.01; .subdivision 18; as it
may be amended..
8. Labelling. Has the meaning given the term in lvlinnesota.Statutes, section 151.72, subdivision i(i).
9. Licensee. The entity -issued a license under their ordinance to sell edible cannabinoid product at retail.
10. MoveablePlaee.of Business. Any form of business operated out of a kiosk; truck, van, automobile, or
other type of vehicle or transportab [ e shelter and not a fixed address storefi7ont or other permanent type. of
structure.authorized for sales transactions.
1.1. Municipal Cade. The most current version. of the Municipal Cade of City.of:Gem Lake,. Minnesota,
1.2. Ordinance. This ordinance requiring a license and imposing. regulations on the retail sale of edible
cannabinoid products.

Section 4. License.
1. Required. No person may directly or indirectly, or by means of any device, keep for retail safe, sell at
retai€, offer to.se11, or otherwise dispose of any edible cannabinoid product at: retail at any place in the City
without first having obtained a license from. the :City issued .in accordance wit]i the provisionsof this
ordinance:
2. Eligibility. The City shall.only issue a license to sell .edible cannabinoid.products to an eligible business
that qualifies to receive a license under the requirements of this. ordinance.

cannabinoid products. or the sale by a manufacturer of its products to.reseliers, provided the manufacturer

Section 5. Ineligible Places and Operations. The City shall not issue or renew a license tinder this ordinance to sell
edible cannabinoid products to:
1.. A business or operation that does not qua] ify.as an eligibi.e business under this ordinance;
2. A business providing delivery sales of any edible cannabinoid products;

licensee, waive strict compliance with this provision; no waiver maybe granted, however; .far taxes, or any
Portion thereof, .which remain unpaid for a period exceeding one year after becoming due unless such one-
year period is extended through no fault of the licensee; or
6. A business that is in violation of one ar more provisions of the rnunicipal code. related to its operations as
an eligible. business..
Section .6..Applicatian Procedure: An application for a Iicense shall be submitted and processed in accordance
with this: section.
1.. License Application:. An'application for. a new or renewed. license to sell ediIll e..cannalainoid.products shall
be made on a form. provided by the City and filed; along with all required fees, with the City Clerk: The
application shall contain the ful] nameof the .appliicant, the applicant's residential: and business addresses,
arid. telephone numbers, the narrieo.fthe business for which the Iicerise is.sought,.informatio.n.to establish
the business qualifies as an eligible business;. asite plan. for the business; arid. any additional information the
City deems.necessary. If the City Clerk determines an application is incomplete; the City.Clerk.shall
provide .:#he..applicant notice of the information necessary to matte the application complete. 'rhe City shall
not process an application until. it is made complete. Upon receipt of a completed application, ilte City
Clerk.sha]I forward the application to the Police Departmeatto conduct.a background investigation:
2. Tees. No licenseshall be processed. or issued under this ordinance until theappropriate fees have been paid
in full. The fees for a license under this ordinance shall be established by City Council resolution.
3. Manager or Agent. If tile.applicant.is a firm, association, partnership, corporation, limited liability
company, orjointventure, the application must include.the name of the natural person who will serve.as.
the manager or agent of the licenscd promises. Such manager or.agent must, by the Terms.of their written
consent; (1.) take full .responsibility for .the conductof the licensed premises. -and (2) serve as agent for
service of notices and other. process relating to. the license. The manager or agent: must..reside within.75
miles of city. hall. The required residency must be established by tile time the license is issued and must be

suspended or revoked during the same time period, provided the applicant had an interest in the

marriage, of a person ineligible for a license under -this ordinance who the City Council determines

current license: 'The issuance of.a license issued under this: ordinance is. a pri.vilege.and does not eatitle the
license holder to automatic renewal: of the license.
7. Non -Transferable. All licenses issued .under ibis .ordinazice shall be valid only on the premises for which
the license. was issued and only for the person. or business to whorri the license Was.. issued, The transfer of
any license to. an other'.location, business,. or person. is prohibited.
Section 7. Operational Requirements.
:1. License Display, All licenses shall be posted and displayed in plain view ofthe general public on.the
licensed premises.

2. Respans.ibility. All licensees under this ordinance sha. ll,be.responsible: for the actions of their employees in
regard.to the sale of edible cannabinoid products on the licensed premises, and the sale of such an item by
an employee shall be considered a sale. by the licensee'.
3. Product Compliance. All edible:cannabinoid.products shall comply with 'the :requiremen% of Minnesota
Statutes; section 15 1.7 2 including, but:not. limited to, that they do not contain..more titan 0.3 percent of any
tetrabydrocannabinol, more titan five. niilligrams. of any tetrahyd.rocannabinot tin a single. serving, or more
thane total of50 milligrams. of any tetrahydrocannabinal per package.
4. Product Display. A11 edible.cannabinoid products shall be stored either: (a) behind a counter .or other area
not. freely accessible to customers; or.(b) in a case ar other storage unit not left open and accessible to the
general public.
5. Age. Past1ng. Notice of the. IegaI sal es.age and age. verification requirement must be.posted prominently and
in plain view. at all times at each location where edibIc cannabinoid products are .of3'ered for sale: The
required. signage must be: posted. in a manner that is clearly visible. to anyone who.is or is considering
making a purchase.

identification that any 'purchaser of an edible cannabinoid product is. at least 21 yearsof

8. Inspections. The premises licensed under this ordinance.must be open to inspection by any authorized '
representative of the City during. regular business hours for purposes of ensuring.compliance with this
ordinance.
9.. Revocation of Suspension. Any license issued under this ordinance maybe revoked or suspended by the
City Council for a violation of any provision of this ordinance as provided herein.
Section S. Other Prohibited Acts.
1. NQn-Compliant Products. No person shall sell or offer for sale a product containing THC, including
edible cannabinoid products, that -does not meet all the applicable requirements ift-Minnesota.:Statutes,
section 151..72.
2, Presumptions. Edible cannabinoid products sliall comply with -the labeling requirements in Minnesota.
Statutes; section 151.72., subdivision 5 and.all other applicable labeling: requirements: The City may
presume; for the purposes of enforcing this ordinance;.an edible cannabinoid product being offered for sale
or that is sold by a licensee has been tested by -an iridependent.lab as required in Minnesota Statutes, section
151.72, subdivision 4 and that the. information contained on the product label is accurate.
3. Pricing and D..iscounts. No. person shall accept or redeem any coupon, .price promotion, or the instrument.
or mechanism, whether in. paper, digital, electronic, mobile, or any other form, that provides. any edible
cannabinoid product to a consumer at no cost or at a price that is less than the non -discounted standard
price listed by a retailer on the item or on any relates shelving, posting, advertising, or display at the
location where the item is sold or offered for sale, including. aI applicable -taxes.
4: Purchase for Others. It is a misdemeanor violation of this ordinance for. any person 21. years of age:or
older to purchase or otherwise obtain any edible can nab inoid product on behalf of a person. under the: age of
2.1.
5.. Under Aged Persons. It is a petty misdemeanor for any person under the age of 21 todo any .d.the
following:
1. To attempt to .disguise their true age by the. use of a false Form. of identification; whether: the
identification is that. of another person: has.been modified or tampered .with to represent an age
older than the actual age of the person using.that identification;:
2. To attempt to purchase. edible.. cannabinoid products; or
I To possess edible cannabinoid products. This prohibition does not. apply to a licensee's employee
who is handling edible.can nab inoid.products.
Section 9. Compiiance Checks. The City may from time -to -time conduct unannounced' compliance checks of
licensed estab.lishnients.'N6 person used iri compliance. checks may attempt to cuss: a forrn of identification. that.
Inisrepresents:the gersdn's.Age.: All. persons lawful ly.engaged in.a comp] lance check shall answer all questions about
their age asked. by the licensee or their employee, and produce. any identification, if any. exists, for which they are
asked. The City will conduct a compliance check. that involves the. participation of a.person at least. 1$ years of age,
but under the age of2l. to enter the licensed premises to attempt to purchase the edible can nabinoid products..
Persons used for the purpose of compliance checks shall be.supervised by law enforcement or other designated
personnO. Nothing in this ordinance shall prohibit compliance checks authorized by state or federal laws for
businesses manufacturing, storing; or selling edible cannabinoid .products. under any applicable federal or state law.
The...campliance checks authorized.by this ordinance are.in addition to any other compliance checks that may be.
performed related to the tobacco or liquor license held. by An, eligible business.
Section 10. License Actions.
1. Basis for Action. The City maysrIspend; revoke, or nonrenew:a.license issued under this ordinancefor any
of the following reasons:

1. The. appIicant. has. been convicted withinthe past five years: of any violation of a federal, state, or
local law, ordinance.provision, or other.regulation relating to the licensed activity, or has had a
license to sell. edible cannabinoid products; tobacco, or liquor revoked or suspended within the
past f ve years;
2. Fraud; rnisrepresentation, bribery, or incorrect statement contained in the application for license,
or made in carrying on the licensed activity;
3. Actions. that are:.unauthorized or otherwise beyond the scope of the license granted;
4. Violation of any federal, state, or local regulation or provision;
5: Failure to :continuously comply with all conditions, required as part of the license;
G. F.a.ilure Jo comply with theapplicable zoning.code; or
7. Failure to pay an administrative penalty iinposed by the City Councii.
S. The City discovers the license was mistakenly issued. or renewed to. a person,'it shall be revoked
upon the 'discovery that the person Was ineligibl&for the license under this ordinance:
2. Process. The City will provide a licensee at least 14 days written.notice of a hearing to beheld before the
City Council .on the potential .suspension, reyocation,..or nonrenewal of its license. The licensee shall be
provided an. opportunity to be heard at the hearing. if the City Council acts to suspend, revoke, or not renew.
the License, the City will provide the licensee a.written notice of the period of suspension, .or of the
revocation. or nonrenewal. All salesof edible cannabinoid products must cease during a suspension: period
or permanently upon revocation or nonrenewal of the license.
Section 11. Violation. Unless expressly indicated otherwise; a violation ofthis ordinance. is a misdemeanor. The.
City may also. impose administrative. penalties on a licensee .for violation of this.ordinance. Any administrative
penalties may be imposed by the City Council.; or by ad in inistrative citation, and: shall. be collected. in' accord ance
with the municipal code. Nothing.in!his section shall prohibit the .City from seeking prosecution as. a misdemeanor
for any alleged v.io.lation.ofthis.ordinance.
Section 12. Severability and Savings. If any section or portion of'this.ordinance is found unconstitutional or
otherwise invalid or unenforceable by:a court of competent jurisdiction, .that finding shall not s0ve.as invalidation
or affect the validity and enforceability of any other section or provision of this ordinance.
Section 13. Effective Date and Term. This ordinance shall become effective;on.:the.first day of publication after
adoption: Th is. ord i n a rice shall terminate and no longer be effective on.cc. the sale of.edible canna binoid products is
no longer a]Iowed. except. upon the issuance of a license to sell Lower -potency hemp edibles by the 0ffca.of
Cannabis Management under Minnesota Statutes,. chapter 341.
Section 14. Incorporation. This ordinance incorporates by'reference the sect ioris or provisions of th6 municipal
code as may be needed to give effect to .the provisions of this ordinanceandto otherwise. carry out. its intent.
Section 15. Not Codified. Because this -ordinance has a Hmiwd.durativn,.it will not be.. codified into the municipal.
code.

damage and. disease. The city does not prune branches that are frown a tree that is growing in the Right of
Way/Boulevard and the branch is over private property.
When Maintenance Takes Place
Pruningtypically take place .from October I"thorough March.3.1". This is the most appropriate time of
the year to trim trees to prevent infection through pruning wounds. During theremainder of the year
trimming is Iimited to the removal of nuisance, broken or dead limbs and hazardous trees for public
safety.
Tree Removal
The City willremove boulevard trees that are dead or dying. have a disease or infestation, pose a. threat to
public safety due to structural hazards or for work to install, expand or repair streets or utilities. Once a
tree.is removed from the boulevard the .city :will contract for removal of the stump and the re -seeding of
any turf disturbed`in the process. Removal. and re -seeding isdone at no charge to the; property ow ner:.ln
the event of a bad storm. and a. tree or branch(es), are a safety hazard or interfere with snow plowing -or
maintenance work; the city will contract for removal.
