Interim Use Permit First Year Review for Goats at3044 Scheuneman Road
City Planner Evan Monson summarized the request.The applicants.proposed having goats on their property
last year, and to use an existing barn located on their property. The City. reviewed their request and
approved two goats on the property through an interim use permit. (I UP}. Said IUP would. run. for one:year
and would haveto be renewed.. The one=year period: was chosen to allow the City to see..if issues would.
arise with the proposed use, as farm aninials are not a common occurrence in the city nowadays. The
Planning Commission reviewed and recommended .approval at the September 2022.Planning Commission
meeting, and the City Council approved the. request per tlie.co)nmission's reconunendation.at. their
September ?0; 2022, meeting.
The:applicantIM's submitted an application to renew their IUP for two goats on their property, with an
.add 6d.request to allow two additional goats on the prop0rtyfor a total of four goats.

structures for housing of farm aniina19 through either a Cpnditionai Use Permit (CUP), or an Interim Use
Permit (IUP). Conditions of approval can be added to both types of.per. ntits; an 1..UP can also have an end
date for the use, in which the applicant would have.to reapply to continue the interim use.
The applicant are proposing to continue.using.An existing barn on the site to house two goats, and would
Iike.to house twa.additional goats as well. A fenced in.area for the goats.of 82 feet by 103 feet (8,446.SF)
was installed east ofthe.barn. The existing barn is approximately 430 SF in size, and was. previously used
under previousowners for housing farm animals (horses) as :well. The applicant also has some chickens on
1110,property, chickens and. fowl are regulated :by Ordinance # 141.
The.Consolidated Land Use ordinance outlines what uses are permitted in each zoning district.. Section
7.3.1 notes that a CUP or.1UP can be issued for "the harboring and housing%of agricultural animals on lots
greater than one (I.0) acre". The applicant'sproperty is over the one acre in size, so this:requirement'is
met.
Section 7.3.3 notes that agricultural. structures'are able to be permitted to house: farm.aniinals, such.as.goats..
The site already has an existing barn that was previously used for .hausing farm animals. The barn does not
conform to the .agricultural building setback of 10O feet from property lines or neighboring dwellings, as
required'in.7:3:.3(B); so it is nonconforming. While the structure can continue as a nonconforming
agricultural structure; it would not. be able: to expand in size. Th0 1 U P last..year permitted the barn can be
used to. house goats but could not..be enlarged dire toits nonconforming status.

The review last year determined that fencing on the site be located a minimum of five feet from the south.

Extension of the fenced .in area may. be: a topic of discussion for the commissioners.
The commission should also discuss if. more than two goats should be permitted: There have been. no
complaints received at the time of writing.this report; The fenced in area is approximately8400 SF, .or 0.19
acres.
The City adopted an animal ordinance (No. 142) in October 2022 (after the issuance of the IU.P to the Pax
family) that.sets a one animal per 0.5: acre of pasture requirement. This was.not.a new requirement With the
adoption or ordinance No. 142, as. the ordinance previously existed in No. 69.. This. would mean that the
Pax's would have to increase their fenced�in pasture area`up to one.acre to keep two goats, Three goats
would require 1.5 acres, while four. goats would require two acres (which would exceed the size of their
property ). W i t h the parcel at 1..85 acres in. size,. dedicating 1.5 acres to..pas ture worild.take up. nearly. 81 % of
the property, and couldsignificantly stand out. from neighboring single family residential uses.
Commissioner:Cummings introduced a motion to open the public hearing on the matter at 7:07 p.m.,
seconded by Commissioner Pratt. Voice vote taken, all in favor; motion carried.
Applicant Ted Pax shared that he felt 0.5 acresper goat was a.bit excessive, but. they can expand the fence
if needed.
Comm. issioner.Cummings is concerned. about the accommodating.agrictiltural use in a low density.
residential area.
Commission Chair Patrick asked those in attendance i f anyone else. had any comments on the matter. The
public had no other comnients.
Commissioner Wippic.h introduced a motion to.close the public hearing on the matter at 7-13 p.m.,
seconded by Commissioner Pratt. Voice vote. taken, all in .favor,. motion carried.
Commissioner W ippich suggested. to the applicants that they do some research on their own to suggest
changes to the current zoning.ordinance and agricultural animal ordinance. The Planning Commission
agreed that a request to renew thelUP for two goats on the property Was reasonable and would like to
revisit the. topic on more goats in the. future once some research leas been completed and presented.
City Planner Evan Monson recommends approval based. on the: reconunendations prepared by'himself

City Planner Evan Nionson sunimarized.the.details.of the concept plan :.At :3'610.1-1ighway 61 North, Barnett
Companies is looking.toxemovc:their existing building (III 8.65 SO and buiId'a ne►v one (32,265 SF 4

their existing one, including spaces for a.carwash. service garage,. sales floor, for vehicle delivery, and
administration. Parking wilt be added in place of the original building.
The existing building is. proposed to remain until the new building is constructed, grid then would be
removed. Phasing and sequencing plans would be.put in place to..remain operational.
The property to the North, 3700, is also owned by Barnett..The.y plan to.survey this. area and propose: a lot
line adjustment to shift the property line north by approximately:215%
Both. properties are within the city Is Gateway Zoning District, and are within.the Neighborhood Center
subzon6. The Gateway.Zotie. has established different building types, which dictate. the built fortis 6fnew
development: within.th.e zone. The Gateway Zooe discusses different uses that are permitted as well. The
applicant's pro posed :liuilding type would not be consistent with: the building types currently in thc.0ateway

Barnett Kia's Architect Elliot Stendel shared with the Commission the concept plan for the new building,
Barnett is .wondering what the next steps wouid be to move the process along. The Coinmissioil provided
some feedback on the project that they feel Barnett glib uId touch on. such.as the nced for more green space.

Ordinance No, 45 Garhage and Refuse Discussion
After a meeting with. the Ramsey County .Cnviron mentaI l:le.alth.team regarding promotion of materials. on
the City's website it prompted the Acting City Clerk to look at the .current Garbage and Refuse Ordinance.
Uponreviewing. the ordinance Mrs. Lawrence.noti6ed that the 0rdiitance. has not been reviewed in 30. years
and could use art update.

ordinance, ,No. 45 Garbage and Refuse, was adapted in 1983, The. City Council is looking at potentially
liiniting the :numbcr.of garbage haulers that are allowed in the -city, and would like the Planning
Commission to study the issue. A.survey was sent out to a]I residents: by the -city to gauge who their current
hauler is and.their satisfaction with the service. The survey will close on October 31 st, At this time. the

OVERVIEW
City Staff sent out a survey to residents and' businesses within the city, looking. to receive feedback regarding their
garbage hauling provider:.The:responses received.were.revieweid, with the.results sumniarized in this memo.
SURVEY
206: residential surveys and 24 commercial surveys were sent out; The. city received:66 responses from
residences; and 11 responsesfrorn businesses. This equates to a response rate of 32% for resident surveys, and
46% for commercial surveys -The survey asked respondents to answer the following questions:
name and..address, their current hauler, satisfaction rating of their.service (Extremely Satisfied, Somewhat
Satisfied, Neither Satisfied or Dissatisfied, Somewhat Dissatisfied, and Extremely Dissatisfied), approximate
monthly cost, and. whether the respondent thought the city should contract garbage hauling services. in the future.
Resi.dentia[Res ponses
Residents identified: three providers for hauling: Waste Management, Republic .Services, and Gene's Disposal
Services, Waste Management -and Republic each served 2G'respondents, while Gene's: served '14.. Table 1 below
summarizes how respondents. rated. their service provider. Overall, 67% of resident respondents were 'extremely
satisfied' with their service,.and.?0%.were 'somewhat satisfied Six. percent .were.neither :satisfied nor dissatisfied.
Each provider had most respondents rate them as 'extremely satisfied'..

Of the residential respondents, five had their -services paid by their Homeowner's Association. Table 2.
summarizes the approximate monthly rates for each hauler. ❑verall,. a plurality: of resident responses noted rates
of approximately $25.00 - $49;99. per month. Prices varied for responders.. who. have Republic or Waste
Management, while Gene's was.under $50 in the responses received by the city.

In terms of whether the city should contract with a. hauler for %services, resident responses showed a split opinion..
Respondents werealmost evenly split. between 'Yes' .(47%) and 'No' (4 %), with a small number responding as
`Indifferent' i9°/a.j.
Seventeen comments were received from residential respondents. Most comments noted supporting the city �.
contracting for hauling services only if prices. wouldstay consistent or go down.
Commercial Responses
Of the businesses who responded, five different garbage haulers provide services: Waste Management (serves
four respondents), Gene's. (three); Walter's Recycling & Refuse (two)., RoadRunner (one), and Nitti .Sanitation.
(one). Responders were satisfied with their services, as 64% reported being `somewhat satisfied', and.366/0 were
'extremely satisfied'.
Monthly rates,did.not vary as much for businesses compared to residential respondents..Nine.of'the business
respondents reported a rate of $150 or more. The.M.ontessori School reported a rate of between $50 and $74.99
with RoadRunner, while another business responded that their rate was.$100—.$124.99 a month with Waste
Management.
Unlike residential responses, ten of the eleven .businesses who responded were not interested in the city
contracting for garbage hauling, One was 'Indifferent' to the idea; -they commented they would support the city
contracting for hauling services if the city can get abetter price. No other.comments were: received from business
respondents,
NEXT STEPS
Given the split in opinion; the commissioners may want to forward the information to the City Council to see what
direction the Council would like to movein'with .regards to contracting for hauling services. The commission can
review other changes to make to.Ordinance 45 in the meantime.

THE CITY COUNCIL OF THE CITY OF GEM LAKE ORDAINS:
section 16 Purpose. It is .the purpose of this ordinance to regulate the disposal of garbage, rubbish, and other'refuse.
in the City of Gem:Lake so as to control rats :and .other vermin and otherwise protect the health of the. inhabitants. and
property located in the City.
Section 2. Definitions. For the purpose:ofthis: ordinance, the foItowing.terms. phrases, words, and their derivations.
shaII:have the in caning given hereiit. When not inconsistent with the context, word s.used in the present tense include
the future, words in. the plural number include the singular number, and words in. the singular number include the
plural number. The word "shall" is always mandatory and not merely directory.
L. Commercial Establishment. Shall nican.any premises where acotnmemial or industrial enterprise.of'any
kind is carried on, andsliail.include:hotels and boarding houses, clubs, c]rurches, and establishments of
nonprofit organizations. where Food is prepared or served or goods are sold.
2. Garbage..Shall:mean animal and vegetable wastes.resvltiing fmm..the handling,.preparation, cooking,
service and consumption.of food and shall also include all other animal wastes, but shall not inc[ude.refuse
or hazardous waste
3. Hazardous Waste.. Shall incan hazardous waste as defined in fIMinnesota Statutes, Section 1.16.06,.
subdivision.7I
4. 1neinerator.. Shall mean. any device. sued for the destruction of refuse, rubbish., or waste materials by fire.
5. Open Burning. aMeans the burning of any matter whereby the resultant combustion products :are emitted.
directly to the atmosphere without passing.through an adequate stack, duct, or chimney..
6. Refuse. Shall include all ivastes.which normally result `from the -operation of a household,: except body
wastes and garbage, including, but not limited to, rubbish, tin cans, paper, cardboard, glass jars, bottles;
wood, grass ciippings, Christmas trees, ashes; sod, dirt, tires,:rocks, household construction material,
cement bricks, trees,.le.aves,.hedge or tree:triminings, burning.barreIs and. mesh backyard burners,
household appliances and furniture, or any other household refuse or:ntaterials small enough for one man to
handle. The term ".refuse simil not include hazardous waste, construction. material or other waste or debris
resulting from construction or rwonstruction of buildings and other improvements by contractors, or -trees
in excess: of six (6) inches .in.diameter.
7. Residential Dwelling Unit. Shallmean. any. single. building consisting of four.(4) or. lesa separate dwelling
places,, with individual kitchen facilities for each. Any building containing more.than four (4) dwelling
places, with individual. kitchen facilities, shall .be.deemed "multiple dwelling residences."
Section 3. Disposal of Garbage and Refuse: Every tenant, lessee, owner, or occupant of every private dwelling,
house. multiple residence, store, motel, restaurant, and every 'other type of property in the city which accumulates
garbage:o.r refuse or both on such premises.shali dispose of such garbage.and refuse: as provided in this section.
Garbage and refuse shall be disposed of at least once.0ch'week from residential dwelling unit properties. Garbage.
and refuse in outside storagp at any commercial establishni.ent shall be disposed of at least`once each week and as
often.as:once. each day ifnecessary .to protect the -public health. No person shall accumulate or. permit IQ accumulate
any refuse on any property in the. city which might constitute a. nuisance. by reason oF.appearancc, odor; sanitation,
possible littering of neighboring properties, littering oIt he property on which the refuse is. accumulated, attracting
rats yr other vermin, or a fire hazard.

Section 4. Collection, Supervision, and Control. The City Council sltaII have the: autbority to make regulations
concerning the days of collection, type and location of wastecontainers; and such other matters pertaining tothe
collection; conveyance, and disposal as they shall find necessary, and to change:and modify the saitie. Any person
aggrieved by a regulation of.the City Council shall have the might of:appeaI to the City Council. which shall have: the
authority to coItfirm, modify; or revoke any such regulation.
Section S. Pre -Collection. Practices. Grass clippings, leaves, and other similar refuse shall -be placed in bags:or
bundles not exceeding three (3)`feet in any dimension and securely fastened to avoid spillage. Household appliances
and furniture falling within the definition of refuse need not be so packaged. All refuse deposited for pickup shall be

location.on'the day of collection.
Section G. Preparation of Garbage and Refuse. Except as otherwise provided in Section 4. all garbage and refuse
as accumulated on any pmmises.shall be placed and maintained.ih containers and shall have drained from it all free
liquids before being deposited for collection And shall be wrapped or bagged.
Section 7—Contagious. Disease Refuse. Refuse such'.as; but not limited to, bedding; wearing apparel, or utensils
from. residential dwelling units or other units where highly infectious or contagious diseases are present.sttalI not be
deposited for regular collection but shall .be disposed of -as directed by the health officer or his. deputy at the expense
of the owner or possessor thereof:
Section S. Hazardous Waste; Hazardous Waste Regulations. All hazardous waste, including but not. limited to,
explosive and highly flarnmable material, shall be disposed of in accordance with applicable taws and regulations of
the United: State.s:of Arile rica and the State.6f Minnesota, including regulations and porinit requirements estabIislied
by the`Minnesota Pollution Control Agency and the. Minnesota Waste Ylanagement Board.
Section 9. Duty to Provide and Maintain Containers in Sanitary Conditions. Garbage and refuse containers
shall be provided by the owner; tenant. lessee, occupant .of the premises or garbage: and refuse collector; located in
such a manner 56 as to prevent them from being overturned. Such containers shall be.kept .inA clean and sanitary
condition acid kept free from any. substance which will attract or breed flies; rriosquitoes, or other insects. No.
garbage or refuse container shall. exceed thirty-two (32) gallons. in capacity or have ragged or sharp edges and any
other. defect liable to hamper or injure the person collecting the contents. thereof: Containers.»ot cotrip lying`with the

or other suitable material, which is rodent, .tire, and -waterproof and which will. not easily corrode and. is equipped

containers shall be of a kind .s.uitable far collection purposes, and shall be of such size and weight that they can be
handled by one inan, and kept tightly covered when there is refuse therein:
Section 10..Multiple Dwelling Residences. Multiple dwelling residences shalizither be equipped with refuse
containers and.refuse. pickup.service:as provided in this.paragraph 10 orbe.equipped with a commercialincinerator
complying with the requirerents of the'Minnesota Pa. ll.ution Control Agency. Refuse containers provided as an
alternative. to. or in addition to. such incineration sliall be. at least .one (l) cubic yard in.capacity, shall be conveniently
located in relationship to the residence units for which they are provided, shall be water -tight and rodent -proof with
self closing lids and shall be kept in.an enclosing structure concealing: them from public view. Such structure shall
have:9 raised concrete floor and shall be surrounded by a concrete barrier curb..Such structure:shaII be kept in a state
of good repair at all times. The. refuse containers shaII be. located so that. their contents are. inaccessibIc.to at least
three {3}..feet.:above the. base of the enelosingstrueture. The owner or operator of such multiple dwelling residence
shall provide for: garbage pickup from :such containers each day. Refuse, debris, garbage. arid other waste materials
slialI not be permitted to be acerimuIated in:or near the enclosing structures (except in. the containers). There shall be
daily cleanup in and around each such enclosing structure..

Section I L Commercial Establishments: The owner or occupant of any commercial establishment or any other
property which provides.a vol time of garbage.or refuse or..both:, which requires garbageandrefuse pickup more
frequently than once a week, shall also comply with the provisions of the. foregoing Section 16.
Section I2. Disposition by Burning; Air Pollution Control Regulations. No.person shall dispose of garbage or
refuse by burning except in accordance with applicable state law and regulations, including the conditions of any
open burning permit obtained for such. purpose. Theregulations of the Minnesota Politttion Control Agency, whicli
have been adopted Aad. incorporated by reference by City Ordinance No. 44 require that a permit.be secured for open
burning.
Section 13. Vehicles for Hauling Garbage'and Refuse. All.persons hauling or conveying garbage or refuse over
the streets in. the city. shAII use a vehicle provided. with a tight cover and so operatedand maintained as to prevent.
offensive adors.escaping therefrom and garb age.or refuse from being blown, dropped or spilled froth the vehicle.:

been used since the last disinfection thereof.
Section. 14. flours for Hauling Garbage and Refuse. No person engaged in hau li ng refuse or garbagefar hire
within the city shall do so after eight:'thirty o'clock p:in. or before six thirty o'clock A. rn. on any day. There shall be
no garbage or refuse pickup from residential dwelling.units on Sunday.
Section 15, .Insp&tion. Each vehicle. engaged in.hauling garbage or refuse in the city shall be subject.to inspection
by the city at all reaso.nable.times. Any such vehicle, while it is used in.the city, shall have the narne'of the: owner
clearly printed.ou both.sides.
Section 16.Obligation of Commercial Collectors. A commercial garbage and refuse collector shall pick up any
garbage and refuse of his customers whicli .has.been deposited for collection; in the manner provided by this
ordinance.
Section 17. Disposal of Garbage and Refuse; Solid Waste Disposal Regulations. No. person. shall. dispose of
garbage or reFuse. upon any property in the city except at.a sanitary landfill site;:resource recovery facility or other,
mixed solid waste. d.isposal facility, approved in accordance. with applicable law, including Mipriesota Statutes
Sections.473.801 to 473.834, and the.rules.and regulations of the Minnesota Pollution Control Agency. Pursuant to.
Mfnnesota Statutes Section 411.62, the Solid Waste Disposal Regulations, of the Minnesota Pollution .Control
Agency are hereby adopted by. reference.
Section 18. Storage of Garbage and Refuse Containers. Garbage cans and other garbage and refuse. containers
shall be so located as to be. out of the public viaw, insofar as possible,. except. oq: the day of pick up.
Section.] 9.. Penalties. Any person violating any ofthe provisions.ofthis ordinance shall be guilty.of a misdemeanor
and; upon: conviction thereof shall be.fined in an amount not.to exceed:$700 for.each violation or both.
Section 20. Enactment. ThIs Ordinance No..45 was enacted and placed in full force and effect on 1.5 August 1983
by a unanimous vote of the Gem Lake City Council.
