Commission Chair Cummings informed those in attendance that the Commission would begin with the Home Occupations public hearing, and that the public would have.a.chance to provide input.:on the topic. Messing CUP Staff Report March 8, 2022 Gem. Lake Planning. Commission Page 2 PROPERTY INFORMATION Description: 398.4 Scheuneman Rd is located. north of Highway 61, on the east side of the city. The lot.is rectangular in shape, and is 1.3 acres in size, per County records. iThe.house:on the site has an attached garage at .approximately 420 SF, as well as a 308 SF detachedshed/garage: located further back on the property.. The .site :is fairly flat, with the lotgradually sloping west towards the street. The east side of the property its bounded by the railroad tracks, and the city's border with White Bear Lake, Land. Use; Single -Family Residential PROJECT INFORMATION The applicant is, proposing to build.a structure that would be 2,176. SF in .size. The structure would. be two stories in size, with a maximum height of 25 feat. THe applicants are. proposing to use .the structure for storage, woodworking, as well as a potential home office in the upstairs space. The applicants would like to connect: the building to. utilities, which would include extending gas, water, -and electric to the building. The applicant has included designs of the structure; showin.g.a dark gray roof and siding; with doors -and columns having a wood finish: The: structure would have a lean-to along on the south side, providing a covered parch area of 6K SF..The. footprint of the garage,. plus. the covered porch, would total 2,856 SF.. The applicant is not planning on extending a driveway to the. proposed garage at this time. Consolidated Land Use Ordinance Requirements The Consolidated Land Use ordinance:outlines zoning requirements for new accessory structures in the. city.. Section 16,5.5 notes that "no combinations of accessory buildings shall be allowed to exceed one - thousand (1,000} square. feet in size,.except by Conditional or Interim Use Permit from the City Council''. Messing CLIP Staff Report Gem Lake Planning Commission Page March 8, 2022 The proposed.. structure size being over 1,000.3F Triggers the need fora CUP from the city. The site as a whole currently has an attached garage, and a detached shed, together totaling 728 SF. The. proposed new detached accessory structure would have a. footprint of 2,176 SF, as well as. a 680 SF covered porch on the.: south side. Other zoning requirements would be required to be met. The proposed structure would have ample space to meet the applicable setback requirements required. The applicant proposes to be 1.5 feet from the north side property line, and nearly 100 feet from the rearleast property line. The structure would be over 70 feet from the south side property line, and over 300 feet from the front property line. The maximum height permitted for an accessory structure is.25 feet; the proposed structure would be. at the maximum permitted. The RO zoning district requires a minimum of 40% of the. lot to be open space, which would equate to 60% of the lot occupied by impervious surfaces. The property, being 1.3 acres in size, would have approximately 10%: of the lot occupied by impervious surfaces (huildings, driveways,. etc.) if this request is approved. The extension of utilities would have to follow .city requirements, and the construction would have to follow applicable building code requirements as well. In discussions with city staff, there have been a few recent requests for :exceeding the 1,000 SF threshold. for accessory structures. The recent CUP request for 3825 Sche.uneman Road permitted a 1,440 SF detached accessory structure:on the property. There was also a CUP issued in 2021 for a detached accessory structure on 5 Hillary Lane, which brought the. total number of accessorystructures on the site to more than two and the total size of the. accessory structures to a total of 1,284 SF. A CUP was issued for 1430 Goose Lake. Road in 2018, .to add a second garage on that property. The .second .garage was only 576 SF in size, though combined with the other accessory structures on the site the total square footage was above. 1,000 SF for the site: The property directly to the north of our applicant, 400.0 Scheuneman Road, has a detached accessory structure of approximately 1,500 .SF in size. Other properties near our applicant's lot (401:0, 4015, 4020 Scheuneman) also have large detached accessory structures currently on their sites. Conditional Use Permit Criteria When reviewing a .CUP request, impact on.the following.criteria shall -be reviewed by the..city, as noted in Section 17.5.2(A); 1). Adjacent Uses 2) Air and Water Quality 3) Traffic Generations 4) Public Safety and Health 5) Area Aesthetics. 6] Economic Impact on the Entire Area 7] Consistency with the Comprehensive Municipal Plan 8) Anticipated Duration of the Conditional or Interim Use Section 17.5.9(B) of the further notes that the following: standards. apply to new CLIPS. 1.) Planning Commission Page 4 4) The: user agrees to any conditions of approval associated. with the approval of. the Conditional or Interim Use Permit by.the City Council, Section 17.5.9tCj finally notes that. new and. existing C U..Ps should adhere to the following: 1 ] .shall maintain harmony and. compatibility with surrounding usesand with the. architectural character and design standards of existing uses and development; 2) Shall meet or exceed all Performance Standards contain elsewhere in this Ordinance; 3] Shall not generate such additional traffic associated with the.use that would overburden or exceed the capabilities of streets and other public services and. facilities including, but not limited to, parks, schools, and utilities serving the area. If the criteria are not met, or thereis findings to 'show that they would not be met; the Planning Commission could add .condi'tions.of approvalonto the CUP to ensure the criteria are met,. or could site the lack.. of criteria.being. met as findings to deny the request. EVALUATION OF REQUEST Below is the Planner's findings in regards to the. criteria for this Conditional Use -request, with the criteria in italics. The. Planning Commission should. discuss whether the findings are met for approval, or if there are criteriathat are not met. f 7.5.2{A} 1 j Adjacent Uses The proposed uze. would be for an accessory. structu re, which is a permitted use. in this zoning district. The proposed building size.should not impact the use of neighboring properties. A condition could be to locate the structure further from the north property line; if there are concerns with placing the structure only 15 feet away;.as well as to require a grading plan be reviewed by the.city during the building permit process. 2] Air and Water Quality The building of an accessory structure should not impact air or water quality. 3) Traffic Generations: A detached accessory structure would not generate new traffic in... the area. 4) Public Safety and Health The proposed project should not have impactson the. safety or health of the public, .provided the structure is built to code and adheres to conditions placed on this CUP. 5) Area Aesthetics The size, while larger than that of typical accessory structures in the. neighborhood,. may not be verynoticeable from the road due to the placement of the. structure.deep in the lot. The structure. would stand out -compared to structures on neighboring properties to the north and south, .though. the neighboring lotto the. north also has a large detached structure in their rear yard. This proposed structure would provide additional storage on the property, which could reduce the need to. store items outdoors on the property, and could lead to removing the. existing 308 SF shed off the property. The city could. add conditions limiting the size, .add screening, or shifting the. location, if there is concerns with impacts to the aesthetics of the area.. Residential accessory structures do not tend to have an economic impact on an area. 7) .Consistency with the Comprehensive Municipal Plan There is not much mentioned in regards to :accessorystructures or detached garages in the Comprehensive Plan. Provided that zoning.requlmments and other municipal ordinances are met, the proposed project would be consistent with the Comprehensive Plan. 8) Anticipated Duration of the Conditional or Interim Use As a conditional use, the:proposed structure. would be intended to be used for a considerable amount of time.. 17.5.9(8) 1) Compliance. with all zoning and other regulations as. may otherwise. be applicable;. The. proposed request is compliant with setbackand heightrequirements, and would be:required to comply with all. other applicable local, State, .or Federal regulations. Any connections. of the structure to. utilities would. have to follow applicable requirements, The proposed. structure could not be used for commercial activity or as a separate -dwelling unit. 2) The. date or the event that will terminate the .use can be identified with certainty, As a conditional use, this requirement is NIA. 3) The existence. of the Conditional or Interim Use will not impose additional costs on the public if if becomes necessary for the public to take the property in the future; In the event of the public taking the property in the future, the presence ofthe proposed detached garage should not impose :additional costs onto the public, 4) The user agrees to any conditions of approval associated with the approval of the Conditional or Interim Use Permit by.the City Council.
