Riedesel felt that Gem Lakes ordinance was good but could possibly have some slight changes made. After discussion Cummings asked Riedesel to write suggested new Ianguage tightening: up the ordinance to include more specific guidelines on traffic, visitors and hours of operation, A summary .of this will .tie presented to the council on April`24th for further action. HIGH FENCE REQUESTS: CONDITIONAL USE PERMIT FOR AN 8' HIGH FENCE 1 FENCE SETBACK VARIANCE APPLICANT: ❑AN MEYSEMBOURG LOCATION: 4144 ;SCH EUN EMAN ROAD ZONING: IRS — MEDIUM DENSITY RESIDENTIAL PUBLIC. HEARING: REQUIRED Mr. Meysembourg is requesting City approval of a Conditional Use Permit which would allow him to construct an 8' high wire fence to help keep deer and other wildlife out of his gardens. Mr, Meysembourg is raising organic corps for distribution to.several customers. The Meysembourg property is located at the corner of Scheuneman Road, the rail line and Hoffman Road. The property is zoned .RS requiring a minimum lot size of ,75 acre, for a non-sewered property. The Meysembourg property is .44 acres in size, Section 16.1.3 of the Consolidated Land Use Ordinance regulates fencing. The following general provisions are from the ordinance: 16.1.11 General Prvvis.ions:. A. No fences shall be placed on or extend into a public or private right=of--way or utility: easement. B, The side of the fence considered the "face" (i.e.. the side having no structural supports). shall face abutting property or the public or private right-of-way. C. Both sides of the fence shall be maintained in a condition of reasonable repair and appearance by its owner and shall not be allowed to become or remain in a condition of disrepair or danger or constitute a nuisance, public or private. D. No physical damage of any kind shall occur to abutting property during fence construction, E. All fences shall be constructed inside the property lines of a lot, If corner property stakes cannot be readily identified, a certificate of survey and setting of corner property stakes is necessary before fence. construction starts. F. All man-made fences shall consist of materials comparable in grade and quality to the following: decorative masonry, wrought iron or wood, provided the surfaces are finished for exterior use, or wood of proven durability such as cedar or redwood is used. Q: Chain link fences shall only .be used for dog confinement areas six (6' foot maximum height), around swimming pools or spas four (4' foot maximurn height) orfor tennis courts (twelve (12' foot maximum height).in rear and side yards only. Chain link fences which need additional height or for other uses or placement shall require a Conditional Use Permit. K Fences, utilized for the protection of gardens, crops and. shrubs from deer and other wildlife which are. setback a minimum of twenty-five (25') feet from any property line, are at least eight (80%) percent open and not greater than six. (6) feet in height and are limited to specified areas requiring protection, shall be exempt from any City review or processing requirements: ** Note - a portion of the garden area which is planned to be fenced abuts the rail line. A variance from this section of the. ordinance is necessary to place the 8' high fence at the property line. It is recommended that all fences be screened with trees or shrubs to buffer views, neighboring property or public right-of-way, or to generally ensure aesthetic quality and compatibility with the natural character of the Community.. 16.13.2 Specific Fence Standards. Fences may be allowed in the City of Gem Lake subject to the. following standards: A. Split rail fences not exceeding forty-eight (4.8") inches in height are permitted anywhere within the property lines of a lot located within the City. Location of the fence in relation to the property line as described in 16.13.1 E) must be followed. B. Except as may he provided herein, fences up to six. (6) feet in height and no more than eighty (80%) percent solid matter shall be permitted. along the boundaries of the side and :rear yard of a lot on a permanent basis, Location of the fence in relation to the property line as described in 16,111 E} must be followed. C. Fences not exceeding six. (6) feet in height, in. areas otherthan for residential areas of the City, may be permitted .in front of the front building lines as established by the primary structure on the lot, where required for screening of adjacent property. D. On corner lots, no fence greater than thirty (30") inches high shall be located in the sight visibility triangle on the corner.of the lot. defined as within twenty (20') feet of the corner formed .by any two streets or within fifteen (15') feet of any street right- of-way, E. All swimming pools must. be completely enclosed with a safety fence at least four (4') feet in height which shall completely enclose the pool. This fence shall. be as 2 described in Section 1.6.14.3. A temporary fence as described in 16.14.3.C) shall be installed and shall. be in -place before the pool is filled. F, All outdoor spas shall have either a fence or a latchable cover, as described in 16.14.3D). G., Freestanding stone, brick, stucco, concrete, wood or other walls, not required as retaining structures, are considered .fences under this section of this Ordinance. H. There are no height restrictions on natural hedges or plantings utilized as fences in any residentialzoning district except no plantings greater than. thirty (30") inches height shall be located in the sign visibility triangle on the carrier of the lot defined as within. twenty (20'.) feet of the lot corner formed by any two streets or within fifteen (15') feet of any street right-of-way.. Temporary snow fences can be erected for temporary site protection or for diverting snow. Snow fences shall not be used as permanent fencing. Snow. fences. shall not: be located in the sight visibility triangle ❑n the corner of the lot defined as within twenty (20) feet of the lot corner formed by any two streets or within fifteen (15') feet of any street right -of way. 16.13.1 Fence standards allowed by .Conditional Use Permits: The following fences may be approved by Conditional Use Permit only, in accordance with the standards as set forth by the City Council: A. Fences allowed by Conditional Use Permit are as follows: 1.) All chain fink fences with a height greater than described in Section 15:13.1.G). 2) Fences, such as sales Iot securityfences, which include a security gate at .a point where access is provided to the property and/or principal building. 3) Fences greater than six (6') feet in height around a garden, crops,. and shrubs utilized for the protection of such from deer and other wildlife. 4) Barbed wire and electrically charged fences (All such fences must be marked with caution signs on all exposures), 16.13.4 Nan -Conforming Fences: It is the intent of this section to allow the continuation of such non -conforming fences as may already exist until they are discontinued as provided herein. However, it. is. riot the intent of this Section to encourage the survival of non -conforming fences and such fences are declared to be incompatible with. permitted conforming fences ..and such fences are declared to be incompatible with permitted fences within. the City. Such fences shall. be regulated by the following provisions: A) An existing fence not permitted by`this Ordinance, except when required to do so bylaw or ordinance, shall not be enlarged, extended, reconstructed. or structurally altered unless such fence is changed. to one permitted. Maintenance of a non -conforming fence. will be allowed, however, when this. includes necessary repairs and incidental alterations which .do not expand or intensify the non -conforming use. Based on the request to construct an 8' High fence, a Conditional Use Permit must be approved per Section 16.13.3A3. Section 16,131 H must also be considered when reviewing a Cond.itiional Use Permit. This section requires a .25' setback from a property line; Portions of Mr. Meysembourg's fencing is planned to be less than 25' from a lot line. Per Section 17,5,2A of the Consolidated Land Use` Ordinance, the impact on the following criteria shall be review and measured by the Plan ling Commission and City Council: 1. Adjacent uses; and 2. Air and water quality; and 3. Traffic generations; and 4. Public health and .safety; and. 5. Area aesthetics; and 6. Economic impact on the entire area; and 7. Consistency with the Camp Plan; and 8. Anticipated duration of the Conditional Use. i The City of. Gem Lake has incorporated a Garden Overlay District into the Zoning Ordinance. This section of the ordinance. recognizes larger acreage lots in the City which per the Comp Plan may develop into smaller lots in the future. The intent of the Garden Overlay District is to allow agricultural uses on large properties until. such time as the property develops. The Planning .Commission and City Council should discuss the use of the. property as requested by the applicant. Commercial crop farming is not listed as a permitted or conditional use in the IRS `Zoning District. Ag related buildings are permitted on properties larger than one acre, The applirants lot is .44 acres in. size.. The following are ordinance requirements License Required. 1.1, Home occupations shall require a Special Home Occupation license if any of the following circumstances would occur more than.30 days each year. a) Employment of a non-resident. in the home occupation.. by Customers or customers' vehicles on the premises. c) Manufacture, assembly or processing of products or materials on the premises, d) More than one vehicle associated with the home occupation which is classified as a light commercial vehicle. e} A vehicle and/or trailer used in the home occupation, and parked on the premises, which exceeds a one tan payload capacity. . fj If the home occupation produces any waste that should be treated or regulated. g) A vehicle used in a. home occupation, and parked on. the premises, with greater than a one ton payload capacity is needed.. Parking of this vehicle shall only be allowed by the issuance of a conditional use parking permit issued by the City of Gem Lake. 1.2 Home occupations, requiring a license, shall be subject but not limited to the fallowing requirements: a) No traffic shall be generated by a home occupation in greater volumes than would normally be expected in a residential neighborhood. The need for off- street parking shall not exceed more than three ofF street parking spaces for the home occupation:at any given time, in addition to the parking. spaces required by the residents, b) No more. than one non-resident employee shall be allowed to work on the premises. Nonresident employees who work off the premises may be allowed to visit the premises. If an on -site: employee is parking on site, off - site employees shall not leave their vehicles on site. If there is no on -site employee vehicle parked on site, one off -site employee vehicle may be parked on site. c) No vehicle. associated with the home occupation, including customers or employees; shall be parked on the street or block sidewalks or public easements. Private vehicles used by the residents shall not be included in this subsection. d) An area equivalent to no more than 20 percent.of each level of the house, including the basement and garage, shall be used in the conduct of a home occupation. e) The home occupation may be. conducted in the principal dwelling and one accessory building or in the garage.. f) There shall be no change visible off the premises. inthe outside.appearance of the building or premises that would indicate the conduct of a home occupation, other than one nameplate sign as permitted. by Section 19.63 of the Gem Lake Zoning Code. g) No more than 20 percent of business income shall come from the sale of products produced off site unless approved by the City Council. h) No equipment or process shall be used in such home occupation which creates noise, vibration, light, .glare, fumes, smoke, dust, odors or electrical interference detectable to the normal senses off the premises. If. electrical interference occurs, no equipment or process shall be used which creates visual or audible interference in any radio or television receivers off the premises or causes fluctuations in line voltage off the. premises, 0. There shall be no fire, safety or health hazards. j) A home occupation shall not include the repair of internal combustion engines, body repair shops, spray painting, machine shops, welding, ammunition manufacturing or sales, the sale or manufacture of firearms or knives or other objectionable uses as determined by the city. Machine shops are defined as places where raw metal is fabricated, using machines that operate on more than 120 volts of current. k) Any noncompliance with this subsection shall constitute grounds for the denial or revocation of the home occupation license. {) The City Council may waive any of these requirements if the home accupalion is located. at least 360 feet from a residential lot line. m) The City Council may add any additional requirements that it deems necessary to. ensure that the operation of the home occupation will be compatible with nearby land uses. The Planning Commission reviewed nearby community home. occupation ordinances. The following list are requirements from other communities which are not incorporated into Ordinance No. 8.5 2 Any home occupation shall be clearly incidental and secondary to the residential use of the premises,. should not change the residential character thereof, and shall be compatible with the surrounding residential uses. • No home occupation shall require internal or external structural alterations or involve construction features not customarily found in dwellings except where required to comply with local and. state fire and policy recommendations. There shall be no exterior storage of equipment or materials used. in the home occupation, except personal vehicles: • No home: occupations shall be conducted between the hours of 9:00 p.m. to 6:30 a,m., Monday through. Friday, after .6:0.0 p.m. on Saturday or at any time on Sunday; or unless said occupation is contained entirely within the principa[ dwelling and will not. require any on -site parking facilities. ■ Sewer and water use and refuse generation shall not exceed normal residential use. • Any construction, alteration, or electrical or mechanical equipment shall not change the fire rating of the structure. ■ The maximum number of business visitors. shall not exceed eight vehicle trips per 60 minute periods or 20 vehicle trips per day. One vehicle trip shall include both arriving and. departing, • Gatherings for the purpose of selling merchandise, taking orders or providing training for sale or marketing shall not be held. more than twice per month and shall cease prior to 9:00 p.m. and shall not have more than ten passenger automobile with not more than six passenger automobiles parked on the street with all on - street parking to occur on one side of the street only. • Transferability. Permits shall not run with the land and shall not be transferable. • Lapse of Special Home Occupation Permit by Nonuse. Whenever within one (1) year after granting a permit the use as permitted by the permit shall not have bean initiated, then such permit shall become null and void unless a petition for extension of time in. which to complete the work has been granted by the City Council. Such extension shall be requested in writing: and filed with the Zoning Administrator at least thirty. (30) days before the expiration. of the original permit.. There shall be no charge for the filing of such petition. The request for extension shall scat® facts showing a good faith attempt to. initiate the. use.. Such. petition shall be presented to the Planning Commission for a recommendation and to the City Council for a decision. • Inspection. The City of White Bear Lake hereby .reserves the right upon issuing any home occupation: permit to inspect the premises in which the occupation is being conducted to insure compliance with the provisions of this Section or any conditions additionally imposed, • No home occupation shall have an adverse effect on adjacent properties due. to excessive traffic or offensive noise, light, odor, dust or other noxious substances. If the home occupation will require a delivery service, such as LIPS., no more than 3 six deliverylpickup trips per week shall be permitted. ❑elivery Vehicles shall not be larger than a typical step van. Conditional Use Permit is required to exceed 6' in height. Section 16.14.1(h) requires fencing not to exceed 6', but must be setback a minimum of 95' from a property line and must be 80% open.
