Planning Commissioner Chairman Don Cummings called the meeting to order at 7:02 p.m. Commission Members Joshua Patrick and Art Pratt were:.present, Commission Members :Derrick Wippich and Stephanie. Minutes A motion was made by Commission Member Patrick, seconded by Comrrmissiorl Member Pratt to approve. the June 1, =I, Planning Commission Minutes. Voice vote taken,.all in favor,:motion passes, minutes are approved. Pubtic.Ifearin�s Commissioner Chairman Cummings informed those in attendance that one public hearingwould be held, and that the.public Would: have a chance to provide input on the subject Commissioner Chairman Cummings pointed out that the topic .had been properly noticed in the White Bear Press. ■ Amendment to the Gem Lake Consolidated Land Use Ordinance No. 131., modify language to clarify agricultural uses in residential districts Cominissioner Chairman Cummings discussed the .proposed changes to 5..1, 5.3, and 73 of the Consolidated Land. Use Ordinance No. 131. In. order to clarify the City's intent regarding truck gardening and other commercial. horticultural uses. The uses would.be made conditional uses in all Residential Zones, The existing Garden Over] ay District can be invoked on lots over 10 acres or conditions can be:. established: for those on.:smaller lots. Commissioner Chairman Cummings introduced a motion to open the. public hearing at 7 05 p.m: on the Consolidated land Use .Ordinance No. 131, seconded by Commission Member.Patrick. Voice vote taken, all in favor; motion passes, the public. hearing is. opened at. 7:p5 p.m. Resident Mr. Paul Emeott stated that. he thinks the Commission should iook at the districts regarding the. required arnount:of open space.that. should be available per zone. A small lot such as. Resident Mr. Meysembourg's, is a.small lot with a driveway, house, garage and 40% is supposed to be considered open space, and that fences depending on wherethey are Iodated could take up that space. Commission Member Pratt inquired if his. concern was overt lie definition of open space and Mr. E.me.ott answered yes. City Attorney Patrick Kelly stated#hat cities have been having problems with the definition of open space. andhave been changing it to green space for this reason. Commission Member Pratt stated his opinion on What hedefined open space as and that it was public space that everyone can use. Mr. Kelly agreed with that definition. "8.3.1 D) Truck gardening And ofh r;co nmercral:harircultural uses andlorthe harboring and housing of agricultural animals on fats greater than one (1.0) acre." 5 Hillary Farm Outbuilding CUP Request ■ As per my conversation with Tom Riedesel - this outbuilding building permit request requires. a CUP due to the fact it will technically register as a. second .outbuilding. It also creates a combination of outbuildings exceeding 1000 sq. ft. on my property. • When my wife and l bought our house. in 2007 it only sat on Lot #1 of Hillary Farm. This Lot had an. existing outbuilding (1955 Vintage screen/ pool house). We decided to restore and maintairn the pool house as we feel it is an architecturally significant part of the original Hillary Farm estate. This. would register as our first outbuilding and has a foundation .size. of approximately 12' x 35. • in .2.012 we purchased the adjacent vacant Lot 910 from the Hillary Farm developer. We then combined. this Lot with. Lot #1 so that our .hous.e parcel now encompasses 9.5 acres between the two lots. • The new outbuilding will sit on Lot #10. But because we have combined Lot #1 and Lot #1❑ we run into the, second outbuilding provision 110g0 sq. ft. max restriction due to the existing pool house. It should be noted Lot #10 was intended to have, a single family home and garage built on it. By comparison our outbuilding building, if.permitted, will only have a footprint:of 24' x .36' with. a. conforming 15' ridge height on this 3+ acre lot. • The proposed outbuilding has been designed to match the appearance of the main house and pool house appearance (painted cedar shake exterior walls, white trim, grey architectural shingles). The design also conforms to the HOA requirements, and has received HOA preliminary approval contingent on City Approval.. • The purpose ❑f the outbuilding will be for storage of property maintenance equipment (tractor and implements). As well as provide storage for gardening equipment for an adjacent vegetable garden. • The current primary garage is considered an attached structure as it has a full connecting foundation and roof. It does not qualify as a detached stricture by city ordinances. • Due to terrain changes and trees the pool hause.will.not be Visible from the outbuilding (and vice versa). As such, this second outbuilding should not create a visual impact of building density in our opinion..
