Committee Reports — Planning Commission Acting Planning Commission Chairman Cummings gave an overview Of the Planning Commission Meeting on May 4, 2021. The Commission is currently still reviewing the Home Occupation Ordinance and fine tuning h and will have 'it ready for recommendation. at the next meeting: Commission Chairman Cummings stated that there will be three (3). public hearings -at the next Planning CommispWri Meeting that they Will be-hearing.regarding urban gardening, fence height, setbacks and zoning. Commission Chairman Cummings -also. stated that they will be. returning to live meetings starting with their -next meeting on June 1, 202.L Old Business Mayor Artig=Swomley presented ideas for the next. Newsletter to include pieces on the White Bear Lake Emergency Food Shelf, Hoffinan. Road Construction, City Clerk becoming a Notary, results. of the June. Artig-Swomley asked the councilmembers for ideas and Councilmember Lindner presented ideas. abbitt-MS4 storm water and Counciilmembex.Jobnson presented an idea about a piece on decriminalizing mental health issues andseMces, based on a program sponsored by the City of Maplewood. New Business Elimination of Mask Mandate = pei•-Gorernors Order as of May 14, 2021 Mayor Artig-Swomley asked for a motion to rescind the mask mandate put in to effect by. the City df Gem Lake.iri July2020. CounciimemberLindnei-motioned to resoind the mask. mandate, seconded by Councilmember Cacioppo. Voice vote taken, all voted yes; motion.passes, the mask mandate is now rescinded for the. -Pity of Gem Lake, This action -would put the. city ir4 sync with the Governor's order of 'Ray -14, 2071. White Bear Lake Emergency Food ShW—Presenfatioa—Perry Petersen Mr. Petersen shared information about the food shelf with the City Council and members .in:attendance. Mr. Petersen.presented everyone with:a-.hattdout and. spoke about how the pandemic:aff'ected the. community and what the Food Shelf was able:to do to help. Numbers rose from about.30 visits a day to 120 visits a day, but the numbers are beginning to stabilize. Mayor Artig-Swomley asked if donations froin. residential gardens. were'acceptable and Mr..Peterseri said they were. Cotincilmomber Cacioppo asked what qualified the food as:rescued; Mr. Petersen responded that any item that is.overmcked or close::to expiration is what qualifies. It was suggested that the City Clerk hold off on sending all bills: out until we receive the bill from Vadnais Heights. The. City Clork will also ensure readito are taken.from the main meter first; then the houses and then irrigation. Counci lmembec Lindner has been appointed•to be the. one'to continue to help "build bridges" with.Vadnais Heights. Approval of Resolution 2021-005 — Acceptance of Z021 Sewer. and Water. Roffman -Road Update — Justin Geae, City Engineer Mr. Gese reported.that•SEH has -received- the signed contracts back and as of right now there is no scheduled start date for the project. Ohdb they start they will have 30 days to complete the project. We have gotten a proposal for where .the trees should go on the South side; still waiting on the North sidb.. The City of Gem. Lake has roughly 72 trees for the South side and roughly 72 trees' for the North side. Plans are to plant in June.. City Clerk has been 'creating a folder of all historical pictures and: documents that come in to the office. for future use: City clerk has serit iri tha paperwork to join the Municipal *Clerks and Finance Officers Association of -Minnesota (MCFOA)-and will go to the first class: in 2022 because thedeadline for this year was missed. City Clerk is in the process of updating the website where peeeded.and is working on adding.more,ordinances to4he website and streamlining them so they are all searchable documents. CUP / IUP Fee Modification Mayor Artig-Swomley made mention that although we did approve removing the escrow from the CUP, IUP and Variance applications, it was not inentioned that for.the CUP and. [UP applications that the escrow fee will. now be. combined with the application fec. The total to apply for a CUP of [UP will now cost $275,00 to -cover tha review time. Commission Members Stephanie Farrell, Joshua Patrick, Art Pratt and Derek Wippich:were**sent.Also present: Planning and Zoning Toro Riedesel, City Attorney Patrick Kelly, Mayor Gretchen Artig- Swomley, and residents Daniel Meysembourg, Ben Johnson, Jim Lindner, lssaoNelson, Harry Groves, Hazel White, Cindy Scruggs, -Bob Scruggs, Carol Schacht. ARRroval of Minutes Pratt Introduced a motion to approve the minutes of the May 4 PlanningCbm fiission Meeting. Wippich seconded themoti.on. All in favor, motion approved. Cummings informed those in attendance that three public hearings would be held. in succession, and that the gublic would have a`chance to provide input on all three subjects. He stressed that there was only one application on the table that required.action-that being the matter of.*a Conditional Use Pertnit for an S' fence: on the applicartt's.property,.The other. two matters would be discussed; due to the intertwined nature of the: issues at hand; Cummings pointed -out -that each of the three topics had °been-piroperly noticed in the White Sear Press and that neighbors within350 feet of the property in giiestioti had been sent a. letter about tht public hearings. ■ Amendment to the Gem Lake Consolidated. Land Use Ordinance Number 131 RS Zone District Tom Riedesel reviewed -a -report on the request by Dan Meysembourg to begin an organic truck farm on his property at 4144 Scheuneman Road. After a careful look at the various applicable cirdinances for this type of use, he.determined that the use was permitted,. although the lot Was only .44 acres in size. Wippich introduced a, motion. to open the public hearing:on the-CoiisoliddW-Land Use Ordinance 131. Pratt seconded -the. motion. All in favor, motion approved. Cummings stressed -that no application..for variance; amendment or CUP regarding this.ordinance had. been received: Due to the interconnected nature of the farming request, he felt it was.& good idea to discuss the possible need for future.amendments as it regards truck farin'sng. Sinee it,was determined that this use was: permitted is this. zone, the commission felt no particular action was needed at this time. Wippich suggested that the.coRtmission look at the possible need to place language in the ordinance section pertaining:to:maximum percentage of a property that could be under cultivation for purposes of truck firm. -Another suggestion was that -truck farming be specifically limited to certain zones in the city eirto*property*of a certain defined size, such as a minimum of one acre, Wippich motion.to close the public hearing on this matter. Conditional Use Permit at 4144 Scheuneman Road to Permit an 8 foot Fence for Urban Gardening City of -Gem Lake City Coonpil Megtidg Minutes June 1, 2021. 111, a K Tom Rieiiesel reviewed the application, which pertained io a request.fh� an 8-foot fence around large garden areas. He -pointed out several issues as:follows: The standard fence ordinance in C•em. Lake limits fence.height to 6 feet, rather than 8; The homeowner wishes to _plant produce gardens up to -the fence line, rather than the:257foot set back required by. the agricultural. ordinance and for fenced in.garden .areas. 8 foot fences are allowed by Conditional Use Permits for :truck farming purposes, as long as. all other conditions of the ordinance are. met. Wippich introduced a motion to open the public hearing on the matter Of a CVP for an 849orfence on the. applicant's property for purposes.of.protecting crops from deer and other. animals. Pratt seconded the motion. All in favor; motion approved. The Commission discussed the proposed .ptdjeet at length, including a short presentation from. homeowner Mej+sembottrg. Several neighbors spoke up in support of Meysembourg's. organic farm:.conce . they included Bob and Cindy. Scruggs. They statid.t>,at the.appli .ant had discussed his plans with them in detail and they were comfortable. with. the 8 feet fence. The applicant.stated that the fence was largely see -through. Pratt pointedout that:the:ordinance had language pertaining to a requirement for fencing that was 8.0%.open. Lihdner.asked the applicantto clarify exactly where the fencing would-be placed. Meysembourg provided a document showing the fencing plan and answered several questions. Schaehtasked the Commission to define the term "truck.fanning," According to: Webster's Dictionary, the term was determined to mean -an .operation that grew vegetables for sale. W ippich motioned. to close the.:public hearing. Farrell seconded the -motion. All in favor, motion approved. -.Pratt introduced a motion that the Planting Cornihission recommend to the Gem Lake City Council approyal of an application fora CUP for air 8 frming purposes onthe property owned by.Dan Meysembourg, as long as the fencing.was. 8OVo-open and that all other conditions of the ordinance were met. Therefore, today's discussion would*be-aimed atg&thering feedback -and ideas. Farrell introduced a rnotionto open the public hearing. Patrick seconded the. motion. All in favor, motion carried. There was a lengthy discussion on the matter of setbacks for garden ;fences. The current code requires for a 25 foot set back from property lines for an 8 foot garden fence. Due to the small -size -of the property Meysembourg.felt this would place a significant hardship on his organic garden cohcept'by dtastically reducing the area of.potential cultivation. Pratt said he was not in favor of doing a city-wide change in the entire ordinancerid cilMinate-the setback requirement, suggesting instead that. a more strategic look at various zone districts t il& be.a better approach. Another idea was to treat this as a potential varianc¢*based:on the uniqueness of the property. Wippich seconded the motion. All in favor, motion carried. Pratt asked for precedents on how variances have to pass the test. for being unique. to property circumstances. Kelly said more information would be forthcoming. SECTION 4. LICENSING; EXEMPTIONS. 4.1 County license required No person shall. conduct.business as a transient merchant within .the city limits without first having obtained a Transient Merchant License from Ramsey County. 42 City license regttired. The suspension or revocation of any license issued far the purpose of authorizing multiple persons to conduct business as peddlers or transient muchants on behalf of the licensee shall serve as a suspension or revocation of each authorized person'.s authority to: conduct business as a.peddler or transient merchant on beha.lf.of the licensee whose .license is suspended ortevoked. 6.3 Nonce. Prior to revoking or suspending any license issued under this chapter, the city shall provide:a license holder with written notice of the alleged violations and inform the licensee of his or her right to a hearing on the alleged violation. Notice shall be delivered in person or by mail to the`permarient residential address listed on the license application, of if no residential address is listed, .to the business address provided onthe license application. 6.4 Pablle..11earirtg. Upon receiving.the notice provided in section 6.3, the licensee shall have the right to requesra public hearing. if no request for. a..hearing is received by the. city clerk within ten (1.0) days following the service of the notice, the city may:proceed with the suspension or revocation. For -the purpose of a, mailed notice,. service shall be considered complete as of the date the notice is placed in the mail. if a. public hearing is requested within the stated time fraiite, a hearing shall be scheduled within twenty (20) days from the +;fate of the request for the public hearing. SECTION 7. LICENSE TRANSFERABILITY. No license issued under thi§ eiiapter shall.be transferred to any person other than the person to whom the license was issued. SECTION 8. REGISTRATION.. 8.1 All solicitors shall be..required to register.with the city prior to engaging in those activities. Registration shall be made on the same form required for a license application, but no fee shall be required. Except as may otherwise be specifically permitted in the Gem Lake Municipal Code, it is Unlawful and a public nuisance for any person to camp, establish, maintain, operate or occupy camping facilities,. or use camp paraphernalia in the following areas: (a).Any public property, improved or unimproved, including but not limited to public streets and sidewalks, open space, and other.pubIic property. (b) The prohibition.set forth in this section does not apply to: (1). Camping on private residential property, witWthe consent of the property owner or a person in lawful possession afthe property; provided the camping does not pose a threat to. the public's health, safety, welfare, or otherwise create a public or private nuisance; (2) Mobile home parks and special occupancy parks; and (3) Day use for lawful activities vn publics'property where authorized.
