PUBLIC HEARING; REQUIRED CarFit is requesting approval of a Conditional Use Permit. which would allow parking of cars: in a new parking lot across from their lot on the west side of the .Hoffman Road. With the redevelopment of the Waldoch site, CarFit has lost several parking stalls used to display cars for sale, They are looking to construct a parking lot on the east side of Hoffman Road on the Birkeland property, which would be a staging area for vehicles to be sold. A 22' stall parking lot is proposed tobe constructed. between the homes at 3524 and 354.2 Hoffima.n Road. Mr. Birkeland awns the two homes and the vacant property where the parking lot is proposed. The area of the parking lot is approxirnately 10,000 square feet. Automotive dealerships are rib longer identified as being permitted or permitted by Conditional Use Permit.in the Gateway Zoning District. Outdoor Display & Sales is listed as a Conditional Use. in the Zone, however. In 2013, the City reviewed a request for an auto dealership in the Gateway Zone: A. Conditional Use Permit to permit Outdoor Display & Sales for a. dealership was reviewed and recommended for approval by the Planning Commission at that time. The City. Council denied the Conditional Use Permit, however. As a result of that denial, a u to. d ea lets hips are not considered outdoor display & sales, as they are."not permitted as a primary use" taper Figure 17 Building Use Matrix:.Cornmerciai-. Use Buildings & Lots of the Consolidated Land Use .O.rdinance). In order to permit this proposed use, it appears that the Consolidated Land Use Ordinance rnust be amended, by adding autoltruck Sales. to the list of uses conditionally permitted in the zone, Currently Gem -Lake has AutoNa.tion*$ Barnett auto dealerships in the.City. These are currently considered non -conforming uses. A new dealership is interested in locating in Gem Lake. and AutoNation is considering a facelift to their building. An alternative to amending the Consolidated Land: Use Ordinance would be to approve an Interim use Permit. The Interim Use. Permit section of the ordinance was adopted to accommodate existing use which - are no longer permitted within the City. Interim Use Permits are regulated by Sections 14A2 and 17.5 of the Consolidated Lane Use Ordinance. An Interim Use Permit expires March 15 of each year and must be renewed annually. Conditions for approval -of sh Interim Use Permit may be required by the City Council: When reviewing an Interim Use Permit (or CUP), the following criteria must be reviewed and-measurad by the Planning Commission and City Council: 1) Adjacent Uses; and 2) Air and Water Quality; and 3) Traffic Generations: and -4) Public Safety and Health; and 5) Area Aesthetics; and 6) Economic Impact on the Entire Area; and 7) Consistency with the Comprehensive Municipal Plan: and 8) Anticipated Duration of the Conditional or Interim Use. Staff recommends the Planning Commission and City Council consider two approval/denial options when reviewing this proposal. 1) Consider approval of an Interim Use Permit for the proposed parking lot: Consider approval of. -an amendment to the Consolidated Land Use Ordinance, adding automotive dealerships to the list of uses permitted or conditionally permitted in the Gateway Zone. Since the lot would have Jess than 1.00 stalls; one landscaping island -would be required in the lot: At least one tree would be required, per Section 26.3:2, A 20 foot. landscaped yard is required..between a parking -lot and the right=of=way (ROW); this is also required for as part of the Gateway -- NC zoning district. The current plans:. do not confirm the. setback from the ROW. ILIP Criteria Interim Use Permits are. covered in section 17:5 of the ordinance.. The section includes information .to review, as well as .criteria to consider when approving or denying. a: request. Section 17.5.2(A) notes that 'Impact on the following criteria shall be reviewed and measured by.the Planning Commission and City Council: 1) Adjacent Uses 2) Air and Water Quality 3) Traffic. Generations 4) Public Safety and Health. 5) Area Aesthetics 6) Economic Impact on the Entire Area 7) .consistency with the Comprehensive Municipal Plan, and 8) Antic.ip.ated Duration of the Conditional or.Interim Use." Section 17.5.9 lists the standards that would apply to .conditional and interim uses: A) Existing Uses. Shall be in accordance with zoning and building standards in effect at. the time of initial construction and development:and shall continue to be governed.b.y such regulations in the future. B) New Uses, Small conform as follows: 1.) .Compliance with all: zoning and other regulations as may otherwise be applicable; 2) The date or the event that will terminate the use can be identified with certainty; 3) The existence of the Conditional or Interim Use will not impose additional costs on the public if It becomes necessary for the public to take the property in the future; 4) The user agrees to any conditions of approval.as.sociated with. the. approval of the Conditional or Interim. Use Permit by the City Council. C) .Existing and New Uses. Shall conform as. follows: 1.) Shalt maintain harmony and compatibility with surrounding uses and with the architectural character and design.stand ards of existing uses and development; 2) Shall meet or exceed all Performance Standards contain elsewhere in.this Ordinance; 3) Shall not generate such additional traffic associated with the use that would overburden or exceed the capabilities of streets and other.public services.and.facilities including, but not .limited to, parks, schools, and utilities.serving the area. Findings Below is the criteria from Section 17.5.2(A) in italics, with the Planner's findings following.: 1) Adjacent Uses The uses directly to the. north and south are residential homes. Screening would be able to reduce issues with views and noise between the proposed parking and the house .to.the. south, though the house to the north. would have its parking connected, to the parking lot based on. the proposed plans, Other properties 7 James. CUP Staff Report November 2, 2021 G.ern Lake 'Planning .Comm ission Page.A nearby have off-street parking, and the zoning designation of neighboring lots could result in the residences next. door eventually being redeveloped. 2) Air and Water Quality The lot. would be for display purposes, so air quality. should not b.e impacted. Water quality could be impacted if drainage is not. properly addressed in the design of the lot. 3) Traffic Generations The lot would. be for display, so trafi'ic generation would be minimal: 4) Public: Safety and Health There could be:pofential.safe#y issues with the proposed parking lot :being connected to the current parking of the house to the. north.. 5) Area Aesthetics Other lots nearby have off-street parking, so the addition of. more parking may not standout. Given the intent of the Gateway zone, the: City will want to. ensure the.51te use and design reflects the purpose and intent of the zoning district.. B) Economic Impact on the Entire Area A parking. lot may result in additional property taxes and business than the current use of the lot being. vacant. 7) Consistency with the Comprehensive Municipal Plan, and The area is guided for mixed use development -in the future. The site, along with neighboring lots, could be redeveloped into mixed -use development in the future. As an interim .use, the proposed parking lot could give way to new development when market conditions change. 8) Anticipated Duration of the Conditional or Interim .Use Interim uses can be issued for up to .five years; if approving .the city would need to determine if an lUP would be:approved for five years or less. Upon expiration of the. permit, the use would cease., or the. applicant would have to. obtain another [UP. Below is the standards in Section 17.x.x.in italics, with the Planner's findings following. 8) New.Uses. Shall conform as follows; I) Compliance with all zoning and other regulations asmay otherwise he applicable, - The plans' would need to be. revised or added onto in order to confirm if all requirements are met. .2) The date orthe event.thatwill terminate the use can be.iclentified with certainly, - The city should determine a. date of: termination if the request is approved.. The applicant did not Indicate a termination date in the application or plans. 3) The existence of the Conditional or Interim. Use will not impose. additional costs on the public if it becomes necessary for the public to take the property in the future; Maintenance and. or redevelopment of the lot if acquired by`the city would result in costs; though it would be hard to quantify whiat those amounts could be at this. time. 4) The user agrees to any conditions of approval associated with the approval of the Conditional or Interim Use Permit by the City Council. James CUP Staff Report November 2, 2021 Gem Lake Planning Commission Page 5 C) Existing and New Uses. Shall conform as follows. 1) Shall -maintain harmony.and corripetfbility with surrounding uses and with the architectural character and design s4mdaft-of 6iisting .uses and development; Given the intent of the*Gateway Zone, conditiQns could be added to ensyye-a.site design meeting the intent Qf thezorling district is achieved.. 2) Shall meet oir exceed all Performance Standards contain elsewhere in this Ordinance, The plans as-subrnitteddo hot confirm if all *uireMents are met. Shall nbtgeneratisoc.h additional traf c associated with the use that would overburden or -exceed the capao l4es of streets and.other public services and facilities including, but not limited to, parks, schools, and .ufilidas serving the area. The use.of'the site would be for display Qf vehicles, so traffic generation would be minimal. ACTION The Planning Commission has the following options: 1. The structure would have a second floor`for additional storage; which would result in a Max height of 28. feet 2 inches for the structure. Accessory stru..ctures. With .a.footprint exceeding 1.,000.square feet would require.a conditional use permit. (CUP) be.issued.by the city. The proposed height, though, would require a variance, as the. maxim urn height permitted for an accessory structure is: "the height .of the principal building... in no case shall an. accessory building exceed 25 feet in height" (.Section 16.5.2). The proposed. structure is also located with required setbacks: Placement of a structure within a setback would require issuance of a variance as well. The site has its front lot line off of Scheuneman Road to the east, which would make the rear yard the west property line: The North and South property lines would have side setbacks, The north property line. abuts what is shown as right-of-way(ROW). though the width of said ROW is under 40 feet so it does not meet: the definition of a street. If it were to meet the definition of a street, the site would be a corner lot..
