WHEREAS,. jn 1:998 the City of Gem lake agreed to re -:zone certain finds. owned by Gem U*e Hills, Iric: upon receipt of a
completed Application For Subdivision of those lands and id consideration of their approval:of City re-xaning all .lands owned
by Gem Lake Hills, Inc. to R-1 3 Acre Residential zoning; and
WHEREAS,.Gem. Lake Hills has made a complete and proper application for the simple subdivision of lands identified as PIN
Q2 3.0-22-34-0 02=?,.consistent with their previous statement. of intent; and
WHEREAS, based upon facts -uncovered during -title searches.of'said lands, lands also owned by the Burlington Northern
Railroad Co. must be included to said rezoning but with no adverse effect»on Land value of the Burlington. Northern lands; and.
WHEREAS,appropriate public notification of the City'Y,.intent was made:by. US mail and publication in the City's legal
publication; and:
WHEREAS, a public hearing was held.and al public, coimment was beard priocto con4doring this resolution..
NOW THEREFORE BE IT RESOLVED, -'that the City Council of the City -of Oetn Lake does hereby order re -zoning of the
.following two.(2) properties lying completely within the corporate boundary ofthe City.from.R l to 94:

BE IT FURTHER RESOLVED, that the City. Clerk is hereby directedto order all. appropriate documents amended with all City
bodies, elected.and appointed, and other appropriate authorities. as well as the owners.
