Meeting Minutes
Mayor Gretchen Artig-Swomley called the meeting to order at 7.00 p.p. Councilmembexs Lon Cacioppo, Laurel
Hynes-Atnlee, Ben Johnson and Jim Lindner were present. Also present: City. Attorney Patrick Kelly, .City Treasurer

A motion was made by Councilmember Lindner; seconded by Councilmember Cacioppo to approve the April 19,
2022 City Council Meeting. Minutes. Voice vote.taken, all in favor, motion passes, minutes -approved.
Committee Reports—•Planning'Coremission
Planning Commission Chairman -]bon Cummings provided:a brief report on theupooming.presentation of the Gem
Lake Comprehensive Plan-and-1heimportant work that would follow final acceptance of the plan by the
Metropolitan Council, which is anticipated to::happ.en. soon. He thanked the council for. the cooperative support and
look forward to the work ahead.
Old Business
Mayor Artig-Swomley: presented ideas for the next-editionof the City Newsletter to include pieces such as
information.on the. Gem Lake Water Plan; the Luther Cadillac Project; the new Public Works arrangement with
White Bear.Township and other potential: stories. Lindner. suggested that he write an article on constructing: a
"pollinator" garden.
Artig-Swomley noted that.Acting City Cleric would be working remotely for the remainder of theweek.
New Business
Special Presentationt. Nate Sparks, Northwest Consulting
Artig-Swomley opened. the. joint City Council and Planning: Commission: Presentation of the.2020 Gem Lake
Comprehensive Plan and introduced Nate. Sparks of Northwest Consulting, who helped write. the document. Sparks
reviewed theplimand its required sections. He explained the.Metropolitan Council's.requirements :forcompletion-
and where the plan stands at this time, in terms of.final approval..Artig-Swornley asked that the Gem Lake.trail in.
the southwestern section of the city be added to the appropriate section of the plan for the final edit. Sparks agreed to
do this. He stated that final approval by the Met Council was expected in -mid id late May. Following this, the City
Council would be required to do an official resolution accepting the plan,
Luther.'CadflIne Project=Developer's Agreement
The Developees:Agreement between Gen Lake and Luther Cadillac was presented and discussed. Linder motioned.
to approve tho agreement as.presented, Cacioppo seconded, all in favor, motion approved.
Haynes-Amlee expressed concerns about:road access and contractors blocking her driveway, which -is -located next
to the construction° site: Peter Beck, attorney for Luther fielded questions on this matter. It was agreed that on May.
I s; three trucks with lowboy trailers will bring equipment to the. site. Another truck will be for erasion control.
materials on the: same day, weather permitting. These vehicles will access the site from existing road. They will them
constriict:the.site access entryway from Highway bl. City. Engineer-Justig-13ese stated. expectations that after May

The Minnesota Department of Transportation QMNDOT) will :approve and issue a permit for site access from
Highway 61. Johnson asked if a'project may he -has is the official project map. Luther representatives stated the niap
issued on Apri12G,:2022 is.considered the final map.
Gem Lake-Itifrastructure Issues
Water Study/Well Situation Update
Richard Parr from SEH reviewed the completed draft water plan for Gem Lake, which.coniained many
possible options for serving all, or part, of the City with a municipalwater system.
SEH used three priority levcls
1) those lots. whose private wells. exceed Minnesota Department of Health (MDH-) health -based guidaitee
levels;:
2) those wells with contaminants present but below MDH guidance ]evels;.an
3) properties adjacent to: those with contamination. levels. The water plan. study considered . sole source
water provider, as well as smaller, localized. plans, .where multiple.providers may:serve. Gem Lake
depending on proxirnity'to those .water providers. Costs are potentially very high, given the project cost
and the limited number of contaminated wells. Justin Gese stated SEH has a department that looks into.
financing these types of water projects:
Mayor,Artig-Swomley suggested holding a public: meeting on the planned date of the September council
workshop.. (September 12) Gese added there should be a. preparatory meeting in August to. establish the
agenda and flow the public meeting will be managed. Lindner moved to accept the water.plan study
seconded by Cacioppo, all in favor,. motion approved..

Attorney Patrick Kelly gave. an update on stormwater"pipe access discussions with 8urlington.Northern
Santa Fe (BNSF) Railway. Lindner moved. seconded by Artig-Swomley directing Kellyld reacb out to
BNSF in June fora, status update.. All in favors. motion approved.
Septic System Education Program
Mayor Artig-Swomley reviewed the septic system educational'materials that will be.posted to the city
website..Resident Craig Rafferty asked about the annual septic inspections. hitig-Swomley responded do
communications between her and the city. septic inspector on expectatttonsi wheduling.and communication.

Facilities Report Energy.Consumption—.Jim Lindner
Lindner provided a report on .HeritaPe.Hall energy bills.and winter weather data from December; 2021
through Febrtuary:2622. Electric use is.down because: of improvements made (lighting retrofits, automation
scheduling), but natural gas costs were high due in part to world events and cold temperatures. Motion by.
Johnson, second by Cacioppo to accept. Lindner's report. All in favor, motion approved.
Park and Trail Discussion
Mayor Artig,Swomley will kot� edst estimate for another park bench. Motion for-her*to proceed by
.Lindner, second by.Cacioppo.. All in favor, motion approved. Discussion then turned to *the pse-bf parlt•and
trail dedication.fuhds:. Attorney Kellyoffered an update on;a.current court case. regarding the legality of
cities: requiring such. fund. developers for commercial land. Case is still pending in the.court.system.
Don Cumming stated several Villas residents and the home owner's. association are willing to help maintain
the trail and plantings. Cacioppo discussed the trees planted by the Tree Trust. Some trees maybe dead.
Tree:Trust is following up on the status of the trees they planted.

League of Minnesota Cities: Training.Progratn
May Artig-Swomley and Acting City Clerk Melissa Lawrence attended League. of Minnesota Cities
Training. last month. and found it very. beneficial. Data practices and records management are primary topics.
for Gem :Lake .in the year ahead. Lawrence is embarking on long-term look at the.. City's record
management, in order to standardize and improve the way the City keeps�records., discards older records
and seeks out ways: to make things easier to locate at Heritage Hall. Data practices training is available on-
line for council members. It -is brief but effective training and comes highly recommended. Council
members should contact Lawrence to -register.
City -Wide Clean Up Event'May 21 Planning
The City will.be.ltolding a city-wide clean-u i tivent on Saturday May.21, 2622 from-9':QQ.a.m. — Noon. The City will
supply. those: who come..to participate. with industrial strength garbage.bags. These trash bags can be dropped offin.
.the Heritage: Hall parking lot. at the conclusion:of the event. At.noon, hotdogs, chips and soda will be served to
celebrate the conclusion of the event. Mayor Artig-Swotnley stated that the food has been purchased for an
estimated four dozen participants. She asked forvolunteers to help with the food service:
The Trash to Treasure part of the event will involve residents .placing unwanted items iif'the end of their driveway's
in order tore -purpose them into someone else's home. lt'was a popular event -in the past mid'she hoped. it would be
again.
Discussion of County Road E CorridvrStudy
Johnson gave an update on the County Road E corridor.study group. He asked how Gem Lake might transfer budget
motley#om various accounts to cover participation costs. Each city in the study was asked to contribute $6,000.
Tom Kelly explained various transfer options. Motion by Lindner second by Johnson'to Begin participating with: this
group byrhakingthe $6,000 payment. All voted. favor, motion approved.
Public Works and White Bear T.oivnship'Rate-Discussion
A•rate.structure. for public works duties .performed by White. gearTownship for the City of-0 em Lake -was agreed to
..y resolution at the last council meeting. Mayor Artig-Swotnley provided an update on discussion with the
Township on the mechanics of the working relationship. They wi11 perform all public works services for the City as
of June 1,1022, including routine, emergency and other special services. The Township voted to approve the move..
gt ihe, board meetingthis week. They agreed to anew Joint Powers Agreement covering this relatiomilip'that was
drafted by Attorney Patrick Kelly. Lindner.niade a motion to. approve: this JPA, Hynes-Amlee seconded, all favor;
motion..approved.

Beyond the Yellow Ribbon Program
Resolution N2022-013 in Support of the "Beyond the. -Yellow Ribbon" Program
The council liad previously supported the veteran -based program called "Beyond the. Yellow Ribbon"
managed by the Suburban Ramsey County Network. It was decided to renew this support of theeffortsof
this group.

Discussion of Gem Lake's Social Media Policy
The City of Gem Lake.has launched a Facebook-page to focus on special events and announcements. (twill be
considered a secondary site for information on Gent Lake, after the web -site: With this in mind, a basic social media
policy needs to be instituted to insure proper adoption of rules.as to how the page.will be managed. Asocial media
policy template was. obtained.from.the League.of Minnesota Cities and modiified .for City use. Lindner introduced a
motion to approve this: policy, seconded by Cacioppo. All in favor;.,motion approved.
Purple Line Discussion
The Council reviewed.proposed changes to the Purple tine .rot te'aitd discussed their merit, Most %yere initially in

A. -new proposal for water billing is being developed by Artig-Swomley, Lawrence and.Patrick.Kelly: Kogy, s been
designated .as the one and only point. person. with Vadnais Heights. for discussion of thisproposal. Lawrence is
working well with the Ramsey County Election.Board: Johnson will manage the relationship with*the City of White
Bear.

City Planner Evan Monson discussed the 2040 Comprehensive Plan with the Commission and made mention
,of Section 14.of he:plan.-lie feels: ihat.these are going to. be important in the following years when the City
begins to implemetit.the plan.
Commission Chair Don Cummings sent an email on points he. had regarding the plan and. he wanted to stress
that everyone.should. be .on the same page and be.ready for any proposals or attempts that may..come to
"deconstruet''the City'.s goals. A good example Commission Chair Cummings. asked Evan to mention was on
the 39.unit apartment building in Mahtomedi and how it contradictod.many of.their Ordinances.

The Metropolitan Council reviewed the City of Gem Lake Comprehensive Plan (Plan) at its
meeting on May 25, 2022., The Council based its review on the staffs report and analysis
(attached).
The Council found that the City's 2040 Plan meets all Metropolitan Land Planning Act
requirements; conforms to the regional system plans including transportation, aviation; .water
resources management, and parks; is. consistent. with Thrive MSP 2040; and is compatible with
the plans of adjacent jurisdictions.
In addition to the AdvisoryComments and Review Record, the Council adopted the following
recommendations..
1. Authorize the Gem Lake to place its 2040 Comprehensive Plan into effect.
2. Advise the City to implement the advisory comments in the Review Record for Forecasts,
and Surface Water Management.
3. Approve the City of Gem Lake's Comprehensive Sewer Plan.
Please consult the attached staff report for important information about the City's next steps. Of
particular importance are the. Council's actions, listed on page 1; general Advisory Comments
listed on page 3, and the specific comments for technical review areas, which are found in the
body of the report. The final copy of the .Plan needs to include all supplemental
informationlchanges made during the review.

Advisory Comments.
The following Advisory Comments are part of the Council action authorizing the City to implement
its 2040 Comprehensive Plan (Plan).
Community Development Committee
1. As stated in the Local Planning Handbook, the City must take the following steps:
a. Adopt the Plan in final form after considering the. Council's review recommendations.as
contained in the body of this report.
b. Submit one hard copy and, one electronic copy of the Plan to the Council. The electronic
copy must be submitted as one unified file.
c. Submit to the Council a copy of the City Council resolution evidencing final adoption of
the Plan.
2. The Local Planning Handbook also states that local governments.must formally adopt their
comprehensive plans within nine months after the Council's final action. If the Council has
recommended changes to the. Plan; local governments should incorporate those recommended
changes into the Plan or respond to the Council before "fina[ adoption" of the comprehensive
plan by the governing body of the.local governmental unit. (Minn. Stat. § 473.864, subd. l )
3. Local governments must adopt official controls as identified in their 2040 comprehensive plans
and must submit copies of the official controls to the Council within 30 days after the official
controls are adopted. (Minn. Stat. § 473.865, subd. 1)
4. Local governmental units cannot adopt any official controls or fiscal devices that conflict With
their comprehensive plans or which permit:activities in conflict with the Council's metropolitan
system plans (Minn. Stat. §§ 473.864, subd. 2; 473.865, subd. 2). If official controls conflict with
comprehensive plans, the.official controls must be amended within 9 months following
amendments to comprehensive plans (Minn. Stat. § 473.865, subd. 3).
Environment .Committee
1. The Council -approved Comprehensive Sewer Plan becomes effective only after the Plan
receives fins[ approval from the local governmental unit's governing body. After the Plan
receives final approval fromthe City and the Comprehensive Sewer Plan.becomes.effective, the
City may implement its Plan to alter, expand, or improve its sewage disposal system consistent
with the Council -approved Comprehensive Sewer Plan.
2. A copy of the City Council resolution adopting its 2040 comprehensive plan, including its
Comprehensive Sewer Plan, must be submitted to the Council,

The City of Gem Lake is in northeastern Ramsey County. It is surrounded by the communities of
the White Bear Township,; White Bear Lake, and Vadnais Heights.
The City submitted its 2040 Comprehensive Plan (Plan) to the Council for review to meet the .
Metropolitan Land Planning Act requirements (Minn. Stat.:§§ 473.851 to 473.87. ) and the
Council's 2015 System Statement requirements,

Minn. Stat. § 4711.75 directs the Metropolitan Council to review a local. government's
comprehensive plan and provide a written 5tatementto the local government regarding the Plan's:

Regional Transportation, Transit, and Aviation

The Gem Lake Comprehensive Plan Update (Plan) conforms to the 2040 Transportation Policy
Plan [TPP} adopted in 2015. It accurately incorporates and integrates transportation system
components of the TPP. The Plan is also consistent with Council poIicies.regarding community
roles, the needs. of non -automobile transportation, and the needs of freight. The Plan is compatible
with the plans of adjacent and affected governmental units.
Roadways
The Plan conforms to the Roadways system element of the TPP. There are no principal.arterials in
Gem Lake; although 1-35 is located just to the west of the: community and serves its residents. The
Plan accurately accounts for the two A- minor arterials located in the community (County Road E,
and. U.S. 61) and has..delineated. major and mirror collectors.. All roads in the city have two (2)
lanes. The Plan identifies existing and forecasted traffic volumes for its A -minor arterials. The.Plan
also. refers to guidelines on how access will be managed for A -minor arterials.
Transit
The Plan conforms to the. Transit system element of the TPP. Gem Lake is in Transit Market Area
ill; with primarily commuter. express bus service. Dial a ride service is available through Transit
° Link. The plan also discusses the Rush Line`Transitway which is funded underthe Current
Revenue Scenario in 2015 and is now identified. as the Purple Line:

The Plan conforms to Aviation system element of the TPP. The Plan includes policies. that protect
regional airspace from obstructions.
Bicycling and Walking
The. Plan its consistent with the Bicycling;and Pedestrian. element of the TPP. The Plan states that
_t;;a motorized vehicles, bicycles, and pedestrians share roadways in Gem Lake. Given the nature:of
the city and low road volumes, this approach is appropriate. The Plan notes that the City should
continue to monitor bicycle and pedestrian safety as part of its transportation planning for public
safety, especially when planning maintenance and improvements to local roads.: Gem Lake has
one future elements of the Regional Bicycle Tran sportatio n Network (RBTN) a Tier 1 Alignment, an
extension of the Bruce Vento trail.
Freight
The Plan is. consistent with Freight policies of the TPP. The Plan identifies two rail corridors which
run northlsouth through the community. There are no truck, barge or intermodal facilities in the
community and .no .commercial or industrial.nodes that generate f reight movements.
Transportation Analysis Zones (TAZs)
The Plan conforms to the TPP regarding TAZ allocationsfor theseven TAZs in the community:

Water Resources,
Wastewater Services

The Plan conforms to the 2040 Water Resources Policy Plan (VVkPP). It represents the City's
guide for future growth and development through the year 204O. It includes growth forecasts that
are consistent with the Council's assigned forecasts for population, households, and employment.
Current wastewater treatment services are provided to the city by the Metropolitan Council
Environmental. Services (MCES). Wastewater generated within the city is conveyed by Council
Interceptors 712-2, 1-VH-423, and 1-VH-423A. Al wastewater generated within the city is conveyed
to, and treated at, the Metropolitan Treatment Plant in St. Paul. The Plan projects that the city will
have 144 sewered households and 490 sewered employees by 2040. The Metropolitan Disposal
System with its scheduled improvements has or will have adeq uate capacity to serve the City's
growth forecasts.
The Plan provides sanitary flow.projections in 10-year increments: The rationale forthe average
day flow projections is given in the Plan and determined appropriate for planning local services.
The Metropolitan Council is. committing to provide the. level of wastewater service based on the
1 sewered forecasts as stated in the sewer element of the Plan.
The Land Use Plan reflects an overall minimum residential sewered density that is consistent with
Council policy for future sewered residential.growth for Suburban communities:
The Plan states that there were 75 existing homes within the city according. to 1970 census data
which represents approximately one-third of the current homes within the city, some of which may
be connected to:the sanitary sewer system. No evaluation of these services has. been conducted
by the city to. determine the susceptibility to Ill. The city is provided regional wastewater service
through numerous.connections either 'directly or indirectly to regional interceptors creating
° individual services areas too small to accurately measure on an on -going basis. Due to this
situation the impact of wet weather events and cycles cannot be precisely quantified and therefore,.
the city cannot determine the impact of I/I on the collection system.. The Plan outlines previous.
efforts to inspect and mitigate Ill within its system, and outlines activities that include sump pump
inspections, manhole structure inspection and rehabilitatiomand flow metering to further identify
and eliminate. sources of Ill in the public collection system and estimates the cost of these efforts A
$323,000, Each pipe section within the city is scheduled to be inspected every 10-years. The plan
also identifies a continuation of a public education program.that discourages the connection of
sump.pumps, foundation drains and roof leaders to the sanitary sewer system. The Plan does not
attempt to describe the sources, extent, or significance of existing I/I within the public or private
wastewater collection system.
The Plan references City Ordinances 64E and 129.that describes the requirements and standards
for minimizing 1/1, including the prohibition of connections of roof downspouts, foundation drains,
sump pumps,. and yard drains to.the public sanitary sewer. The Plan. states that th e discon n ectio n
of these prohibited connections is not required urider the ordinance but rather relies on voluntary
compliance
Comprehensive Sewer Plan
The Sewer Element of the Plan has been reviewed. againstthe requirements for Comprehensive
Sewer Plans for Suburban communities, It was found to be.sufficiently complete and consistent
with Council polices, Upon. adoption of the Plan by the City, the action of the Council to approve
the Sewer Plan becomes effective: At that.time, the city may implement its Plan to alter, expand, or
improve itssewage disposal system. consistent with the approved Sewer Plan. A.copy of the City
Council Resolution adopting its Plan needs to be submitted to the Metropolitan Council for its
records.
Surface Water Management.

Gem Lake lies within the oversight boundaries of the Ramsey -Washington Metro Watershed
District and the Vadnais Lake Area Watershed Management.Organization. Gem Lake submitted a
draft Local Water Management Plan (LWMP) to the Council for review in September201.7.
Council Water Resources staff reviewed and commented on the draft LWMP to the City,
Watershed District and Watershed Management organization in a letter dated October 6, 2017,
The revised version of the LWMP submitted on January 13,2021, adequately addresses concems
raised in our October 2017 letter. The Vadnais Lake Area Watershed Management Organization
approved the LWMP on 6-27-18.
Advisory Comments
The City needs to provide the date the Ramsey Washington Metro Watershed District approved
the plan for our records.
Consistency with Council Policies
The Council reviews plans to evaluate their apparent consistency with the adopted plans of the
Council. Council staff have reviewed the City's Plan and find that it is consistent with the Councii's
policies, as. detailed below.
Forecasts

The. Metropolitan Council requires the Plan address how land supply far future development (or
redevelopment) accommodates the community's growth forecast. The City's approach is
discussed in section 5.7 (page 24) of the Plan. There are 81 acresin the mixed -use category, of
which 34 acres are considered available for residential development. The City estimates the
potential for 174. additional housing units if fullydeveloped and absorbed: This accommodates the
forecasted growth.
Council policy requires some measure of employment -bearing land use intensity. The. City
provides impervious surface and building coverage rates in table.5.4.
The Council requires 2020, 2030, and 2040 forecasts assigned transport analysis zones, or
portions of TAZs within the city boundaries. This is found in table 6.4;.TAZ allocations summarize
to the city total.
Chapter 7 includes a discussion of sewer -serviced forecast and an accompanying table (table 7.5)
consistent with the Council's System Statement.
Advisory Comments
Employment in Gem Lake has not grown as was previously projected; local employers have
reduced their employment. Council staffadvise that the City could request a lower employment
forecastwith afuture amendment; if desired.
The forecast of sewer -serviced households and employment (Platt table 7.5) shows 110
households, 280 population, and worksites with 150 employees remain outside of the.wastewater
system (and utilizing SSTS) throughoutthe forecast period. The sewer -serviced. forecast can be
adjusted in a future amendment if the City expects more households.to transition to public sewer
service.
Thrive MSP 2040 and Land Use.

The Plan is consistent with. Thrive MSP 2040 (Thrive) and its land use policies. The Plan
acknowledges the Thrive community designation of Suburban (Figure 2). Thrive describes
Suburban communities as those that experienced their primary era of development during the
1980s and early 1.990s as Baby Boomers formed families and entered their prime earning years.
Suburban communities are expected to plan for forecasted population and.household growth at
overall average densities of at least five units per acre, and target opportunities for more intensive
development near regional transit investments at densities and in a manner articulated in the TPP,
Plans are also required to identify areas for redevelopment; particularly areas that are well -served
by transportation options and nearby amenities and that contribute to.better proximity between jobs
and housing.
13 The existing pattern of development in Gem Lake is one of primarily single-family homes, nearly
E] 90-percent of which are own er-occupied. A small portion of the City known as "Hoffman's Corner"
located in and around the U.S. Highway 61 /County Road E intersection is the business. center of
® the City. The City envisions this area in the Plan for redeve lopment as a mixed -use area with an
approximately 50150 residential/commercial mix, in four mixed -use land use categories, as shown
on Table 2.

than 1.70 homes including 5 mu[tifamily units. Approximately 12 homes are rented. More than 80
housing units are currently affordable to households earning under 80% of Area Median Income
(AMI), however; nearly 25 households earning 80% of AMI or below are paying more than 30% of
their income toward housing costs. There:are about 2 units affordable to households with income
at or below 30%AMI and more than 10 cost.burdened households with incomes at or below 30%

Plan guides sufficient land expected to develop in the 2021-2030 time period at a minimum of eight
units per acre to allow for development of at least 32 new housing units.
The housing imp lementation plan component of the Plan describes that the City will consider T1F,
housing bonds and tax abatement for new housing development. The City states th at. they wi 11
partner with Ramsey County to meet many of their housing needs.
Water Supply

This Agreement is. between the City of Gem .Lake, a municipal corporation ("City") and
Ramsey County, a political subdivision of the State of Minnesota,.("County" ) for the repair
of a stormwater outfall southeast of County Road E and Hoffman Road ("Project").
RECITALS
1. County Road E (CSAH 15) has drainage to the Project.
2. The Project located within the City and conveys both County and City drainage.
AGREEMENTS
Responsibility for Design Engineering,
11, The. City will prepare plans, specifications, and proposals for the Project..
1.2. Plans for the Project showing proposed construction will be presented to the
County and will be on file at the City.
1.3. Any costs associated with Project revisions after the completion of plans and
specifications will be paid for by the party requesting the revisions. The County
must. concur with plans for the Project before. proceeding and must: approve any
subsequent revisions that increase County costs or impact Courity elements.
2. Responsibility for the Right of Way Plan and Acquisition
2.1, The City will prepare a right:of way acquisition plan showing easements and
other property interests required for construction of the Project. The acquisition
plan is subject to approval by the County before proceeding.
2.2. The City will acquire the proposed easements and right of way.

3. Procurement and Award of Contract.
3.1. The City will take. quotes in accordance with state law,
3.2. The City will prepare an abstract of bids and a cost participation summary based
on the lowest responsible bidder's proposal, and. will provide the same to the
Cou nty.
3.3. The. County must concur with the determination of the lowest responsible bidder
prior to award of a contract,
3.4. The City will award a contract, and pay the contractor from local funds identified
for the Project.
4, Responsibility for Construction Engineering
4.1. The City shall perform or contract the performance of the construction
engineering for a11. elements of the. Project.
5. Project Costs
5.1, Except as provided herein, the County and City will participate in the costs of
construction in accordance with contributing drainage area of 28.9% County and
71.1 % City as shown in Exhibit B.
5.2. A Iist of the construction pay items and the total estimated Project cost is
:attached as Exhibit A. Quantities and unit.prices in Exhibit A.are estimates.
Actual costs shall be based on the contract unit prices and the quantities
constructed.
5.3. Design Engineering Costs
5.3.1. The County shall pay the City a design engineering fee equal to 14%fl of
the County's share of the project items identified in Exhibit A.
5.3.2. Design engineering fees shall be calculated based on. the quantities and
unit prices at the time of contract award.
5.4. Easement. Acquisition Costs
5.4.1, Easement acquisition costs Including payment to owners, relocation
assistance, appraisal fees, and other related costs of acquiring
easements for the Project will be the responsibility of the City.

5.4.2, The County will not be responsible for assessments, fees, or fines,
associated with owning property acquired for the Project. If the City
imposes assessments, fees, or fines, the County will pay those costs and
the City will reimburse the County for those costs..
5.4.3. The City will pay 100% of the cost to administer easement acquisition.
5.5. Construction. Engineering Costs
5.5.1. The County shall pay the: City a design. engineering fee equal to 14% of
the County's share of the project items identified in Exhibit A.
5.5.2. Construction engineering and administration fees shall be calculated
based on the final contract quantities and unit prices.
6. Payment Schedule
6.1. Design engineering will be invoiced at the time of contract award.
6.2. The City will invoice the County for construction costs incurred on a monthly
basis or as determined. by the payment schedule for the contractor,
6.3. Construction engineering will be invoiced at the time of substantial project
completion, as determined by the City.
6.4. Payment will.. be made within 36 days of receipt of an invoice
7. The County grants the City temporary construction permits over all County owned
rights -of way and property within tine limits of the Project for use during construction at
no cost.to the City.
8. The City and County shall indemnify, defend, and hold each other harmless against
any and all.liabiiity, losses, costs, damages, expenses, claims, or actions, including
attorney's fees, which the indemnified party, its officials, agents, or employees may
hereafter sustain, incur, or be required to pay, arising out of or by reason of any act or
omission of the indemnifying party, its officials, agents, or employees, in the
execution, performance, or failure to adequately perform the indemnifying party's
obligation pursuant to this Agreement. Nothing in this Agreement. shall constitute a
waiver. by the County or the City of any statutory or common law immunities, limits, or
exceptions on liability.
g. This Agreement shall remain in full force and effect until terminated by mutual
agreement of the parties.

I rated the City of Gem Lake's street system yesterday using the Town's rating system. Below are my
recommendations based upon the condition ratings. (Rating is 3.2 using a scale or 1-5, with 1 being the worst
condition)
1. Haven Lane— I recommend cracksealing and sealcoat in 2023. Some of the transverse cracks are alligator,
so will require some milling and patching in those prior to Sealcoating. - AGREED
2. Tessier Road (2.03) — I recommend that the street be considered for full depth reclamation or reconstruction
with concrete curbing. The cul-de-sac is a 3.5. I recommend cracksealing and sealcoating the cul-de-sac in
2023. - In the past the Council has been reluctant to install concrete curl) , „,, al streets in order to keep
the small town rustic feel, thus have not been used. This road may need more discussion or just stick with
the crackseal & seal coat on all of in 2023.
3. Little Fox Road (3.36) — I recommend that the street be considered for crackseal and sealcoating in 2023.
There are a few alligator transverse cracks close to Labore Road that will need to be milled a patched. 1 also
noticed snow plow/wing damage on the surface. - AGRE'ED
4. Big Fox Road (3.78) — I recommend that the street be considered for crackseal and sealcoating in 2023.
Snow plow/wing damage to the surface. There was in interesting find in the cul-de-sac, a Pickle Ball Court.
Will you need to replace the court after sealcoating? Or do the players even want the cul-de-sac sealcoated?

5. Summit Farm Lane (4.75) —1 recommend that the street be considered for crackseal and sealcoating in
2023 even though the road was constructed in 2020. If not in 2023 then use the 5 year plan of 2024. The
sooner you can get a treatment on the surface the longer the projected life is until a mill and overlay is
required. AGREED in 2023
6. Hoffman Road West (4.95) — I recommend that the street be considered for crackseal and sealcoating in
2023. Road was constructed in 2018. Aligns with a 5 year sealcoat plan. — This was paved in 2020, so I
would hold off in this one
7. Scheuneman Road South (4.7) —1 recommend that the street be considered for crackseal and sealcoating in
2023. Aligns with a 5 year sealcoat plan. - AGREED
8. Scheumeman Road North (4.1) — I recommend that the street be considered for crackseal and sealcoating in
2023. It has been 8 years since the last sealcoat. Transverse cracks were overlayed/filled with asphalt fines,
not actually sealed in 2015. - AGREED

There has been some recent engagement with the monitoring consultant and developer. at Villas of Gem
Lake. I am still hopeful that.they will be willing to pay for over seeding various areas around the. site. We
have it on our schedule for multiple rounds of vegetation. management this year— spot herbicide and
spot mowing, I've recommended over seeding the sand infiltration. basin and some of the other problem
areas around.the.site. Currently -I'm waiting for confirmation that.I can provide a quote for this
additional work, implyirig they. wiII pay for the additional work.
The watersheddistrict is still holding escrow and.is aware.of.some of the issues..Again,.hopeful. that
these mist items will get covered during our last year of management currently under contract,.

Sect11on.1. Findings -and Purpose. The City Council finds.that:
