Public hearing open. Tom Riedesel, City Planner,, discussed the proposed changes in the context of Honey Bear Meadery and.HyVee.. Changes.to the .ordinance would .includ.e: on/sale, off sale, production. and retail of microbrew. and meadeary; convenience store; liquor store, fueling station, distillery,. coffee.shop. Counn ssioner Wippich asked abaut:other municipalities that are similar. City Attorney Patrick Kelly: Look at the evolution of the .city; look at traffic, land use. Is this a good place for this type of operation? City Planner Tom. Riedesel says yes. Josh Eckton; Honey Bear Meadery, gave an overview of the proposed. Honey Bear Meadery; a 830'square foot production/package and retailproposal at 1595 E. County Road E. Parking and hours of operation were discussed. A question arose about the fire sprinkling, the White Bear Lake. Eire Department has completed their review and recommendation for fire sprinkling. Questions about hours of operation and foodpreparation onsite were asked — M r. Eckton said. that hours would likely be 2:00--10:00 PM and they were considering carrying: prepackaged food, but would not be preparing food at the.meadery. Representatives.from.HyVee.presented an overview of the proposed 10,500 sq ft: Past and Fresh store proposed for the corner of County Road E, Hoffman Road anal.. I-lighway 67 . Discussed the traffic study,. drive thru, future look of Hoffman Road, 60% glass requirement and agreed to give. the. City of Gem Lake an extension to the 60 day xequirement. Commission MeetingMin utes July 9; 2018 1 Commissioners Wippich and Pratt agreed, good changes, no reason not to allow the additions. and :to rnove.forward these changes to the -city council. . . The Planning Commission for the City of Gem Lake. voted 3-0 to recommend that the City Council approve the following amendment to Ordinance No.1.3I r- the Consolidated Land Use. Ordinance. In the categories of permitted uses in Section 9.6.5, under "Corxmn.erci.a "', the following uses shall be added to:'the. perTnitted..'Conditional uses of space assigned as. "commercial "Convenience stores with fuel islands, restaurants, coffee shops, rnicrobreweries;. meaderies and microdistilleries and their associated retail operations, and on -sale & off-. sale intoxicating liquor sales." The city shall update and make. corrections throughout Ordinance No. 1.31: - Section 9, and any supporting documents or city ordinances, to ensure consistent and accurate reference to and application of these .changes. Commissioner Johnson inane a motion, seconded by Commissioner Pratt to. close the public comment period. Motion approved, comment period.closed at'8:46 p.m, Public Comments Fritz Magnuson, Daniels Farm Road, as: a result of the. 41h of July storm and grading within the Villas Development, he estimated that 16,000 gallons of `muter has settled in his back yard and the, adjacent property awned by Anthony Scoinavacco and Michael Garrett. Mr. Magnuson stated that the wafter. was present for 5+ days and caused damage to approximately 1,500 sq ft of property and will be seeking remediatian and reparations. He will also be attending the City Council meeting to discuss. .Commissioner Johnson made: a motion,seconded by Commissioner Pratt to adjourn the meeting. Any total surface coverage or building footprint standards may be combined among.;all. of the buildings included on a particular lot. 9.6A New Building.Types. New building types.:may be proposed in the manner of other amendments to the Zoning Code using the procedure in Section.l7:G of this Ordinance. A proposal must contain all information included in existing analogous Building Types, including but not. limited to the dimensional standards, use designations, and frontage requirements, 9,6.5 Use Regulation in the Gateway District. A MEADERY BREWERY FOR HONEY WINE REQUEST: ZONING ORDINANCE AMENDMENT, CONDITIONAL USE PERMIT LOCATION: 1601 COUNTY ROAD E APPLICANT: JOSHUA ECKTON ZONING: GATEWAY ZONE, NEIGHBORHOOD CENTER Mr. Eckton is requesting City approval to run his business from one of the suits at.1601 County Road E. The site is located at the, corner of County Road E and Scheuneman Road and is currently vacant. The cornier suite is where Mr. Eckton would like to open his business. Additional businesses located in the small strip center. include Al's Gun Shop and.,2rid Hand Tools, facing County Road. E and McDou.gh Vending facing. Scheuneman Road (to be occupied by Mr. Eckton) and St. Paul Smiles (making dental ceramics). A former auto repair shop faces east at the rear of the building is vacant. There is also a residential apartment in the upper level of the building. Mr. Eckton would occupy 838 square feet of the building if approved, The interior of the building would have a retail area serving food, drink and merchandise. Eleven tables (serving up to 4 each) and. 5 bar stools. are proposed. The brewing/manufacturing area is proposed to be 280 square feet in size.. One restroom is. proposed also.. The use, since it will manufacture and. serve alcohol, requires City approval of both an on -sale and off -sale liquor license. Currently,. the Consolidated Land use Ordinance lists the following uses which are permitted. A) General Terms and Permitted Uses. Conditional uses of space assigned as "commercial" are: car wash; fight industrial uses which manufacture',. process, store and %distribute foods. and materials not likely to create offensive noise, Odors, vibrations, dust smoke, heat, glare or other objectionable 'influences and are in general dependent upon raw materials refined elsewhere. On -sale and off. -safe liquor are not listed as.permitted or conditionally permitted under the Retail .heading. Uses which manufacture., process, store. and distribute foods is listed as a Conditional Use under the Commercial Heading. The meadery use could fall under this. heading but the distribution of alcohol will require an off -sale license. The City of Gem Lake may want to. consider modifying the list of permitted and. conditional uses to address this specific use. On/of sale liquor could be added to the list or in the alternative, microhrewery. The use could be permitted. under'the '`retail" heading also. Identifying a more specific use .and adding that use to the. list of allowed uses plus. eliminating "retail" may keep out certain. uses which may not be wanted in the City.. Parking - Section 20.5 of the Consolidated Land Use Ordinance regulates parking. This section of the ordinance regulates residential :parking but does not address commercial. parking: The City should consider adding Commercial. Parking requirements. White Bear Township requires the following minimum parking for a shopping center; 1 space for each 100 square feet of useable floor area for the first 15,000 square feet of building. A restaurant in White Bear Township is required to have 2 spaces per 100 square feet of floor area, The retail center where the Meadery Brewery as proposed is just over 6,000. square feet in area. Forty-eight parking spaces are provided on the south and west sides of the building. Based on the. size. of the building 60 parking spaces could be required. The gun 'shop and 2nd Hand Tools do not generate a significant amount of traffic. Mr. Eckton plans to use 838 square feet of the building. Using a I parking space per 100 square feet of useable floor area model. will require. only 9. spaces.. There are approximately 18 parking spaces. in front of (south side) or west side of the building where the Meadery Brewery is proposed. The. amount of parking appears to be adequately provided. If this use is one that the City of Gem take would like to have, the following actions should be taken: 1. Modify the Consolidated Land Use Ordinance, Section 9.6.5 as follows: Commercial. — Add on -sale liquor, off -sale liquor,. micrvbrewlm.eadery brewery to the current list of Conditional Uses. Note -- other uses could be added/subtracted or modified, unrelated to Mr. Eckton's request. 2. Approve. a Conditional Use Permit for Mr. Eckton's meadery brewery. The HyVee proposal requests a convenience store with fuel islands, a restaurant, liquor store, and coffee shop. None of the uses are specifically identified as being permitted in the City. Staff recommends adding these uses. to the list if the City wants to approve the HyVee proposal. Vacation of Public Right -of -gray HyVee would like the City to vacate 11,985 square feet of the current Hoffman Road right-of-way which would allow the use .of the area for development. HyVee is planning the drive-thru stacking lane within this area which is currently right-of-way. The Hoffman Road right-of-way is the jurisdiction of Gem Lake this is being verified with MnDGT and Ramsey County). The width of the right-of-way is approximately 95', Detachment & .Annexation -- A portion of the property which HyVee is planning to redevelop is located within the City of Vadnais Heights. The City Attorney is working with 2 the property owner and the City of Vadnais Heights to process a detachment of the property from Vadnais Heights and incorporating it into Gem Lake.. Conditional Use Permit -- If the Zoning Ordinance Amendments are recommended for approval, the City may take action on the request. for a Conditional Use Permit. A Conditional Use Permit may be issued by the City which includes. reasonable conditions for approval. The Conditional Use. Permit is the official action by the City to approve the. proposal, Section 17.5.2 of the Consolidated Land Use Ordinance lists what the Planning Commission and City Council must consider when reviewing a development proposal. It states: When reviewing a Conditional Use Permit, the following criteria. must be reviewed and measured: t. Adjacent Uses 2. Air and Water Quality 3: Traffic Generation 4. Public Safety & Health 5. Area.Aesthetics 6: Economic Impact on the Entire Area 7: Consistency with Comprehensive Municipal Plan 8. Neighborhood Center: Intended for the most urban conditions within all of the shown mixed use areas. The mixture of land uses emphasizes ground -floor retail with. offices and residentiallrental above (as market acceptance matures) and structures providing commercial space for medium and large -sized retailers: Street frontages throughout this subzone should be pedestrian -oriented, and the public space should be defined by placing building facades at the edge of the sidewalk, Neighborhood Center [and that abuts other aubzones on the north and west sides will. be carefully planned to ensure lower -density buildings. Section 9.2.4 also provides for incentives for projects which include public transit support.. This is timely in relation to the HyVee proposal. as staff from area communities, and Met Council., Ramsey County; MnDOT and consultants are planning for Future Bus Rapid Transit along the Highway 61 corridor. El The group working on the BRT Master Plan is aware of the HyVee plans. HyVee has not proposed any site improvements specifically related to accommodate the BRT and as a result, no incentives would be available.. Section 9-4 defines. Thoroughfare Standards. Section 9.4.2 states: The thoroughfare design in a given area of the Gateway District is determined in part by the subzone to which the land is assigned. Right-of-way dedication and the use of the right-of-way is set forth in the Thoroughfare Type diagrams in Figures 2: and 3. The presence of trees within a diagram indicates a requirement to plant "street trees" within. the indicated. area.. A development plan's thoroughfares shall comply with the dimensional ;and layout. standards applicable to each thoroughfare type. The following Thoroughfare Types are. allowed in each sub -zone: 17 Neighborhood Edge; A, B, Alley; ii} Neighborhood General: A, C, C*, Alley, Boulevard (Type C only allowed within 250' of Mixed -Use sub -zone. boundary) iii) Neighborhood. Page 31 of the Ordinance shows corridor improvements. planned by the .City for redevelopment of Hoffman Road. There are no plans by HyVee to improve Hoffman Road. A possible condition for approval could include a requirement that Hoffman Road be reconstructed as .shown as a Type D medium -volume commercial street or a Type: Boulevard. This option must be considered prior to action to vacate a portion. of Hoffman Road as the design standards for both options require 80-94 feet of .rig ht-of-way or 93-120 feet of right-of-way. Figure 14 on Page 45 of the Consolidated Land Use Ordinance provides requirements for a single use Building in the Gateway Zone. .The parking requirements are 4 spaces per 1;000 square feet of retail.
