Resolution 2016-04 Adopting the New Voting System
A. motion was made by CounciIrhernber Artig-Swornley; seconded by Councilmember Lindner to Adopt
the use of anew voting system. Motion. passed. The. $10,000 payment for the new system would be.
spread over a five year period.
Trash to Treasure Day, Aril 3[3
Councilmember Artig-Swomley made a motion; seconded by Councilmember Lindner to adopt a "Trash
to Treasure Day" within the City of Gem lake on April 30th.. Noted that residents retrieve unclaimed
"treasures" at. the end of the day. Motion passed.

RESOLUTION ADOPTING THE USE OF NEW VOTING.5YSTEM
WHEREAS., Minnesota Statutes §:206,58, subdivision 1 authorizes cities to use voting systems at their
elections, subject to the approval of the County; and
WHEREAS,. Ramsey.County has authorized the use ❑f the Hart Verity voting system for the city primary
and general election to be conducted ❑n August 9, 2016 and all elections conducted thereafter;
NOW., THEREFORE, BE IT RESOLVED, that the Hart. Verity voting system is hereby authorized for use in
ail elections conducted in the City of Gem Lake on August 9; 2016 and thereafter;.and
BE IT FURTHER RESOLVED, that the City Clerk is directed to transmit a copy of this resolution to the
Ramsey County Elections office; and.
BE. IT FURTHER RESOLVED, that the City Clerk is directed to. provide information to the: voters concerning
the use of the new voting system; and
BE IT FURTHER RESOLVED, that the City Clerk. shall make the new voting system ava liable for

1, PURPOSE'
The purp6se of this .fault I.0wcrS Agreement is to establish and describe the roles and
responsibilitics oFthe County and the Municipalities in connection with the 'RCI Uis)tion,
i.nip Icincniation, and operation ot.a new noting system. for use throughout -Rain Sey County
("Prpjec:t"), including.equipment that will be owned and operated by the County and equipment
that wiII be uwited and operated by the M anivipal ities,
11. COUNTY ROILS AND RESPONS113ILiTTES-SYSTEM IMPLEMENTATION
A. General
-the County 4,vill provide the services, materials; and egtiipmont necessary to procure and
ii-tplemenl.a rep] aceme;fit voting; system ("System.") in. Ramsey County, including software,
hardware. materials -ballot printing, and .other serviecs as further. described in.this.Agmement.
Services imy be provided directly by Count), staff or by outside vendors, as deterniitied by the
County.
B. System Description

1.. The. County will provide services, including training,.related to the
implementation of the System by the County and the Municipa itiesi as described

Agreement,
2. T.lie County will provide implementation project management services through a
1'c?ject Manager. Joseph Mansky, or his designee, shall serve as Proj:cct Manager
for the County.
3. The goal is to have the System imPleinente.d rind ready for use by the Cout7ty and
the M11i7icipalities in time fOr the 201 G.state priina:ry. At the.dispretion of the
County, the implementation of the System may be delayed for initial tisc at the
?016 state general election or a future election,

D. Post -Warranty Maintenance Services

A. The County will initially own all syste3n Equipment.
B. Upon payment. in full .to the County in accordance with the. terms oi'this. Agreement:

related equipment that. were originally purchased by the Counly under this Agreement;
this provision shall not apply to equipment leased by the County. The Comity "will
Maintain ownershipof backup ballot counters and ballot marking.devices, the c:cntrai
count ballot chanters and any precinct ballot counters that are. needed for.counting
absentoe baIIot.s, the mernory devices. for alI- ballot CC) Lin icrs and ballot mankind dQvi ces,.
and the. computer hardware and soRware needed to. operate and administer the System.
C. The. County is the sole Licensee of the System software and the Municipalities are
users.
VL WARRANTY
The CoYiilty makes no representations and extends no warranties with respect to tile: use of the

VII. SYSTEM TVIPL EM1:NTAl'T[]N' FI-TN ]TNG
A. The County will provide initial financing for the costs of aegtiisition, installation, and
irnplernentmion.of the System (' implementation Cysts").

be adjusted throughout the term of this Agreement including.any extensions.
For those Munici.paliLies that have elected to pay for the.bal1ot counters,
ballot boxes; and ballot inarking devices over time, the total amount to he
paid will include their proponipnate sharc of any financing). costs incurred by
the C:ounty.fo.t. the purchase, installation and iniplelnentation of the System
Equipment, Which financing costs will be shared among those. Municipalities
that have elected to pay over a period from two to l iv.e years: The .Coumy
will charge. each ;Municipality that chooses to finance the purchase of its
System Equipment 2% per annual.

Items listed. in.Section 11I.13 t. of this Agreement and, until repaid in lull,
the Implementation Costs described in Section VII1.A.1

the costs of licenses and lees required for the County to administer the
System, which have been submitted to. and approved by the County.

C. Payments
The C:oumy shall invaice.a M.tinicfpality after the initial delivery of
County -tested ballot. counters, ballet bones, and ballot marking,. devices to
the Municipality. If a Municipality will pay over a period of 2-5 years, the
county .wall invoice the M.uiiiuipality its appropriate annual sure along, with
the invoice. for annual Operating Casts. Paymem shall be made Nt ithin thirty
(30) calendar days of the date of the invoice.

XI1. INDEMNIFICATION AND INSURANCE
A,. Each party agrees that it will be responsible for its ownacts and the acts of its
employees, elected. ottscials. and agents as. they relate to this Agreetnt nt and for any
liability resulting therefrpm, to the exteilt autlloriceti by law, and shall not. be
.respons'ible for the acts of the other parties or their employees;.elected ol7icials, and
agents, or for any liability resulting tlierelro n. party's liability shall be
governed.andlimited by the .Municipal'Mort Claims Act, Mirim Stat. Chapter 466 and
other applicable law.
B. Each Warty agrees.to defend, indemnify and hold. barmles5 the other Pal -lies, their
eiliployees, elected ofti.c als, and agents from any -liability, claims, causes of action,
jLid gments, damages, Iosses, casts or expenses, including reason able.auo.meys fees,
rQsul.ting.directly or indirectly from any act or omission of the .in&iunifyiiig party,

Subject to the provisions of Section XIV, each Party aLrecs that the other Parties, the State
Auditor, or any of their diily authorized representatives shall, at any time during normal business
hours, and as often tis they may reasonably deem nec:emary, have access to and the right to
vxanum. audit. eycerpt and transcribe any books; documents, papces, records. etc., which are
pertinent to the accounting practices and procedures of governmental entities.and which involve
transac.tia.lis relating to this,Avreemenl,

Cnunty that mast be used in every electioi! conducted in the County. Each Municipality must use
the ballot counters. ballot boxes and ballot narking devices provided i.rt this Agreement for all
elections conducted ice the M-LITti6pality.
XVII. TERMINATION
A. This. Agreement shall terminate upoli unanimous consent of the Parties as eVidenced
by a writtQrt. resolutjon of the governing body of each Party or when necessitated by
operation of law or as a result ofad coision by a court of competent jurisdiction.
83 Effect of termination. Termination shall not discharge ny liability incurred by any
Of the Parties during the term of this Agreement including any extensions prior to the
cffective date of termination. Each fart • shall be liable Im its own acts to the extent
provided by law.

XVHI. PROPERTY DISPOSITION

negotiate a new agreement, which shall include the disposition of the System
EgUipment, whether owned by the County or the Nlunieipalities.
XIX. NOTICE
A. All notices, reports or demands given or made by a Party under the terms 6F this.
Agreement or auiy statute or ordinanec shall be in writing and shall be sent registered
or certified snail.
B. All notices, reports or demands shall be sent to the representative designated in writing
by the Party. If nonc lens been designated, notice: to.the Party`s ch i c17 elected official shall
be deemed adequate;
