Mayor Uzpen called the. meeting to order at 7:00 p.m.. Councilmembers. Bosak,. Kuny :and
Lindner. were present. Cou.ncilmember Ar:tig-Swomley was excused.. Others. i.n. attendance:
City Attorney; Pat Kelly; residents Beth Hansen, Tom Hansen and Susan Pratt. Matt jolimon,.
Landmark Development and Len Pratt, area business owner.

A motion was made by. Councilmember Liridner seconded by Councilmember Bosak.to
approve the agenda. Motion passed.

Temporary Ordinance 127 Moratorium for Residential Development.
The City of Gem -Lake has been working on updating a number of ordniances since Febnary,
2016. The ordinanceshaven't been updated for 9-10 years and need to be completed and
updated prior to the Comprehensive Plan update for .201:8. Section} 5 of Ordinance 127 allows:
for a variance. Section 4 states the terms of the Duration. Five local.cities were consulted as to
the duration of their moratorium and the. moratorium duration was mirroredafter those cities.
Councilmember Bosak inquired as to the status of the ordinance updates. Councilmember
Lindner; :a member of the group working. on the ordinances, stated that they have made quite a
bit of progress on the ord nancesj with a meeting scheduled for next week and then an update
to the City Council:at the scheduled workshop on June 1.3, 2016.
Tom Hansen, inquired as to who called. the meeting, was the calling of the zneeting.following
the appropriate notice, why the area in question was targeted, who would the.moratorium
serve and lus current proposal for development would dissolve because of the ordinance.
Attorney Kelly responded in regard to the appropriate notice. Minnesota Statutes §13D.04,
subd2. The clerk must also post written notice of the date, time, place and purpose of the
special meeting on the principal bulletin,board of the city..A principal bulletin board must be
located iIl a place reasonably accessible to the public. If: the city does. not have a principal
bulletin board, the notice: must be posted on the door of its. usual meeting room, Notice.of
special meetings must .be posted. at least three days before the date of .the meeting.

In addition.to: posting, the city must also mail or deliver notice to. each. person who has filed. a
written request for .notice of special ineetirigs with the city. Notice to these individuals roust be
mailed or delivered at least three days before the meeting. As an. alternative to mailing .or
delivering the. notice, the city may publish the notice.once in its official newspaper at .[east: three
days before the meeting. If there is. no city newspaper, notice must be published in a qualified
newspaper of general circulation that covers the city. The official notice was in the weekly
White Bear Press.
No further discussion.
A motion was made by Councilmember Lindner, seconded by Councilmember Sosalc to:
approve Temporary Ordinance 127, a voice vote was taken, Councilmember .Svsak, opposed,
Mayor LFzpen abstained,. Couneilrnember.Kuny, yea, Councilmember Lindner,. yea. Motion.
passed 2-1; with Mayor Uzpen abstaining.

A motion was inade by Councilmeinber Lindner, seconded by Councilmember Luny to close
the meeting at 7:16 p.m.

Temporary Ordinance Number 1.27
AN INTERIM ORDINANCE PURSUANT TO MINNESOTA. STATUTES SECTION 462.355,
SUBDIVISION 4, TO ESTABLISH A MORATORIUM PROHIBITING THE GRANTING OF
PRELIMINARY SUBDIVISION APPROVAL, ZONING (CUPVARIANCE) APPROVAL, REZONING;
OR PUD APPROVAL WITHIN THE MORATORIUM AREA AS DEFINED. HEREIN.
Section L Purpose.. and Intent: The City Council on February 22" d 20.16, formed a committee to review the
cities ordinances with the intent to update them as to whether they fulfill the iunderlying purposes of the City's
land use and zoning provisions. and prepare there for the 2018 Comp. Plan.
Section 2. Moratorium Area: Real property West of Highway 61; East of Big Fox Rd, North of County Road E,
South of 21. Daniels Farm Rd; South of 19 Daniels: Farm Rd and South of 3 Daniels Farm Rd in the City of Gem
Lake.
Section 3. Restrictions: No. approval shall be grafted for Subdivision, Zoning (CUP Variance), Rezoning, or
PUD approval far any property within the Moratorium Area.
Section 4.. Duration:. This Ordinance shall expire twelve.montlis of the passage. of this.. Ordinance by the City
Council or it may be repealed earlier if the Council determines that the appropriate Ordinances have been
updated and the zoning codes have been finalized. This Ordinance maybe extended by adoption not to exceed
the statutory limits in Minn. Stat. 462355, subdivision 4.
Section 5. Variance: The Council may.grant a variance to this ordinance if the. Council finds after careful
review of all the.Tacts that a proposal is not contrary to the intent of the 2018. Comprehensive Plan, that it is
compatible with the zoning and official control amendments being considered by the City; that it does not.
adversely impact the health, safety or welfare of the citizens and.that it. otherwise u eets the requirements of the
City of Gem Lake and state law.
Adopted by the City Council. of. The City of Gem Lake on this Yd day of June, 2016, by a vote `of ayes
and nays.
