Adjournment City of Gem Lake City Council Meeting Minutes December 16, 2025, 1 City of Gem Lake City Council Meeting – December 16, 2025 Meeting Minutes Mayor Gretchen Artig-Swomley called the meeting to order at 7:00 p.m. Councilmembers Len Cacioppo, Ben Johnson, Jim Lindner, and Joshua Patrick were present. Councilmember Len Cacioppo was absent. Also present: City Attorney Martin Norder, City Treasurer Tom Kelly, City Engineer Justin Gese, and City Clerk Barb Suciu. December 16, 2025, Agenda A motion was introduced by Councilmember Lindner to accept the agenda, seconded by Councilmember Johnson. Motion carried 4-0. Minutes A motion was introduced by Councilmember Lindner, seconded by Councilmember Johnson to approve November 18, 2025, City Council Meeting minutes. Motion carried 4-0. A motion was introduced by Councilmember Lindner, seconded by Councilmember Johnson to accept the December 2, 2025, City Planning Commission Meeting minutes. Motion carried 4-0. Special Presentations/Public Hearings Truth In Taxation Hearing City Treasurer Tom Kelly gave an overview of the 2026 budget and property tax levy for the City of Gem Lake. The 2026 proposed final property tax levy is proposed at $715,830, which is a 0.4% decrease from the 2025 final property tax levy. The 2026 preliminary property tax levy consists of a debt levy of $85,778.00 (an increase from 2025 debt levy of $2,042.00) and the general operating levy of $630,052.00 (a decrease of 0.78% from the 2025 tax levy). The following changes were made from the 2025adopted budget as a basis for the 2026 proposed budget and property tax levy: 1. Based on the 2015 Refunding Bond schedule the debt levy for 2026 is set for $77,763.00. In addition, in 2018, the City issued bonds for the improvements on Scheuneman Road and the 2065 debt levy for this issue is $8,015.00. The two of these debt levies make up the City’s 2026 debt levy of $85,778.00. 2. City Council wages remain at $9,000, which remained the same as 2025. 3. City Council contingency left at $9,000. 4. Clerk/General Government budget includes $64,900.00 for wages and for health insurance coverage. Based on current rates and COLA increases. 5. Financial Administration and Legal Services reduced based on past expenditures. 6. Planning & Zoning budget increased $12,000.00 based on past expenditures. 7. Police budget increased by 4.16% to $153,537 based on the City of White Bear Lake budget provided and includes $139,470 for police services and $14,067 for the public facilities building. 8. The cost of fire services could increase 1.22% to $53,474.00. It includes $35,196 for fire services, $9,087 for fire marshal services, and $9,191 for the public facilities building. 9. Road Maintenance budget includes $18,000 for road maintenance/repair and $8,000 for trimming boulevard trees. 10. Ice & Snow Removal budget increased 2.13% to $24,000 based on past expenditures. 11. Heritage Hall budget includes $10,000 for building improvements and $10,000 for other improvements. City of Gem Lake City Council Meeting Minutes December 16, 2025, 2 12. Park maintenance budget of $14,500 for maintaining park area of the Villas of Gem Lake and replacing trees. 13. The 2026 budget includes $20,000.00 for future road improvement projects. 14. Revenue and other expenditure line items adjusted based on historical data These changes result in the city proposed preliminary tax levy of $715,830.00 for 2026. This compares to 2026 preliminary levy of $768,005.00 and 2025 final levy of $718,736.00. Using a 2026 property tax levy of $715,830.00 and the City’s 2026 tax capacity ($1,884,274.00) and median valued home ($460,750.00) for Gem Lake, that median valued home, would pay City property taxes of $1,680.15 in 2026 compared to 2026 preliminary levy of $1,806.40 (a decrease of $126.18) and the 2025 final levy amount of $1,680.37 (an decrease of $0.15 even with a market value increase of $18,530). A motion was introduced by Councilmember Lindner to open the public hearing at 7:17 p.m. for the 2026 Proposed Budget and Property Tax Levy, seconded by Councilmember Johnson Motion carried 4-0. No public comment was taken. A motion was introduced by Councilmember Lindner to close the public hearing at 7:19 p.m. for the 2026 Proposed Budget and Property Tax Levy, seconded by Councilmember Johnson. Motion carried 4-0. A motion was introduced by Councilmember Lindner approving Resolution #2025-036; Adopting the Final General Fund Budget and Final Amount to be Raised by Property Taxation for 2026, seconded by Councilmember Johnson. Motion carried 4-0. Councilmember Lindner introduced a motion to approve all the items listed on the consent agenda, seconded by Councilmember Patrick. Motion carried 4-0. City of Gem Lake City Council Meeting Minutes December 16, 2025, 3 Committee Reports None. Old Business Newsletter Updates / Topics / Suggestions Mayor Artig-Swomley stated the newsletter was just mailed and the next edition would be going out early February. She indicated it would include an article on the budget and a water update. She asked for other suggestions. There were suggestions for an article regarding the County Road E corridor project and a recap of the 2026 deer hunt. Future Water System Planning Mayor Artig-Swomley stated the city has applied for several grants to assist with the costs of the municipal water system. Justin Gese, City Engineer, stated there would be a neighborhood meeting for the households that are impacted by Phase 1 of the project. New Business 2026 COLA Discussion Mayor Artig-Swomley stated COLA could be anywhere from 2.6% to 3% increase. A 2.8% increase was suggested. A motion was introduced by Councilmember Lindner to approve the Cost-of-Living Adjustment (COLA) of 2.8%, seconded by Councilmember Johnson. Motion carried 4-0. Resolution # 2025-042; Approving a Conditional Use Permit for 3601 Highway 61 North PID 273022430031 Mayor Artig-Swomley stated the Planning Commission approved this item and the City Planner provided a detailed staff report. A motion was introduced by Councilmember Lindner to approve Resolution 2025-042; Approving a Conditional Use Permit for 3601 Highway 61 N PID 273022430031, seconded by Councilmember Johnson. Motion carried 4-0. Resolution #2025-043; Approving a Minor Subdivision (Lot Line Adjustment) for 3696 Scheuneman Road and 0 Scheuneman Road, PID 273022430027 & PID 273022430029 Mayor Artig-Swomley stated the Planning Commission approved this item and the City Planner provided a detailed staff report. A motion was introduced by Councilmember Lindner to approve Resolution 2025-043; Approving a Minor Subdivision (Lot Line Adjustment) for 3696 Scheuneman Road and 0 Scheuneman Road, PID 273022430027 & PID 273022430029, seconded by Councilmember Johnson. Resolution #2025-045, Approving a Conditional Use Permit to Allow Outdoor Storage for 0 Scheuneman Road, Parcel ID 273022430029 A motion was introduced by Councilmember Lindner for Resolution #2025-045; Approving a Conditional Use Permit to Allow Outdoor Storage for 0 Scheuneman Road, PID 27022430029, seconded by Councilmember Johnson. Motion carried 4-0. County Road E Brand and Placemaking Plan Councilmember Johnson provided an overview of the County Road E Brand and Placemaking Plan. There are five areas with regional centers. The messaging and branding ties everything together along County Road E. The goal is to elevate awareness of the area. A motion was introduced by Councilmember Lindner to approve the County Road E Brand and Placemaking Plan, seconded by Mayor Artig-Swomley. Motion carried 4-0. Code Enforcement on Troubled Property Mayor stated she had a meeting with police department regarding a problem property which we have received over 12 complaints. She would like to develop some procedures for these types of properties and would like the City Attorney to investigate and complete a non-renewal for the rental license. A motion was introduced by Councilmember Lindner to instruct the city attorney to investigate a non- renewal for a rental license, seconded by Councilmember Patrick. Motion carried 4-0. Minnesota Mayor’s Facts Mayor Artig-Swomley indicated she received an email from the Mayor of Crosslake, MN soliciting support in signing a letter concerning the fiscal direction of the state and its increasing impact on the cities and residents. After discussion, the consensus was not to participate in this at this time. Community Outreach to Other Cities and Government Bodies Mayor Artig-Swomley stated White Bear Township has served the two-year notice to White Bear Lake Fire Department for fire services. With this notice, it could have an impact on the fire costs for Gem Lake. Tom Kelly explained how the contract distribution is calculated. Mayor Artig-Swomley hopes the two- year negotiations go smoothly. City of Gem Lake City Council Meeting Minutes December 16, 2025, 5 Mayor Artig-Swomley has served on the purple line and one of the first cities to say no to this project. This week the project has been renamed to the Bronze Line and Ramsey County is going to take on the costs of this project and St. Paul is absorbing 10% of these costs. Call to Order of the Planning Commission Meeting By Chair Don Cummings at 7:00 p.m. II. Call of Roll Commission Members Don Cummings, Art Pratt, Derek Wippich and Daniel Epelboim were present. Commissioner Stephanie Farrell was absent. Also present were City Planner Andrew Boucher, TKDA, City Attorney Martin Norder, and City Clerk Barb Suciu. III. Approve Agenda and Minutes A. Approve the Agenda for the January 6, 2026, Planning Commission Meeting A motion was introduced by Commissioner Pratt to approve January 6, 2026, agenda, seconded by Commissioner Wippick. Motion carried 4-0. B. Approve the Minutes of December 2, 2025, Planning Commission Meeting A motion was introduced by Commissioner Wippich to approve December 2, 2025, Planning Commission Meeting minutes, seconded by Commissioner Pratt. Motion carried 4-0. IV. Public Hearings A. Planning Case 2025-013; Conditional Use Permit for 3550 Hoffman Road (Parcel ID 343022120052), White Bear Floral on behalf of Superior Molecular, Inc. to allow Cannabis Cultivation through a Microbusiness License City Planner Andrew Boucher summarized the request for 3550 Hoffman Road. Commissioner Pratt introduced a motion to open the public hearing at 7:18 p.m., seconded by Commissioner Wippich. Motion carried 4-0. Tanner Berris, Superior Molecular, provided a statement regarding the operation of the business. Commissioner Pratt asked about the security piece of the operation. Mr. Berris stated there haven’t been any issues. Commissioner Pratt introduced a motion to close the public hearing at 7:21 p.m., seconded by Commissioner Wippich. Motion carried 4-0. Commissioner Wippich introduced a motion to recommend approving the request based on the City Planners’ recommendations to the City Council of the Conditional Use Permit to allow Cannabis Cultivation through a Microbusiness License for 3550 Hoffman Road Parcel ID 343022120052, White Bear Floral on behalf of Superior Molecular, Inc. with the following conditions: www.gemlakemn.org 1. Superior Molecular, Inc. is permitted for the cultivation of state-licensed products only at the address listed above upon registering with the City of Gem Lake as a condition of approval. If the Conditional Use Permit is approved, the registration will be placed into effect. 2. The applicant is required to completely satisfy the State Office of Cannabis Management licensing for a cannabis microbusiness. 3. The applicant is required to identify on the site plan the boundaries of the business issue within the existing structures and record this exhibit as part of the Conditional Use Permit resolution. 4. No retail sales are permitted 5. No outdoor storage of cannabis and hemp products is permitted 6. No on-site consumption is permitted. 7. The use is required to maintain compliance with state and local building, fire and zoning requirements or regulations. 8. All signage shall require sign permits and comply with Chapter 19 – Signs. 9. All plans must be submitted to the Metropolitan Council for Sewer Availability Charges review prior to the issuance of any building permits and any applicable Water Availability Charges or Local Sewer Availability Charges as established by the City of Gem Lake. 10. The applicant shall pay all fees and escrows associated with the project. Seconded by Commissioner Pratt. Motion carried 4-0. V. Old Business A. Comprehensive Plan Update & Joint Meeting with the City Council Staff will follow up with the City Council on obtaining a date for the meeting. City Planner stated there are two new components for the 2050 Comprehensive Plan. The two new components are a climate system chapter and natural system chapter. VI. New Business A. Appointment of the Chair and Vice Chair for 2026 Chair Cummings will continue as Chair and the Vice Chair will be Commissioner Pratt. Commissioner Epelboim introduced a motion to appoint Don Cummings as Chair and Art Pratt as Vice Chair for 2026, seconded by Commissioner Wippich. Motion carried 4-0. VII. As part of this renewal process the city must decide if it wishes to waive or not waive the statutory tort limits. If the City DOES NOT WAIVE the monetary limits on municipal tort liability, then an individual claimant could not recover more than $500,000 and the total which all claimants could recover would be limited to $1,500,000. These limits would be on only those claims which the statutory tort limits apply. If the City WAIVES the monetary limits, it would then be subject to up to $2,000,000 on an individual claimant but the total for all claimants would still be limited to $2,000,000 regardless of the number of claimants. The City currently carries $1,500,000 in liability coverage from the LMCIT. The City does not currently purchase excess liability insurance at this time. Staff recommends the City Council approval to select DOES NOT WAIVE the monetary limits on municipal tort liability as established by Minnesota Statutes 466.04 on the renewal application with the LMCIT. The CUP is to allow for a “cannabis microbusiness,” or a state licensed adult-use legal cannabis cultivation business within three existing buildings. The property is located within the Neighborhood Center, NC, Sub-Zone of the greater Gateway, G, Zoning District. The applicant is the Director of Operations for Superior Molecular, Inc. and is required to obtain a CUP to open their business. The business has received Preliminary Approval from the State of Minnesota’s Office of Cannabis Management for a Microbusiness Cannabis License; (MICRO-A25-001329) to cultivate cannabis. Cannabis microbusinesses are permitted as a conditional use within the Gateway Zoning per Ordinance 147, Section 4.2. Following local zoning approval, the City will report compliance to the State Office of Cannabis Management (OCM). OCM will then finish their review of the application and grant or deny a cannabis microbusiness license. CUP processes are governed by Ordinance 131, Section 17.5. A CUP application receives review and a public hearing at the Planning Commission. The Planning Commission gave a positive recommendation to the application at their January 6, 2026 meeting. The City Council can consider and act on the application. PROPERTY INFORMATION Description: 3550 Hoffman Road is located in the Neighborhood Center Sub-Zone of the Gateway District. The building includes the existing business, White Bear Floral Shop and Greenhouse, which the property owner, John Birkeland owns and operates. The existing White Bear Floral Shop and Greenhouse is not part of the applicant’s business. The property owner has given the applicant permission to rent greenhouse and storage space within the existing site. The applicant has indicated that they “propose to operate a state-licensed adult-use cannabis cultivation within two existing commercial greenhouses and one existing garage for secure storage”.” They state that the “use will fully comply with Minnesota State Statue Chapter 342, applicable rules adopted by the Office Cannabis Management, and all local ordinances governing cannabis microbusinesses, environmental controls, public safety and licensing requirements established by the City and State.” Cannabis Microbusiness is defined as, “A business licensed to operate as a ‘cannabis microbusiness’ by the Minnesota Office of Cannabis Management, pursuant to Minnesota Statutes, Chapter 342.28. “Cannabis Microbusiness” includes up to 13 different more specific uses as defined in state statute. The applicant has received Preliminary Approval from the State of Minnesota’s Office of Cannabis Management for a Microbusiness Cannabis License (MICRO-A25-001329) for cultivation and growing of cannabis and is not seeking a retail endorsement as they do not have any plans to open a retail location in the future. Additionally, they will not be receiving an onsite consumption endorsement; therefore, any on site use of cannabis or hemp products is prohibited. Ordinance 147. Cannabis Business Adopted by City Council on January 21st, 2025, the purpose of Ordinance 147 “is to implement the provisions of Minnesota Statutes, Chapter 342, which authorizes the City of Gem Lake to protect the public health, safety, welfare of Gem Lake residents by regulating cannabis businesses within the legal boundaries of the City of Gem Lake.” The application will be consistent with all regulations set forth in Ordinance 147 with conditions. 3550 Hoffman Road – Cannabis Microbusiness CUP Request Gem Lake City Council Meeting 1/20/2026 January 12, 2026 Page 5 • Section 3.1 requires all cannabis businesses to register with the City of Gem Lake. The applicant shall register with the City of Gem Lake as a condition of approval. If the CUP is approved, the registration will be placed into effect. Staff should issue new registration, signed and dated accordingly. If the CUP is denied, the registration will be officially revoked and staff should issue a formal letter stating the situation and status of the registration. • Section 4.1 outlines the minimum buffer requirements for a cannabis business. The proposed location is not located within any of the prohibited buffer areas. • Section 4.3 restricts retail sale to hours of operation Monday – Sunday, 10:00 am – 9:00 pm. The applicants is not proposing retail sale of cannabis flower, cannabis products, lower-potency hemp edibles, or hemp-derived consumer products “in accordance with City Ordinances.” The applicant would require a retail endorsement and this restriction would apply if there was an interest in retail sales. • Section 4.4 permits up to two fixed signs on the exterior of the building or property of the business. The applicant will be required to apply for sign permits for any desired signage and comply with this requirement. • Section 8 states that “No person shall use cannabis flower, cannabis products, lower-potency hemp edibles, or hemp-derived consumer products in a public place or a place of public accommodation unless the premises is an establishment, or an event licensed to permit on-site consumption of adult-use.” The applicant is not applying for an onsite consumption endorsement. This activity would be prohibited if granted a CUP for the microbusiness. Ordinance 131. Consolidated Land Use Ordinance Section 17.5 regulates Conditional and Interim Use Permit processes. When reviewing a request eight (8) criteria should be reviewed by the Council. Below are the criteria in italics, followed by information from the application and staff review. All eight (8) criteria are met. 1. Adjacent Uses; and The use is permitted by Ordinance 147 in this location (Gateway, Neighborhood Center). The business is not located within any restricted buffer areas. 2. Air and Water Quality; and State Statute requires cannabis businesses to “maintain a ventilation and filtration system sufficient to meet the requirements for odor control.” 3. Traffic Generations; and The applicant states that existing on-site parking for the floral business will be utilized and that traffic patterns will not change significantly with the addition of transportation of raw materials or inputs and harvested product from the site. The applicant states the only shipment will be from this site to their processing facility in Blaine, MN which is expected to happen quarterly based on the growing schedule, and be transported in a secure van. 4. Staff is requesting to amend the Employee Handbook; Meals & Other Break Period to reflect the recent changes from the Minnesota Department of Labor & Industry. Here is the amended language. Meal and Other Break Periods Mealtime shall be provided to non-exempt employees who work six or more consecutive hours. Employees will receive an unpaid meal break of 30 minutes. Employee lunches should occur at a point during the day to allow ample work time prior to and following the lunch period. Employees should not perform any work-related duties during this time. Employees are expected to be at their workstation, ready to work at the end of the break. Generally, employees are not allowed to take their meal break as the final 30 minutes of the workday. A six-hour day must be worked to earn the 30-minute meal break. Paid rest breaks include two a 15-minute breaks (one generally during the first four hours of work and the other generally during the second four hours of work) period within each four (4) consecutive hours worked. Since this time is paid as time work you should not extend the allotted time away from your work area. Employees can choose instead to combine their two 15-minute paid breaks into one 30-minute paid lunch break. Breaks may be taken in conjunction with the meal break when receiving prior approval from the supervisor. If you choose to take the two 15-minute morning and afternoon breaks, which would be paid for, you can also receive an unpaid break of 30 minutes during your shift, which will be scheduled by your supervisor. You should not perform any work-related duties during this time. Non-exempt employees must record their time in and out at the beginning and end of the meal break. You are expected to be at your workstation, ready to work at the end of your break. The City of Gem Lake will provide reasonable unpaid/paid break time each day to employees who need to express breast milk for their infant child. This break time must, if possible, run concurrently with any break time already provided to the employee. Any other time needed for this purpose will be without pay.
