Adjournment City of Gem Lake City Council Meeting Minutes January 20, 2026 1 City of Gem Lake City Council Meeting January 20, 2026 Meeting Minutes I. Call to Order Mayor Gretchen Artig-Swomley called the meeting to order at 7:00 p.m. II. Call of Roll Mayor Gretchen Artig-Swomley, Councilmembers Len Cacioppo, Ben Johnson, Jim Lindner, and Joshua Patrick were present. Also present: City Attorney Martin Norder, City Treasurer Tom Kelly, White Bear Lake Fire Chief Greg Gustafson, White Bear Lake Police Chief Dale Hager, and City Clerk Barb Suciu. III. Approve of Agenda and Minutes A. Approve the Agenda for the January 20, 2026, City Council meeting. A motion was introduced by Councilmember Lindner to accept the January 20, 2026, agenda, seconded by Councilmember Cacioppo. Motion carried 5-0. B. Approve the Minutes of December 16, 2025, City Council meeting. A motion was introduced by Councilmember Lindner, seconded by Councilmember Cacioppo to approve December 16, 2025, City Council Meeting minutes. Motion carried 5-0. C. Accept the Minutes of January 6, 2026, Planning Commission meeting. A motion was introduced by Councilmember Lindner, seconded by Councilmember Cacioppo to accept January 6, 2026, Planning Commission minutes. Motion carried 5-0. IV. Special Presentations/Public Hearings A. White Bear Lake Police and Fire Department Report Fire Chief Gustafson presented an overview of the area of coverage, staffing levels and call volumes for the department. Police Chief Hager presented an overview of staffing levels of the department. He highlighted events that happened in 2025 and items coming in 2026. V. Consent Agenda A. Resolution No. 2026-01; Resolution Approving the 2026 Gem Lake Appointments List B. Resolution No. 2026-02; Resolution Opting to Not Waive Limited Tort Liability for 2026 C. Monthly Financial Report(s) D. Claims Item C was removed from the agenda and all other items on the consent agenda were reviewed by the Council. Councilmember Lindner introduced a motion to approve all the items listed on the consent agenda except item C, seconded by Councilmember Cacioppo. Motion carried 5-0. VI. Planning Commission Reports A. Resolution No. 2026-03; Resolution Approving a Conditional Use Permit for 3550 Hoffman Road, Parcel ID 343022120052, White Bear Floral on behalf of Superior Molecular, Inc. to allow Cannabis Cultivation through a Microbusiness License, Planning Case No. 2025-013. City of Gem Lake City Council Meeting Minutes January 20, 2026 2 Mayor Artig-Swomley stated with the information provided by the city planner was very thorough and asked for any questions. Councilmember Lindner introduced a motion to approve Resolution 2026-03; Approving a Conditional Use Permit for 3550 Hoffman Road, Parcel ID 343022120052, White Bear Floral on behalf of Superior Molecular, Inc. to allow Cannabis Cultivation through a Microbusiness License, Planning Case No. 2025- 013 all the items listed on the consent agenda, seconded by Councilmember Cacioppo. Motion carried 5-0. VII. Old Business A. Newsletter Updates/Topics/Suggestions Mayor Artig-Swomley stated the newsletter is almost complete and the Council can expect a draft early next week. B. Rental License Update Mayor Artig-Swomley stated one rental license has not renewed their license for 2026. A second notice has been mailed, and they have been given until the end of January to apply for their license. C. Heritage Hall Generator Status Mayor Artig-Swomley stated the contractor that was awarded the bid for installing the generator has withdrawn their bid and we will have to start over. Mayor Artig-Swomley asked Councilmember Patrick to work with the City Clerk to obtain two (2) bids. D. Water System Update Neighborhood Meeting Mayor Artig-Swomley stated the neighborhood meeting was held on January 12 and there was a good turnout of residents. The participants were engaged and inquisitive about the cost of the project. VIII. New Business A. Resolution 2026-04; Resolution Authorizing the City Treasurer to Distribute a Monthly Donation in the amount of $1,500 of the Charitable Gambling Fund to the White Bear Lake Area Food Shelf if the Funds are Available. A motion was introduced by Councilmember Lindner, seconded by Councilmember Cacioppo authorizing the City Treasurer to Distribute a Monthly Donation in the amount of $1,500 of the Charitable Gambling Fund to the White Bear Lake Area Food Shelf if the Funds are Available. Motion carried 5-0. B. Ordinance 2026-001; 2026 Fee Schedule A motion was introduced by Councilmember Lindner, seconded by Councilmember Cacioppo to approve Ordinance 2026-001; 2026 Fee Schedule. Motion carried 5-0. C. Employee Handbook Update – Meals & Other Break Periods A motion was introduced by Councilmember Lindner, seconded by Councilmember Johnson to approve the Employee Handbook Update – Meals & Other Break Periods. Motion carried 5-0. D. League of Minnesota Cities “Day on the Hill” Mayor Artig-Swomley stated this is just informational and no action is needed. E. Preliminary Planning for the next Comprehensive Plan Mayor Artig-Swomley stated the 2050 Comprehensive Plan needs to be started and she is thinking of holding a meeting in March to start the planning process. To save money, she would like to see the City of Gem Lake City Council Meeting Minutes January 20, 2026 3 council and planning commission along with staff will do most of the work and pull in consultants as needed. IX. Community Outreach to other Cities and Government Bodies No issues raised. X. Presentation from the Public No issues raised. XI. Open Items for Council Members to Bring up No issues raised. XII. There being no further business, following a motion from Councilmember Lindner, seconded by Councilmember Johnson, the meeting adjourned at 8:17 p.m. Respectfully submitted, Barbara Suciu Excerpt from Gem Lake City Ordinance Chapter 83 Section 10. Licensing of Rental Units. From and after January 1, 2008, no person shall operate a rental dwelling without first having obtained a license to do so from the City of Gem Lake as hereinafter provided. The license shall be issued for a period of one (1) calendar year. Licenses which have less than one (1) year remaining on this term shall pay one half of the license fee. 1. License Fees. Fees for rental unit licenses shall be as set forth by the City Council in a fee schedule, which the Council shall pass by ordinance from time to time. The fees shall be due 60 days prior to the license expiration date; in the cases of new unlicensed dwellings, license fees shall be due upon issuance of the certificate of occupancy; in the cases of licensing periods of less than one (1) year, license fees shall be prorated monthly: 1. A delinquency penalty of 5% of the license fee for each day of operation without a valid license shall be charged operators of rental dwellings. Once issued, a license is nontransferable, and the licensee shall not be entitled to a refund of any license fee upon revocation or suspension. 2. License Renewals. Every operating license up for renewal will be subject to a police call report of the last twelve (12) months. The city receives police report information from the White Bear Lake Police Department monthly. This information will be a factor when reviewing for approval of the renewal of a rental operating license. 1. More than one police call or more than one code violation(s) at a rental address can be considered when determining whether a rental license should be issued, renewed or revoked. 3. Owner or Agent to Apply. License application or renewal shall be made by the owner of rental units or his legally constituted agent. Application forms may be acquired from and subsequently filed with the Compliance Official. The applicant shall supply: 1. Name, address, and telephone number of dwelling owner, owning partners if a partnership, corporate officers if a corporation. 2. Name, address, and telephone number of designated resident agent, if any. 3. Name, address and telephone number of vendee, if the dwelling is being sold through a contract for deed. 4. Legal address of the dwelling. 5. Number of dwelling units within the dwelling. 6. Description of procedure through which tenant inquiries and complaints are to be processed. 4. Resident Agent Required. No operating license shall be issued or renewed for a non-resident owner of rental dwelling units (one who does not reside in any of the following Minnesota Counties: Hennepin, Ramsey, Anoka, Carver, Dakota, Scott, or Washington) unless such owner designates in writing to the Compliance Official the name of his resident agent (one who does reside in any of the following Minnesota Counties: Hennepin, Ramsey, Anoka, Carver, Dakota, Scott, or Washington) who is responsible for maintenance and upkeep and who is legally constituted and empowered to receive service of notice of violation of the provisions of the City Ordinance, to receive orders and to institute remedial action to effect such orders and to accept all service or process pursuant to law. The Compliance Official shall be notified in writing of any change of resident agent. 5. Conformance to Laws. No operating license shall be issued or renewed unless the rental dwelling and its premises conform to the Ordinances of the City of Gem Lake and the laws of the State of Minnesota. 6. Inspection Condition. No operating license shall be issued or renewed unless the owner of rental units agrees in his application to permit inspections pursuant to Section 10. 1. The initial inspection and first re-inspection will not incur an additional fee; however, if the city has to conduct additional inspections to bring a rental property into compliance, the additional fees will apply: 1. 2nd re-inspection - $200.00 fee; 2. 3rd or more re-inspections - $500.00 fee 2. If your rental property has already been identified as being contingent upon passing a required monthly inspections / monthly grounds inspection, monthly inspections will not incur an additional fee; however, if the city has to conduct additional inspections between the required monthly inspections to bring a rental property into compliance, the additional fees will apply: 1. 2nd re-inspection - $200.00 fee; 2. 3rd or more re-inspections - $500.00 fee 7. Posting Of License. Every licensee of a multiple dwelling shall cause to be conspicuously posted in the main entry way or other conspicuous location therein the current license for the respective multiple dwelling. 8. License Not Transferable. No operating license shall be transferable to another person or to another rental dwelling. Every person holding an operating license shall give notice in writing to the Compliance Official within 72 hours after having legally transferred or otherwise disposed of the legal control of any licensed rental dwelling. Such notice shall include the name and address of the person succeeding to the ownership or control of such rental dwelling or dwellings. 9. Occupancy Register Required. Every owner of a licensed rental dwelling containing three or more dwelling units shall keep, or cause to be kept, a current register of occupancy for each dwelling unit which provides the following information: 1. Dwelling unit address. 2. Number of bedrooms in dwelling unit. 3. Names of adult occupants and number of adults and children (under 18 years of age) currently occupying the dwelling units. 4. Dates renters occupied and vacated dwelling units. 5. A chronological list of complaints and request for repair by dwelling unit occupants, which complaints and requests are related to the provisions of this Ordinance, and 6. A similar chronological list of all corrections made in response to such requests and complaints. Such register shall be made available for viewing or copying by the Compliance Official at all reasonable times. 10. License Suspension or Revocation. Every operating license issued under the provisions of this Ordinance is subject to suspension or revocation by the City Council should the licensed owner or his duly authorized resident agent fail to operate or maintain licensed rental dwellings and units therein consistent with the provisions of the Ordinances of the City of Gem Lake and the laws of the State of Minnesota. In the event that an operating license is suspended or revoked by the City Council for just cause, it shall be unlawful for the owner of his duly authorized agent to thereafter permit any new occupancies of vacant or thereafter vacated rental units until such time as valid operating license may be restored by the City Council. Any person violating this provision shall be guilty of a violation of this Ordinance.
