Approval of the:1019 Fee Schedule
The 2019 Fee Schedule includes the fees that White. Bear Township charges for services to Gem Lake
and a new $1.00 fee for a final design including elevations viewed from neighboring properties for
approval for:projects/developments within the City of Gem Lake. A motion was:made by
Councilmember Artig-Swo.mIey, secontle.d by.Cauncilmember Cacioppo to approve the 2019. Fee

Resolution 2019.001 Assignments (Appointing Individuals:and Firms to Perform the Functions

Resolution 2019-004 Donation to New Trax, Inc.
A motion was made by Councilmember Lindner, seconded by Co.uncil.member Artig-Swo.mley to approve
the Resolution 2019-004.. Motion passes, resolution approved:
Fritz Magnuson — Purchase of Larid. from. the City of Gem Lake.
Mr. Magnuson wishes to purchase a piece of land that was part the Hansen properties and sold to
Hansen Homes to be part of Gem Lake Villas. City Engineer recommends that the City not sell the land
because of future utility needs. City Attorney Patrick Kelly said there is a warranty deed on Outlot A and
land that. has been donated to the City has to be held in trust. Mr. Kelly will research regulations for city
donated land and report back to the Council at the February City Council meeting.
The lilacs on Daniels. Farm Road: were briefly discussed. Daniels Farm Road Associa..tion is willing to
continue to maintain the lilacs, Costs associated with the lilac upkeep last year were.over $1,000.
Approval of 67D_--.Septic Ordinance - Minor _Changes
A motion was made by Councilmember Artig-Swomley, seconded by Councilmember Lindner to approve
67D Septic Ordinance. Motion passes, septic ordinance changes approved.
Approval of Ordinance 9, Liquor Ordinance
A motion was made by Councilmember Artig-Swomley; seconded by Councilmember Kuny to approve
the changes to Ordinance 9,. Liquor Ordinance. Motion passes, Ordinance 9 changes approved.

Luther Auto Group. and Peter Oswald have signed a purchase agreement to.purchase the. Oswald.
property at 3.516 Highway fit, Gem Lake. A brief presentation was made -of the proposal. Council
.agreed they liked the. init la I concept. Anticipated construction is. sum mer, 2019. John Birkeland,. White
Bear Floral, Country Lounge; Cafe Cravings, asked the council to check with other -municipalities on haw
they hand Ie assessments, briefly discussed a gravel car lot for Car Fit on Mr. Birkeland's property, Paul.

4140 Otter Lake Road, failed septic, progress on hooking up to: the manhole, none, building inspector to
red tag the building, health. and safety issue, Gem Lake Villas house lighting, too bright?, Councilmember
Lindner will measure with his light meter. Rush Line, original proposaI was toga to Forest Lake, costs
are still the same but a shorter route, Concerns about the cost the Rush Line being much too expensive
and don't support..

Acting Mayor Ardg-Swomley called the meeting to order at 7.00 p.m. Councilmembers Artig-Swomley,
Cacioppo,. Lindner and Kuny were present. Mayor Uzpen was absent (excused). Dthers in attendance:

Planning Commission Chair Ben Johnson reported on the November 71h meeting. Changes to ordinances
#t67D (regul.atin.vubsurface sewage treatment systems) and #9 (regulating the sale and consumption of
intoxicating liquor) were reviewed and recommended for approval �3-0 vote in favor) to be forwarded to.
the council for their approval at January, 2019, City Council meeting.

-Charitable Garribling Donation„to Newtrax
Go u nci 1. discussed making a donation to Newtrax at their November, 2018, meeting. A motion was made
by Councilmember Lindner, seconded by .Councilrnember.Cacioppo to.approve a $.1,000.donation to
Newtrax in November. Due to the decrease in anticipate d.gamblirig funds and the council's historic
donation to the White Bear Lake Food Shelf in. December of each year, the Council agreed to reduce
their donation to Newtrax from $1,000 to $500.00. Motion passes, donation reduction approved.

Staff has recently completed the updates as requested by the Met Council. The updates
include:
• :Stating that the City of Gem Lake does not have plans to add additional lanes to any
of its roads.
• Clarifying proposed road realignment for Otter Lake Road and County Road F
• Clarifying proposed road. realignment of Daniel's Farm Road to International Drive 1
County Road E.
• Removing Lake Area Bus. dial -a -ride.
• Updates to Transit Market Area III by including more information on commuter transit
services,..
• Identifying that there are no transit facilities. in Gem Lake.
• Updating the name of St. Anthony Railroad Spur Trail Search Corridor.
• Removing Table 5.6 as a redundancy and not needed.
Updating Table 5.3.
Remaining Issues:
• Wastewater Plan needs updates identified by Met Council.
• Addressing Table 5-6 which shows no minimum density, for residential land uses. Staff
will work with Met Council to address this.
• Include a map that shows redevelopment sites.
Next Steps.
Staff is recommending that the plan be sent out for adjacent community review and comment
once the final issues are addressed. The City should schedule a public hearing at a future
Planning Commission meeting to hear resident comment and make a recommendation to the
City Council. Staff Irecommends the April Planning Commission forthe public hearing to give
adjacent communities time to review the plan.

Enclosed are two copies of the 2019 Fire Service contract addendum. The addendum is
consistent with our long-standing agreement. Budget detail regarding the 2019 budget
to support the budget calculations is attached for your information.
The 2019 addendum represents a significant change from previous years' service level
and resulting service level costs. The City conducted a comprehensive fire and
ambulance operational review during 2018. This review resulted in a departmental
reorganization, which implementation occurring during the. last four to five months of
2018. The reorganization addressed changing resident service level expectations and
utilization. During the fire operational review, it became evident that the City's reliance
on a "paid on call" fire and ambulance service membership was not feasible. for
providing quality future service levels. it is no longer feasible to expect fire service
membership to be available to address the increasing service level demands on a
strictly "paici-won-calf" basis.
Due, to service level, reorganizational operating costs are. adjusted accordingly. Gem
Lake's tax capacity valuation along with operating costs including fire inspections results
in Gem Lake's share of. the 2019 fire .and. inspection contract amount being set at
$21,$80.

restaurants. A license mu. be issued to -clubs and congressionally charteired veterans
organizations if they have been in existence for at least three years -and liquor sales
will only be to members and bona fide guests. A. restaurant that holds an on -sale
intoxicating liquor license may also operate undoh'kat caterer's permit issued by the
:Minnesota commissioner -of public safety, if tl txon i§ in. accordance with state

sale brew pub license; in accordance with Minn. Stat. § 340A.24. The off -sale brew
pub. malt liquor license authorizes the off sale of :malt liquor produced and packaged
on the premises.
7.9. "Off We -small. brewer malt liquor" licenses may be issued only to a brewer who
holds a brewer license.. issued by the Minnesota commissioner of public safety, in.
accordance with. Minn. •Stat, § •3-40A.28. The license authorizes the brewer to. sell, at..

Section 11. Financial Responsibility.
11.1. Every application for k.hqugr license must be accompanied by evidence of adequate
financial responsibility -for liability in a form permitted by Minn. Stat. § 340A.409;
subd. 1. This provision. does not apply to "on -sale culinary class" licenses and to
establishments exempt from financial osponsibil iy requuirements by Minn. Stat. §
34.0A.409, subd. 4.
112. A liability insurance policy must name the City of Gem Lake as an additional insured
